Upon this point, fir, we may borrow
a few additional. rays of light from the
conffitutions of Pennfylvania, of Delaware,
and of fome other IRates. In thofe flatts it
.has been thought, that there might be mif-
condnut on the part of -a judge, not amounting
to an- impeachable offence, for .wlich he
flould be li,ble to be removed. Tiieir contli-
tutions therefore have varied from that of the
United States,, and rendered .their judges
liable'to be removed upon 'the addrefs of two
thirds of each bratsch of the iegiflature. De'ts
.it not ftrike every mind, that it was the intcn-
tention of thofe conflitu-ions to have judges
independent of a majnirity of each branch of
the legislature ; and I apprehend alfo that it
may be fairly inferred, that it was underflood
in thofe plates when'their conflitution 'ias
formed, that even two thirds of each branch
of lthe legifleture would not have the power
to remove a judge whofe tenure of office was
during good behavior, unlefs thle power was
exprefsly given to them by tlhe- conflitution.
I cannot well conceive of any thing more ab-
furd in an inftiument designed to hlft for
centuries and tb bind tle furious paffliiis of
party, than ao fortify one p.ifs to judicial inde-
pendence, and to leave another totally unguar-
ded againil the violence of Legifl.icive pow-
er. '
It has been urged by the genitleiian of Vir-
girtia, that our idohrli,. that Congrefs has a
power to modify the office of judge, leads to
the conclusion, that they have the power to
abolith the office. Bi c-ufe by parting away
their p.m-..nIs they may at length reduce them
to a shadow, ard leave them as humble and as
contemptible as courts of piepoudre. The
office ef a judge confiils of judicial powers
which he is appointed to execute. Every-
law which is paffred increases bor dirilnilhes
thofe powers, and fo far modifies the office :

lhas its bounds. You may modify the office

pendence of the judges. The judge is to hold
the office during good behaviour ; now modify
as you pleafe, fo that you do not infringe the
conflitutional provision.

far you can go and no farther. I admit a line
can be drawn. It is an aft.ir of found and
bona fide discretion, bec;,ufe a discretion on,
the fubjuf is given to.the legislature, to argue
upon the abule of that diferetion is adopting a

The conflitution is predicated upont the
exiflence of a certain degree ofinmtegrity ii
man. It has truled powers liable to et-iormous
abfe,' if all. political honesty be discarded.
'1 he legifature is not limited in the amount t of
the taxes which they have a right to impofe
nor as to the obje6 s which they iare to be
applied. Does this power give us thle pro-
perty of the country, because by taxes we
might draw it into the public cofil'rs, and then
cut up the treasury and divide the fpoils ; Is
there any power in refped to which a precife
line ran be drawn, between the difVorcet exer.-

of granting commiflio for a judicial office,

'pradice to consider the acceptance of an
office, as relating to the date of the com-

date, it then does not appear very incorrect

circuit judge, granted to a ditlria judge, as

mer office relates to the date of the com-
rmiflion, to Eo.ld-hl-r ihe hitter office as vacant
from tlhe fame time. The offices are incom-
patible. You cannot fuppofe the failme perfon
in both offices at the fame time. From the
noiinent, therefore, that you considerr the
office of circuit judge filled by a person who

This has been affumed as a fufficient grotids,
not only of fufpicion, but of condemnation.-
The prefent executive, leaving fcarcely an
exc ptioni has appointed to office, or has by
accident, indirectly gratified every mant, who
had any diftiguiihed means in the competi-
tion, for the Prefeieutial office, of deciding
the election in his favor. Yet, *fir, all this
