Palm Beach to

draft hurricane

plan for boaters

After last year's busy hurricane season, officials at the
Marine Industries Association of Palm Beach County are
taking action to draft a plan that will help boaters in their
district become better prepared for future storms.
"We want to limit damages by helping people make
decisions in advance," said David Roach, executive direc-
tor of the Florida Inland Navigation District and chairman
of the association's hurricane preparedness summit.
The gathering, held on May 4 in West Palm Beach,
drew about 80 representatives from the marine industry
and governmental organizations. Organizers expect to have
their plan ready for public distribution sometime in June.
The date coincides with the start of the new hurricane
season, which takes place June 1 to November 30, said
Margie Yansura, spokesperson for the Marine Industries
Association of Palm Beach County.
Prior to the summit, there were no industry-wide
guidelines established in Palm Beach County.
The plan being drafted will reach out not only to indi-
vidual boat owners, but also to everyone in the marine
industry and governmental agencies, Yansura said.
"Coming off the four hurricanes last season, we
learned some lessons and we want to apply them to cut our
losses in the future," Yansura said. "We are formalizing a
plan so everyone has access to the same information."

Suggestions for the plan include
providing information on bridge
closings, flood zones, safe mooring
areas and no anchor zones

At the summit, representatives included federal, state
and local officials, boatyard owners, towboat operators
and yacht brokers, Yansura said.
Discussions centered on topics such as pre-hurricane
planning for marinas, boatyards, boat owners and govern-
mental agencies. There were also presentations on post-
hurricane issues for those in the legal community and law
enforcement, and post-hurricane waterway clean up.
"People at the summit spoke on the need for more
coordination and communication between the industry,
governmental agencies and boat owners," Roach said.
"We didn't have that before."
Following the summit, participants have stayed in
contact via email to provide input for the finalized draft,
Roach said.
Suggestions for the plan include providing informa-
tion on bridge closings, flood zones, safe mooring areas
and no anchor zones. Another proposal was to insert a

Boaters stinging after city limits boat anchorages


'Riff-raff' portrayal draws protests

A law forbidding cruising sailors to anchor within Miami
Beach city limits for more than seven days was passed in mid-
May by the Miami Beach City Commission, responding to
complaints by island dwellers that the boats spoil their views
of Biscayne Bay, and the occupants behave badly.
A marine community that spreads beyond the sailors and
residential islands protested in vain. Its views had not been
solicited while the ordinance was being drafted. They antag-
onized by the characterization of anchored sailors as riff-raff.
"We are equal residents of your community while we
are here," Richard Blackford told the commission on May
18, when it voted 6-1 to enact the ordinance.
Blackford, vice president of the Seven Seas Cruising
Association, has a 42-foot sailboat, Slow Dancing,
anchored off the Miami Yacht Club, a few yards from the
Miami Beach city waterline. He spread word of the ordi-
nance and organized the opposition.
Miami Beach had no prior regulations for mooring and

anchoring, nor for live-aboard boats. It still has no designat-
ed area for cruising sailors stopping there between legs of
their voyages. Commissioners said they are considering
establishing one.
They should have done that first, objectors argued.
Exactly how and when boaters will be affected isn't
certain yet. Restrictions were to take effect on May 28, but
the commission delayed enforcement until October, the
beginning of a new fiscal year. The current city budget
lacks money to enlarge the police marine patrol or to pay
towing and storage costs.
Saul Gross, the commissioner who voted not to enact-
ed the ordinance, preferred a different approach.


"I thought an ordinance restricting boats from anchor-
ing closer than 400 feet to a residential building for more
than 12 hours would have been a win-win," he said. "It
would have more directly addressed the problem home-
owners are most concerned about, which is invasion of their
privacy while in their homes, and it would have been
acceptable to the boating community as well."
Besides Seven Seas, objectors at the commission meet-
ing included representatives of the Miami International Boat
Show and the Marine Industries Association, and about two
dozen individual boaters and local business people. Others,
such as BoatUS, sent letters, petitions and offers to help
draft rules that everyone could live with.
They argued that the city is wading out of its jurisdiction
into state.waters, that it can't arbitrarily say when stopping-
over boats are legitimately "in navigation" or out, that the
anchorage areas are no one's back yard but are as public as
the streets and parks, and that Miami Beach should have des-
ignated mooring and anchorage fields before telling sailors
they can't use the sheltered waters between 11 islands.
Some of the boats at issue are live-aboards. Most are
owned by cruising sailors, stopping in Miami and Miami
Beach to re-provision, make repairs and wait for good sailing
weather before crossing to the Bahamas or heading north.
At first, the ordinance gave them only 72 hours
at anchor.
Protests since the law's introduction in April caused the
commission to loosen it a little. The biggest change was
increasing the time limit to seven days, but sailors remain
antagonized by the city's refusal to recognize them or any-
one in the marine community as stakeholders in the issue.
They also are angry that the ordinance echoes property
owners' complaints that anchored boats and boaters are unde-

