Revised rule allows

more dock slips to

be built at condos

Developers meeting certain criteria might be able to
build more dockage under a newly revised statewide rule
regarding the construction of waterfront condominiums and
other multi-family residences.
The revisions were approved by the Florida Cabinet this
summer and took effect in October. The cabinet's decision
can be a boon or a bust for the boating community, depend-
ing upon whom you ask.
On one side, the state Marine Industries Association of
Florida believes the revised rule can help alleviate the short-
age of existing dock space. On the other, environmental
groups like Save the Manatee see it as placing more strain on
the ecosystem.
But both sides agree that the revised rule is not a give
away to developers.
"It's not carte blanche" said Pat Rose, director of gov-
ernment relations for Save the Manatee. "But it gives [devel-
opers] the chance to get more."
John Sprague, chair of the governmental/legislative
committee for the Marine Industries Association of Florida,
doesn't expect every developer will be able to meet the crite-
ria for added dockage.
"There are a lot of hoops they have to cross," said
Sprague, who also serves as director of governmental affairs

for the Marine Industries Association of Palm Beach County.
Under the old rule drafted in 1987, the number of per-
mitted docks was based upon how many units were being
constructed. On occasion, exceptions for additional dockage
were granted by the Florida Cabinet. But there was no offi-
cial set of criteria.
The recent revision defines requirements that must be
met before the developer can move ahead with the exception
process. Developers can build a dock for each unit in their
buildings after meeting requirements and receiving approval


from the Florida Cabinet.
One of the most important deciding factors in gaining
an exception will be how many slips can fit into 40 square
feet of pre-empted area for each foot of shoreline owned by
the developer.
The state defines pre-empted areas as all of the dock
and mooring space on publicly owned submerged land, said

Gulfstream hosts

The South Florida Senior Games sailing competition
will return after many years to Hollywood's North Lake.
The annual competition, previously held at Century
Village in Pembroke Pines, takes place on Feb. 4, hosted and
organized by the Gulfstream Sailing Club.
Club members were taken up on their offer to oversee
the event and provide sailboats to participants after contact-
ing the senior games committee. The sailing competition was
last held at North Lake some 10 years ago, said Dori
Horowitz, special populations coordinator for the Broward
County Parks and Recreation Division, which helps organize
the South Florida Senior Games.
"Gulfstream graciously offers its services and we
thought it would be a nice change," Horowitz said.
The senior games, now in its 16th year, will run from
Jan. 25 to Feb. 8. Several competitions ranging from bocce
to shuffleboard will occur at sites throughout Broward
County. Participation in all events is open to anyone ages
50 and older.
Sailing at North Lake will be one of two aquatic compe-
titions scheduled for the games. The other is swimming, to be
held Jan. 28 at the Fort Lauderdale Aquatic Complex.
Gulfstream is providing 15 club-owned Sunfish sail-
boats for the event at North Lake. Participants will be divid-

Smith, chairman of the Gulfstream Sailing Club's lake man-
agement committee.
The club has an existing agreement with the City of
Hollywood to hold sailing classes for adults and kids at the
lake. The next session is scheduled for weekends, beginning
in January, Smith said.
Hosting the senior games at North Lake should provide
more exposure for the club's activities, which include a sum-
mer sailing camp for kids, Smith said.
"It's a gorgeous place to be and it's very functional," said
David Vazquez, athletic superintendent with the City of :.
Hollywood who also sits on the South Florida Senior *4- "
Games's steering committee. "It's a nice environment. It's
maybe one of the best kept secrets in Hollywood."
The saltwater lake is just off the Intracoastal Waterway.
There should be a nice ocean breeze for the senior games's
competition, Smith said.
Registration for the senior games is $10 per person, if
paid prior to Jan. 18. After that date, the fee is $15. The cost
entitles entry in one competition and admission to all special
events such as opening and closing ceremonies and a tea
dance. For people wanting to participate in more games, the -
cost is $4 per competition, Horowitz said. .

