Jorge Pino, southeast public information officer for
the Fish and Wildlife Conservation Commission, said
the basic fine will be $50 with more added on for court
costs that vary from county to county. In Miami-Dade,
the total is $90.
"If you're caught twice in one year, then you're not
permitted to operate a vessel on state waters until you go
through a course and show proof of completion to the
FWC," Pino said.
The FWC website's boating pages link to seven online
courses (see up close box), including seven for motor boat-
ing and one for jetskiing. All have the approval of the Coast
Guard and National Association of State Boating Law
Administrators, which requires a course of at least eight
hours.
That indicates it's not a quickie. Take a preliminary
scroll through any of them and you'll confirm the suspicion.
In different ways, the courses all present the same
kind of material. They miss little if any important informa-
tion, covering nuts-and-bolts fundamentals such as hull
types, propulsion systems, required equipment, navigation
lights, radio, trailering and maintenance.

Learning on the run is over for boating beginners in
Florida.
The new law, requiring new boaters to pass a thor-
ough course in boating basics and safe operation, isn't
broad enough to beach every clueless klutz now on the
water. It only covers boats of 10 or more horsepower and
people born since Jan. 1, 1988 those whose ages reach
21 beginning Jan. 1, 2010.
The list of common errors is long. By taking action to
force basic boating education on the unwilling and the
indifferent, Florida validates the typical complaint by
smart, responsible boaters that most bad things happening
on the waterways are caused by ignorance and inexperi-
ence.
Pass the course (costs range from cheap to free) and
you'll get a card with an ID number almost a license,
if not quite that says you've completed an approved
safe boating course. You only have to do it once; it's good
for a lifetime.
Don't do it and you're taking a risk. If you're stopped
by a state or local marine patrol officer and you don't have
the graduation card with a photo ID to prove the card is
yours, you're in for a ticket.

Laud. man says device makes bait hooking a breeze

A Fort Lauderdale entrepreneur has patented a bait
bridling kit he claims makes it possible for novice anglers to
rig up live bait faster than the professionals can, and with
less damage to the bait.
Howard Rosenberg has been selling the bait
bridling kit for a year now, and received the patent
for it in early 2009. A former ladies handbag man-
ufacturer, he retired several years ago but had trouble
staying retired.
His love of fishing got him working on ways to make it
easier, and to take the hassle out of the fun.
"What you used to do is take floss in a needle and put it
through the eye socket of most live baits," Rosenberg
explained. "The fish is not happy about the whole idea, you
have him out of the water for too long and you're damaging
his skin by holding him in a towel or between your legs or
what have you."
Rosenberg's system allows the hook to be placed any-
where on the fish without damaging it, so it can swim natural-
ly in the water.
"That's what you want him to do," he said.
But is the Quick Rig bait bridling system the proverbial
better mousetrap that all inventors are looking for? More
importantly, will it deliver on Rosenberg's promise to make

in action and thought it would be pretty helpful to novices.
"It looks good. It looks clean. It looks fast,"
said Roydhouse, who runs charters out of Fort
Lauderdale "For the novice fisherman.

Ro.ydhouse said he didn't think the sy stein would
be cost effective for his operation, however.
And there's the rub. The Quick Rig tool, which looks like
a pair of modified needle-nosed pliers, costs between $59 and
$99, with bait clips included.
"That's an expensive pair of pliers," said Capt. Alan
Sherman, who fishes out of Miami.
But he agreed with Roydhouse, the system does make it
easier to rig live bait well.

"In the past, if you just used a circle hook, the fish would
have a tendency to turn and the hook might not set right," he
explained.
Rosenberg's system puts the hook in the bait in such a
way that makes it nearly impossible for the fish to twist it
wrong, Sherman said. But he also said another system that has
come out recently is getting rave reviews from captains he
knows. The Gerry Rig is similar to the Quick Rig system, but
ilic clip can be tightened down on the fish by hand, with no
S.pccial pliers necessary.
Sherman said he hasn't used either the Quick Rig or
cl ny Rig, but knows a lot of other captains who are using the
(Gcny Rig.
"'It makes for a quicker cleaner connection from hook to
I\ c bait fish, without really hurting the bait fish and it makes
ilic hook set in the fish's mouth easier," he said.
"Everybody is always looking for something easier
and quicker that works," he added. "This is one of the
newer things on the market. The clip itself is very use-
ful, regardless of whose it is."
Rosenberg said he has sold about 2,000 kits,
and is hoping that an improved economy will bring in
more buyers.
"The sales, as with the economy now, are very slow. We
looked forward to this season, this season never really came.
Sales were great last year," he said, noting he's shipped the
kits to Dubai, Scotland and South Africa and several online
and traditional stores are carrying them.
"People who have used it, love it. They come back and
order more of them."

