City law prohibiting dockside gas deliveries sparks debate

DANIA BEACH A phone call to have their boat
refueled has led Rendi and Randy Arline on a campaign
to amend a law in Dania Beach that forbids dockside
deliveries to residential neighborhoods.
The couple discovered the rule after a vendor declined
to provide gasoline for their newly purchased 36-foot Sport
Fisherman, docked behind their home in the cir 's Da\ Is
Isles section. The couple were told that the company\ could
not enter Dania Beach's neighborhoods, said Rendi Arline.
She and her husband have since contacted cit offi-
cials about changing the ordinance and have started a
petition drive. Some 85 signatures have so far been col-
lected, she said.
The Arlines, joined by several of their neichhor,.
appeared before Dania Beach City commissione:- on Auo
8, asking for the amendment.
But the couple and their supporters might be entcrnn
rough jaers in r\ ing to reverse the ruling.
A report completed on Aug. 21 by City Fir- Cluel
Kenneth Land states there are serious safety con crn, i'.. Ith
allowing tankers to travel on neighborhood streets.
"As you are aware, due to the highly dangerous nature
of gasoline, I am totally against allowing gasoline tankers
to operate in residential areas," Land wrote in his study. "I
attempted to find any positive articles or other materials
on the subject. Unfortunately, I could find nothing to
change my mind."
Land also lists environmental hazards among his find-
ings, including a recent rollover on a city roadway that
resulted in the spillage of 3,000 gallons of gasoline.


"Imagine if this had happened in a residential neighbor-
hood?" Land states in his report.
Land's report is currently being reviewed by city offi-
cials. A date when the issue will be discussed at the next
commission meeting will be announced.
City commissioners had expressed concerns about
the possible hazards of huge tankers traveling along res-

Rendi Arline insists that supporters of the amendment
are not asking that huge tankers be allowed on to the streets.
"Most of the boats docked behind residences are not
mega-yachts," she said. "It wouldn't be feasible for a com-

Boat, vehicle traffic rerouted during Hollywood bridge project

Motorists and boaters will travel back in time, in a
sense, when the Hollywood Boulevard Bridge makeover
is complete.
Included in the structure's $10.7 million overhaul will
be architectural enhancements 'reminiscent to what
Hollywood's beachfront looked like some 90 years ago.
Among the new features: acorn-shaped fixtures on
fluted poles, which are copies of the lights that once
graced the original wooden structure in the 1920s. The
reproductions will line the existing bridge and its
approach ramps, said Susan Goldberg, city architect.
Rehabilitation of the bridge began in late April. The
decorative enhancements, along with the installation of new
equipment and other improvements, are scheduled to be fin-
ished in June, 2007, said Evelio Hemandez, a project admin-
istrator for the state Florida Department of Transportation.
Until then, the public can expect revised opening
schedules and lane closures, said Hernandez, who is over-
seeing the state's transformation of the bridge, which was
built in the 1970s.

openings are on demand, with a two-hour advance notice.
Vehicles have also been restricted to using one lane in
each direction, Hernandez said.
The bridge will be closed to all pedestrian and motor
vehicles from Oct. 26 to Nov. 26, and directed to alter-
nate routes.
Single leaf openings only for boaters will be permit-
ted during the 30-day period. No double leaf openings
will be held during that time.
After Nov. 26, one lane on each side will reopen for

struction will resume and remain until the end of the proj-
ect, Hernandez said.
A ramp that was closed to motorists earlier this sum-
mer will also reopen in late November. Currently,
motorists heading southbound on State Road A1A are
restricted from turning to travel west across the bridge.
Westbound access is open only to vehicles traveling
north on State Road A1A.

