ing area, with boats heading up the Intracoastal north to
Lake Santa Barbara. Winterfest committee members dis-
cussed redesigning the route for years and began serious-
ly making preparations for the switch in 2006, said
Kathleen Keleher, marketing and parade director.

Major Brett Norton calls it the "what ifs."
As chair of a maritime task force, Nonon leads a
group of marine law enforcement officials from federal,
state and local agencies that began gathering after 9-11 to
go over numerous scenarios.
The monthly meetings prompt discussions ranging
from terrorism attacks to hurricane-borne disasters. Now,
another scenario can be added to the list a possible
bridge collapse similar to the recent one in Minnesota.
"Every time an incident occurs, we look at it and
determine how we would respond," said Norton, com-
mander of the South region law enforcement division for
the Florida Fish and Wildlife Conservation Commission.
"We intend to look at the response in the Twin Cities to
see how it relates to what we do in Florida."
The maritime work group led by Norton is affiliated
with the state's domestic security task force, formed in
response to 9-11. There are seven task forces in the state,
each covering a different region. Norton's group oversees
Southeastern Florida.

"We look at things more from a preventative point of
view," Norton said.
The group has also often put their plans into action, such
as mounting rescue operations at airline crashes and provid-
ing security from the water for major, large-scale events.
"We are probably the most practiced group in the
nation, working together as one unit," Norton said.

South Florida being a major
diving destination lends an
added advantage.

Florida marine law enforcement officers are already
experienced with bridge-related disasters, most notably the
major structural damage done by Hurricane Ivan in 2004 to
the Escambia Bay Bridge in Pensacola, Norton said.
Most of the same equipment, from boats to underwa-
ter sonar, would be used if a bridge \\ere struck in South
Florida or elsewhere in the state, Norton said.
"If there is a disaster involving the water, there are
special operations teams and a fleet of boats in each


region," said Capt. John Miller, with the commission's law
enforcement division headquarters in Tallahassee
"Plans are in place and everybody is well equipped."
The search and recovery work in emergencies is extreme-
ly difficult and dangerous work, said Jeff Torode, owner of
South Florida Diving Headquarters in Pompano Beach.
"In a situation like the area in Minnesota, there's lim-
ited visibility under the river's water," Torode said.
Much of the retrievals are done by feel, rather than
sight. Adding to the danger are jagged edges of metal and
getting tangled in debris, he said.
South Florida being a major diving destination lends
an added advantage. Generally, law enforcement are the
only personnel allowed, at the scene and departments have
their own dive teams.
"But there are a lot of master divers here who could
-lend assistance in the event of an emergency," Torode said.
"If a disaster were so big and volunteers were needed, the
area has many dive professionals who could be called in."
Crossing bridges is part of the day-to-day travels for
many residents.
"The fact of the matter is that we are a community
linked by bridges," said Frank Herhold, executive director
of the Marine Industries Association of South Florida. "I
have every confidence that appropriate agencies will
quickly respond to any similar type of disaster."

Size always counts when it comes to catching snook

In a small clearing among
mangrove roots, a wise old snook
is trying to explain Florida's new
fishing regulations to a school of
young snook. Let's listen:
"The season opens on Sept.
1." Old Man Snook begins. "That
means anyone who catches you
from that date until Dec. 1 is
allowed to keep you if you'ie at.
Arnold Markowitz least 28 inches long. but not if
you're longer than 33 inches.
"After Dec. 1 they ha\e to let you go, no matter what
size you are, until March."
That's the newest rule for the Guilf coast, including
Everglades National Park and both sides of the Florida
Keys that are in Monroe County but not in Miami-Dade.
On the Atlantic coast the dates haven't changed since last
year but the size limits have. The Atlantic minimum now
is 28 inches and the maximum is 32, not 33.
"That's the long and the short of it. Any questions?"
A student who hasn't dozed off yet raises a pectoral fin.
"How long are we?" that one asks. "Where are we?"
another wants to know.
"I m not sure but I'll find out and get back to you with
that information," says the wise old snook.
He's stalling, of course. Snook. no matter how old or
wise, don't know how to take measurements. Their
schools don't teach geography. They can't tell the differ-
ence between the Julian calendar and the Gregorian. The;\
learn by instinct. intuition and experience.
Fortunately, they don't have to know size and bag
limits or the dates of different open and closed seasons.
Unfortunately, we do. That's where fishing writers
come in, but this one's going to duck die issue. Tell you
what: Get a copy of the 20T.)7 saltwater fishing regulations
next time you're in a tackle store, or Google Florida snook
2007 regulations and keep them in your tackle box. Look
'em up when the need arises.