Florida to lower boaters' legal blood-alcohol threshold


skills lookout duties, seamanship, approaching and over-
taking other boats, chart reading, ship avoidance, docking,
anchoring and on and on.
Along the way the courses present quizzes and reviews
to keep you paying attention. In the end there are final exams.
Most are equivalent to reading a book. BoaterExam.com
calls its course an animated study guide. It looks a lot like a
Power Point presentation, with a pleasant female voice recit-
ing the material as you read along.
You can scroll through the entire contents of that one, the
Boat Smart course and BoaterExam without having to regis-
ter or pay for anything until the final exam when you get that
far. The others require upfront registration. The highest fees,
just under $30, are charged once you pass the final.
We spent enough time on the courses and quizzes to feel
the need for brushups of both skills and knowledge. Anyone
who's between boats and doesn't get out much would bene-
fit by reading all the way through any of them.
Casual boaters and fishermen who think they know
enough about boating and safety also should take a careful
look. Even if you're not required to pass the course, it's
liable to contain a lot of information you've forgotten or
never knew.

Drink this in
There's another new Florida law that sober boaters can
drink to.
Next year, it says, drinkers can qualify for enhanced
drunk boating penalties without being quite as dnmk as they
have to be this year.
The new threshold for boating is a blood-alcohol meas-
urement of 0.15. Before, a more lenient standard of 0.20 was
considered three sheets in the wind.
That doesn't mean you can get as drunk as 0.15 and get
away with it. You're still bustable at 0.08, the same as for
drunk driving in a car.
The difference is that up to now they couldn't throw the
rest of the book at you on your boat unless the drunkome-
ter gave you 20 points. At 15 points, you're more likely to
understand why you're in so much trouble.

In 2008, says the Fish and
Wildlife Conservation Commission,
the Legislature made the enhanced
penalty level 0.15 for drunk driving,
but not for drunk boating. Now
they're the same.
Who will enforce that law? Jim
Brown, the FWC's new enforcement
chief. Brown boasts a background as
a fellow who knows his business.
He grew up in Homestead, near
the edge of the Everglades, and


hunted and fished from the Keys to Lake Okeechobee. Brown
studied criminology at Miami-Dade College and sociology at
the University of Miami and began his conservation career in
the Keys in 1981.
The new post opened when FWC enforcement director
Julie Jones was appointed head of the state department of
Highway Safety and Motor Vehicles.
Brown, now a colonel, was appointed FWC's chief
enforcer by Ken Haddad, the agency's executive director.
It is an office job, but if FWC field men ever have to move
a small ship from one place to another they can invite Brown
to take the assignment. He holds a 100-ton captain's license.

Seafood sustainability contest not about stuffing yourself

Economic news was so good in
mid-October that the naively opti-
mistic were carried away by exces-
sive enthusiasm. As usual, that led
fishing-doers into rash decisions.
They invested unwise portions
of their shriveled assets in bait and
engine fuel, then rushed to the
f docks and ramps without skunk
repellent. Those of us who enjoy
learning from other folks' mistakes shook their empty, fish-
less hands and smiled knowingly.
"Nice sunburn," we said.
"Shut up," they replied.
Their excitement was caused by news that the Dow
Jones Average broke 10 thousand and the S&P Index broke
10 hundred. Even we dour skeptics who write about fishing
got worked up about it.
Not that many of us really understood it. Our kind sup-
poses the Dow Jones Average is a minor football statistic, cre-
ated to keep television announcers yapping between downs.
If any of us know the initials S&P stand for Standard
& Poor, we guess it's a way to measure our poor standard
of living.
Still, the good news so buoyed my mood that I was
gulled by the announcement that nominations are open for
the 2010 Seafood Champion Awards.
Oh boy, I thought, an eating contest. Shrimp! Lobster!
Stone crabs! So what if I don't win? I can't lose. I hoped the
entry fee wouldn't be too high, and in fact there isn't a fee,
but other than that my investigation led to a letdown.
I wanted seafood sustainability to mean how long I can
keep eating stone crabs without bursting, or without having
to pay for them.
It turned out that the championship is sponsored by the
Seafood Choices Alliance, and the prize's purpose is to rec-
ognize seafood industry stakeholders, not gluttonous free-
loaders. Nominees have to be people or organizations that
"have made an exceptional contribution to improving
seafood sustainability," the contest criteria say.
"Sustainable" is a popular word in the conservation