Keeping your house and boat safely apart in a hurricane

We've all been clenching our
fists and teeth, squeezing our eyes
shut, holding our breath and wish-
ing with all our might, and so far it's
working: We are hurricane free as
this dispatch is written near the mid-
dle of August.
There's a risk in saying this,
like a baseball player mentioning
aloud in the fifth inning that his
Arnold Markowitz pitcher has a no-hitter going.
Other than sheer force of will, I attribute our success so
far to preparation.
You know how that goes: the readier you are for some-
thing, the better the chance that it won't happen. Forget to
bring lunch on the boat and you'll starve. Remember it and
you won't feel like eating.
Either by our own bitter experience or the misfortune of
others who hesitated and were lost, boating people have
learned to prepare for the bad. Some are so well prepared that
we're a little disappointed if nothing happens.
Those of us keeping boats at the dock have stockpiled
enough ropes and fenders to protect our vessels against
anything short of a battleship at large in our canals. We've
leaned on our few indifferent neighbors just hard enough,
it's hoped, to convert them from part of the problem to part
of the solution.
Whatever spare space we had in our homes and garages
is so crammed with safety and survival supplies that now we
can't find anything.
Trailer boat pullers have not been so diligent. On our
long evening walks, my dog Beaver notices a lot of boats
parked in driveways, directly beneath trees or close beside
the house.
"Arf woof," he says, meaning "Look, there's another."
He should say "Arf roof," because in a hurricane your
roof could endanger your boat. If you must keep it so close

up there to see if anything's loose.
You doubt it? So did I, until I went up to clean the roof
and found 25 overlapping cement ridge tiles held down by

ers with fingertips. I also found six or seven flat tiles that
were cracked, presumably by wind-blown debris.

You can do it yourself if you're physically fit and agile
enough to walk the roof. Go slowly, row by row. Loose tiles
underfoot will wobble a little. Mark each loose or broken oi ie

Next, hit the paint department of your favorite home
improvement store. You'll find the right adhe ive "or y( ur
type of tile in caulking tubes. I used up one tube for every

Do one tile at a time so the adhesive doesn't have time
to dry before you set the tile. I suspect that's why mine did-
n't adhere to one another when the roof was built. An isolat-
ed case? Probably not. Careless mistakes don't happen only
once, so check your roof carefully.
Next, walk around your boat. Can you move it a little
further away from the house? If there's room, do it. Heavy
tiles dislodged by wind seldom fly; most slide down the roof
and tumble over the edge. Even though you took care of the
loose ones you found, a hurricane can make more.
Now that you've protected your boat from your house, is
the house safe from the boat? When windspeed breaks 40
knots and lightning's frightening, that's no time to wrestle
with a vessel. You should have stabilized it long ago.

Jim, who lives up the street from me, hired a backhoe to
dig the equivalent of a launching ramp in his backyard. He
stashes his 25-footer down there on its trailer. The boat was-
n't vulnerable to tumbling tiles before, but it was too conspic-
uous even with a high hedge alongside.
Now only the tip of the T-top shows an impressive
Achievement that's sure to protect Jim's house from the boat,
ut we'll have to see if it protects the boat from anything. Of
course we don't want to see that, and so far so good.
You can find other less complicated ideas online at
www.boatus.com.hurricanes. If you're in a flood evacuation
zone, you should seriously consider the suggestion to arrange
safer temporary housing for your trailer boat.
That's hard to find in southeast Florida, and you
should not be pulling a boat on our inadequate highways
with evacuations in progress and wind gaining speed. The
best alternative probably is to secure your rig at home, as
firmly as you can.
Even if the most you can move it is a foot or two further
from the house, do that.

Safety measures to help anglers weather a lightning storm

At its best, fishing takes us out of this choppy world
and into another, detached from life's noisy realities and so
close to perfectly carefree that we can forget to be careful.
Then flash, then boom. We're bombarded not by a
neighborhood hothead with a gun or an enemy with
bombs and rockets, but by Nature, everybody's mother,
with lightning and thunder.
Our fishing rods are lightning rods, ungrounded. If
you didn't know that, it must be because you fish only in
good weather. If you fish only in good weather, maybe it's
because you knew that.
Weather doesn't always give you a choice. You go fish-
ing in good weather and it turns bad while you're out there.
Low clouds appear, the sky darkens.
Barometric pressure drops. Fish start biting.
What should you do?
Lots of things, but first:
Put down that rod. Immediately.
Never mind that the handgrip is cork or synthetic rub-
ber. Unless your rod's an antique, it's made of graphite, a
great conductor of electricity.
Put it down, all the way down, not sticking up in a rod
holder where lightning can find it. If it's a two-piece rod,
take it apart quickly, put it down, get your hands off it fast.

