Students embark on new yacht design degree program

Art Institute a first to offer
'overdue' marine major
By. BETH FEINSTEIN-BARTL
Waterfront News Writer
Jeff Cunningham dreams of one day designing
powerboats.
He might get his wish through a program in yacht and
marine design, which started in September at the Art
Institute of Fort Lauderdale.
Cunningham, 20, from Akron, Ohio, is one of the
eight students now studying for a degree at the school. For
Cunningham, the program has so far been a good experi-
ence.
"I'm learning more than I expected," he said. "I
looked at other schools, but most were naval architecture.
It wasn't what I wanted. At the Art Institute, it isn't about
how the boat floats, it's on the design aspect."
Jack MacDonald, curriculum coordinator for the new
program, said it falls under the Institute's industrial design
department. Of the school's 27 campuses throughout
North America, the Fort Lauderdale site is the only one to
offer yacht and marine design. .
Graduates will receive a bachelor of science degree in
industrial design with a concentration on yacht and marine
design, MacDonald said.
The program grew out of a 22-week internship over-
seen by Paolo Caliari, an international yacht designer.
"The results were so gratifying," MacDonald said.
"There was a special show of drawings and models in the
school's gallery. It brought about a lot of interest from stu-
dents."
Once plans were made to offer the degree, it took the
institute one year to put the curriculum for its yacht and
marine design program together. Courses were construct-
ed based on questionnaires sent to people in the marine

industry and suggestions made by a review panel of pro-
fessionals, he said.
Courses explore the marine design process, funda-
mentals of vessel design, marine drafting and rendering,
exterior and interior yacht design and marine construction
materials and techniques.
Students also have the opportunity to take classes in
recreational boat, super yacht, powerboat and personal
watercraft design.
"The focus of the program is not to develop naval
architects or marine engineers," MacDonald said. "We
want graduates who can work with these specialists, and

with custom builders and manufacturers."
Grads will have the ability to work as entry level staff
designers, project development assistants, yacht construc-
tion supervisors, liaisons between architects, builders and
clients or as liaisons between sales, marketing and manu-
facturers, said MacDonald, who is one of two faculty
members presently instructing courses for the program.
Paolo Caliari will join the school and teach classes
when he returns from Europe, MacDonald said.
MacDonald expects enrollment to increase once the
program becomes better known. The institute's yacht and

Woman grows native mangroves for houseplants
w

By DAVID VOLZ
Waterfront News Writer
Would you like your own mangrove plant? You can
have one for as little as $10.
That is the starting price that Nan Rhodes is charging
for the potted plants. She owns and operates Mangrove
Mania in Fort Lauderdale.
"You are buying a piece of natural South Florida,"
said Peter McNaughton, a customer and Fort Lauderdale
resident. "The plants are hardy and attractive. They are
unusual. I had several mangroves but bought one that was
beautifully potted from Rhodes."
On a mission to promote the native vegetation, Rhodes
has sold 300 plants since starting her business in October.
"I am trying to get people to understand the impor-
tance of mangroves and how they hold Florida together,"
said Rhodes, 48, of Fort Lauderdale. She also has seed-
pods that have sprouted at a cost of 50 cents.
"They prevent erosion and are home to a great deal of
aquatic and marine life," she said.-
The importance of mangroves to the environment
cannot be overstated, she says. The roots protect a number
of fish species that provide food to manatees. The trees are
home to marine birds such as ospreys. The plants also dis-
courage soil erosion,
And they make nice house and patio plants, are low

maintenance, requiring only tap water. They don't involve
dirt and can grow in gravel. They can also grow in pots with
no holes.
Rhodes is licensed by the Florida Department of Plant
Industry to sell mangrove plants. Anyone can pick-up the
seedpods which fall from mangroves and plant them. But
to sell them requires a state license.
"When the pods hit the water, they float horizontally,"
she said. "Then when they find brackish water, the brown
end of the pod dips down. Eventually, the pods lodge in
mud, sand or rock and start growing into a tree. The ones
I have in containers grow vertically and don't put out
branches. They only need water and don't need saltwater."
Rhodes has long had an interest in nature.
"I was a commercial artist and typesetter but business
got slow. I had been picking up stuff on the beach for
years. For example, I have been picking up sea beans so I
have an interest in.what washes up on the beaches."
She sells the mangroves at flea markets and craft
shows. Every other Sunday starting Jan. 12 to March, she
will sell them at the Lincoln Road Mall Green Market.in
Miami Beach, on Lincoln Road, between Drexel Avenue
and Alton Road, from 9 a.m. to 6 p.m.. Online:

Mangroves, man share sprawling county nature preserve

West Lake Park caters to
boaters, birds, nature buffs
By WILLIAM R. HAWKINS
Waterfront News Writer
This is one in a series of special features exploring
landmarks and wetlands along South Florida's water-
ways. This month's feature takes a look at the 1,500-acre
mangrove preserve in Hollywood's West Lake Park.
Nearly 30 years ago, a Broward County commission-
er's fears over encroaching development on natural wet-
lands along the Intracostal led to an intense effort to save
the area.
Today, the 1,500-acre mangrove preserve, part of the
county-run West Lake Park, is an example of how well
man and nature can get along.
Considered the largest mangrove ecosystem along
Florida's East Coast, it is also thought to be one of the
largest in the nation.
Boaters, naturalists, bikers and joggers are regulars at
the park, which is located off Sheridan Street, stretching
from Port Everglades south through Dania Beach to
Johnson Street in Hollywood.
"Being able to visit such a special natural setting is a
real thrill for many people," said Joanne Howes, assistant
manager and park naturalist. "And visitors are able to dis-
cover the plant and wildlife either by foot or water."
The sprawling natural coastal area covers 47,800 feet
of waterfront, and an additional 20,600 feet of mangrove-
fringed shoreline along interior waterways.
Back in the 1920s, the area was being filled in for res-
idential development, but hurricanes and the Depression
delayed the projects. Then in the 1940s and '50s, devel-
oper Hollywood Inc., began residential construction.
In 1974, a grassroots effort led by Kolb pushed for
preservation over commercialization, sparking environ-
mental groups nationwide to join the campaign.
In 1978, Broward voters approved a $7.5 million plan
to buy the tract of land. Although Kolb died of cancer in
July, 1981, her work paid off in April, 1984 when the land
purchase was completed.with some $20 million in local,

About 70 acres of parkland south of Sheridan Street
was developed first as a recreational area, including boat
launch and picnic areas, tennis courts and a children's
play area. The larger section of the park is north of
Sheridan Street and includes the Ann Kolb Nature Center,
a marina area for boat rides, four major walking nature
trails, bird sanctuary, observation tower and picnic areas,
Howes said it's an on-going effort to bring school
children to the nature center so they will learn to appreci-
ate the environment and want to preserve it.

Scouts earn badges by participating in youth pro-

The park changes with the seasons, as it contains a
spawning and nursery for juvenile fish, and migrating
birds nest in the mangroves as they pass through the area.
The nature center contains a 3,500-gallon aquarium,
replicating the mangrove swamp outside. Studying the
snarled mangrove roots under water, it's easy to see how
they serve as a refuge for fish, while birds nest in branch-
es overhead. Herons, sandpipers, willets, ibis and others
are drawn to the park.

Law

Time is of the essen

- relatively speak

By MARK ERCOLIN
Waterfront News Columnist
Although I can't speak for others,
2002 seemed to go very quickly.
Interestingly, it is almost 100 years since
Einstein pointed out that in the realm of
physical science, time perception can be
truly relative.
However, legal science is not usually
so accommodating. The law prefers to treat
time asa concrete and unwavering mea-
surement. So, in natny legal situations,
time is of the essence.
Yet since different problems can
touch upon'~seeral varying legal con-
cepts (such as cases which could, at first
blush, be argued under either state laws
or maritime law), time may not seem so
clear or concrete.
In legal cases where there may be a
conflict of laws or when time limits to
bring forward an action are not set by
statute, the term relativity can once again
seem relevant.
Generally, the law goes by several dif-
ferent factors: rules and statutes (i.e. writ-
ten laws and policies set down by legisla-
tures or administrative bodies), common
law longstandingg traditions and rulings
developed by earlier courts on similar mat-
ters), and, finally, time bars set by contracts
between parties.
Here's an example of how time can
IWCliTffebfoi fffg Wherffi itTnvholve mar-'
itime'TelTients: ..
Let's say a passenger on a vessel
receives an injury while the vessel is in
state waters. Generally, most states allow
at least four years to file an action for a per-
sonal injury. But let's say this passenger
has a ticket that states there is only one
year to file, suit against the vessel and its
underlying company.
The U.S. Supreme Court has ruled
that tickets with a time bar are, in fact, per-

