Regatta eliminates

anchorage area

Anchor your boat anywhere. That's the message
being given to entries competing in this year's
Columbus Day Regatta.
The decision was made after last year's anchorage
spot lay empty. It seemed the buoy-designated area
for regatta participants within Biscayne National
Park in Miami-Dade County was too far from the
following day's starting line.
"In our talks with the park, we all agreed that
having a specified area did network," said Jeff Rubin,
regatta chairman. "They were making a rule that they
couldn't enforce."
So this year, participants have their choice of

same strict enforcement as last
year inside the park
anchorage within the park.
Race organizers have long contended they should
be able to anchor wherever they want because the
event's past rowdy reputation of drinking and littering
wasn't caused by entrants, they say.
Instead they blame the large fleet of spectator
boats, which crowd into the park during the holiday
weekend.
"We're not the problem," Rubin said. "We never
have been."
Still, race committee members realize that park
rangers and other law enforcement agencies must
patrol the waters. They pay an annual permit fee to
offset those and other costs, such as trash clean up.
"This is the busiest weekend of the year for them,"
said Rubin, an attorney from Miami.
The upcoming Columbus Day should be no
exception. The festivities will begin at 6:30 p.m. on Oct.
8, with a free pre-Columbus Day party at the Coconut
Grove Sailing Club.
The race will set sail at 9 a.m. on Oct. 9 from
Quickflash, a channel marker at the north end of
Biscayne Bay,justsouth of the Rickenbacker Causeway.

Entrepreneurs put plans on the table for pier restaurant


Dania Beach to consider private
enterprise or city-run eatery

Dania Beach Commissioners are very close to
making a decision on whether to give a pair of young
entrepreneurs permission to place a restaurant with
public restrooms and an observation tower on the
city's pier.
A vote on the matter is expected sometime this fall,
either in October or November. Plans for the eatery
and tower have been on the table for the past 15
months.
If the project is approved, it will mean a $1 million
investmentby Joseph Stadlen, 24, and Benjamin Wohl,
31. An additional $400,000 in grant monies will be
provided by Dania Beach.
As part of their proposed 20-year lease with the
city; the partners want to build the eatery on a 5,700-
square-foot concrete slab and find a tenant to occupy
the space. Dania Beach commissioners will get to select

If all goes as planned, folks should be dining with
an ocean view by fall, 2000, he said.
Stadlen describes the deal as a "can't miss"'
opportunity for taxpayers. The pair estimate that Dania
Beach will receive anetbenefit of $2.15 million during
the lease's term, he said.
When the 20 years are up, the city can continue
contracting withboth men, who go under the corporate
name of Pier Pointe. Or officials can run the restaurant
themselves, Stadlen said.
But some city commissioners are saying why wait.


The Dania Beach fishing pier: The city is reviewing
whether it should run the eatery itself or put the project
in the hands of private enterprise.



They want to build and manage a restaurant, without
Stadlen and Wohl.
"We can do this ourselves and cut out the middle
man," said Vice Mayor C.K. "Mac". MIElyea, who
wants to see the project completed with city money
within the next three years, before his term of office is
up.
"It doesn't have to be a super duper restaurant. It
can be rustic looking and still be a money maker," he
said.

City debates restaurant for Dania Beach pier


Chamber of Commerce, said the group would welcome
any new business on the pier regardless of who is
operating the venture.
With the exception of Martha's and the Dania
Beach Grill, the immediate area has no other eateries.
The Dania Beach Grill is closest to the pier, but it's a
long walk across the parking lot for folks who want to
grab a bite, she said.
An eatery on the pieris also likely to be the magnet
that will attract more visitors. "It could be an activity
center, a place where people can gather," Davenport
said. "There would be options of providing
entertainment and other events to draw people in."
Stadlen believes the surrounding area can well
support a restaurant on the pier. There are two
condominium towers due to rise in Hollywood's North
Beach community, meaning an increase in population.
"We're not counting on those people, but it is an
added benefit," said Stadlen, a commercial contractor.
He and Wohl, a real estate investor and president
of Dania Beach's Main Street downtown
redevelopment program, were good friends when
they began making plans to become business partners
and develop the pier's pad.
"We saw a notice from the city asking for
proposals," Stadlen said. "We took a walk out there
and thought it was great idea."
Stadlen's relationship with the pier goes way back.