Two popular fishing

Boat access to two of Florida Bay's most popular fish-
ing and bird-watching keys, Frank and Sandy Keys, is being
curtailed until mid-March to protect the nesting sites of
roseate spoonbills from engine noise, wake, nest predators
and even peeping toms.
Channels to both keys are closed. The bird maternity
wards will be open only to immediate family members.
Away from the channels, humans can still approach in shal-
low-draft boats near high tide when water covers the flats.
Frank and Sandy are near Everglades National Park's
visitor center and marina at Flamingo. The waters are infest-
ed with gamefish, so the channel closings are a nuisance to
fishermen, more so to those whose V-hull boats draw too
much water to float the shallows.
Roseate spoonbills, with backs and wings of vivid pink,
are among Florida's most treasured birds. Long-diminishing
numbers on those keys, their favorite nesting sites in
Everglades National Park, might have forced such closures
anyway in the near future. Right now, though, problem num-
ber one is Hurricane Wilma, perpetrator of extensive dam-
age to mangroves and buttonwood trees where the birds
build their nests, lay their eggs and rear their chicks on the
two keys.
The loss of foliage cover, causing more exposure to
human disturbance and predators, could accelerate the
decline of their population in Florida Bay, according to
David Szymanski, the park's Florida Bay project manager.
There are 30 known spoonbill nesting islands in the bay.
Since 1996, Sandy with the largest colony and Frank
have harbored more nests than the other 28 put together.
Their decline is demonstrated by recent surveys led by
Audubon Society ornithologist Jerry Lorenz. These are not
estimates, but hand counts of successful nests those con-
taining live chicks.
Sandy Key's nesting colony had an average of 170-plus
active nests per winter between 1984 and 1999. The last
peak was 177 in the 1998-99 nesting season. In the next one
there were 130.
There was a small recovery to 140 nests in '01-'02, but
then it fell to 128, then 96. Last year it increased to 155, con-
tinuing a pattern of up down up.
Frank Key also saw a sharp drop, from a peak of 125
active nests in the 1998-99 season to 89 in the next count.
Like Sandy Key, it also began a recovery 99 nests, then
107 and 111 in 2003-04 but last year the score dropped
alarmingly. There were 100 nests on the island, but only 15
contained live chicks. That was the first time the nesting
score on the two islands moved so sharply in opposite direc-

tions a 61 percent increase for Sandy Key and an 86.5
percent decrease for Frank.
Annual counts on all known sites documented the
decline from 1,250 nesting pairs of spoonbills in 1978 to 500
pairs in 2002.
Nesting season begins in December and usually
goes two weeks deep into March. If the birds leave
early, the channels will be reopened as soon as they go,
Szymanski said.
Until then, the channels will be marked off limits,
rangers will patrol the two areas more often and volunteers
will be sought to supplement the patrol, fending off boaters
who don't know they shouldn't be there.
Wilma hit the bay on Oct. 24 with an 8-foot tidal surge,
knocking down many trees and substantially defoliating
both islands curiously stripping leaves off only the west-
ern side of Frank Key. That's the side where the spoonbills
nest, and that's where the channel is.
The islands had sustained little damage from earlier
hurricanes Katrina and Rita, which flooded the national park
marina and visitor center at nearby Flamingo.
Wilma worsened Flamingo's damage, and the National
Park Service closed it for the third time in 2005. It was still