vocabulary. It sounds righteous and looks good in print but
I'm not sure any more what it really means or whether any-
one is using it correctly.
Six seafood champions, who presumably understand
it, were crowned this year at the International Seafood
Show in Boston. Just getting into that is a very alluring
award all by itself.
It's too bad that none of the champions were seafood
consumers, like you and me. They were all stakeholders in
the trade for example Caroline Bennett, proprietress of
Moshi Moshi, which was cited as the only sustainable sushi
restaurant in London.
Why the only one? Don't the English like to eat
responsibly?
As for our kind of stakeholders, in this case we might as
well be steak holders.
Personal disappointment aside, it's good that there are
rewards for the best efforts on behalf of seafood sustainabil-
ity, other than spelling it right.
Anyone who knows what it actually means should write
up a nomination for a qualified sustainable seafood hero. The
deadline is Nov. 10.

Let's say there's a hypothetical island
inhabited by penguins whose population is
gradually being diminished by a hungry
orca. Once the last penguin is consumed, a
statistician could point out that the monthly
mortality rate for the island's penguins has
gone down to zero, and now things will
only get better for them.
Similarly, television's talking heads
are calling the present recession almost
over since statistics show that fewer peo-
ple are getting laid off. Are they right?
I'm not sure...
Historically, recessions just like
hungry orcas tend to have rest cycles.
Let's hope the economy is not coming
down to its "last penguins."
Obviously recessions result in a higher
number of layoffs and fewer jobs. In the
marine industry, fewer businesses are get-
ting paid for work they've already per-
formed a particularly troubling situation
during a bad economy.
In healthy economic times, many com-
panies can and often do allow some
unpaid debt to "ride." But as money
becomes tight, collection on unpaid bills
tends to become more aggressive.
Ironically, this also is when debts are
least collectable. Even if a company should
take the debtor to court and win, collecting
on the judgment could prove impossible.
Loyal readers of this column know that
I am a big advocate of taking preemptive
measures to help keep unfortunate situa-
tions from occurring. This includes having
professional, well-written contracts and the
request of reasonable, but sizable, up-front
down payments before work begins on
projects and deliveries. But let's say the
worst happens: no further compensation is
forthcoming from a client, and using
extraordinary collection methods is either


too expensive or futile.
This is usually when a marine compa-
ny will inquire about the concept of mar-
itime liens for the providing of necessaries.
Basically, this is a federally recognized lien
for costs, which attaches directly to a ves-
sel pursuant to work and/or provisions
already provided to that vessel.
Technically, the lien attaches immedi-
ately upon work provided, or a provision
being given to the vessel, and doesn't actu-
ally require the official recording of a lien.
However, enforcement requires the arrest
of the vessel by the U.S marshal an
expensive proposition unless the lien in
question is in the mid-five figures.
So, is there an alternate route for mar-
itime companies that don't want to spend
finite resources on a federal arrest?
Possibly.
Under certain circumstances, some
maritime liens can actually be recorded
with the U.S. Coast Guard. This option is
less expensive than going to federal court
and having a boat arrested, but it has limit-
ed application. The following criteria and
steps must be met:
*First, to record a lien against a boat,
the vessel in question must presently be a
U.S.-documented vessel registered with the
U.S. Coast Guard.
*The vessel's documentation number
submitted for recording must be correct.
*Before submitting any papers to the
Coast Guard, the lienholder should ask and
pay for an Abstract of Title for the vessel to
review all other present lienholders, and
confirm the actual owner of the vessel.
*Notice of the lien being recorded
must be sent to all other present lienholders
as well as to the vessel's present owner of
record.
*To record the lien, the lienholder must

Every time I'm on the water, I am
amazed at how little nautical knowledge
most boaters possess. When I got my
captain's license, a fellow captain told me
that I now have a license to learn. I'll be
the first to admit that I'm still learning.

