Broward: Waterfront doesn't need mosquito spraying

While many residents are swatting away during one of
the worst mosquito seasons in recent memory, people living
on the water are reportedly spending their summer bite-free.
According to Broward County officials, the pesky lit-
tle bloodsuckers don't like flowing waterways such as
canals and rivers.
Most mosquito spraying in South Florida occurs
inland where a record number of the insects have been
driving people, well, buggy.
"Once in a while we get calls for requests to spray, but
we tell the homeowners there's no need," said Joseph
Marhefka, manager for Broward County Mosquito
Control, referring to waterfront neighborhoods.
Fish are believed to eat mosquito larvae and eggs,
keeping down the waterfront mosquito population.


"I'll remind my guests of that fact when swatting the
mosquitoes in my backyard," said Pompano Beach water-
front resident Patrick O'Donnell, who says his property
has been inundated with the pests.
Anything with stagnant water can create a breeding
ground, including boats. Trailered vessels returning from
an outing need to be properly drained. Even boats sitting
unused must be monitored because craft can collect rain-
water, said Gary Goode, an environmental analyst with
the Palm Beach County Mosquito Control Division.
Other possible domiciles include birdbaths, pools,
storm gutters and plant pots. "Anything in your yard that
holds water can produce mosquitoes, no matter where you
live," Marhefka said.
His advice: dump and drain.
Not taking proper precautions doesn't only affect the


homeowner. It can infest an entire neighborhood.
"Mosquitoes don't pay attention to yard boundaries,"
Goode said. "They have a pretty good flight range."
Getting rid of the insects requires more than spray-
ing. It's a community effort, Goode said.
"The more eyes we have, the more of an impact we
can make on mosquito production," Goode said.
Mosquito workers in South Florida could use the
help. Heavy rains have boosted the mosquito population,
causing an increase in complaints. In Broward alone,
some 80,000 acres have been sprayed countywide by aer-
ial crews in June, Marshal said.
He expects to stay busy. Mosquito season runs from
May to October.
"This is one of the worst I've seen in the last 10
years," Marhefka said.

Census to show which fish are demographic stars

About 25 years ago I gave up
scuba diving to save my hearing.
It wasn't too hard a choice for a
news reporter in mid-career, but
the misgivings and regrets that I
thought drowned still bubble up at
certain times.
A biteless day's fishing
makes that happen. Along about
the middle of the afternoon, I get
an urge to go under water just to see what's swimming
around other than me. If the fish finder marks a bunch of
fish over a reef and I'm not catching any, I want to go
down scouting. If I see it's just a school of bait and noth-
ing's dining on it, I should change locations.
How many hours have you spent cruising unpopulat-
ed weed lines, convinced that dolphin are close by but
somehow failing to put a bait before their faces? As a
diver, I could submerge and look around, maybe see a
school of them over thataway. Not that I ever did. I just
thought it was cool that I could.
The idea never occurs to me in the Everglades, not
that I'm actively afraid of alligators. I just don't trust
them, you know? I don't trust fish finders too much either,

not until they learn to tell a gator from a garfish.
The other thing that reminds me I miss diving is the
Great Annual Fish Count in Biscayne National Park. This
year's count was scheduled for July 25 and I can't help
wishing I'd been in on it, never mind that my diver's cer-
tification expired in a prior century.
Even if you know a lot about fish and even though
scuba diving's just been mentioned, you can be excused
for guessing that the fish being counted are being caught
first.
How else would you count them? How can you know,
for example, that a mangrove snapper about 16 inches
long isn't the same one that swam past your face a minute
ago? Suppose a whole school of snapper goes by, hun-
dreds of them all about the same size and all dressed alike,
and you guess there are 300 and you call it an estimate
because that sounds more authoritative than a guess.
Then suppose that 10 minutes later you see another
school, or maybe just a couple of classes. How do you
know they're not part of the first outfit?
Those are rhetorical questions. You're not expected to
know.
One answer is they're counted without being caught first.
Let's shut our eyes real tight and try to imagine what
that's like. Here come some fish, swoosh. There go
some fish, swish. One, two, three, four, uh, eleventy-
five? Wait, no, umpteen hundred at least. I don't know

about you but I'm humming the good old fishery rhyme
that goes like this:
Did you ever see a fishy go this way and that way,
Go this way and that way,
Go this way and that way?
Did you ever see a fishy go this way and that?
Maybe you don't know that one. It's not as popular as
the hokey pokey.
I used to be skeptical about a census of creatures that
look alike, travel in large groups and are constantly dart-
ing here and there, not holding still long enough to count
even a dozen without getting mixed up.
Then one summer just as I was getting ready to poke
fun at the fish count, someone in the Reef Environmental
Education Foundation (REEF, get it?) explained to me
that it doesn't matter too much if they can't exactly get a
precise count.
This might seem like a rather loose application of
scientific method, but the general idea is that if each
year a given number of divers, properly indoctrinated in
fish identification and counting techniques, apply the
same methods in the same places, there's some meaning
to the year-to-year consistency or inconsistency of
their numbers.
Let's say that summer after summer, the REEF divers
count (give or take 10 or 20) 1,000 specimens of a fish called
Hamlet in Biscayne National Park. What if this year they
find fewer than 500 copies and next year barely half that