closed in mid-December, but expected to be reopened any
day, with a predictable spike in the motorboat population.
The reopening, coinciding with spoonbill nesting sea-
son on keys so close to Flamingo, heightens already serious
concerns for the birds' future in the park.
"This storm damage leaves these nesting spoonbills
very vulnerable to weather, predators, and disturbance by
both powerboats and paddlers," Szymanski wrote in a pub-
lid notice announcing the channel closures.
Frank Key is 2.5 nautical miles from Flamingo if you
follow the channels a necessity at low tide. The closed
channel, with low tide depths of three to six feet, runs
right up to and alongside the island. When spoonbills are
present, boaters like to sound their horns, spooking the
birds to take flight.
It's a breathtaking sight and makes a good photo, but in
nesting season crows seize the opportunity to raid the unde-
fended nests. They eat eggs and chicks, killing the chicks
they haven't time to eat before the parent spoonbills return.
What do the channel closures mean to fishing people?
Potentially plenty, according to Eric Herstedt, a fishing
guide who makes his living on Florida Bay.
"Those are the spots I fish every day," he said.
"Especially Frank Key. Every guide fishes Frank Key, Palm
Key and Murray Key. A lot of them fish there 12 months out
of the year."
At Frank, the guide not only shows his clients spoon-
bills, but also gets them a variety of fishing action. 'Tarpon,
redfish, trout you can fish there for anything. There's a
hundred islands in Florida Bay, but only a few that are real-
ly, really productive and that's one of them."
Then again, he can do all right at other spots a mile or
so away and his boat's a shallow-draft skiff, so he can still
pole the flats off the closed channels when the tide puts a lit-
tle water on them.
At high tide, when the depth on the flats can reach 18
inches, even a V-hull can get up there with the engine raised

New Year's resolutions that gently lift the nautical spirit

S .Y The beginning of the year is a
good time to think about making
the world more nearly perfect.
After a year like 2005, so bad for
so many, it should be easy to
imagine a list of resolutions, wish-
es, even pipe dreams, and then
find ways of prodding them to
come true
The world? Oh boy, that may
Arnold Markowitz be too much. Let's narrow it down
to what we can see from our own bulkheads, banks and
gunwales.
First, before the guy on stage asks the audience to get
involved, he should sing a few verses himself.
Pitch pipe? Hmmm. Here goes:
In my more nearly perfect world, real estate develop-
ers in '06 will gaze at wonderful waterfront property, buy
it and then compete ferociously for the rights to build pub-
lic nonprofit marinas. The winner will be the guy who
makes the commitment to charge ramp and dock fees clos-
est to cost plus 1 percent.
(Refrain: Hey lyley, lyley, lyley).
Switching from fantasy to possibility, I resolve to bring
an empty five-gallon bucket every time I launch my boat,
and bring it back full of bottles, cans and whatever other jet-
sam it will hold. I will dispose of the trash with enough
drama and flamboyance to attract the attention of others, and


to make them feel guilty for not doing the same.
(Chorus: Hey lyley, lyley, lo).
I will continue to publicize annual mass shoreline
cleanup, such as Baynanza in Miami-Dade, and make
myself feel guilty for not giving all such projects equal
attention, and make you feel guilty if you don't volunteer-
for any of them.
I know a man who loves fishing, but.his hobbly foot-
ing makes him unable to climb in and out of a boat. Bet
you know someone like that. Do you pray? Ask for a high
tide, close to the dock decking, whenever our physically
limited friends wish they could fish or go for a boat ride.
Do them another favor and tell your local parks depart-
ment you want public docks made more accessible to the
handicapped.

It's not nice to scold, but once or twice a year you can
be forgiven for gently admonishing someone who flips a
bottle overboard, who fills a cooler with four-inch grunts
and undersized mackerel, who takes two parking spaces at
the ramp on a weekend, who drags a big bow wave on a
narrow waterway.
No gentle admonitions to the lowlife who smashes
bottles at launch ramps. May I hold your hat while you
break a bottle over that one's head?

There aren't too many police or park rangers
patrolling our local waters, so we can get away with a lot
- speeding in no-wake zones, ignoring manatee protec-

tion laws, plowing deep-draft boats across seagrass flats.
Even though we can get away with all that, let's start not
doing it. That might hurt a little bit, but by next year it'll be
easier to comply and we'll feel better about it.
Last year the Miami Beach City Commission (motto:
shoot first, aim later) enacted an ordinance slandering tran-
sient cruising sailboaters as riffraff, and drastically limiting
their access to local anchorages. This year, waterfront
property owners who vote in Miami Beach should take a
stand against arrogance by demanding that commissioners
repeal the ordinance and issue two statements of contrition.
To the sailors: We're sorry we insulted you. To the
waterfront homeowners whose outlandish accusations
instigated the law: We're sorry we listened to you.
Get below quick, Matilda. Here come the politics.
No, we'll back out of that shoal water right now, with
a suggestion that next time you meet a politician, you
should mention that you'll vote for candidates who take
boater-friendly positions on marine issues and then vote
to re-elect those who go beyond talk to stick up for boaters
and fishers.