limit now is one legal-size snook per day. If you catch a
keeper every day (you should be that good), don't keep
each one just because you can.
All those new nitzy-pixy rules were enacted in an
effort to maintain a stable population of these awfully
popular fish. We have to cooperate.
The closed winter season has been lengthened by six
weeks on the Gulf side because hatless. coatless snook are
especially sensitive to cold. The snaps are longer and
deeper there, where the water is shallower than on the
Atlantic side.
Gull' coast fishermen supported that a sacrifice
they hope will be rewarded with better fishing the rest of
the year.
We can all help by complying with the rules even if
nobody's looking. Let's do so, and have some fun adding
our own rules-- rules that the Florida Fish & Wildlife
Conservation Commission likes and recommends to us,
and ought to require but doesn't.
Let's start \with circle hooks for fishing with bait. espe-
ciali li\e bait. That is the most popular snook-fishing Lactic.
Wh\ circle hooks? Because theN're less likely to get
stuck in a fish's gullet than the J-hooks that still fill most
of our tackle collections. Get the kind with the bend of the
hook in line v% i\h the shank, not offset.
A snook doesn't nip or nibble. It sneaks up on its prey
from behind or below engulfing it %\hole in that long.

\~hien we nhten the line, a circle hook usually\ comes


right back up the throat w without snagging vital organs
because its point is turned inward. As the fish turns to
swim away, the hook catches -a comer of its jaw \with
uncanny consistency. That's how it works with any fish
that swallows bait whole.
When a fish swallows a J hook, it snags deep. Then
we have to grab the snook, grip it tightly, stick a de-hook-
er or long-nose pliers down its craw, get hold of the hook
and twist it loose. The fish squirms out of our hands and
falls to the deck. We pick it up and start over.
By the time we free the hook and turn the fish loose,
it's so messed up that it won't survive for long.
Circle hooks prevent that most of the time.
It's why the FWC buys large lots of circle hooks to give
away. Capt. Waine Conn receives boxes of them for the
Kids Let's Go Fishing project that he runs on his Rew\ard
fleet of headboats at Miami Beach. FWC also supplies cir-
cle hooks to the Kids Fishing Clinics that it co-sponsors.
The idea is to get children accustomed to circle
hooks, so they will favor them once they're old enough to
buy their own tackle.
It ought to be extended to adult snook fishers. If I ran
the FWC, I'd put a supply of circle hooks and instruction
sheets on ever marine patrol boat for officers to hand out

It's a long voyage for

injured foreign sailors

It's been a long while since I last read
"Moby Dick." Recently the movie version,
with actor Patrick Stewart as Capt. Ahab,
was on late night television so I stayed up
to watch. (By the way, I consider the 1956
film with Gregory Peck as Ahab to be far
superior to the Stewart version).
While watching the movie, I was
struck by the international nature of the
crew on the whaling ship. Indeed, when
Herman Melville wrote his great novel he
accurately portrayed that crews on com-
mercial voyages tended to be people com-
ing from all parts of the world.
This has not changed in the 156 years
since "Moby Dick" was written. In fact in
modem times, larger vessels may be even
less likely to have crews that represent the
nationality, of its actual owners than they
did in Melville's day.
Now, you might think that with the
international flavor of vessels and their
crews, laws regarding those seamen would
treat each member precisely the same in a
time of mishap. But this assumption is only
partially true, and may be changing even
more in the future.
Certainly, since the events of Sept. 11,
it has become increasingly difficult for
many foreign seamen to gain proper paper-
work for even temporary entry on shore
from their vessels while in U.S. ports.
Aside from administrative hassles, there are
also more substantive legal concerns not
directly related to the 2001 tragedy.
It remains true that under most circum-
stances, ill or injured seamen are entitled to
maintenance and cure until they reach mnL\ -
imum recovery as well as the right to \work
on a seaworthy vessel. But for the foreign
seaman, the procedures to enforce such
nhri-hmay acrualh vary.-
In fact, it has long been a problem for