Festival that took place in early October
near Haulover Marina, I got mixed sig-
nals from the Miami-Dade Marine Patrol
and the U.S. Coast Guard Auxiliary.
Judging from all the boats crisscrossing
every which way, it was clear that I was
not the only one unfamiliar with the
applicable navigation rules.
Upon returning home that evening, I
checked the "USCG Navigation Rules"
and "Chapman's Nautical Guides" where
I could not find any reference on who has
the right of way when meeting up with a
dragon boat.
Several months earlier I had encoun-
tered a similar situation at Haulover dur-
ing an offshore powerboat race. The
boats were being launched from a barge
near shore. Several boats from various
marine units were there with their lights
flashing indicating that we should
slow down.
When I was in earshot of the Miami-
Dade marine boat, I suggested that they
broadcast a security announcement. They
looked at me like I was an alien. But I
was pleasantly surprised when I heard
just such an announcement during the
dragon boat races. I'd like to think that
when the officers got home they said,
"Maybe Capt. Bob is on to something."
Heading south on the Intracoastal
approaching mile marker R "4a," I was
at the far west side of the channel. A
large sportfish was heading north and we
were on a collision course. I could not


move to starboard or I would have been
out of the channel.
The sportfish could not change
course to her starboard as the Miami-
Dade Marine Patrol was forcing her over.
I had no choice but to stop and let her
pass through the now single lane.
Why wasn't the race course set up
west of the ICW closer to Oleta River
State Park? This area is nearly three
times larger and would not have restrict-
ed the ICW channel, other than requiring
the boats to go at idle speed.
Returning north several hours later
after dropping a lunch hook at Florida
International University, I was approach-
ing marker R "4a" again and the same
Miami-Dade Marine Patrol boat was
drifting aimlessly right in the middle of
the channel.
I assumed that he wanted me to pass
close to R "4a" as if it was the English
Channel. As I got closer he kept drifting
in front of me so I passed astern.
A few hundred yards further north,
as I hugged the west side of the ICW, a
Coast Guard Auxiliary boat was signal-
ing for me to slow down and move fur-
ther west, which would have been out of
the channel.
By the way, not only was there no
race in progress, there was also no drag-
on boat in sight. I yelled to the Auxiliary
that I was at idle speed and that I was not
going out of the channel unless they were
willing to pay my tow bill.
Luckily they did not fire a shot
across my bow, so I continued home.
It's hard to keep a sharp eye with all
the distractions. After yelling to the
Auxiliary, I looked up just in time to see
a small boat come out of the Haulover

submit a sworn and notarized affidavit attesting to the lien
against the vessel and will be charged by the page for the sub-
mission.
If the affidavit fails to accurately include specific infor-
mation required by the Coast Guard, the affidavit will be sent
back for re-filing and further payment with all previous fees
retained by the Coast Guard. Note: The Coast Guard does not
offer a template for this affidavit, but does offer some guide-
lines on its website.
*Finally, if the filed affidavit proves to be fraudulent, or
the underlying lien improper, the submitting lienholder may
be subject to some severe federal penalties.
Remember, the recording of a maritime lien is not a
guarantee of future payment. But it does put the owner and
other recorded lienholders (such as a bank) on notice that

other liens now exist on the vessel and are subject to pay-
ment. It is most effective as a tool when the owners are con-
sidering putting the vessel up for sale.
Many lienholders fmd the affidavit preparation process
time consuming and a bit daunting, and are prepared to pay
a maritime legal professional to carry through with the work.

by doing it themselves can refer to the Coast
Guard's National Vessel Documentation website at:

Hopefully, such tools may help some maritime business-
es in wading through the present recession.