missile in maritime cases and will dictate
over any state law to the contrary.
Time disparities are not just found in
maritime vs. land cases. Here's an example
of a disparity in what is generally under-
stood as a situation exclusively controlled
under admiralty law:
Let's say a seaman is negligently
: injured while working on board a vessel.
Generally, he would have three years to
Sfile suit against the owner of the vessel in
order to collect liability under the theory of
negligence.
But suppose this vessel was a civil-
ian-manned ship owned by the U.S. In
most cases, a seaman will have only'two
years (rather than three years, as normal-
ly allowed for non-government vessels)
to file suit before being forever barred
from redress.
It should also be noted that there
might be several administrative "hoops" to
be dealt with before the federal govern-
ment will allow itself to be sued for such
an incident, so this must also be reviewed
before the two-year window closes.
As you can see, time can become pret-
ty fluid in the maritime legal iorld. And to
add to the confusion, it's not just time lim-
itations that can be a problem it's also
the fact that some situations may not have
any predictable time bar at all.
Maritime liens held. against civilian

tion without a time bar, and to quote a
famous treatise on the subject, "maritime
liens are secret and follow a vessel virtual-
ly forever."
Because of the traditional lengthy
voyages of old, as well as the continued
inability to always find boats whose own-
ers may not wish them to found, there

When a rose by any other name still smells like a fish

By ARNOLD MARKOWITZ
Commentary for the Waterfront News
When they changed the name of the jewfish to Goliath
grouper, who could have foreseen the rising tide of problems
to follow?
It took not quite two years for someone to petition the
U.S. Board on Geographic Names to rename Jewfish Creek
in Miami.
It's almost logical. If there isn't a jewfish, how can we
have something named after it?
SOnly that's not the reason Arnold G. Konheim of
Washington D.C. gave in his petition to the government. His
reason is ethnic offense. "The word Jew in any form other
than a noun is derogatory," he wrote.
Ordinarily we think of a petition as a document signed
by many people, but in this case there's only Konheim, and
just wait till we tell you who he is.,
There's good reason to believe the government is taking
him seriously, so all of us should start thinking up new
names to propose.
How about naming the creek after Henry Fleigel?
Legend says he named Jewfish Creek when he built the
Florida East Coast Choo-Choo tracks across it, almost 100
years ago. He'd be a good one, but no. Every town in Florida
already has a street or something named after him.
It might be fun to name Jewfish not really a creek but
a channel- after someone on the verge of imprisonment,
but by now the politicians in Miami-Dade have nominated
their favorite campaign contributors. We can do better.
Two names I've tossed overboard are those of Gary
Grossman, the guy to blame for renaming the fish, and
Arnold G. Konheim, the one who's trying now to do the
same to the creek.
A couple of years ago Grossman, a professor of fish
ecology at the University of Georgia, got the attention of
The Committee on Names of Fishes of the American
Fisheries Society and The American Society of
Ichthyologists and Herpetologists (AFS/ASIH). For short,
it's called the Names of Fishes Committee.
It consists of six fish officials named Nelson, Crossman,
Espinosa-Perez, Findley, Gilbert'and Williams.
None of those names look Jewfish, do they?
Grossman was not the first person to make an issue of