a foreign seaman to be heard in U.S.
courts regarding the doctrine, forum non
conveniens.
Under the theory of forum non conve-
niens, U.S. courts can determine that a case
put forward by a foreign seaman against a
foreign vessel should not be tried in U.S.
courts, even if certain portions of the inci-
dent resulting in damages may have
occurred in U.S. territory.
Depending on the facts, this doctrine
can become very complex. Moreover, in
cases involving a claim for Jones Act neg-
ligence, the use of the forum non conve-
niens doctrine can vary from state to state,
with Florida being among the least recep-
tive for accepting foreign cases.
And now, recent federal court rulings
may limit the access of foreign seamen to
U.S. courts and remedies even further than
contemplated under the forum non conve-
niens doctrine.
Recent court decisions from several
circuits hearing the most maritime cases
seem to indicate that they will enforce arbi-
tration clauses signed by foreign seamen
who work on a foreign-flagged vessel as
part of their employment contract.
As an examei," should ai; injured i'or-
eign seaman have signed employment doc-:
uments requiring him or her to arbitrate and
seek award for claims against a vessel in
another country (the Philippines, to name
one), given the right circumstances, such a
clause would be determined as acceptable
by U.S. courts.

cause the courts to determine such clauses
as valid will focus on whether the seanian
actually signed the employment agreement
him or herself; and whether the country
chosen in the clauses a subscriber to either
the Panama Convention or the New Yor'k

It had seemed like forever since I'd
last had the chance to go sailing. Finally
my significant other, Mike, and I went out
for an afternoon with our friends Harry
and Frances aboard their Gulfstar 47.
Mike and Harry spent most of the
cruise finetuning the rigging, fiddling with
the instruments and otherwise immersing
themselves in technical stuff while
Frances and I stood on deck and enjoyed
the sail and good conversation.
On our way out, we encountered a
storm, of course, but even that was enjoy-
able. There's something about watching a
storm roll toward you over the water that's
invigorating. And a first for me in that I
wasn't drenched to the skin because when
the rain began, we simply went into the
partially enclosed pilothouse and stayed
dry. Although I've never cared much for
the way a pilothouse looks on a sailboat, I
have to say it was much more comfortable
than simply hunkering under the dodger.
We motored a good ways out before
hoisting the sails but when we finally did
it was heaven. Standing on deck with only
the sounds of the wind and water, feeling
the boat pull ahead as the sails were
trimmed "properly, the breeze in my
face... it was beyond words for me. And
just when I thought it couldn't get any
better, a school of dolphin (porpoise, not
mahi-mahi) joined us, leaping and diving
in our bow wake.
After the sail we sat iith our friends
for a cocktail and discussed their plans to
sail offshore up the coast to New England.
Frances showed me all she'd done to the
cabin to make-it-thei home.

she did it all. She'd modified many of the
lockers, galley cabinets, and even access
to the bilge., al to-be. more efficient and


user friendly. So many improvements at
the hands of this grandmother; she is
truly inspiring!
Eventually the day came to an end and
we returned home. It was a difficult evening
for me. The chance to go sailing again after
so many months was bittersweet.
It was less difficult to push sailing out
of my mind when I was preoccupied with
a new job, new house, new life, therefore
having little time to miss it. But lately
schedules have leveled off. We've settled
into routines that allow us more free time,
and I've grown wistful to be out there.
Still, after so many months, I'd almost
forgotten the feeling of being out on the
water under sail, and that day was a heart-
wrenching reminder of what I was miss-
ing. Ironically, this was the same week our
sailboat, "The Beast," sold.
We had agonized over the decision for
months and finally decided that bringing it
down here from Georgia wouldn't be prac-
tical. Re-experiencing the joy I feel while
sailing, coming on the heals of realizing
that we're actually without a sailboat, was
a horrible feeling.
And so our search for our next boat
has kicked into full gear. Overdrive mode,
really. I've had several leads from readers
(thank you!) on boats for sale and we've
gone to look at those that meet our needs.
We're looking for something in the
mid 30- to mid 40-foot range, a well laid
out cabin, an adequate number of sails, a
trustworthy rig, stable hull, the list goes on.
We'll find the boat for us eventually
and we'll get out there on the water and
once again feel the wind in the sails. In the
meantime, we're very grateful for Harry
and Frances and other sailors who've been
so willing to let us get our sailing fix.

