When Plantation Isles residents Bette McDavitt and
Pat Robinson went boating earlier this summer along the
canals behind their homes, it was no pleasure cruise.
The women were on a mission to snap photographs in
their subdivision of cracked and crumbling sea walls, a
condition that leads to erosion of canal banks and
encourages silt build-up.
They gave the pictures to Plantation city officials in
mid July, along with a request to enforce an existing
ordinance that requires property owners to maintain the
structures.
"It's been an ongoing problem," said McDavitt,
president of the South Plantation Homeowners
Association and Yacht Club. "Idon't think [city officials]
knew how bad it was."
Once the ordinance is enforced, the women want the
canals dredged. They say years of silt has been filling up
the waterways in certain areas, lowering the depth and
making it nearly impossible for some folks to use their
vessels.
"I haven't left my dock in two months," said Robinson,
past secretary of the association and the owner of an 18-
foot cabin cruiser. "The canal outside my home is so
shallow at low tide, it's only two feet deep in most places.
The last time we attempted to go out, our propeller
broke."
But repairing the sea walls and dredging the canals
may take a while because deeds state that the canals are
privately owned.

Plantation Building and Zoning Director Manny

"We need to be clear about how to resolve this issue,"


Mac Lain said. "If a homeowner were cited, they could
use the fact that we were trespassing to contest the
city's actions."

alike make up membership

Long ago, the Offshore Power Boat Racing
Association lost its macho male swagger, and that's just
fine with most current members.
"Back in the early days it used to be a big boys club,"
said Harry Schoell, a boat designer from Fort Lauderdale
who joined the group in the early 1960s. "Today, it's
much more easygoing."
Diversifying the membership, bringing races closer
to the shoreline and increasing its fund-raising activities
have been just some of the changes that the group has
undergone since forming in 1963.
The transformation has suited the non-profit
organization, which is now celebrating its 35th
anniversary. It has never been better or stronger, say
supporters.
Known as the "granddaddy of offshore," the Fort
Lauderdale-based OPBRA is the oldest powerboat club
in the nation, and is credited with helping to start similar
groups across the country.
Although it began with nine men, OPBRA's current
membership now has about 230 people who come from
all walks of life. Meetings are held at 7 p.m. on the third
Tuesday of each month at Tugboat Annie's restaurant in
Dania. Annual dues are $45 and includes a monthly
newsletter.
The gatherings attract a combination of both race and
pleasure boat owners.
"We used to be strictly a boat racing club," said Art
Kriner, president. "Now, we're more of a social group.
You don't even have to own a boat to join."
A member for 18 years, Kriner initially got involved
with OPBRA because his son used to race. After his son
left the sport, he continued to remain active in the group.
One reason why the club has lasted so long is its-
location, he said.
"This is the boating capital of the world," said
Kriner, a retired aircraft mechanic and records supervisor
who lives in Hollywood.
But even though its headquarters are in South Florida,
OPBRA manages to draw enthusiasts from all over the
state, who come to participate and watch the club-

sponsored races.
The final event for 1998 is scheduled Oct. 9-10 atthe
Holiday Isles Resort in Islamorada. Cash prizes totaling
$14,000 will be awarded to first, second and third place
winners in nine professional classes.
Registration before Sept. 15 is $300-$400. After
that date, the fees are $350-$450, Kriner said.
There will also be four separate local classes for
amateurs with a $200 entry fee. There is no deadline to
register. No money prizes are given to the local classes.
Competitors vie for trophies only, he said.
In addition to its own events,,the group participates
in the American Power Boat Association offshore series,
Kriner said.
The club became affiliated with the American Power
Boat Association one year after being established. They
were the first to bring offshore racing to the Detroit-
based association, the sanctioning body that hosts a
series of national offshore races throughout the United
States.
Statewide, spectator attendance at the races has been
building, said Debbie Fleischman, OPBRA race
chairperson.
The increase in fans has been mostly due to giving
them a better view of the action, she said.

City seeks to determine who should dredge private canals

After the matter is straightened out, Plantation city
officials plan to hire an outside engineering firm to study
the area and make recommendations, Mac Lain said.
In other municipalities, the question of access by
inspectors is more clear-cut. For example, in Pompano
Beach and Fort Lauderdale, the canals permit public
access.
John Smith, a building official in Fort Lauderdale,
said most homeowners keep up their sea walls without
being told. State law requires them to maintain the
structures, he said.
Problems with broken sea walls don't abound in
Pompano Beach either. "We get complaints once in a
while, but not an abundance," said George Hopper, a city
engineering inspector. "We may get two to three calls a
month."
Despite the lack of complaints, Pompano engineers
do keep an eye on the sea walls by going out once a
month with the city's marine patrol.
"We target different neighborhoods until the entire
city is covered," Hopper said. "Then we start the process
all over again."
Last month, inspectors toured the city's southeast
section. They went down nine canals and handed out
several citations, Hopper said.
McDavitt is confident that Plantation city officials