Drownings should make you sad, sorry and vowing to be safe

We were on Chokoloskee Bay,
heading into the wilds of the
10,000 Islands when Dave Risberg,
a new fishing buddy, began his
announcement: "The safety gear's
in a big white bag down here, under
the console flares, life jackets,
first aid kit. The anchor's in that
/ l hatch behind you."
If you wonder what it means to
Arnold Markowitz show someone the ropes, that's
what it means: show him where everything is on the boat,
especially the emergency stuff. Including ropes, which I had
unhitched at the dock and stashed myself.
By the time Dave stopped talking and we started fishing
at the mouth of Turner River, I knew my way around his boat
as well as my own.
If he had also shown me how to start the engine and
reminded me that boats don't have brakes, I wouldn't have
been insulted. He was just being responsible, making sure
that in case of trouble I would know everything I needed to
know, before I needed to know it.
That's the best way to deal with emergencies, and the
best time before anything happens. When something
does happen, it usually happens too fast for us to catch up.
By the time you figure out what to do, you should have done
it already.
Sometimes that makes people drown. Four days before

Dave and I fished together, someone did.
There was a man overboard accident at Jupiter Inlet,
and the only person who knew anything about boats was in
the water without a life jacket, caught in a current, being
pulled away from the boat. That was Stanley Shakespeare,
42, who owned the 17-footer.
With the inlet full of rough water and his friend lying
seasick on the deck, he had broken off from the fishing trip
and headed toward calmer inside waters. A big wave jarred
the boat. Shakespeare fell over the side.
The engine was off stalled or switched off, it isn't
clear and Shakespeare's friend didn't know how to
restart it. The police said he more or less panicked. By the
time he got hold of a life jacket to throw, Shakespeare was
far out of reach.
It-took a long time to get to the point, didn't it? Yes,
because I hate this as much as you do, but when someone
dies the way Stanley Shakespeare did, we are forced to think
about it.
That could have been me. You too.
If there's anything marginally good about Shakespeare's
tragedy, it's that it probably snapped more of us out of com-
placency than most one-victim accidental drownings. Those
don't get much publicity in South Florida. This one got more
than most because Shakespeare played wide receiver for the
team that won the University of Miami's first national foot-

ball championship, in 1983.
In the years since then, he had blended into the real
world married, made a family, earned a managerial job at
a Publix market, got a boat, invited a buddy from work to go
fishing. If that's not exactly us, it's pretty close.
A couple of weeks after he died, I was forgetting about
it already. Then I read a news report about the deaths of a
Texas couple, thrown off a fishing charter in a rough inlet
near Quepos, on the Pacific Coast of Costa Rica. No life
jackets, of course.
Dave Risberg and I weren't wearing life jackets either,
that weekend on Chokoloskee Bay. We had them but it was
a calm, safe day, and we spent most of the time in sheltered
waters, fly fishing for snook and tarpon.
Then again, if we had needed the jackets in a hurry,
maybe we wouldn't have time to get them out of the gear
bag. I don't recall noticing anyone else wearing theirs either.
These are our look-back excuses: We were fishing on
calm, shallow water, casting to mangrove shorelines just a
few strokes away. The worst predicament of the weekend
was getting stuck on a mudflat for about three minutes. If the
waters had been rough enough to make us nervous enough
to wear the jackets, we were smart enough to avoid open
areas of the bay.
Qkay, but:
Wefished standing up on a boat with low freeboard,
usually concentrating so hard on aiming our casts that we
scarcey, noticed the occasional horsepower showoffs zoom-
ing by until their bumpy wakes jiggled our balance.
Once in a while the sudden back-or-forward motion of
our own trolling motor made us a little tippy, too.
Chokoloskee Bay is dotted with oyster bars, many not
shown on marine charts, that could have bucked us both
overboard if we'd whacked one at speed.
And if we'd backed off the mangroves after retrieving a
snagged fly, just as someone went by dragging a big wake,
it would have been like backing into a following sea: Ploop,
slurp, dunk.
I can see you nodding in agreement.
Now the-sermon.
Next time you're out, show everyone on your boat
where the emergency stuff is.
If the life jackets and fire extinguisher are stowed, make
them easy to grab nothing on top of them, nothing in front
of them. Encourage anyone who'd feel better wearing one
all the time to go right ahead, with minimal teasing.
When drifting or at anchor, insist that everyone sit down