One of the best things I've done as a semi-profession-
al outdoorsman was to take a safe boating course offered
by the Miami Power Squadron. After 30-plus years of, ah,
independent study, it was about time. I think it gave me the
authority to be preachy on this subject. Next month at the
Miami International Boat' show, visit the booths of, the
Power Squadron and the Coast Guard Auxiliary, which
also teaches safe boating. Don't just inquire. Act. Compare
their class dates, pick a schedule that suits you and sign up
on the spot.

Sometimes when we return from a day on the water,
we find trash containers at the marina overflowing, the
wind spreading stuff around. Aggh, we cry. How disgust-
ing! And then we add our own trash to the pile.
I don't know about you, but where I live the town col-
lects garbage twice a week. When the marina bins are full,
I take my trash home and put it in the can there. Isn't that
noble? You're right, it calls for a medal, but I'll feel amply
rewarded if you'll do the same with your trash. No, not in
my garbage can. Yours.

It's a good thing the new year coin-
cides with other holidays or it might pass
as uneventfully as, say, Columbus or
Arbor Day.
On the other hand, it is the tradition-
al ending to a celebration cycle that has
been part of the western calendar for over
2,000 years. My own family always used
New Year's Day as an excuse to get
together with good friends and relatives
to share in consuming hog jowls and
black-eyed peas to assure a lucky transi-
tion into the next 12 months (yes, it is a
"southern thing.")
A more universal tradition is to
make important lifestyle changes, includ-
ing drastic career changes, in the form of
resolutions. In fact, more than a few of
my friends have announced around Jan. 1
that they were going to join yacht crews
and "travel the world."
Coming from a maritime family,
such pronouncements don't really shock
me. After all, as the narrator Ishmael
from Melville's "Moby Dick" put it,
"Whenever I grow grim about the
mouth... whenever, I feel that deep, dark,
drizzly November in my soul.... I find it
is high time to take to sea."
First let me answer a question that
often comes up when discussing yachts:
Is being a crew member on a yacht differ-
ent from crewing on other boats?
The answer: generally not, but there
are a few real differences that must be
noted to prevent surprises.
As with any other vessel, those who
crew yachts are legally considered Jones
Act seamen and share certain legal rights
of others in that category.
This means that like any other sea-
man, a yacht crew member would be a
"ward of the court of admiralty." Those

recognized as seamen have a legal right
to maintenance and cure, the right to a
seaworthy vessel and usually keeping
in mind possible contractual and statuto-
ry restrictions the right to sue the ves-
sel owners for negligence under the
Jones Act.
SThe most ancient of these rights and
least understood by both seamen and
boat vessel owners is maintenance and
cure. As presently interpreted, it means
that a boat owner is required to provide
for the medical needs of seamen working
in the service of the vessel. This often
includes temporary employment.
Covered is virtually any injury or
illness incurred, or one that becomes
known or is exacerbated while the sea-
man is employed by the vessel or work-
ing in the service of the vessel -
whether or not such injury or illness even
originated on the vessel.
The right of a seaman to a seaworthy
vessel allows the crew member to seek
damages if an injury results from the boat
being in faulty condition, or because of
negligence on the part of the vessel own-
ers or its agents. This right that did not
exist under U.S. law until the 1920s.
So, if a crew member of a yacht is
generally vested with such rights under
U.S. maritime law, what could be miss-
ing from the equation?
Well, the real answer is that if you
carefully look at the list of what a vessel
owner is legally obligated to offer a
yacht crew, while the list of obligations
are quite broad, it is, in fact, a rather
short list.
Unlike seamen in merchant service,
yacht crews are generally exempt from
statutory schemes that would otherwise
obligate an owner to pay overtime or