Have you ever looked at a red and
white striped barber pole and wondered
about its origins?
For those unfamiliar with its history,
in earlier times barbers were also sur-
geons. The barber pole is an anachronistic
symbol, with the red stripes representing
blood and the white stripes representing
bandages.
You see, unlike lawyers who can
trace the profession in a linear path back
to biblical times (some might say begin-
ning with the casting out of Lucifer from
heaven but that's another story), sur-
geons and physicians as we know them
today derive from a multitude of separate
historical disciplines.
Until only recently, many of the skills
now expected in a modem medical doctor
were within the purview of other crafts-
men, including alchemists, shamans,
herbalists, exorcists and barbers.
Indeed, from the time of Hypocrites
and almost into the last century, the cutting
of urinary stones was considered a profes-
sion unto itself. And, it wasn't until the
middle of the 1800s that surgery was final-
ly fully considered a separate avocation
from barbers.
Yet, despite the possible spotty nature
of their skill base, from the time of explo-
ration in the 16th century and onward, a
ship's surgeon was considered an impor-
tant crewmember on any ship bound on a
long voyage.
Even pirates were known to spare a
ship's surgeons and conscript them into
duty performing amputations, suturing
wounds and therapeutic bloodletting. And
if a ship lost its surgeon/barber, it was
occasionally the ship's carpenter who took
over medical duties, thanks to his skills
with sharp tools.

Actually, by the time of the
Napoleonic Wars many ship's surgeons
were actually educated men of the Age of
Enlightenment, with multiple skills and
interests. The quintessential fictional exam-
ple is Stephen Maturin from the Patrick
O'Brian "Master and Commander" novels.
Maturin is the arch-type of the physi-
cian/scientist. He represents the best his
times could offer in a ship's surgeon, and
he certainly would have had more in com-
mon with Ben Franklin than the barber
Sweeny Todd. It was also at this time that
a ship's surgeons had become sufficiently
respected that they were generally second
only to the captain for apportionment of
any prize award given for captured vessels.
There have also been nonfictional
ship's surgeons of great note. The most
famous may have been Sir Arthur Conan
Doyle, the creator of Sherlock Holmes. In
1880, the young Conan Doyle signed on as
a surgeon aboard a whaling ship bound for
Greenland. Doyle always claimed this
experience helped him mature as both a
doctor and a person.
While relations between a ship's doc-
tor and crew appear to have advanced
through time, the relationship particu-
larly legally between a ship's doctor
and passengers still seems to be in flux.
This, in part, might be because ships and
their owners have a legal obligation
regarding the health of crewmembers, but
they are not held to the same standard
when it concerns passengers.
Crudely put, there is a basic legal view
that passengers are on a vessel by choice,
and if they want to pay good money to
accept the dangers and perils of the sea,
then they are free to do so. Those respon-
sible for a passenger's welfare on a vessel
generally only need to offer them "reason-

Ship doctor's legal responsibility to

passengers depends on individual cases

And, in the past, it was generally accepted that a passen-
ger's relationship with an on-board doctor (especially on
cruise ships) was akin to dealing with a private contractor
aboard the ship. This meant that if a physician's conduct
resulted in malpractice, the passenger would have to pursue
a claim against the doctor directly, relieving the vessel and
its owners from any claim.
This view makes it difficult for a passenger to seek a
claim for malpractice, as these physicians tend to come from
foreign nations and have little in attachable assets, even if a
suit could be brought to completion.
Some have argued that a passenger visiting a physician
on a vessel would not always be in a voluntary situation,
given the restricted environment of a ship. Therefore, the

ship should take some responsibility for these interactions.
Well, in just the last few years some courts have come
to agree with a portion of this argument, allowing passen-
gers to claim an action against ship owners based on the the-
ory of vicarious liability. So far, these are matters that rely
very much on the facts of the case.
So remember, should you be on a ship and need a doc-
tor, consider your options. If you elect to see a ship's doctor,
keep track of the details of your visit and don't be afraid to
discuss any possible choices in treatment.
However, as a matter of good will, I might avoid
reminding the physician of the rich heritage of barbers.

