Former U.S. Army Col.
Michael Pheniger, spoke about the
importance of civil liberties on
Tuesday April 5 to members of the
Suncoast Tiger Bay Club. In partic-
ular, Pheniger discussed his displea-
sure with the USA Patriot Act.
The Patriot Act was established
after September 11 to make the pro-
cess of finding and capturing terror-
ists more feasible. Pheniger says
that despite what the government
tells the public, the Patriot Act has
done nothing but remove the checks
on the government's ability to col-
lect information on innocent Ameri-
cans.
"On the other side of the look-
ing glass, everything is the same, but
different," said Pheniger, referring
to a line from the movie "Alice in
Wonderland."


What Pheniger was trying to get
across was the fact that things have
changed since September 11, but
have they changed for the better?
Pheniger feels that the Patriot Act
was passed with undue haste and
that it contains many flaws.
"We are sacrificing liberty to
maintain security," he said. "In my
opinion, there are quite a few prob-
lems with the Patriot Act. We are
giving up the civil liberties and free-
doms that make this country unique.
Those liberties are what separates us
from them (terrorists)."
"The president said the reason
this act was established was to break
down the walls between the CIA and
the FBI," he added. "But that's not
the sole reason."
According to Pheniger, the
Patriot Act hasn't shown any signs
that it has been doing its primary job
of capturing terrorists. If anything
Pheniger believes it is being used to
violate Americans who aren't terror-
ists, while giving the police a signif-
icant amount of leverage.
"This act is being used improp-
erly for regular investigations, not
just terrorists, but for strip club own-
ers," he joked.
Pheniger also said that law
enforcement agencies had been try-
ing to get the Patriot Act passed
years before September 11, but
congress wouldn't allow it. When
tragedy finally struck America on
9/11, the window of opportunity
quickly opened for law enforce-
ment.
"The Patriot Act has been on the
law enforcement's wish list for the
longest time," he said. "After 9/11
this act passed with almost no con-
gressional hearing. And reading it
would do you no good."


Pheniger adds that the wording
in the Patriot Act is obscure and
deceptive. He believes this is lead-
ing to a violation of American's
amendment rights.
"This act lowers the standards
of the 4th amendment's right to
probable cause," he stated. "It also
reduces the ability of the judiciary to
apply checks on executive power."
There are clauses in the act that
allow the government to check
library records, financial records,
business records, employment
records and 'any tangible thing.'
Another problem about the act,
according to Pheniger, is that the
government is too secretive about it,
which could worry the American
public.
"They won't tell us how they
use the tools, now that it has been
passed," he said. "The act is largely
applied in secret providing little
information to the public on its use."
"The person who is the target of
the act, does not have to be a target
of an investigation," he added.
"People served under (certain sec-
tions) cannot say they are involved,
or they can be arrested."
Pheniger says that in order to
change the act, people must contact
their local representatives to help
bring back some of their basic civil
liberties that the Patriot Act has
taken away from them. Even to
modify the act could be a step in the
right direction.
"We need to maintain the con-
stitutional system that makes the
United States unique and worth
defending," he said. "America,can
be safe and free."

Tampa Bay's media guide says
he stands six feet tall..it's question-
able. It also says he weighs 170
pounds...it's possible. It is also
reported that he throws a baseball
between 94-96 mph... that's a fact.
He is Scott Kazmir. The 21-year-
old left handed pitcher that was on
the hill for the Devil Rays Tuesday
night at Tropicana Field.
The young Houston native with
a blistering fastball and excellent
changeup hopes to create havoc for
batters around the American League
this season and he got off to a strong
start in his first appearance, despite
the Rays losing the game 6-3 to the
Toronto Blue Jays.
Kazmir allowed just three hits
in five innings and only gave up one
run, thanks in large part to a triple
that should have been caught by
outfielder Eduardo Perez. He
walked two and struck out two. It
wasn't, a spectacular performance,
but it certainly was strong, a posi-
tive sign for a.team that'll be depen-
dent upon good startingpitching if it
hopes to be successful this season.
"He's an exciting pitcher to
watch," said manager Lou Piniella.
The Rays are trying to be care-
ful with their young star, in hopes
that he can perhaps be the fran-
chise's future number one star on
the mound.
"We want to continue to watch
his pitch count, keep it between 90-
95 and bring him along gradually,"
said Piniella. "Eventually we will
get him throwing between 115-125
pitches."
Piniella kept to his word Tues-
day, pulling Kazmir after five
innings and 89 pitches. Kazmir
understands his role on the team and
just wants to make progress.
"I completely understand with
the pitch count and what the team is
trying to do," he said. "We just have
to move ahead."
That is' exactly what he has
done since arriving in Tampa Bay
last year via a trade with the New
York Mets. The Mets, looking to
make a playoff run, made arguably
one of the worst trades of their sto-
ried franchise, according to many
baseball insiders. They traded
Kazmir, their number one pitching
prospect at the time and one of the
top prospects in all of baseball, in