Boaters should review insurance
poiies on marine salvage

issue regarding marine salvage companies is filled with
misstatements and complete falsehoods. His conunent
that disputes involving salvage usually ended in vessels
being sold is pure nonsense. I have been personallN
involved in several hundred salvages and haxe almost
never seen this result.
Sallage costs are normally covered by marine insur-
ance policies under the "Sue and Labor" clause. This
clause states that the insured must take all steps neces-
sary to protect his property Saldors have sa\ed insur-
ance companies hundreds of millions of dollars by pre-
%enting damage to property. It is not the salvor's respon-
sibility to reduce a bill because the boater chose not to
purchase good marine insurance.
Perhaps the most flagrant act of ignorance in Mr
Ercolin's column is his report on the licensing statute for
Florida salvors. He is referring to 46 USC 80102. Last
year, a routine codification or updating of this 1847 law
whose original intent was meant to protect ship ow ners

The Coast Guard Authorization Act of 2007 current-
ly on the floor of the U.S. House of Representatives.

tutionality of this antiquated law when a Florida salhor
attempted to comply with it.
There are many misconceptions about marine sal-
vage. Ve recommend boaters review\ their insurance pol-
icy and understand w hat coverage is atforded to them. It
they choose not to carn' marine insurance, understand
theN are self-insuring. If their boat is in an) danger or it
is stranded. it is a salvage situation.
Boaters should get to know their local salvor before
being faced w ith a salvage situation. Learn about their rep-
utation. Knowing who to call will make all the difference!

tration clauses in international employment agreements.
The result of a determination for validity on the clause
will not only require the seaman to travel to the other coun-
try, but he or she will also have to accept the remedies offered
in that jurisdiction for damages, which will probably be far
less generous than remedies in the U.S.,.

employment agreement becomes injured in the future, he or
she may discover that the voyage has become longer than

Revised parade to bring new challenges to entries, spectator boats


made being at the port more difficult. Because the river is
narrower, it will create a more intimate setting allowing
better viewing for people lining the rikerbanks:Increasirg
the route from 10 to 12 nules will also boost the number
of sites where people can watch from land. Keleher said.
For spectator boats. no anchor zones ill exist along
the New River, from Channel Marker 9 to the South Fork
near Davie Boulevard, and along the North Fork west of
Southwest 11th Avenue. The stretch \ ill be used for stag-
ing entries. Since the '7th Street Causewak is no longer
part of the route, spectators are ad\ ised to anchor further-
north, Keleher said.
For the first time in the parade's history docking for
entries on the New River will be assigned to each vessel.

One tradition will still hold true. The rush of new
entries isn't expected until early fall when brochures are
distributed touting the parade. This year's theme: Magical
Movie Moments.
Brantmeyer's company ill mark its 25th year partic-
ipating in Winterfest. One of the .achts he will enter
measures 110-foot, the other 137 feet.
"It's going to be a challenge and if e\er one prepares
properly and the weather complies., e should be tine."
Brantmeyer said. "It can be done. but it has to be coordi-
nated."


Another daunting task, traveling on the river in an
outgoing tide. "There's not a lot of room for error," he
said. "E\er one \will have to be on their toes."
Having the parade downtown could be a great way to
showo'off Riverwnalk. Some 100 public slips will be made
available for staging, said Jamie Ha!t,.-Ci.ty of Fort
Lauderdale dockmaster.
Boaters renting public slips not in the parade will be

Accommodations are being made for them to temporarily