There's no scarcity of litter at annual coastal cleanup

If the trash that litters Florida's coastline always annoys
you but you never do anything about it, here's a fresh chance
to relieve your guilt. The 21 st International Coastal Cleanup,
organized by the worldwide Ocean Conservancy and carried
out locally by people like you.
It's scheduled for Saturday, Sept. 16. If you're reading
this report close to its Sept. 1 publication date, you have
enough time to choose your airiest wide-brimmed hat, res-
cue your most raggedy sneakers for a final sacrificial wear-
ing, wheedle friends into joining you and register so you can
work where you'd like or where you are needed most in
your home county.
In three hours you'll help to collect a staggering amount
of shoreline litter enough to fill you with pride in your
accomplishment and dismay when you contemplate how
much more must still be out there, snagged in seaweed at the
high-water line, trapped in the roots of mangroves, sub-
merged in the shallows and depths.
How much? No telling, but last September's collections
indicate there's plenty. At a time when hurricane-related
problems curtailed the project in some areas, 25,090 Florida
trash-pickers still picked up 292 tons. Only California and
Georgia gathered more.
"We've been growing. We have 18 sites this year," says
Marella Bradway, a site coordinator and Florida Sea Grant's
extension agent in Miami-Dade County.
"In 2003 there were 11 sites and 697 people in Miami-
Dade. Last year over 1,000 volunteers showed up. We're
collecting double the amount of debris, pretty good com-
pared to two years ago."
Or pretty bad. After a recent meeting with Bradway
and countywide coordinator Melissa Sessoms in
Bradway's office on the Rickenbacker Causeway, a
Waterfront News' reporter took a fishing break nearby on
the flats at Hobie Beach. It's a popular spot for picnics,
windsurfing, dogplay and wallowing in warm, shallow
water, with little weekday traffic.
The catch: A small barracuda plus eight Heineken cans,
two Coke, one Budweiser and one Sierra Mist, an unlabelled
green bottle and a child's snorkeling mask. All were found

without seeking, gleaming in sunlight on sandy bottom and
grass patches in knee-deep water.
That indicates they were dropped there, not on the
beach where there are so many trash barrels that it's sur-
prising how many bottle caps and bits of broken glass lie
in the sand.
Perhaps it seems as if you've read or heard about
something like this rather recently. You probably have.
Environmental organizations stage annual cleanup projects
like it all the time, most on rather smaller scales. Enough
stuff litters the shore of Bear Cut Preserve for the Marjorie
Stoneman Douglas Biscayne Nature Center to run a
cleanup on the third Saturday of each month.
Activists from PalmBeach County to Key West can find
organized local-only shoreline cleanup on almost any
weekend they choose. Big ones like the International
Coastal Cleanup recruit casual volunteers by the thousands.
Do all those cleanup succeed? Certainly.,


They fail, too, for no matter how grand or modest
their scale, no matter how frequently they're done,
there's always enough trash left with more on the way to
tucker out the next squad, platoon or battalion of volun-
teer stoop pickers.
Years of litter analysis exonerate boaters and fishers
in southeast Florida, although the Ocean Conservancy's
global statistics list fishing line and netting as a leading
category of debris. The organization states that, "59 per-
cent of all debris is from land-based shoreline and recre-
ational activities, and an additional 29 percent is from
purely smoking-related activities. The remaining items are
a mix from oceanic activities, medical or hygienic materi-
als, or the result of dumping."
Evidence here points more toward beach users and
upland litterbugs whose trash is blown into canals, drifts
down to salt water and ends up on shore. Cigarette butts,
plastic bags, cans and bottles are the most common discards
found in the Miami area.
Joy Tatgenhorst, cleanup coordinator in Marathon
for a 100-mile stretch of the Keys, mentioned finding a
mystery item last year a strand of fishing line with a
swivel at one end, a sinker at the other and a lot of tiny
hooks between.
That was a Sabiki rig, used by offshore fishermen who
catch their own bait. The fact that Tatgenhorst had never
seen one in seven years of collecting shore litter suggests
that Keys fishermen are careful to bucket their trash and dis-
pose of it responsibly.
If they'd like to be even nobler and volunteer to clean up
other peoples' litter, Tatgenhorst would like to welcome
them. Perhaps more than any other coordinator, she has to
scramble to assemble a team actively seeking out volun-
teers instead of merely announcing the event and expecting
mass response.
"We don't have a lot of people saying they want to vol-
unteer," she says, attributing the shortage to a high turnover
rate in the Keys' year-around population and the absence of
seasonal inhabitants. "Our winter residents have more time.
It's the quiet time down here."