Boating takes captain away from stresses on land

Meet Capt. Lanny Dixon of Fort Lauderdale, a pest
control operator and owner of Marine Mentors, a company
offering private boat instruction. She and her husband, Jim,
have a 45-foot Jefferson motor yacht named Silver Gift,
bought "the year of our 25th wedding anniversary after
owning several boats and moving up in size."
Where is it docked?
Just off the New River in Fort Lauderdale.
Favorite local spots to go boating?
Haulover Inlet anchored in the cove, playing at the sand-
bar, fishing the flats, Lake Sylvia, Boca Inlet. For longer
trips we love the Keys, especially the Islamorada area.
Whom do you take aboard your boat?
We occasionally take friends and family, but mostly we
have kept this boat a private haven to escape the daily rou-
tine of work and life's stresses.
How did you get involved in boating?
My father had small boats that we used during sum-
mers in Clinton, Conn. When I moved to Florida in 1975, I
became very involved in fishing and bought my own first
boat. I paid a mere $500 for the 17-foot Cobia and on the
way home the trailer axle broke. Ahh, welcome to the world
of boating
I kept that boat for a number of years and began doing
some commercial fishing. A few years later I purchased a
22-foot cruise boat and had that when I met my husband of
now 29 years. Where did we meet? At the 15th Street boat
ramp in For Lauderdale, of course.
We eventually sold the 22-footer and moved up to a 25-
foot Sea Ray, which we trailered with the Fort Lauderdale
Boat Club for over 10 years.

After seeing every navigable waterway in the state of
Florida, the Keys, Bimini, and the entire St. Johns River, we
bought our dream fishing machine a 35-foot Alura
Express, which we named It'$ Only Money, Honey.
We ran the boat locally for many years, fished,
overnighted, cruised and then traded up to our current
motor yacht, Silver Gift. She will be our home in the Keys
once we retire in a few years.
Along the way, we restored and sold a 1967 little Cobia
and then later a 1957 Red Fish. We have two inflatable
boats, an 11-foot Caribe with 25-horsepower Mercury and
an 8-foot Avon with an eight-horsepower Johnson. Lately
we added two kayaks, which I am learning to fly fish from.
What's the one item that you can't live without on
your boat?
My "Easy Sudoku" book.
Scariest experience on the water?
Once while anchored well south of Bimini, a very bad
storm came up across the Banks and pulled our anchor.
We were up once the winds started to blow watching the sit-
uation unfold. Once we broke anchor we drifted fast toward


the rocks that we had anchored behind to break the seas for
the night.
Getting the anchor rope pulled up while trying to move
forward took two very experienced mariners to get out of the
situation safely. Chop had built within minutes, the wind
was over 30 mph and the rope had to be handled and pulled
as the windlass was too slow. We finally got control of the
vessel in 3 feet of water, our draft was 2 feet 10 inches.
When I anchor in a strange light-free area, I always
write down the compass heading at the helm in pencil to
navigate out to safety in an emergency. Who has time to
load up electronics?
Most memorable experience?
So many. We trailered our boat to Sanford, Fla. and
launched the 25-footer, running the boat through St. Johns
River and up the Intracoastal to Ferandina Beach. We
spent the night in Silver Glen Springs where the otters, owls,
frogs, cool waters and beauty surrounded our little vessel.
In Femandina we ran outside to Jacksonville and then
on to Daytona Beach. This was a 250-mile, 10-day trip and
we rented a car to go back to Sanford to pick up our safe
and sound truck and trailer.
Also, on a two-week trip to the Abacos we chartered a
38-foot single engine Gulfstar with friends from California.
We cruised from north to south and thoroughly enjoyed
every part of the Bahamas. We cooked on board, fished,
lobstered and walked the beautiful little islands.
What do you like least about boating in South
Florida?
The inexperienced boaters that do not take the time to
advance their skills.
What do you like most?
The beautiful waterways, the coves, easy access to the
Florida Keys and Bahamas. Also the fishing, the New
River, the history, the weather (most of the time). It is a per-
fect place to live if you are a boater.