When I tell people I'm a maritime
attorney, the uninitiated often ask for
an example of what maritime attorneys
do that would set them apart from
other lawyers. I often reply by stating,
"Well, maritime attorneys occasionally
arrest boats!"
Usually someone then comments on
the difficulty of placing handcuffs around a
boat's propellers.
As amusing as that might be, the actu-
al prospect of a vessel being arrested is a
serious situation. The threat should never
be taken with a light heart.
OK, so when can boats get arrested
and when should you be concerned
about it?"
Well, pursuant to federal law, vessels
usually get arrested for civil actions known
as maritime liens.
Simplistically put, a maritime lien
occurs when either work or money is
expended for the maintenance or opera-
tion of a vessel directly for the vessel's
benefit, and the appropriate parties fail to
be compensated.
Obvious examples would be failure to
pay dock bills, repair bills, salaries to sea-
men, required medical care for seamen,
legitimate salvage awards, required pay-
ments to a preferred ship's mortgage that's
been properly filed with the U.S. Coast
Guard well, you get the idea.
By the way, as a side note, yacht bro-
ker commissions do not fall under mar-
itime liens, since the sale of a boat alone is
not considered to be a direct benefit to it.
A maritime lien becomes active as
soon as work or moneys have been
expended to the benefit of the vessel. Such
a lien does not need to be filed to become
active and in most instances can follow the


vessel regardless of prior ownership or
new ownership by a bona fide purchaser.
Theoretically, a vessel can be arrested
at any time after a maritime lien has been
created against a vessel and the lien holder
decides to enforce it.
However, at least for the small vessel
owner, most maritime arrests do not go
down in such a draconian fashion. The
boat owner will probably have some notice
about the arrest before it actually occurs.
At that point decisions must be made about
the potentially arresting development.
Before the arrest, most boat owners
will generally get a bill, often accompa-
nied by a letter of demand regarding the
debt. Sometimes the boat owner will have
a specific number of days to respond, usu-
ally with a threat that failure to respond
will result in some form of legal action.
Such letters can specifically threaten the
arrest or detainment of the vessel. In any
variation of this situation, the boat owner
should regard the matter seriously.
It can often prove very expensive for a
lien holder to put up the front-end costs
required to arrest a vessel under federal
law. However, depending on the facts of
the case, I have seen arrests done for sur-
prisingly small liens. Therefore, a boat
owner should deal with a letter of demand
(or even an invoice) against their vessel
with utmost prudence.
First, find out where the invoices or
demand letters are coming from. It is
important to know whom to contact to
alleviate the situation, if that's possible.
Next, review the history of events that
might have created the lien with any and
all related paperwork, including past
invoices, contracts, and previous corre-
spondence on the matter. Try and be
impartial in your review and see if there

Do you have neighbors who are new
to the coastal area? Or do they just ignore
valid hurricane precautions?
Last year, all my neighbors told a new
homeowner to tie his boat up before the
first hurricane, and he promised to do so.
But each hurricane came and went, and he
did nothing.
Foolish? You bet. Inconsiderate? Yep.
Downright dangerous? Yes again.
Remember the pictures of boats inside
people's houses after Hurricane Andrew?
It's one thing if the neighbor who ignored
the warnings finds his boat in his livin-
groom, but quite another if it ends up in
mine!
So, for those who want to give some
neighborly advice, or for those who are
boat owners themselves, here are the rec-
ommended boat security precautions from
the U.S. Coast Guard Auxiliary and the
Sun-Sentinel's Hurricane Survival Guide
from a few years ago.
You have about 24 hours advance
notice to get your boat secured against the
storm's full force.
If you can trailer the boat:
Store it ashore far from the high
water. Try to put it in a garage, but if you
cannot do that, secure it to strong trees or
a "deadman" anchor. Strip off everything
that could be torn loose by the wind. Then
increase the weight of the trailered out-
board boat by filling it with fresh water
(only halfway, as overfilling can damage
the trailer) and leaving in the drain plug.
Insert wood blocks between the trailer
frame and the springs for extra support
with the added weight. Let some air out of
the tires. Remove the outboard motors.
Remember, drawbridges will be
locked down within hours if there is an