this, but he was the most persuasive. The committee's report
of Jan. 24, 2001 announced the new name and thanked him.
As if anticipating catfish calls, the fish officials men-
tioned that they rename fishes reluctantly, by admonition of
their Principle 8, which is something like a commandment.
Principle 9 provides for exceptions: "Names shall not vio-
late the tenets of good taste."
I was about to argue that all groupers taste pretty good,
but Principle 9 says that means names mustn't contain offen-
sive words.
Prof. Grossman convinced the committee that Jewfish is
an offensive word..
His photo on the university website portrays a zaftig
young man, just in'from the wind, with a beard and a jolly
grin. Helooks like a sport, not a stiff, but when The Miami
Herald reported that prominent Jews didn't take him seri-
ously, this was his reply:
"I am saddened that Jewish leaders could ever believe
that efforts to remove a patently anti-Semitic name from offi-

cial usage were trivial or wasted. Although I certainly would-
n't claim that changing the name of thejewfish ranks up there
with working on peace in the Middle East, it does stop scien-
tific sanction of a negative, ethnically motivated stereotype."
Suppose jewfish really was an offensive name. Was it a
better idea to name the fish after Goliath, one of the Bible's
worst anti-semites?
You may recall the story of David and Goliath. David
was a good-natured Jewfish kid who was fishing when
Goliath, the most villainous Philistine, came zooming by on
water skis, running over David's line, taunting him. David
loaded his slingshot with a rock and the next time Goliath
buzzed him, wham! Right between the eyes.
The catch set a light tackle record that still stands.
So, should the jewfish be renamed David? Maybe not.
He was a little guy and that's a big fish, largest of the
groupers. Surely the fish officials were acknowledging
Goliath's size, not honoring his villainy.

nal nature of the maritime lien.
Of course that's not to say that a maritime lien can't be
barred due to elapsed time. Such an instance would be based
on the theory of "laches."
Basically, this allows a maritime lien to be extinguished
if it can be shown that much time has passed and that the
claim holder had previous opportunities to enforce the lien
without doing so (e.g. a boat has returned to the harbor 20
years in a row during season and though the plaintiff knew
this, he failed to act and arrest the vessel until the 20th year).
Whether laches will actually extinguish a claim is a
decision left to the court reviewing the case. I have not seen
many cases crumble based on laches, but it does happen.
On the other hand, just to show how long a maritime
claim can endure, it should be noted that Lloyd's of London
demanded a portion of the proceeds from a recently sal-
vaged wreck for which the insurance company had paid off
on well over 150 years earlier.

The Supreme Court ruled that the Lloyd's. claim was
good, and the salvors were made to share their take with the
company.
Is there a lesson to be learned on time and maritime
law? Well, I usually advise that the sooner you deal with an
incident, the greater your chance is of resolving it. Even
though some cases can last, literally, over 100 years, you
don't want it to be your case.
So, if you are involved in a situation with potential legal
ramifications, it is probably better to prepare and consult,
rather than to wait and sulk.
When it comes to legal problems, time waits for no man
-at least relatively speaking...
Happy New Year.

Proposed Riverwalk development to feature maritime museum

By WILLIAM R. HAWKINS
Waterfront News Writer t'

Plans for a long sought-after Fort Lauderdale maritime
museum have become part of a proposed $6 million New
River development project.
"I think we have come up with a plan that allows every-
one to win," said developer Alan Hooper, who helped form
the New River Trading Post partnership, which has won city
approval for the project.
Hooper, along with his Trading Post partners, boat
rental operator Kelly Drum and restaurateur Tim Petrillo,
are expected to present a contract to the city early this year,
offering a 50-year lease on a one-acre parcel of Riverwalk
land off Southwest Second Street at Southwest Fourth
Avenue, which will be the home of the maritime museum
along with retail and commercial development.
Over a year ago a committee, co-chaired by attorney
Hampton Peterson and former Fort Lauderdale Mayor
Robert Cox, began an informal effort to secure city support
for turning over the old postal facility on Southwest Second
Street to the group to create the museum.
In early 2002, the city asked for official proposals for
the abandoned site and the maritime museum committee
presented one. But city leaders were more interested in com-
mercial development of the site, so the committee began to
look for options.
"We envisioned the museum as a key attraction that
would draw people to the area as well as fulfill the commu-
nity's need to recognize the heritage of the maritime indus-
try," Hooper said.
In November, the Fort Lauderdale City Commission
approved the plan and authorized staff to work out a lease
agreement. Hooper said a proposed 50-year pact will be pre-
sented early in 2003 to the city while architectural plans
move forward on the development.
The timetable calls for actual construction to begin in
2004 with the museum to be completed later that year.
The Marine Industries Association of South Florida has