All fish count, even if methodology is not precise


many? Why? Predators? Pollution? It will be impossible to
avoid suspicion that something is rotten in Denmark.
There's no way to count all the species in the park in
one day. I can't even count all those listed on the park's
website. There are 19 beginning with the letter A. The lists
beginning with B and with S look like the longest ones.
Some of my favorite names are the blackcheek
tonguefish, the dusky cusk eel, the fat sleeper, the high-
hat, night sergeant pugj aw wormfish, saddle stargazer, and
whitefin sharksucker.
Those and many more would make great names for
show dogs and especially for race horses, whose owners
always have trouble figuring out what to call them. I think
the people who dreamed up those fish names should be
invited to the White House and given medals for cleverness.
When the numbers are added up and the census made
public, it will be interesting to see which fish are the


demographic stars, so to say. I long for great increases in
bonefish, grouper, snook and tarpon, but if that can't be
done, I guess I'll settle for other fish as long as their
names are amusing.
One species not on the official list but too important
to ignore is the Indo-Pacific lionfish, an exotic that prima-
rily infests the Bahamas, but just you wait. It's not only
coming, it's already here. One was found in mid-June by
a sport diver at the bow of a sunken freighter in park
waters 60 feet deep.
Park staff went out there to see, and they saw it too.
There had been other reported sightings in the park, but
that was the first one officially verified.
Of course there will be more. Nobody in the exotic
species fright field believes there's any such thing as just


one lionfish. We're supposed to hate and fear and kill them
because they eat the same forage as native reef fish, only
much more of it, and they are known for entirely taking
over whatever habitat pleases them.
They also have venom in the spines of their fins.
That's too bad, for the lionfish is a joy to the eye. On the
upside, it's supposed to be delicious. Those in charge of
telling us how we should behave encourage suspension of
the catch-and-release ethic for lionfish only.
I guess we can do that. If I'm on your boat and we
catch a mess of lionfish, I hope you'll be glad to clean and
fillet them. I'll keep quiet, except for suggesting that you
do the chore with gloves on, and before your first beer.

In an old Warner Brothers cartoon,
Bugs Bunny ends up on the planet Mars
through a plethora of misadventures.
During his visit, Bugs meets a martian
who intends to blow up Earth. When
Bugs asks why, he calmly explains,
"because it blocks my view of Venus!"
In the past, many waterfront home-
owners had a similar attitude toward
anchored vessels out in the water they
didn't like seeing them.
It can be an understandable position.
More than a few anchoring boat owners
seem to remain in the same spot for a
long time. The anchored boats are not
always "charming" in their appearance.
I've also heard it argued that some of the
vessel owners are not very "charming" in
their appearance either and also not
very modest!
Local cities have been encouraged
by many homeowners to take a harsh
stance against what might be called the
"right to anchor." Generally, they enacted
ordinances restricting a vessel's anchor-
ing rights in the area, and combined it
with heavy fines and penalties for any
infraction.
But what most of these communities
and municipalities have failed to consid-
er is their underlying authority to enforce
these ordinances based on existing feder-
al and state preemptions.
The issue came to a head a few
months ago in Stuart where a vessel's
right to anchor when it's not impeding
on navigation was affirmed by the
courts. Basically, a local government
took a broader view of the anchoring
boater's authority on the water than was
contemplated by the state.
When it comes to the right of
anchoring, the courts recognize that


within the limits of their territories,
states generally have concurrent juris-
diction with the federal government on
the waterways. This authority though
does not necessarily extend to local
municipal governments unless it is
granted to them by the state.
In Florida, the statute in question
was Section 327.60(2), which until
recently stated:
"Nothing contained in the provi-
sions of this section shall be construed to
prohibit local governmental authorities
from the enactment or enforcement of
regulations which prohibit or restrict the
mooring or anchoring of floating struc-
tures or live-aboard vessels within their
jurisdictions. However, local govern-
mental authorities are prohibited from
regulating the anchorage of non-live-
aboard vessels engaged in the exercise of
rights of navigation."
As is the way of government, many
cities used this statute to grant them the
broadest authority possible. They chose
to interpret the concept of being "in
navigation" very narrowly and the con-
cept of the live-aboard vessel rather
expansively.
However, Florida specifically de-
scribes a live-aboard vessel as any vessel
used solely as a residence, or represented
as a place of business, a professional or
other commercial enterprise, or a legal
residence.
Pursuant to most federal interpreta-
tions, a vessel used "solely as a resi-
dence" would mean a vessel that could
not be moved or utilized in navigation.
And, the other live-aboard definitions in
question would require legal licensing
and paperwork to prove the premise. This
would mean that most anchored vessels