evacuation. That limits boat traffic, so
boaters must act early. Canals leading
inland offer some protection for boats, but
most major east-west waterways are
blocked at some point by floodgates. Don't
impede other boats by anchoring yours in
the middle of a canal or river.
If your boat must stay in the water:
Berth at a dock which has sturdy pil-
ings and offers reasonable shelter from
open water and storm surge. Double up all
mooring lines but provide enough slack so
your boat can rise with the higher tides.
Put out extra fenders and fenderboards.
Enough line should be on hand to allow a
scope of a least 10:1 for each anchor.
Hurricane holes, deep, narrow coves
or inlets surrounded by a number of sturdy
trees which block wind, are good locations
to moor your boat.
Never stay with your boat. Your boat
should be stripped of anything that can
become loose during the storm. Remove
documents, radios, valuables and unstep
the mast.
Disconnect shore power. Be sure bat-
teries are sufficient to run bilge pumps
throughout the storm. Insert plugs in
engine ports. Close fuel valves and cockpit
seacocks. Use duct tape to seal windows
and hatches. Remove all canvas, chains,
life rings, etc., to reduce the wind load.
Advance planning cannot- guarantee
that your boat will survive a hurricane
safely, or even survive at all. Planning can,
however, improve survivability and is
therefore certainly worth the time and
money to do so.
And it sure makes your neighbors feel
better.

Give original Water Taxi owner credit
To the Editor:
In Gloria Katz's March column titled, '"The River Can
Aid Transit in Lauderdale, she refers to Bob Beckoff as the
founder of Water Taxi.
In fact, a gentleman named Steve Halbrook con-
ceived of the idea and name, went through a long process
to convince the Fort Lauderdale City Commission that it
was a good and workable concept, and then ran the sys-
tem for a year before selling to Bob Beckoff.
Mr. Beckoff bought Water Taxi and all rights from Mr.
Halbrook.
Incidentally, that first year of operation of this new
service was quite interesting from some of the stories
I've heard.

Gloria Katz is right on target in her March column.
The use of the water taxi service should be expanded to
include stops at Andrews Avenue in Fort Lauderdale, with
a golf cart-type service transporting people to the new
Publix in downtown Fort Lauderdale. Many people would
do their shopping by way of water taxi if this service to the
supermarket was developed.
The use of water transportation has shown to be very
effective at the Fort Lauderdale International Boat Show.
The river can aid transit in Fort Lauderdale.

Check to see if there are indeed outstanding invoices.
Determine if your paperwork review shows any mistakes
regarding payments including your own own mistakes.
Hey, it's possible!
If your review shows that there are matters in dispute,
consider compromise. You may also have to analyze the eco-
nomic pros and cons of paying for professional legal advice
concerning the matter or complete capitulation to a lien
holder's demand.
Sadly, despite some boat owners' best efforts, some-
times the arrest of a vessel is inevitable and matters will have
to be resolved inside the legal forum.


On the bright side though, boat owners who keep
good records, read and negotiate contracts thoroughly,
keep payments current, and take extra time to find good
workers with good communication skills, are the ones
with the least amount of risk for having their boats arrest-
ed. Hopefully, you are and will remain among such boat
owners. So, be careful.
By the way, when arresting a boat, the U.S. Marshal has
found that it is sufficient to place a red sticker on the vessel
rather than take the time to handcuff its propellers. Thought
you'd want to know.