will take action sooner or later.
"We know they are looking into it," she said. "We
just started addressing this. We know that we can't
expect to have answers within a few weeks."
McDavitt estimates there are at least 20 sea walls in
her 1,000-home neighborhood that badly need repairing.
The association runs from the Florida Turnpike to
University Drive, and from Peters Road to State Road
84, she said.
The subdivision is unique because its canals have
the westernmost ocean access in Broward County. If the
depth decreases any further, the results could have a
direct impact on property values, McDavitt said.
Robinson said it's irritating to pass by the broken sea
walls. "Nothing has been done to make people fix them,"
she said.
But since the city has not enforced its own laws in so
many years, administrators should take some of the
blame for the condition of the canals, McDavitt said.
The city has told the association they will look into
helping homeowners obtain grants. Whatever monies
the grants don't cover, the remaining cost should be split
evenly between property owners and the city, McDavitt
said.
"I'm not asking the city to shoulder everything, but
they should shoulder some of it," she McDavitt, who
contends that the canals have long been used by outside
boaters.
But the city and the Old Plantation Water Control


District each say that the canals belong to the homeowners.
There are four main canals in the association's
boundaries and several smaller finger canals. The water
control district can only lay claim to one of the main
waterways, a canal that runs east and west just north of
Southwest 20th Street. The waterway veers south along
Southwest 59th Avenue and discharges into the New
River, said Pat O'Quinn, district superintendent.
"As far as I've known, they've been private,'.
O'Quinn said. "The homeowners own out into the center
of the canal."
It's the same with hundreds of lakes in Plantation,
which must also be maintained by property owners, he
said.
Plantation Councilman Lee Hillier believes the city
should do something: Officials have an important stake
in maintaining the area because of its ocean access, he
said.
"We need to protect our investment and the tax
base," he said. "Plus, it would improve the lifestyle for
the residents and make the people happy."
Restoration could also add another $10,000 to the
accessed value of each home, he said.
But Hillier doesn't know how officials are going to
find the cash required for the project. Even if the city
obtained grants, they would still have to come up with
matching funds, he said.
"I don't see the money in the budget for the sea walls
or the canals," he said.

shirts. To the
uninitiated,
E.A.A. stands
for Experimental Aircraft Association,
a group devoted to enthusiasts of
homemade aircraft. They have their
major events every year in Oshkosh,
Wis. and in our own Lakeland, Fla.,
where you'll see all the fun aircraft
designs you could ever imagine and the
gizmos which comprise them.
Watching them, I was struck by the
irony that these airplane devotees were
at a maritime event. It's the same way at
boat shows. If you check out the Fort
Lauderdale boat show this fall, you'll
probably find a display of some type of
amphibious aircraft, and it's likely -it
will be the most crowded booth in the
area.
There does seem to be a kindred
spirit between people who float boats
and fly planes. It does make sense if you
think about it, as both flying and boat
handling are technical skills. Serious
practitioners in both endeavors deal in
the arcane art of navigation. Both boating
and flying are procedures designed to
allow humans and their cargo travel
over or through mediums they would
not otherwise be able to travel.
So, it stands to reason that with so
many similarities in skills, spirit, and
purpose, that flying law and floating law
would also parallel each other and be
similar in procedure and execution,
right? Well, yes ... and ... no.

when some innovative cave dweller threw
a log into the river and rowed it to the
other side. Admiralty law and the laws
dealing with vessels are a result of almost
3,000 years of tradition.
It wasn't until World War I that
governments began to take the airplane
seriously. That's when laws and treaties
started being created to deal with the
newfangled conveyance. Interestingly,
Europe took the initiative concerning
aviation law before the United States.
While it might have been originally
possible to merge more maritime concepts
in aviation law, that isn't what happened.
Aviation law became a "hodgepodge" of
treaties and rules some federal and
some local.
So, let's compare some of the
similarities and differences between
maritime and aviation laws. Sometimes
even the similarities aren't so similar.
Both airplanes and vessels now have
a central headquarters for their
documentation. Aircraft documentation
are filed in Oklahoma City. And, thanks
to Sen. Robert. Byrd, vessel
documentation is filed in beautiful Falling
Waters, W. Va. (where there is no water).
But, while all U.S. airplanes must be
documented in the central system, not all
U.S. vessels need to file documentation
with the federal system.
Liens are also handled very
differently. Maritime liens are secret and
follow a vessel virtually forever!Priority.
on maritime liens is based on federal
statute and general maritime law -
which, by the way, is usually "first in,,last
out" the exact opposite of "land law."
Liens on airplanes nust be properly filed
and priority is based on the laws of the
state which would control that lien.