exchange for starter Victor Zambra-
no at the trade deadline last year.
The move didn't pay off for the
Mets as the team failed to make the
playoffs last year and Zambrano
tore a muscle in his forearm, ending
his season.
The Rays on the other hand
made a wise investment in the
future of their ball club with the
acquisition of Kazmir.
In his first start against Seattle
last year, Kazmir pitched five score-
less innings, striking out four.
Maybe it was his size that
scared the Mets away, or maybe it
was his occasional lack of consis-
tency to find the strike zone. What-
ever the,reason, it wasn't the first
time Kazmir was passed on by a
teamror 14 for that matter.
In 2002, the year he was draft-
ed, Kazmir fell to the Mets at pick
number 15. He wasn't even the first
player from his high school drafted
that year. His teammate, pitcher
ClintEverts, was drafted fifth over-
all by the Montreal Expos.
Kazmir has dominated just
about everywhere he has been. As a
high-school junior he pitched four
consecutive no hitters, adding two
more in his senior year.. As a senior,
he struck out 175 batters, breaking
the season record in Texas previous-
ly set by 2003 World Series MVP
and current Florida Marlin Josh
Beckett.
He and Rays future phenom,
B.J. Upton, helped the United States
Junior Olympic team earn a silver
medal in 2001 in Camaguey, Cuba.
Despite being ill, he struck out 33
batters in 16.0 innings and recorded
a 13.0 scoreless innings streak dur-
ing the tournament.
Despite his impressive outing
Tuesday night, and a strong start to
his career, Kazmir is not satisfied.
He is a perfectionist of sorts and.
vows to improve.
"I definitely feel I can do better,
no doubt," said Kazmir. "As for the
future, I'm not going to put any
added pressure on myself. I'm
going to take every start like it's my
first and continue to get better."
If every game is going to be
like his first, the Devil Rays will be
in pretty good shape.

Clubs celebrate national Boys &
Girls Clubs Week
The Clearwater Boys & Girls Clubs will
have plenty of company as they launch local
observances of National Boys & Girls Club
Week, April 3-9.
The Clearwater Clubs have big plans, includ-
ing Daily Open Houses from 6 pm-8 pm at four
Boys & Girls Units: the North Greenwood Unit
featuring the KUNGA Project; the Sabal Walk
Unit; the Wood Valley Unit and the Wellington
Extension Unit.
"We plan to show the community the rich
diversity of programs and benefits the Clubs
provide to our children and teens," states
Clearwater Area Director Aaron McGlon. "The
Boys & Girls Clubs impact millions of young
lives every day, year-round, and this annual
observance is our golden opportunity to let the
world know.
The Clearwater Clubs will also host events
and daily activities, as well as receive a Procla-
mation from the City of Clearwater on Thursday,
April 7th. Some of the events include "Bring a
Friend Day," poster and essay contests, health
fairs, community service projects, field day and a
celebration of the Arts.
In addition to these fun and exciting activi-
ties, the Clearwater clubs will be kicking off the
annual Support a Child Campaign. This is an
annual plea to local businesses, churches, civic
organizations, and individuals to support a child
for Summer Camp. "Through this effort last year,
we were able to offer more than 100 children full
scholarships to the ten-week summer day camps
in Clearwater," states McGlon. "This year we
hope to offer scholarships to over 200 children."

Air housing month symposium
The city of St. Petersburg, Pinellas County
and Boley Centers for Behavioral Health are
observing Fair Housing Month with a free, one-
day symposium, April 20, on fair housing for per-
sons with disabilities at Sunken Gardens, Garden
Room, 1825 Fourth St. N. The symposium is
sponsored with funding from the U.S. Depart-
ment of Housing and Urban Development.
Two half-day sessions will be held. The first,
from 9 a.m. to noon, provides specific informa-
tion for housing professionals attorneys, apart-
ment managers, housing owners, social service
providers, etc. Experts will review the Fair Hous-
ing Act and discuss 'compliance, define "reason-
able accommodation or modification" and review
accessibility requirements.
The second session, 1:30 to 4:30 p.m., is
designed to educate the public regarding its rights
under federal, state and local fair housing laws. It
will provide people with an understanding of
what they are entitled to regarding housing rights,
as well as what obligations landlords have under
the law.
Special presenters will include Michael
Allen, Esq., a senior staff attorney and director of
housing programs at the Judge David L. Bazelon
Center for Mental Health in Washington, D.C.
Pre-registered attendees will be reserved a
seat, and will receive all materials. For more