S.E.A. summer camp aims to teach kids about the ocean


Marine sciences and watersports the
focus on new Hollywood program

The sands along Hollywood Beach will host more than
sunbathers this summer.
A camp focusing on marine sciences and watersports
will be held at the Hollywood Beach Culture &
Community Center, beginning June 6. The newly created
Science, Education and Adventure Camp, known as
S.E.A., will be the first of its kind offered by the
Hollywood Parks, Recreation & Cultural Arts
Department, said Linda Goberna, the city's acting recre-
ation manager.
It also marks the first time a summer camp will be held
inside the oceanfront community center, at 1301 S. Ocean
Drive in Hollywood. The combination of marine sciences
and the facility is a good fit, Gobema said.
In summers past, the city had sponsored water activi-
ties such as sailing classes at several of its camps and a
Scuba program for at-risk youth. But S.E.A. is more exten-
sive.
The camp will serve as a classroom without walls for
children ages 8 to 14 years old, who will learn about marine
life and natural sciences, with an emphasis on marine biol-
ogy, oceanography, water safety and ecology, according to
city officials.
Campers will explore the beach behind the community
center, as well as take field trips to local nature centers and
the Everglades to learn about habitats, ecosystems and envi-
ronmental issues.
Beach activities will include snorkeling and hunting for
seashells. Outings will include Parrot Jungle in Miami,
Lion Country Safari in West Palm Beach, the Anne Kolb
Nature Center in Hollywood, Tree Tops Park in Davie,
Secret Woods Nature Center in Dania Beach, air boat rides
in the Everglades and trips aboard a glass bottom boat, said
Edwin Cruz, recreation coordinator at Hollywood Beach
Culture & Community Center.
The program will kick off with a three-week session,
June 6 to 24. Two more sessions will follow, June 27 to July


15, and July 18 to Aug. 6. Campers will meet 7:30 a.m. to
6 p.m., Monday through Friday.
Participation will be limited to 50 youngsters each ses-
sion. It is strongly suggested that children already know
how to swim, Cruz said.
"If they don't, it will curtail their camp experiences
because they will have to sit out from the water activities,"
he said.

The program will kick off with a
three-week session, June 6 to 24.
Two more sessions will follow,
June 27 to July 15, and
July 18 to Aug. 6.

Cruz will oversee the camp, which is being funded
with a $250,000 grant from the Children's Services Council
of Broward County and the Hollywood Beach Community
Redevelopment Agency.
The council also provides grants for city-run camps at
the Dr. Martin Luther King, Jr. Community Center and
Washington Park, he said.
Monies for S.E.A. will be put toward field trips, sup-


plies and staff salaries. Four science teachers, four recre-
ation aids and one recreation leader will conduct the pro-
gram, Cruz said.
Because the council requires that grant recipients have
a sliding scale fee, scholarships will be available, he said.
The full cost is $300 for residents and $500 for non-
residents, per three-week session. People qualifying for
financial assistance will pay either $75 or $150 per session.
All fees include outings, breakfast and lunch, Cruz said.
City officials are expecting the program to be popular.
Registration for the S.E.A. Camp began on May 9. One
week later, the opening three-week session was close to half
filled, Gobera said.
The city is especially trying to attract children from
low-income homes by providing free round-trip transporta-
tion from community centers in other sections of
Hollywood, Goberna said.
However, any youngster in Broward County is eligible
for financial assistance, provided parents or guardians meet
the guidelines and provides verification of income, she said.

Galvin. Both men are members of the Palm Beach Sail
and Power Squadron.
Elderidge, a resident of Singer Island, said he doesn't
want a repeat of the damages he saw this past hurricane
season.

The marine industry suffered about $100 million in
losses from storms that hit the area in 2004, according to
the Marine Industries Association of Palm Beach County.
"Where I live, there were boats scattered all over the
bay," Elderidge said. "Near the Blue Heron Bridge, I esti-
mate there were 40 to 50 boats destroyed. I saw boaters
put down one anchor. They came back and their boats
were gone."
The preparedness plan is expected to greatly assist in
educating the community.
"There's a lot of opportunity to get the word out on
what can be accomplished with saving property and
lives," he said.