When traveling by car, it's common
practice to make a hotel reservation for the
night. With your AAA TripTik in hand, it's
pretty easy to estimate where you'll be by
late afternoon. There are plenty of hotels, so
even without a reservation you can usually
find a room. Also if you're cheap, like me,
you have picked up a copy of "RoomSaver"
coupons at Denny's.
It is not as easy when travelling by boat.
There are far less transient slips than
motel rooms, and there are no coupons. No
matter how much you weigh, the Hilton will
have a bed for you. But if your boat has a
wide beam or a deep draft, the options
become limited. (Of course with a boat you
can always spend the night "on the hook"
which is far more comfortable than sleeping
in your car in the Wal-Mart parking lot).
Traveling by boat has its unique prob-
lems. After planning a trip for a month, it's
not unusual to arrive at your boat the mom-
ing of the trip and find that it won't start.
The weather, always problematic when
cruising, is even more unpredictable. Some
marinas have a two-week cancellation poli-
cy even though conditions can change daily
if not hourly.
When traveling in a group, as I often
do with my yacht club, the reservation
process becomes even more complicated.
Marinas such as Hawks Cay in Duck Key
want credit card info for all the boats, as
well as LOA, beam, draft, and power
requirements and mother's maiden name;
whereas Gilbert's in Key Largo asks only
for boat name and length.
Seemingly no marina keeps a database
of repeat business. After giving the length,
beam, etc. during the reservation process, I
always wind up commenting, "Don't you
people keep a database?"
I get the same reply from all marinas.


"We just got a new computer system and
are in the process of updating it."
The computer business must be good
in South Florida.
I would love to know how many
boaters make reservations and don't show,
and how many times the marina lost a book-
ing because they were holding the slip for a
no show. I have to assume it's a lot, as the
marinas spend much time and energy get-
ting all the information and then having to
cancel everything, especially when a group
is involved, and when the weather changes
your plans.
When traveling alone, making a reser-
vation at the last minute is much easier. Most
marinas will have at least one slip available.
Such was the case recently after I stayed a
few nights at Hawks Cay. I called Marina
del Mar the morning I was leaving and
asked Candi, the dockmaster, whether she
had a slip available. She replied "come on
down." No credit card info was needed and
she even remembered me from prior stays.
Once you are settled in at a marina and
the weather turns bad, it's not likely that the
dockmaster will kick you out should you
want to stay another day. Generally when
the weather is a problem, no one will be
arriving to take your slip. I suppose it could
happen. I don't know what the dockmaster
would do if a boat with a reservation shows
up and you are still there because of bad
weather or a mechanical problem.
I get a chuckle at Bahia Mar when they
ask the beam and draft of my 40-foot Sea
Ray. Bahia Mar can accommodate vessels
up to 250 feet. Their smallest slip probably
can accommodate a 60-foot boat. So what
kind of a boat could I possibly have that
would not fit?

New state statute spells out rights of anchoring boats


would not come under the statute for the purposes of
imposing local authority, and would generally be inter-
preted as vessels "in navigation."
To prevent further misinterpretation of their intent,
the Florida State Legislature has chosen to rewrite the
statute. Starting Oct. 1, 2009, the portion of Statute 327.60
will read:
"[A] county or municipality shall not enact, continue
in effect, or enforce any ordinance or local regulation:
Regulating the anchoring of vessels other than live-aboard
vessels outside the marked boundaries of mooring fields
permitted as provided in s. 327.40;".
These permissible mooring fields mentioned in the
statute must be cleared by cities through a complicated
state process. Authors of the statute say this is in no way
designed to impede on anchorage outside these clearly
marked designated areas.

anchorage and navigation to the municipalities that might
otherwise write and attempt to enforce them.
So, as it stands now, those waterfront homeowners
who long to sing "Anchors Go Away" to the boats in their
view will not find much comfort in the state's new statute.
Further, they will probably not be able to seek remedy


Teenage behavior appalling, not amusing


As a long time resident and boat owner in Fort
Lauderdale who respects other people's property, I
found last month's Dead Reckoning column on the
stealing of beer, underage drinking and boat engine
theft to be neither funny nor good reading.
When someone cut a steel cable and stole my inflat-
able and motor from the New River Canal I live on, I
suppose Captain Sherman would have laughed.
His fond memories lacking character and replete
with criminal antics were not amusing. The charter boat
captain's irresponsible boating behaviors set the wrong