He grew up in Hollywood and would fish off the
structure with his father and older brother.
"I have many great memories," he said.
The original, 870-foot-long pier that Stadlen visited
was closed in 1990 after city officials deemed it to be
unsafe. It was torn down in 1992.
The newly re-built pier was opened some 18
months later. There is only a bait and tackle shop
housed in-a trailer there now and bathrooms also in a
trailer.
Wohl thinks it's nearly impossible for the city to
attemptbuilding the restaurant on its own for $400,000.
"You can't build a place for the size and caliber that
we're talking about for that kind of money," he said.
But the city wants to weigh the cost of doing it in-
house versus a private sector enterprise.
"We're pretty confident that after they analyze
everything, they will come back to us,"Wohl said.
In the past the city ran an eatery on the site that
served mainly burgers and fries.
Wohl and Stadlen have been discussing their plans
with several interested restaurant companies. They
would like to see a eatery that can serve breakfast,
lunch and dinner.
"It would be a home-style family-oriented place
that might turn a little more elegant in the evening," he
said. "The pad is just sitting. there, vacant and raw. It
is a wonderful piece of property. We want to bring it
back to the community."

Guilty. That's the word to sum
up Stanley Cameron's actions after
an evening spent drinking ended
in the fiery death of six people.,
But whether he should spend
the next 75 years in prison for what
was an accident is another issue
altogether.
It took a Broward County jury
nearly 18 hours to hand down the
verdict in mid September. Quite a
while, considering that Cameron's
blood alcohol level was nearly
three times the legal limit. That,
and his Sonic racing boat was going
almost 50 mph in a posted no-wake
zone on the Intracoastal Waterway
that day in late November, 1997.
The dangers behind drinking
and driving is exactly why James
Colonna, John Colonna, Donald
Draper, Roger Wypyszynski and
Joseph Mongelluzzo hired Capt.
Simon Prankerd as a designated
boat operator for the evening. The
businessmen, four of whom were
from out of .town, wanted to let
their hair down and enjoy an
evening on the water without
worrying about drinking too much
and then having to drive home.
Give credit where credit's due.
Cameron's defense, attorney
claimed that the captain of Bill It,
a 31-foot cabin cruiser, made a
wrongful turn into the path of
Cameron's 45-foot Sonic called
Merrymaker. The attorney added
that blood samples were
mishandled and contaminated
before they were tested for alcohol
content.

the jury watched a videotape of
workers pulling half pieces from
the Bill It off the bottom of the
Intracoastal. Cameron's boat
literally sliced clean through the
cabin cruiser. Witnesses
described the collision of the two
boats as sounding like a "sonic
boom."
But here's where things gets
fuzzy. For the most part, there
are no specific laws that address
drinking and boating simply
because, at least in,Florida,
boaters don't need a license to
drive a boat.
Cameron's girlfriend,
Deborah .Keener, was also
drinking that night and clocked
out with a 1.4 blood alcohol level.
She could have woken up the next
morning with an army
steamrolling through her head
and the only thing she would
have been guilty of was a nasty
hangover.
But place her as a passenger
in a car at the scene of a fatal
accident, and she's not only
staring at charges of drinking in
a vehicle, but also manslaughter
as an accomplice to a crime.
As it turned out, Keener
escaped with afew broken bones
and enough memory recall to tell
the court that it was the Bill It
that pulled out in front of the
Merrymaker.
Cameron sustained severe
head injuries and wound up in a
coma for six days after the crash.
He testified that he doesn't

Volvo yacht race committee
should prohibit discrimination
in entry's quest for funds
To the Editor
With the Whitbread yacht race coming back as a
Volvo-sponsored event, I would like to take the time to'
ask for some corporate accountability and responsibil-
ity that was somewhat lacking in the foriner Whitbread
sponsorship.
I'm referring namely to the all-female crewed boat.
This practice is quite inappropriate in today's legal cli-
mate in the United States. At least, an all-female crew
is fine until they start to advertise and solicit funds based
on their intent to exclude males from their crew.
I would venture that if an -entry openly advertised
and asked for funds with the intent of refusing black
crew members, the Volvo race committee would dis-
qualify that entry.

While there are boats with no black crew members,
not one of them is putting that message in their ads.
,Not so in respect to the female crewed boats and their
gender issue fueled ads. And if I remember correctly,
they did not get very far with their anti-male theme.
Although the Volvo race is global and in no way
subject to anti-discrimination laws prevalent in the U.S.,
it would seem that an example should be set on the con-
tent and context of acceptable advertising and slogans
for their entries. I would ask that any yacht entering the
race be held to a certain level of professionalism over-
looked by the former sponsorship.
Discrimination is discrimination no matter how you
package it, or how lofty you claim your purpose to be.