Fishing pier atmosphere draws anglers, spectators

Longer daylight hours in the summer are likely to bring
more traffic to Broward's popular fishing piers.
The 876-foot Anglin's Fishing Pier in Lauderdale-by-
the-Sea is the oldest in the state. It's also one of only two that
are privately owned among Florida's roughly 60 piers. All
others are operated by cities or counties.
Anglin's reopened Feb. 20 after one of the pier's sup-
port columns was knocked down during a storm in late
2003. It took a year-and-a-half to get the section rebuilt.
"We're glad to be back in business and expect to open a
final section at the end this summer," said Richie Behr, 13-
year pier manager. "This place is a vital attraction of this
community."
The pier jets out into the ocean at the end of
Commercial Boulevard and is named after Lauderdale-by-
the-Sea's founding father, Melvin Anglin. It was originally
built of wood in 1941, but in the 1960s the Anglin family
leased the land to Everett Sorenson, who then built a new
pier with concrete pilings. It was opened on Nov. 22, 1963 -
the day of President Kennedy's assassination.
Over the years, locals and visitors have tossed their fish-
ing lines from the structure and those who were lucky to
land big catches proudly displayed their picture on the pier's
photo gallery. There's also a chalkboard listing the biggest
recent catches.
"We had to start a new photo gallery because the old
space got all filled up," Behr explained.
Rudy Cascio, 75, of Tamarac makes the Sunday mom-
ing drive to the pier with his son, Tracy, and grandson, Tom.
"I've been coming here for 25 years. I love the sport of
fishing and this is the friendliest place I know of to enjoy it."
Robert Pinto of Plantation agrees that the pier attracts
friendly folks who bond from week after week of fishing
together. "I like the fishing aspect of all this, but I toss what-
ever I catch back in the water," he said.
The Pier Coffee Shop sits at the entrance to the pier and
is a popular early morning gathering spot. Owner Nancy
Pisarzewski enjoys chatting with regulars who visit the

quaint eatery.
Fishing piers along South Florida's coast have seen
their share of storms, but cities and counties have made
repairs to keep them open. The pier at Newport in Miami is
the only one left in Dade County, while Broward boasts pub-
lic piers in Dania Beach, Pompano Beach and Deerfield
Beach. Palm Beach County has piers in Lake Worth and
Juno Beach.
In Pompano Beach, a new $900,000 Hillsboro Inlet
Park, on State Road A1A just south of the Hillsboro Inlet


drawbridge, attracts people coming for the great view, and
fishermen to a new pier.
"This has been a wonderful effort and people really
seem to be enjoying the new park," said Mark Beaudreau,
recreational manager of the City of Pompano Beach Parks
and Recreation. He said the park replaces a vacant lot that
overlooked the waterfront spot for more than 20 years while
the city slowly moved to create the green space.
"We were lucky to get a lot of grant funds from various
sources to make the park and fishing area a reality,"
Beaudreau said.
Sheba Haston regularly travels from her Coral Springs
home to the new fishing pier for her weekly catch.
"I love it and the fishing is great," she said. "I've been
coming here for two years."
Convenient cutting boards are in the park to clean
catches.
"I never go home without a full cooler," said Gene
Capalbo of Deerfield Beach, who reeled in one fish after
another. "It's great fishing and a great view with all these
boats coming by."
Assedo Maurice, a Canadian with a winter home in
Deerfield Beach, said he's been fishing in the area for two
years, but the new pier and park make it easier. "The city did
ja great job in making this place, so even parents can fish
while their kids play on all the recreational equipment."
Boaters also have access to new marina docks,
Beaudreau said. And the Hillsboro Lighthouse Preservation
Society plans to use the park as a base for ferrying tourists
by boat for lighthouse tours.
"The park offers something for everyone," he said.

Know the ins and outs before you need help


before putting the engine in gear.
Make sure someone other than you knows how to start
and restart the engine, use the throttle, read the marine chart
or GPS, call for help on the radio and take the boat back to
port in case you can't.
In the middle of writing this, I saw another report about
-a young man and his six-year-old son, found dead in a calm,


slow Indiana river. Their light little plastic 14-footer, motor
running, was turning tight circles by itself.
People had seen them fishing, but there were no wit-
nesses to the accident. The police reckoned that the little
boy fell in the water and his dad jumped in to save him.
They had a life jacket and a floating cushion, which were
found on the boat.
Okay. No more heartbreaking stories.

pays a tax of $44,582.67 on his Rivo Alto Island house.
Houses on that and the other islands typically sell for
prices ranging from one to many millions.
"There are currently a dozen boats in my back yard,"
Gold wrote to Mayor David Dermer in March. "The prob-
lems brought by these transients are obvious. Waste dispos-
al, pollution of our waterways, hazards to navigation, illegal
dumping, unsightly and dangerous vessels, safety and secu-
rity of our residents, noise and boisterous behavior, to name
a few ... they illegally park their tenders along private or
public seawalls and sneak ashore."
Police, however, have attributed no such offenses to
anchored boaters.
"I don't go into your backyards. I don't steal from you,"
Richard Spicijaric said, his voice tense with anger. He is a
hotel bartender who lives on a boat.

nance is Bob Garritano, who lives on DiLido Island.