St. Anthony's triathlon
One of the nation's premier multi-sport
events returns to downtown St. Petersburg April
22 24. Beginning with a free Sports & Fitness
Expo on Friday in Vinoy Park, the weekend con-
tinues with the popular Meek & Mighty competi-
tion on Saturday morning, followed that evening
with a live concert by legendary 1970s rockers,
Firefall. On Sunday, St. Anthony's Triathlon kicks
off at 7 a.m. at Spa Beach, downtown at The Pier.
One of Tampa Bay's signature events, St. Antho-
ny's Triathlon has defined a culture focused on fit-
ness and fun for the past 22 years.
Salute to Professional Assistants St. Antho-
ny's Hospital Auxiliary will host its 13th annual
Salute to Professional Assistants on Monday,
April 25, 2005, at the Radisson Hotel and Con-
ference Center, 12600 Roosevelt Boulevard, St.
Petersburg. The event provides a way for business
executives to recognize their professional assis-
tants with nominations for Assistant of the Year.
This event would make a great photo opportunity.
Ten Weeks to a New You The Carillon
Wellness Center hosts a life-changing program
that's based on solid scientific research, not fads,
that has helped dozens of people achieve their
personal fitness goals and start on the road to feel-
ing 10 years younger in just 10 weeks. The next
10-week class begins this month. The program
would make an excellent long-term feature, fol-
lowing participants' progress. It is also a strong
tie-in to national Physical Wellness Month, which
runs throughout April.
Understanding false alarm issues
Alarm systems are meant to bring a sense of
security and peace of mind when properly
installed. However, poorly used, installed, or
maintained systems can cause significant prob-
lems for both consumers and police..One study
estimates the annual cost of false alarms to police
departments nationwide to be at least $600 mil-
lion.
Several communities in Florida like
Gainesville and Cape Coral have many false
alarm calls that cost taxpayers money and divert
law enforcement officers from real emergencies.
In order to control false alarms and their costs,
many police jurisdictions are adopting laws and
regulations from false alarm fines to requiring
permits or registrations to install an alarm system.
There are many electronic security methods
such as motion detection, audio detection, video
detection, and access control. Some systems are
more prone to false alarms than others; however,
with a verified system an operator can hear and
see what is actually happening during the real-
time break in. This provides law enforcement
with the intelligence, information and investiga-
tive evidence to respond to alarm calls and then
later use this information in court hearings. Com-
pared to the non-verified alarm system which has
a 90 percent false alarm rate and in the same time
it takes a verified system to apprehend the sus-
pects, the non-verified system is just' dispatching
the police.

The Housing Finance Authority of Pinellas
County (HFA) now has funds available through
its Home Key Plus program to assist residents of
Pinellas, Pasco and Polk counties to buy their first
home with a low interest rate mortgage of 4.99%.
"We are very excited about our new low
interest rate programs. Our Home Key program at
5.4% and our Home Key Plus at 4.99% combined
with our new Home Key 2nd program, provide
buyers the opportunity to borrow their down pay-
ment and closing cost, eliminating the biggest
obstacle to homeownership for most families,"
said Darlene Kalada, HFA Executive Director.
Rodney Fischer, Chairman of the HFA Board
said, "With this new bond issue, we have made
changes to the program to make homeownership
a reality for working families in the counties. We
have eliminated all discount and origination fees,
which can save families literally hundreds of dol-
lars in closing costs."
The HFA program has generous income and
sales price limits and serves Pasco, Pinellas, and
Polk County first-time buyers. In all three coun-
ties, a one to two person household may have an
income up to $51,900 and larger households may
have income of up to $59,685. The sales price
limits for a new or existing home is $204,432 in
all three counties.

Applicants must demonstrate a broad range of experience in an office
park type development environment. Full consulting services relating to
design, permitting, and representing the owner, during construction, is
required.

Serivces may include, but are not limited to:

Site Infrastructure Improvements include domestic water main.
fire protection, sanitary lift station/forced main and lighting.
Replace a 500 gallon steel sulfuric acid tank and ancillary piping.
Replace approximately 20 air handler units sized from 2.000 -
20,000 CFM. This project is to be broken down into smaller
projects.
Replace a 5.400-ton HVAC cooling tower. Final decision based on
engineering study to evaluate current/future loads, energy
efficiency and construction materials.
S Install a synchronization control and distribution system for three
600KW emergency power generators.
Review. revise/upgrade electrical power sub-metering to multi-
tenant spaces.
Support small renovation projects that involve HVAC. fire
protection and power modifications.