State's vague boating laws blur punishment


remember anything about the crash. Whether
or not it was the. massive head trauma that
caused him to lose any memory of that evening,
one thing is for sure:
Six people will never remember anything
again. And this is after they were smart enough
to hire a designated driver for the evening to
watch out for the proverbial other guy in the
event that they were partying too hard to notice.
If the judge throws the book at Cameron,
he's looking at spending the next 75 years in
prison.
That's a long time. Probably too long when
you consider that he was convicted on 16 of 22
drinking and vehicular manslaughter charges
without any solid boating laws from where a
conviction should spring.
Fact is, this was an accident. Accidents
happen. Sometimes people are killed during


accidents.
And those responsible for maiming or
killing people should be made to pay.
Cameron, a big time developer in both
Florida and Texas, will no doubt pay hard in
other ways too. This criminal guilty verdict
opens the door to a whole new civil court case
that is already in the works by the victim's
families.
And they should probably get every dime
and then some for their losses.
It's just that when they start talking about
how much prison time Cameron should get,
the courts should take into consideration that
the man is no murderer.
At least not on purpose.

Death on the high seas could bring

inadequate legal remedy for non-seamen


federal courts began to fill this gap by applying
state laws in certain cases, often making for very
complicated decisions.
Finally, in 1920 congress enacted the Death
on the High Seas Act, or DOHSA, which was
designed to bring uniformity to wrongful death
actions brought before the courts in admiralty
cases, along with the Jones Act, which deals in
part with the wrongful death of seamen.
DOHSA was designed to kick in as a remedy
for non-seamen at one marine league (about
three miles) beyond any state, territory or
'dependency of the United States. Essentially, in
most cases, it appears that if a death by fault or
accident occurs at sea to a non-seaman outside a
state's territorial limits, the remedy provided
by DOHSA would be the exclusive remedy for
the spouse, parent, child, or dependent relative
of the person who died (even if that death
occurred in an airplane).
Now here's the problem. The remedies
afforded through DOHSA are very narrow. If
you die from another party's actions in the
middle of the ocean, and the courts determine
that DOHSA is the only cause for which your
family has as a remedy, they may be limited to
collecting only pecuniary damages pursuant to
your loss. Crudely put, pecuniary damages are
those losses for which a monetary value can be
calculated.
In other words, such an award could consist

of little more than the estimated economic
support that the deceased would have provided
to a spouse or children had the person lived.
Pecuniary damages would not include any
award for loss of love or companionship being
experienced by the surviving family. It also
wouldn't include any punitive damage awards
designed to punish a faulty party for their
actions.
The basic outcome of this system means that
if a wealthy athlete at the height of his career
was killed on the high seas and his family sued
the responsible party under DOHSA, they would
probably get more for his loss than another
family, suing under the same scheme, whose
lost loved one was an older middle-class street
artist. This is the case even if the older street
artist was a nicer, more beloved person, who
performed many more good deeds than the
athlete.
So, if you're ever feeling down about your
existence, and you're like me and just can't watch
that saccharin movie one more time, think
instead about the Death On The High Seas Act.
You'll realize that Lionel Barrymore's character
was wrong, after all you probably are worth
more alive than dead!
At least under some legal remedy doctrines.

More competitive, less recreational entries now define Columbus race


Participants will travel to the East Featherbed Bank,
near Elliot Key. They will anchor overnight and start
on their return route at 10 a.m. the next day.
Entry fees are $75. A $5 reduction is available to
boaters who show a copy of their United States Sailing
Association membership card. No entries will be ac-
cepted after 7 p.m. on Oct. 2.
Fees also include a trophy presentation at 7 p.m.
Oct. 16 at the Coral Reef Yacht Club in Miami.
The race will have 17 classes, including .a family
division. The category, which was introduced in 1998,
is for boats carrying two adults and an unlimited num-
ber of children ages 12 and younger.
Organizers changed the family rule this year. "Be-
fore, it was only for the couple's children," Rubin.said.
"We've expanded it so that their children can now bring
aboard their young friends."
It is unknown how many people will participate in
the regatta. Last year's race attracted about 235 entries.
Organizers admit that the regatta has shrunk in size,
mostly due to the after-effects of Hurricane Andrew.
The regatta had to be canceled that year in 1992 be-

cause of the storm, the first time in its 45-year history.
"Before Andrew, we used to get between 600 and
700 entries," Rubin said. "After, many people didn't
replace their boats, or they left the area."
Even with the decrease in entries, supporters say it
hasn't diminished the regatta's spirit. If anything, the
race has become more competitive, Rubin said.
"The competitive classes have increased, while the
leisure classes have grown smaller," he said. "At least
50 percent of our entrants are people who race through-
out the year."
Boats in the upcoming regatta and spectator fleets
can expect the same strict enforcement as last year in-
side the park.
Pamla Bennet, a race committee member from Fort
Lauderdale, recalls heavy patrols.
"I saw a lot of tickets being written." Most went to
spectators in powerboats, she said.
Rangers and law enforcement officers from several
agencies will patrol the area over the holiday week-
end, said Monika Mayr, assistant superintendent at
Biscayne National Park.
"This is not the weekend to come with non-work-
ing running lights and expired registrations," she said.