Vessel owners' obligations broad but concise


offer vacations. Moreover, since the voyage schedules for
most yachts and recreational-type vessels are tenuous at
best, crew members must accept that without any writing
to the contrary, they are probably "employees at will,"
meaning they can be dismissed at any time.
The only way to avoid such pitfalls as the member of
a yacht crew is to be employed by someone who offers a
written contract and has a reputation for standing behind
contracts. After all, if the owner and the vessel are from
another country, enforcement could prove difficult even if
the crew member is in the right.
It's also helpful for the potential crewman to know if
the yacht is properly insured for the rights a seaman would
normally have under maritime law. This makes life easier

- although those boats are harder to pole than a skiff.
"We're hoping they'll still be able to fish the flats,"
Szymanski said. "Then there's Murray and Clive Keys to the
west and there's the channel between Frank and Palm Key
to the east. We're hoping that people's ability to get to the
fishing grounds won't be affected."
Gary Meyer, president of the South Florida Fly Fishing
Club, agreed that it won't hurt. "I don't think the closures
will have any significant impact on the fishing, overall...
There are just so many square miles of fishable water,
including other island channels to fish."
Sandy Key, also a nesting site of pelicans and herons
has been off-limits for several years to humans lured ashore
by its long, attractive beach. Rocky Channel near it a cut
eight to 10 fet deep atlow tide, through a large shoal named
First National Bank hadn't been closed before.
That channel provides access to Carl Ross Key, a desig-
nated campsite that used to be the grip end of golf club-
shaped Sandy. Hurricane Donna cut it off in 1960. Even
though Wilma cut off more of Sandy and left only a little of
Carl Ross, there's still some camp-able space and it's still
easy to go from there to Sandy forbidden, although the
rule is often disregarded.
Carl Ross wasn't much of a campsite anyway. There are
better places to camp on Cape Sable, close to the spoonbills'

Herstedt, the fishing guide, said the birds haven't shown
much fear of him, especially not at Frank Key.
"They ignore you. They just walk back in the man-
groves a little ways. They don't fly away or freak out
because they're used to the boats. There's a steady flow of
boats there."
Szymanski says the spoonbills are not always that casu-


al about the traffic. "They've never ignored me. They defi-
nitely spook."
Repeated closures of the Flamingo marina forced Florida
Bay fishing guides based on the mainland to launch from
ramps in the keys. Herstedt, from Broward County, launches
at Islamorada. He said it takes 30 to 40 minutes to reach the
Flamingo area from there, subject to skills and weather.
That seems like a lot of added trouble and expense.
More miles, more gas, all that. Is it worth it? Silly question.
"You can catch more fish there than almost any place else
in the world if you know what you're doing," Herstedt said.

Environmental group: More docks could mean less public access

The pre-empted area was referenced in the original
rule. But with the revision, submerged land takes on a more
prominent role during the exception review process.
"Under the old rule, we spent a lot of time counting the
number of slips and units, when what we needed to focus
on was the pre-empted area and the resources that need to
be protected," Stoutamire said.
The revised rule only applies to multifamily dwellings,
not single family or commercial marinas.
To increase the amount of dockage, developers must
adhere to other provisions such as manatee protection. They
must also show proof that their request will benefit the pub-
lic, such as making docks available to the general boating
community or installing a boat ramp, Stoutamire said.
'This is an attempt to balance the exclusive use of pub-
lic submerged land for private purposes with a correspon-
ding public benefit," he said.
Another factor will be water depth. Shallow water
might limit the number and type of vessels allowed at the
development. For instance, if the water is three feet deep,
the boats would be limited to a 2-foot draft.
"The one slip per unit doesn't help anybody unless they
have a lot of shoreline," Stoutamire said. "It depends on

a jet ski or a 100-foot vessel. The bigger the boat, the more
shoreline you use."
Since the revision just took effect in the fall, it is
unknown how many developers will seek exceptions. There
might be exceptions working its way through the process,
but as of December there were no scheduled hearings
before the Florida Cabinet.