either an airplane or on a ship, the Death

It's not like
Frank Arrigoni
and his buddy
Richard Hoover.
I- were out to bust
a major theft
ring.
It was more
like a kiddie
S ring. The stolen
items were
a small and the
targeted boats
were outboards and johnboats.
Still, most of the crimes occurring off
the finger canals that feed into the larger
Dania Cut-off Canal are generally
committed by adults, who steal large boats
and take them to remote areas where
they're stripped and sold for parts.
But neither Arrigoni or Hoover knew
they were lookingforyoungthieves when
they set out to find the gas tank and paddle
that was missing from the 14-foot Stubby
Duck, which was docked on the finger
canal in back of the home Arrigoni shares
with his wife.
Arrigoni, a general contractor by
trade, noticed the items missing from his
boat after coming home from work one
early August evening.
Two days later, after cruising the
finger canals with Hoover and talking to
neighbors, Arrigoni struck on his first
clue. Two kids on Styrofoam floats pulling
themselves along the sea wall had been
spotted by neighbors.
S Then, as luck would have it, the teens
unexpectedly appeared. Aboard passing
johnboat, of all things.
"They casually waved at us as they
passed by," Arrigoni says of the three
kids he figures to be about 15 years old.
The kids headed down the fingercanal
toward the Dania Cut-off before
disappearing from sight.
Arrigoni and Hoover followed their
path. Suddenly they noticed one. of the

kids in a yard, emptying items out of the
tied-up johnboat. When the two moved
in closer, Arrigoni noticed that the kid
was carrying a paddle emblazoned with
the painted figure of a duck.
"My wife painted that when we
named our boat the Stubby Duck,"
Arrigoni says. "It's like the figure of a
little rubber duck."
Arrigoni also recognized Stubby
Duck's gas tank sitting by the side of the
house. "The kid saw me and he tried to
hide it," he says.
As Arrigoni began to go ballistic at
the thought of catching the thieves red-
handed, neighbors called the Broward
Sheriff's Office. "I was very upset, and I
was hollering pretty good," he says. "The
neighbors were coming out."
While waiting for BSO deputies to
arrive, a few of the neighbors began
discovering items that had been missing
from their own boats.
One resident said to be missing a
Boogie board found the board hidden in
the yard. Another found what he believed
was his lost gas can.
Someone else just happened to be
missing a johnboat. When the police
compared the registration number on the
Teens' boat to the one reported stolen, the
police discovered that lo and behold
- it was the same boat.
"They had put amessy paintjob over
the neighbor's new johnboat to try to
make it look old," Arrigoni says.
While police took statements and
perused the property for more stolen
goods, the boys continued trying to hide
whatever items weren't being claimed
by neighbors, repeating over and over
something to the effect of"I didn't do it,"
as they scampered around the yard
looking for secret spots to hide any
unclaimed loot.
"One of the kids was a real smart
aleck," Arrigoni says. "He never did
anything wrong. He didn't even-know
that anything was stolen."

"The parents come up and didn't care what was
stolen from anybody," Arrigoni says. "They just wanted
to know why their kids were being picked on."
When a BSO deputy informed one parent that the
alleged little thieves were going to be charged with
multiple counts of theft, the parent responded with, "all
the kids in the neighborhood are stealing," Arrigoni says.

"What got me was that they were driving around in
this boat, past the boats they stole, stuff from, waving at
people," Arrigoni says. "I think they were setting
themselves up to do this on a regular basis.
"If my son ever did anything like this," he adds, "I
would be so apologetic to the people and see what I could
do to straighten things out.
"If you're not concerned, how do you expect your
children to be concerned?"

Boating group races to hold charitable events

ocean," said Fleischman, a realtor from Tamarac. "Unless
you had a boat, you couldn't see it."
These days, the events are so close to the coast that
folks standing on shore can see the numbers and names
on the vessels as they whiz by, she said.
Fleischman has been involved with the club for
eight years. Her boyfriend, Rick Turmel is the throttle
man for Stainless Steel, an A-class, 30-foot Phantom
race boat. Turmel owns a rigging business.
Since joining, Fleischman has seen the group's
charity work grow. At each of the races and monthly
meetings, members hold raffles to benefit various non-
profit organizations.
"A lot of us have been fortunate and want to give
something back to the community," she said.
Over the past year, OPBRA has worked with some
20 different charities. Their most recent race in July in
Sarasota raised $415 for the Suncoast Foundation for
Handicapped Children. A few more thousand dollars
were contributed by several winners, who donated their
purses to the foundation, she said.
Proceeds from raffles and donated purses from the
Islamorada race will go to the American Cancer Society
Winn-Dixie Hope Lodge in Miami, Fleischman said.
The group intends to expand its charitable activities
by holding its first holiday Toys for Tots run. Members
will be stopping at docks up and down the Intracoastal
the weekend after Thanksgiving, collecting items for
needy children.
Doing the fund-raisers makes being involved in the
sport all the more worthwhile, Kriner said.


Considered the oldest powerboat organization
in the nation, the Offshore Power Boat Racing
Association is celebrating its 35th anniversary
this year.
"It's very gratifying and you get to meet a lot of nice
people too," he said.