"I've got to look at the boats," he said." A lot of them
look like the Beverly Hillbillies. I can see them with binoc-
ulars, looking at this house and that house, and I'm going
like, 'What's this?'"
Gunnar Schrader, who has a condo ashore, docked his
61-foot sailboat Kaweah, behind a small apartment building
on Lincoln Court until the property was sold for redevelop-
ment. Now he's anchored about 150 feet away roughly half
the distance to the parking lot of high-rises on Belle Island.
Schrader said he has seen transient sailors setting up
within 50 feet of residential properties, and sympathizes
with those landowners.
"If I owned their property I wouldn't like that either," he
said. He wishes the city would do something simpler, like
creating a buffer zone say 200 or 300 feet between resi-
dential property and anchorages.
Rebecca Castellano spoke up for two sets of interests.
She is both a sailor and an administrative assistant at the
Marine Industries Association of South Florida, which has
800-plus marine-related business members in Miami-Dade,
Broward and Palm Beach counties.
She reminded commissioners that transient boaters spend
plenty of money in Miami Beach while anchored there.
"Our members ... provide boat parts, service, fuel, sails,
repairs, storage, dockage, pump-out, towing, just to name a
few. We respectfully request this current ordinance be

My fly rod curled over like a hyperactive question mark.
"I got one!" I screeched.
Then it launched three feet, waggled twice, and splashed
down. Our eyeballs popped out, bounced against themselves,
and somehow found their way back into their sockets.
"BIG RAINBOW!" my fishing partner, Preston declared.
ZZ77ZZ777777ZZZ7 spun my spool, evaporating
the remainder of the 150 feet of sinking line before moving
on to the cloth backing. I gripped the rod in my left hand,
high above the handle for leverage, and palmed the free-
wheeling reel with my right, a manual drag to prevent this
prize from getting too far for free.
It ran, then paused for a breather. My right hand
rewound as fast as it could twirl until the fish lost patience. It
made another break for liberty, fleeing until its anaerobic
energy depleted again.
"Whirl now that you have the chance!" I ordered myself.
Without maintaining a taut line, and my rod tip up, the
trout could spit the hook out while resting. Hooks famously
tear through their tender mouths, but this guy had bit hard.
"We gotta 50-50 chance of landing this guy!" squealed
my sidekick. "Keep him snug!"
My prisoner jarred the rod again, forcing my left grip to
clench, and I let it run with about 25 percent resistance. It
was so strong and angry, too much brake would snap the
tapered leader, ample where knotted to the 20 pound sinking
line, but thread-like at the hook.
Back and forth the tug-of-war swung. Lunges and
plunges. Bounds and belly flops. Blast-offs and re-entries.
Detonations and dives. Right to left it took us on the ride of
both of our lives. ZZZZZ tighten. ZZZZZ tighten.
Then, no Z7.7 Z. Its silver flashed along the surface as
it seemed to charge the boat, either disoriented or somehow
crossbred with a grizzly. It stopped and floated where we
could see there was lots of it, in case there was still any ques-
tion. My reeling drew the line tense. Infuriated by the pull, it
dove under the 12-foot aluminum craft and out the other side.

boy had the pluck left for one last run until finally saying
"uncle." Exhausted, it fought the good fight. Preston dipped
the net into the crisp mountain water and docked the four-
and-a-half pound "Rainbow Warrior."