Effeminate male fish may be result of human carelessness

hauled up a giant squid, 19.5 feet long, from 1,500 feet down?
The ship cruises the Gulf of Mexico for the Southeast
Fisheries Science Center, from its homeport at (speaking of
spelling) Pascagoula, Miss. It was on a summer voyage,
seeking info about what whales eat.
That required a trawling rig, dragged at depths too great
for rod and reel fishing.
Scientists already knew that whales eat giant squid,
because they've found pieces of the species in the gullets of
sperm whales from the Gulf. Enough was known about the
giants to satisfy a layman's curiosity but not a scientist's.
Just about all they knew was reported in Richard Ellis'
322-page book, "The Search for the Giant Squid," published
in 1998. If you know scientists, you can guess that they
guess there must be at least another 322 pages worth of info,
not yet discovered.
Even though the scientists on the Gordon Gunter sort of
knew they'd have to trawl at 1,500 feet to net a giant squid,
that's not exactly what they were after, according to the
National Marine Fisheries Service.
They wanted to know whatever whale prey could be
found way down there. The elusive giant squid was a
happy surprise.
Here's Anthony Martinez, the chief scientist on the voy-
age: "As the trawl net rose out of the water, I could see that we
had something big in there...really big. We knew there was a
remote possibility of encountering a giant squid on this cruise
but it was not something we were realistically expecting."
If you do much bottom fishing on deep reefs, you know
that anything hauled up in a hurry is going to be gas-inflated
and suffering something like the bends. Although technically
a live catch, our giant squid was as good as dead by the time
it came aboard.


The scientists stretched it out on deck, measured it at 19
and-a-half feet and piled it on a scale: 103 pounds.
As a sporting tackle angler, you're probably thinking
that's an awful lot of bait. As a seafood consumer, you're
probably thinking it's an awful lot of calamari.
Theoretically true, but people who've tasted giant squid
found it awful, with a strong smell and taste of ammonia.
Scientific investigators determined that's because giant squid
contains uh-oh a lot of ammonium chloride.
Nevertheless, the catch was something to celebrate
because the only other whole giant squid found in the Gulf,
in 1954, was floating dead on the surface.

You know what they suspect?
Endocrine-disrupter chemicals
from human sources. You know
what those are? Birth control pills.
Elsewhere, squid grow even bigger than the Gulf giant.
One kind is called colossal, like a half-ton 33-footer caught
in 2007 by an Australian longline fishing boat on the Ross
Sea off the coast of Antarctica.
Ours has been shipped to the Smithsonian National
Museum for Natural History, where it's being examined.
Maybe some day they'll hang it from a low ceiling where
everyone can see it up close.
It was caught in July, but its capture was not made pub-
lic until September. The scientists were still so excited about
it that they forgot to mention what other whale bait, if any,
they found in the depths.

We're a little afraid of this story because it's about You
Know What, but here goes.


It concerns the feminization of male fish, especially the
largemouth bass, Florida's signature freshwater gamefish.
Government scientists (them again!) report that 60 percent
of male bass they examined from the Apalachicola River at
Blountstown, Fla., were intersex fish, meaning their male you
know whats contained some female you know whats, orYKW.
The scientists also found male YKW in female fish,
although that was less prevalent.
According to researchers of the U.S. Geological Survey,
the largemouth bass intersex phenomenon is most prevalent
in the southeastern states. It reaches cross-country and
includes the smallmouth bass.
The greatest concentration of feminized male large-
mouth was found in the Pee Dee River basin in South
Carolina as high as 91 percent of the fish examined at
Bucksport, S.C.
The Apalachicola's 60 percent is second highest.
Concentrations from 30 to 50 percent were found in
Georgia's Savannah, Chattahoochee and Flint rivers.
To lesser extents, the same thing is going on in the
Colorado, Rio Grande, Mississippi and Mobile River basins,
plus other locations in Texas and Colorado.
Intersex smallmouth bass were found in the rivers of
Minnesota, Idaho, Colorado and Oregon.
Scientific publications asked other scientists what the
cause could be.
You know what they suspect? Endocrine-disrupter
chemicals from human sources. You know what those are?
Birth control pills.
Will somebody please tell the rustics, especially in
Blountstown and Bucksport, about stuff they mustn't toss in
the creek?