allocated $25,000 in seed money toward the project. The
developers plan to allow the museum to operate free of any
rental fees for five years so it can become established.
Drum, the grandson of Cox, is taking on a leadership
role in overseeing the museum.
"My family has been involved in the boating business for
more than 50 years and I know we have many items that will
be donated to the museum, and I know that many others in
this community are ready to support the effort," said Drum.
He said in the year ahead the committee will focus on
developing an archive for display." We just have to take it
one step at a time to do the project right."
Currently, no museum chronicling Fort Lauderdale's
maritime history exists, despite the city's "Venice of
America" tourism label. The only maritime museum in
Florida is a small one in Stuart. There are also some spe-

cialty museums like the Mel Fisher Museum in Key West
which displays sunken treasure.
The Fort Lauderdale museum's mission will be to
preserve, record and exhibit the maritime heritage of the
city while also providing an educational facility for adults
and children.
Gypsy Graves, founder of the Graves Museum of
Archaeology and Natural History, is the museum's executive
director. Board members include George Counts, president
of the Marine Historical Society, as vice chairman; Emily
Rushin, former business owner and civic activist, as secre-
tary, and Mary Jane Cockerham, Broward County
Archaeological Society treasurer, as museum treasurer.
Hooper envisions an exhibit space on the museum's
ground level and giant doors that would open to allow large
boats to be brought in for special displays.
The actual building will be in a 1920s-style boat ware-
house, with about 5,000 square feet of space and a dock on
the New River so special historic boats and other craft could
accommodated as added attractions.
Developers also envision linking the site to the annual
Fort Lauderdale boat show, with visitors being shuttled from
Riverwalk to boat show sites.
"There are so many exciting possibilities:' said Hooper,
who said the museum would draw people to the site along
Southwest Fourth Avenue, which will contain retail space on
the lower level and living quarters on the second. Another
seven retail shops, with 7,000 square feet of space on each
of two levels, will front Southwest Second Street.
Plans call for the old 1927-built post office to be demol-
ished as part of the development.
Frank Herhold, executive director of the MIASF, has
said, "it's only fitting that we recognize the heritage of the
marine industry." He said his organization, which represents
800 marine-related businesses, pumps $8.8 billion into the
local economy annually.
"Marine life still plays an important role in the eco-
nomic and recreational aspect of the area." he added.

Yacht design major may enhance Lauderdale's marine image

>7iT marine program is a perfect fit for the area, he said.
"We are strategically located in the heart of the yacht
building business," he said. "Broward County ,alone, sup-
ports 124 manufacturers in 825 marine-related businesses."
The institute is currently associated with the Marine
Industries Association of South Florida, the National
Marine Manufacturers Association and the American
Boat and Yacht Council.
"We are still building the program by seeking intern-
ships, job referrals and adjunct faculty from local marine
businesses," MacDonald said.
Peter Caspari, director of marketing for Power-Vent
Technologies in Pompano Beach, sat on the institute's
research panel. He says the idea for a yacht and marine
design program is very much needed in the industry.
"Especially here in South Florida, where we have such a
diversified market," said Caspari, whose firm does research,
development and manufacturing of marine drive systems,'

He foresees graduates will have excellent job market
opportunities in the region. "And it will enhance our local
marine industry because there will be more qualified per-
sonnel out there," he said.
Martha Lord, who also sat on the institute's research
panel and is director of association services at the MIASF.
said the program can only help but further enhance South
Florida's reputation as a boating center. -
S"It's overdue," Lord said. "We're in the yachting cap-
ital of the world and we haven't had a yachting design-
program. This is a first.
"A lot of the design is happening elsewhere in the
country and in Europe," Lord said. "This program is going
to present an opportunity for local growth in design. It's
exciting to see this type of thing happening here."
David Wallace, a yacht and marine design student at
the institute, said he would like to stay on and work in
South Florida after receiving his degree.
The program will greatly improve his chances of getting
a job in his desired career choice of designing yachts, he said.
"The program is ver- speciahzed," said Wallace. 21,
a Fort Lauderdale resident. "It's all boats. It just teaches
everything you need to know."