Despite reports of drinking and other bad behavior
at past regattas, the event seems to have become better
controlled, Mayr said. She credits the change to in-
creased law enforcement patrols and more public aware-
ness of safety hazards.
Regatta committee members have worked out an ar-
rangement with the park to pay a set cost for permit
fees this year and in 2000. The fees amount to $6,000 a
year. In 1998, organizers were charged $5,000, Rubin
said.
By law, Biscayne National must charge the regatta
for any additional operating expenses incurred by the
event, he said.
Having a second sponsor, a Spanish lager called
Estrella Galacia, will greatly help toward paying for
the permits. The regatta is also retaining its long-time
sponsor, Merrill-Stevens Drydock in Miami, Rubin said.
Having a two-year permit, instead of going on a
year to year basis, will make things easier for organiz-
ers, Rubin said.
"We can concentrate more on how to continue mak-
ing the regatta safer and more fun," he said.

Green Turtle Cay home
to All Abaco regatta

Turtle sustained severe damage, and it
was uncertain as the Waterfront News
went to press whether the All Abaco
Regatta, highlighted in this article, would
take place as scheduled. Readers are

Settled by British buccaneers who
fled during the American Revolution,
today you'll find descendants from the
many of the original Loyalist families
manning Green Turtle Cay's
commerce and preserving its seafaring
tradition.
Set among the northernmost
Abaco cays, Green Turtle is a 20-
minute ferry ride from Treasure Cay's
pocket-size airport. On the journey
along the Sea of Abaco, visitors gaze.
across translucent waters at the
settlement of New Plymouth, which
shimmers like a mythical village.
Most of Green Turtle's 500
residents live in the old town, where
narrow, white-washed streets are
lined with cottages, shops and
restaurants painted once-vivid, but
now sun-beached colors.
Green Turtle's latest sailing rivalry
is the All Abaco Family Island Regatta,
taking place Oct. 29-31, which pays
homage to vintage Bahamian sailing

sloops. Native wooden-
hulled"workships" travel from all
over the Bahamas to take part in the
cup races.
Overall length of the craft must be
no greater than 28 feet and three
inches, and must be outfitted with--


canvas sails and a single wooden
mast. No vertical transoms. No
bowsprits. No spreaders or
aluminum spars. No winches or
wind/speed instruments.
The boats sail three times around
orange buoys placed at each corner of


a triangular course. To balance the
vessel and maximize speed, as many
as nine crew members perilously
scramble up three "prys"- wooden
planks that jut out four feet on either
starboard or port. Seasoned teamwork
is the key.
Last year's regatta saw the
triumph of the Abaco Rage, in the class
A group, skippered by Hope Town's
Chris Thompson. A 28-foot sloop built
in 1980 on Man-O-War, the Abaco Rage
was the boat to beat in the Out Island
regatta until it retired in 1990.
A couple of years back it was
refurbished by new owners in Hope
Town. Running with the wind and
listing at improbable angles, the Abaco
Rage rallied past Rupert 's Legend to
capture the '98 cup as streams of
Abaconians and visitors from Nassau
and the states lined the docks and
roared their approval.
The upcoming third annual
regatta kicks off with an early evening
skippers meeting and "bash" at the
charming and casually elegant Green
Turtle Club. Tucked on the northern
point of the three-mile long, one mile
wide isle and overlooking the White
Sound, the Green Turtle Club,
established in 1965, is one of the oldest
Out Islands resorts.
A growing number of divers visit
the club to probe the island's
wondrous underwater wilderness and
there's plenty of snorkeling on a coral
reef just 30 feet offshore. Afterwards

from the club's lodge house.
Guests stay in Abaco pine cottages on a hill
behind the lodge house, set off by casaurina palm
trees and splashes of purple, magenta and salmon

of villas are nestled along the harbor's edge.
Seasoned anglers show up at Green Turtle for
its superb bonefishing on the flats of the shallow
lagoons. Outside the reefs, you'll find massive runs
of snapper, grouper and barracuda.
Getting around the island is easy on bicycles or
canopied golf carts. Walking down Parliament
Street you'll discover the Albert Lowe Museum,
which uncovers the village's past through writings
and paintings of another celebrated Lowe, Alton.
Don't miss the Loyalist Sculpture Garden, where
bronze busts of the island's founders and heroes
are showcased.
About two blocks away is Miss Emily's Blue
Bee Bar, a ramshackle bright blue concrete
building that's known far and wide for it's
Goombay Smash, a crippling concoction of four
types of rum with a few fruit juices tossed in.
Run by the founder's daughter, Miss Violet
explains a portion of the proceeds benefit the
church next store. Don't expect her to give you the
recipe, though.