New UF/IFAS study farmland shows

The value of agricultural land continued to increase in all areas of the
state last year, buoyed by a population boom and strong nonagricultural
demand for land, according to a new University of Florida survey.
"Following recent trends, the market for agricultural land was very
active this past year, and the rate of increase in land values was particularly
high in the southern regions of the state," said John Reynolds, a professor
emeritus with UF's Institute of Food and Agricultural Sciences. "In most
land-value categories, we recorded double-digit increases."
He said the most prominent changes occurred in South Florida where
the value of cropland increased by 58 percent and pastureland values
jumped by 76 percent. The largest increases were in the Indian River area,
Okeechobee County and the Gulf Coast counties.
Cropland and pastureland in other regions also experienced substantial
increases: 19 to 25 percent in the central region of the state, 10 to 19 percent

The value of land with 5- to 7-year-old citrus plantings increased about 9
percent in the gouth and central regions.
The average value of orange groves in the south region was $6,540 per
acre, about $130 per acre higher than in the central region. The estimated
value of grapefruit groves increased to $5,264 per acre in the south region,
about $746 per acre higher than in the central region. The average value of
land with 5- to 7-year-old citrus groves was $5,920 per acre in the south
region, about $580 per acre higher than in the central region.
Reynolds' 2004 land value survey, which measures changes over the
past year, divides the state into five regions: south, southeast, central, north-
east and northwest. Because of the impact urbanization has on agricultural
land values, Reynolds collects data for the southeast region, including
Miami-Dade, Broward and Palm Beach counties.
He also measures the value of transition land acreage being convert-
ed or likely to be converted to nonagricultural sites for homes, subdivisions
and commercial uses. Counties were divided into metropolitan and non-
metropolitan counties, and transition land values were estimated for each
region.
The value of transition land within five miles of a major town in
metropolitan counties increased by 7 to 13 percent in northern regions of the
state and by 6 to 52 percent in southern regions. In dollar amounts, the value

of transition land in metro counties ranged from $14,082 to $24,983 per
acre, except in the southeast region of the state where transition land values
were $62;500 per acre.
The value of transition land more than five miles from a major town in
metro counties ranged from $7,950 to $14,352 per acre, except in the south-
east where the value was $36,250 per acre.
In non-metro counties, the value of transition land within five miles of'
a major town ranged from $4,793 to $6,778 per acre. Transition land more
than five miles from a major town ranged from $3,921 to $5,446 per acre.
For the 2004 study, six counties were reclassified. Reynolds said the
changes in the northwest include moving Jefferson and Wakulla counties
into the Tallahassee metropolitan statistical area (MSA), which is a federal
designation for urban or urbanizing areas. In the northeast region, Gilchrist
County was moved into the Gainesville MSA, and Flagler County was
removed from adjacent MSA counties. In the southern region, Indian River
County was designated as the Vero Beach MSA.
"It is important to emphasize that the value of a specific tract of land
may vary substantially from the survey estimates because of the physical
characteristics of the tract, its location and the economic or institutional fac-
tors that restrict its use," Reynolds said. "The survey measured land values
up to May 2004, and it does not include any changes in land values that may
have occurred after last year's hurricane season."
The 2004 Florida Agricultural Land Value Survey also shows:
Last year, the value of cropland and pastureland in the south region
increased from $1,100 to $1,400 per acre. The value of improved pasture
was higher in the central region than in other regions. The lowest agricul-
tural land values were reported in the northwest region, ranging from $1,450
per acre for unimproved pasture to $2,193 per acre for irrigated cropland.
The value of irrigated cropland was $3,901 per acre in.the south region,
$3,709 in the central region, and $3,428 in the northeast region. The value
of non-irrigated cropland was $3,237 in the central region, $2,657 in the
northeast region and $1,983 in the northwest region.
The value of improved pasture ranged from $3,608 per acre in the cen-
tral region to $1,783 per acre in the northwest region. The value of unim-
proved pasture ranged from $2,605 per acre in the south region to $1,451 in
the northwest region.
The value of farm woods increased by 18 percent in the northwest
region of the state and by 16 percent in the northeast region.
Survey respondents were asked if they expect agricultural land values
to be higher, lower or remain unchanged during the next 12 months. Eighty-
five percent of the respondents in northern areas and 67 percent of the
respondents in south region expect land values to increase during the next
year. Only 2 percent expect lower land values during the next 12 months.
Respondents in the southeast region said that they expect land values to
increase by 30 percent, primarily because of strong urban demands.