What's in a name? That depends on whom you ask

The next town down the line from the creek also used to
be called Jewfish, until 1921 when it was changed to Key
Largo. I don't know why, but the old name seems to have
stuck everywhere else it was mapped in Florida.
Right there in the Keys, we have Jewfish Basin and
Jewfish Channel in the Snipe Keys. Jewfish Bush Banks and
Jewfish Hole wrap around Fiesta Key. On the east shore of
Card Sound, there's a cape called Jew Point, and on the Gulf
Coast, we have a Jewfish Key at Bradenton Beach and
another Jewfish Creek at Pine Island.
It looks like we'd better get ready to rename them all. If
you look up the U.S. Board on Geographic Names, you'll
see that it follows pretty much the same policies as the
Names of Fishes Committee when it comes to naming and

renaming things.
Okay, now for the man Konheim, the gent who peti-
tioned to change the name of Jewfish Creek.
His first name, Arnold, means mighty as an eagle. Yes,
it does. You can look it up. Men named Arnold tend to be
brave. A notable historic example was Saint Arnold, a musi-
cian who played rock and roll in the court of the emperor
Charlemagne when that was very risky. Another was Arnold
of Brescia, an Augustinian monk who rebelled against the
church and was hanged. Since then, most people have been
afraid to name their babies Arnold. It's going to take an
extremely popular soap opera character to change that.
Some daily papers reported the story of Konheim's peti-
tion to the government, but apparently didn't run his name
through the Intemet. If they had, the news stories would
have mentioned that the only Arnold G. Konheim to be
found is a U.S. government guy himself senior policy
analyst in the Office of the Assistant Secretary for
Transportation Policy.
I e-mailed him two questions:
1: Are you the guy who petitioned to change the name
of Jewfish Creek?
2: Are you serious? .
He didn't reply. I tried again later, asking if he has ever
been to Jewfish Creek and what he would like to call it
instead. He still hasn't replied, but he's a busy man who rep-
resents the Secretary of Transportation on numerous intera-
gency committees aviation noise, invasive species and

electromagnetic fields, to name a few.
We already know Prof. Gary Grossman agrees with
Konheim, but does anyone else? Especially where it counts?
"It is not a subject of conversation among Jewish people
around here," said Jim Boruszak, congregation president of
the Keys Jewish Community Center in Tavemier. "Most peo-
ple don't even know the name of the fish has been changed."
The Monroe County Commission, which lacks jurisdic-
tion but may have influence, has voted against changing the
name of the creek. That could change if someone proposes
naming it after a couple of commissioners.
If it's to have the name of a real person, I nominate Billy
Wagner, a great Monroe Countian who's chief of emergency
management in the Keys. If Billy's not eligible, I'm for
choosing a name that looks and sounds as much as possible
like Jewfish while still reflecting natural realities.
Based on my experience fishing. there, I'd name it
Fewfish Creek.
To get involved inthis issue, visit the U.S. Board on
Geographic Names at http://geonames.usgs.gov/bgn.html.
Click on principles, policies and procedures to read the
rules, then page back and click Propose a new name or a
name change, where you can stick up for Jewfish Creek or
nominate another name you like.

BEING STRANDED AT SEA! O

Fuel tanks collect water, sludge, silt, and algae. This
adds up to a scum that can collect on the bottom of your
tank and save itself for a special day., :
The water and sludge that occur in all fuel will quickly
stop a diesel engine, and cause expensive damage
over time.
Our fuel polishing service will prevent major engine
damage by recycling your fuel and clean your tanks at
your dock or marina. .
With our system, r-
removal of fuel is not
necessary; No spills -