granted 25 slips. That would mean 15 of those property
owners would go to a public marina and use those slips.
"We need to be able to utilize the waterfront with as
much public access as we can," Sprague said.
Save the Manatee's Rose cautions the revision could
have an adverse affect on water quality and habitat.
"The more submerged lands that are covered with
docks, the less there is going to be available for fish to
reproduce and sea grass to grow and to have a healthy
aquatic system," Rose said. "These docks are over pub-
lic, submerged land. This is not on private property. This
is public submerged land held in trust for all the people
of Florida."
The stance taken by Save the Manatee is not anti-boat-
ing, he said.
"We're for balanced protection of the environment and
recreational boating opportunities," Rose said. "Personally,
I am a boater, a fisherman and a scuba diver. There's a right
way to do it and a wrong way."
Save the Manatee is also concerned how the revised
rules will affect the future of affordable recreational boating
for everyone.
"We think this is leading to is less public access. We
feel this will make it more difficult for protection of
resources and put more pressure on building more docks in
places that are less environmentally suitable."

Adding New Year's resolutions with an altruistic twist

Biscayne Bay (if not all the world) will be a better
place if every shallow-draft power boater helps one
grounded keelboat off a grass flat this year. Anchor care-
fully on the edge, wade over to the boat and speak very
tactfully with the skipper. Here's a sample script, based
loosely on a thousand or so true stories:
You: How did this happen?
Him: Uh, I dunno, We were floating, and next thing
we knew the boat was lying on its side like that.
You: Do you have a tide table for this area? A chart?
Him: There's a table in the cabin. It broke when we
fell over. What kind of chart?
You: A nautical chart. It's like a road map. See those
poles way over yonder? One with a red triangle on it and
the other with a green square? They're channel markers. If
you had a chart, you'd know you're supposed to sail
between the poles, not here where it's too shallow.
Him: No kidding? I wondered what those were for.
You: In about four hours, the water should be high
enough to float you off the flat. Give me your cell phone
number and I'll call later to see how you're doing. If you're
still stuck, I'll come back and try to give you a nudge.
Him: Can't you just tow me out of here now?
This seems like the perfect time to tell the skipper
which half of a horse you think he is. Don't, unless he asks.
Then smile and reply as follows:
You: The stem?

Boaters who hate going slow complain about Florida's
manatee protection laws. There are plenty of manatees,
they say, so give us back our throttles. Not so fast, dude. If
the manatee crisis really is over and the laws are repealed,
and we speed through a herd of manatees, carving them up
with our engine props, is that okay?
It's not okay on my boat. Not on yours either, okay?

More resolutions:
I resolve this year to make a donation to the Pelican
Harbor Seabird Station in Miami, where they take such
good care of pelicans and other seabirds who get tangled
or strangled with fishing litter lines, lures, stuff like that.
This year too, I'm going to try extra hard to get my
boat ready to ferry Baynanza volunteers to littered islands
in Biscayne bay. It's in April. I can do that.
When I'm paddling a canoe on a suburban lake or canal
and a dog barks at me, I will accept its invitation to come
ashore and play.
I'm going to tell two of my neighbors one an ele-
mentary school teacher, one a principal about Officer


Snook, the pollution-fighting fish, and how to invite him to
their schools.
Once again, I'll volunteer as an observer in billfish
tournaments that give an ample percentage of their entry
fees and sales proceeds to marine research and conserva-
tion projects.
True, I'd much rather catch fish than watch others do
it, but on the upside I'll spend a lot of time with some of
the best fishing-doers on the ocean, getting to know them
better, learning something every day.


All that and this, the best part:
Being reminded that I get to go fishing and write about
it. Other than not getting rich, I'm awfully lucky. A new
year is a good occasion to remember it.