The Canadian Rocky Mountains
Close to an hour from the town site of Jasper, Alberta,
Maligne (ma-LEEN) Lake nestles into the Canadian Rocky
Mountains. It stretches more than 14 miles long, and is only
about a mile across, broadening to one-and-a-half at its
widest point. Glaciers carved the floor into a V, leaving a
depth of 350 feet down the middle.
At an elevation of 5500 feet, the Upper Maligne River
feeds into the lake, along with assorted drainage creeks off
the mountains. Maligne Lake empties into the Mid Maligne
River. Fly-fishing and white-water rafting disrupted the sen-
sitive Harlequin duck breeding grounds, thus permanently
closing the river to human use.
The Mid Maligne drops 500 feet of elevation into

Medicine Lake, 13.5 miles away. A rockslide from ages past,
in conjunction with the undercutting and shoveling actions of
a glacier, had blocked the normal outflow of Medicine Lake.
As a result, the lake drains through gravel-choked sinkholes
through its limestone floor. The water then collects under-
ground to emerge at various spots in the Maligne Canyon
some 12 miles away, another 1,400 foot descent.
Maligne Lake offers world-class fishing of rainbow and
Eastern brook trout. Amid spectacular backdrops of moun-
tains, it's open through the first weekend of September.
There's no ice fishing permitted during winter.
So how did I end up in the Rassle with the Rainbow? We
had left Edmonton shortly before midnight the night before,
and drove slowly west to Jasper 230 miles away. Then we

Driving all night, fishing all day in the Canadian Rockies

navigated south, passed the five-star Jasper Park Lodge,
climbed the Maligne Lake Road, and pulled into the Maligne
Lake parking lot.
At 4:30 a.m., mustering a couple of winks in the Chevy
Hilton proved a lost cause. Since the sun rises so early in
summer, and because the fish stories were getting too thick,
it was soon time to put in the boat, rig the electric motor, and
doctor the lines.
Egg-sucking leech. I had always thought Preston and I
were friends; and I smarted from his insults. I had paid my
share of the gas. Then I saw the object of his comment. A fly
with black hairs and a fluorescent orange ball imitating a
leech that found a fish egg for breakfast was the insider trad-
ing for a trout lure. Bait is prohibited.
With the whir of the electric motor pushing the boat
about four mph, and the haunting call of a loon somewhere
in the dawn mist, the depth finder fidgeted between 45 and
185 feet. Far too deep. Trout hang out on the flats and ledges
at around 12 feet, so we headed for the lake's far edge.
Fishermen have two choices to propel their boats: elec-
tric motors or paddles. The only powerboats permitted are
double-decker boat tours filled with tourists and warden's
speedboats. The tourist vessels create wakes that pitch and
toss canoes and 12-foot aluminum boats, so the admirals cut
power and troll past. The noise of the engines echoed against
the mountains and glaciers, which still engulf whole ridges
and faces. Mini-avalanches emitted their roars.
Slowly trolling at the speed a man walks, a stone's throw
from shore, we were teased with tugs and pulls, and even
landed the odd small fry.
Sandpiper's Point, or more affectionately called "The
Mekong Delta," approached, a spot where the mouth of a
stream squashed out and emptied into the lake. The depth
was perfect, and with the agitation of swirling water in the
pools, action was nearly guaranteed.
7ZZ Z ... Preston's reel sang that magic melody.
Somewhere we're stars. At the bend of his rod, more cameras
lifted than at a Tiger Woods press conference. Boating a nice
pound and a bit brook trout brought smiles and waves from

between us, sniffed the fish, but the ducks, geese, and loons
bobbing on the surface summoned her retriever instincts.
The weather, as usual, was a lottery. The cold in our
bones couldn't break until the sun climbed over the peaks.
Throughout the day, one minute we were sun tanning, and

the next, cloud cover cut off all that nice scenery. Rain, sun,
and snow toggled on a moment.
Trolling in as the sky clouded over and darkened, we
caught and released a couple more until another nice one-
pounder cooperated, filling our limit of two each. Driving all
night, fishing all day, and then making it home deserved
decent keepers.

Provincial fishing permits are not valid, a National
Parks permit must be bought separately. Prices are $4 for a
week or $9 for the year.

Five additional trout-fishing spots for anglers to try in
the Jasper area include: Medicine Lake on the way to
Maligne. Pyramid Lake, a few miles west of town up the
mountain, has rainbows and lake trout. You'll find the turn-
off by the community center and ball diamonds.
Snaring River, under 10 minutes east of Jasper on
Highway 16 where you can catch rainbows, Rocky
Mountain whitefish, and bull trout (Dolly Varden).
Talbot Lake, 15 minutes east of Jasper along the high-
way, has northern pike.
Obed Lake, 20 minutes east of Hinton, a pretty commu-
nity 50 miles east of Jasper. Obed has brown trout and perch.
If fishing for perch, bring an anchor with around 10 feet of
rope, then jig for the perch.