gasoline companies are licensed and insured. To avoid large
tankers, the city can institute a gallon limit, she said.
Rendi Arline disagrees that bringing gasoline to the
couple's boat at their home is unsafe.
"In my opinion, it's safer to fuel my boat at my dock,"
she said. "When I fuel my boat at dockside, there are no pas-
sengers and the boat is not running."
It's less time consuming too. Because the couple lives
west of Interstate-95, the nearest marina is in downtown Fort
Lauderdale.
The size of their boat and the fixed bridges make it
impossible for the couple to enter any of the mom and pop
marinas between Anglers Avenue and Interstate-95. "We
must take the South Fork of the New River if we want access
to the Intracoastal Waterway," Rendi Arline said.

Also, the ordinance is not good for Dania Beach's
image, she says.
"It's shocking. Everywhere you look, Dania Beach is
advertising itself as a boater's community. We want Dania to

Kim Sisler, and her husband, Jim, who live in a water-
front home next door to the Arlines, say the ordinance stands
a good chance of being amended, but only if more boaters
speak up.
The couple has a 36-foot vessel docked behind their
house. "If a lot more people get involved, I think we can do
something," said Kim Sisler.
City Commissioner Anne Castro said although she


doesn't own a boat, she was bom and raised in South Florida
and understands the importance of the marine industry.
She hasn't reached an opinion on whether to amend the
ruling. However, she doesn't believe keeping the ordinance
will hurt the city's boating image.
"There are people too who live on the canals and are
concerned about a gasoline spill," Castro said. "They might

say it's convenient, but it's not worth the risk.
In his report, Land said he sympathizes with boaters.
However, he adds that, "I do not believe that the possible
savings of an unknown amount of money per gallon or sheer
convenience are worth risking lives and possibly millions of
dollars in damage to other vessels and homes if an accident
were to occur."

New bridge will reflect elements of city's past

The last bridge renovation took place in the 1980s when
the structure's mechanical gear mechanisms were replaced
with hydraulic bridge lifting pistons, Hemandez said.
Under the current project, crews are doing more than
switching parts. "We're going to gut the bridge and put in
all new components," Hemandez said. "It's a major rehab.
When we leave, we hope that nothing needs to be done for
25 years."
Over the next several months, workers will install
new electrical equipment and computerized bridge operat-
ing controls, Hernandez said.
Decorative features will include a new gatehouse and
railings. The second floor of the control house, where the
bridge operator sits, win get a new look too, with arched


windows and a barrel tile roof. Embedded into the con-
crete of the control and gate houses will be will be medal-
lions bearing the City of Hollywood's logo.
A state of the art lighting system, which will permit
operators to program different color beams of light, is also
in the plans. The system will be capable of reflecting dif-
ferent holiday decors, such as red, white and blue, for
Independence Day.
The Hollywood Boulevard Bridge is considered the
gateway to the city's beach, Goldberg said. Its redesign
ties into what the city is doing throughout the entire dis-
trict, including the widening the Broadwalk, the beach-
front's main pedestrian walkway.
The bridge's new decorative enhancements, with ele-
ments of Spanish Mediterranean architecture, stem from his-
toric photographs and postcards found in the city's archives.

Jeff Justice, a bass fisherman in Sunrise, was hit by
lightning in 2001 and thought he was dead.
It happened during a weekend tournament so there
were plenty of witnesses, either to the lightning strike or
the immediate aftermath. Justice recovered and took the
incident rather casually, if not complacently. Now he
just takes his boat under a bridge when a thunderstorm's
coming,

throttles wide open, they blast off toward the docks.
