Waterways not a

dumping ground

Once again thousands of volunteers are expected to don
gloves and sunscreen for an annual waterway cleanup at some
25 sites across Broward County.
The event, now entering its 21 st year, will be held 9 a.m.
to 1 p.m. on March 20. As in the past, organizers are again
hoping to send a strong message that folks can't use the area's
rivers and canals as their personal dumping ground.
"It's amazing what some people will drop in the water,"
said Kitty McGowan, director of association services for the
Marine Industries Association of South Florida, sponsors of the
cleanup.
During previous events; volunteers have always managed
to find a wide array of junk. The hauls have ranged from
standard trash such as Stryofoam cups and glass bottles, to
unusual finds like guns, a bale of marijuana and a hand grenade
that had to detonated by police.
"Last year, workers found a dead body," McGowan said.
"It was a homeless man in his tent by theater's edge in Dania."
They also discovered a safe that had been stolen during a
robbery in Plantation, she said.
There's no telling what volunteers will find this time
around but one thing is for certain: They will probably pluck out
fewer appliances and pieces of furniture.
"Those large items have been drastically reduced,"
McGowan said. "We take that as a good sign that people are
paying attention."
Other items have decreased too. Nearly 3,000 participants
retrieved 75 tons of garbage from more than 300 miles of
waterways at last year's cleanup. In 1997, the numbers were
almost the same.
"We're so happy to see the amount of trash is either less or
staying the same," she said.
Although no one knows exactly why residents and visitors
toss debris in the waterways, the association wants them to
know that their actions are unhealthy for the environment.
"Maybe they don't want to spend the time and monev
taking these things to the dump, or maybe they think the items
are biodegradable and won't harm anything," McGowan said.
But they are wrong. Even something deemed harmless
like tree clippings can raise the oxygen level in the water,
allowing for more fungi and algae to grow, throwing off the
delicate balance of the ecosystem, she said.
Just as dangerous areplastics thatcan cause posea choking
hazard for fish and floating construction materials, which can
do damage to passing boats, McGowan said.
"And the stuff looks ugly too," she said.
Having a cleanup is a good way to highlight these dangers
and get the community involved in beautifying their own
backyard, McGowan said.
Obviously, plenty of people agree. The association is
heartened to see that so many want to help.
"We have people scheduling their vacations just so they
can participate," she said.
Participants can assist either by bringing their own boat or
showing up at one of the land-based sites.
They are advised to bring gloves, sunglasses, hats, drinking
water and sunscreen.

New trash boat to aid in quest for clean waterways

The latest addition to their arsenal is a new trash
boat, which will be dedicated on March 20 during the
.nual waterway cleanup.
I Fort Lauderdale has several sites in the countywide
event, sponsored by the Marine Industries Association
of South Florida. A ceremony to christen the boat will be
held 8:30 a.m. at Esplanade Park, at Southwest Seventh
Avenue and Second Street in Fort Lauderdale.
The waterway cleanup will be'the first day the boat
will officially be put into use. The 9,600-pound steel
twin hull vessel measures 34 feet long and nine feet
wide. '
It has special arms on the, front that skim the water
removing any floating garbage. The items are placed on
a conveyer belt, then placed into a holding bin.
Fort Lauderdale is the only city in Broward to use
such high-tech means. City officials spent $249,000 to
purchase the boat. The price also includes a trash transport
barge and trailer.
Greg Slagle, city sanitation superintendent, said it's
money well spent. "We're the boating capital of the
world," he said. "This is an important investment."
The vessel will be used to clean about 85 percent of
the city's 185 miles of navigable waterways. The only
exceptions will be a few narrow canals, Slagle said.
Having the vessel should greatly increase the amount
of trash picked up.
The way it works now, two men with pool nets man
a 20-foot pontoon boat. They can usually gather about
500 pounds of wet debris in a single day, from palm
fronds to tires. By comparison, the trash boat can hold
2,000 to 3,000 pounds, Slagle said.
The more trash that city workers can remove from
the waters surface, the better. Whatever garbage isn't
taken can sink to the bottom of the waterway. The build
up of debris can kill plants and fish, Slagle said.,


"We're thrilled about the city putting this much
i significance on the'imnportance of a clean waterway,"
said Kitty McGowan; directorof association services for
the Marine Industries Association of South lorida:
But Fort Lauderdale isn't alone in making an effort
to clean the waterways. Many municipalities do have
trash crews. "There's a growing understanding,"
McGowan said. "Cities are stepping forward to spend
time and resources. They realize this is one of our
important assets in South Florida and we have to take
care of it."
Frank Herhold, executive director of the Marine
Industries Association, is hoping cities follow Fort
Lauderdale's lead.
"Other municipalities need to pay close attention to
this investment in clean water by Fort Lauderdale," he
said. "It's time to take cleaning up our waterways more
seriously. The association applauds Fort Lauderdale's
commitment to clean water as signified by this new
high-tech, more efficient vessel."
Herhold recently took about 140 representatives
from marinas around the world to view the vessel. The
representatives were in town for the International
Conference of Marine Industry Associations.

The vessel was bought from Ellicott International in
Baltimore. That city presently has five of the boats,
running seven days a week, Slagle said.
He would like Fort Lauderdale to eventually acquire
several of the boats. "One is not enough, but this is a
good start," he said.

pAfter several
years of not following this sensible
rule, I began sorting through old
pamphlets and sales sheets when I
came across one particular brochure
on an item called an AquaCar (not its-
official name, but it will do for example
purposes).
As the name implies, the AquaCar
was an amphibious vehicle/vessel that
purported to function-as both a boat on
the water and a car on the road. This
particular design seemed to be made
mostly out of fiberglass, had a rather
substantial engine,.and it seemed abit s
wider and longer than your average-
sized vehicle. With a pull of a hafidle,;'
the drivetrain went from turning the.
wheels tQ rotating,the propellers inrthe
rear,(oops,; I mean-the stern!)
Thebrochure onthis AquaCarwas
printed a few years ago and I didn't see
any other recent examples of it at this
year's boat show. Too bad, for
apparently it could be taken home for
just under $100,000.
Of course, the AquaCarwasn't the
first try at a practical amphibious
vehicle. Jules Verne wrote about such
contraptions in his 19th century science.
fiction epics. Just before World War
II, Volkswagen designed a rather
whimsical looking amphibian with the
really cool name of the
Schwimmwagen (literally translated,
the "swimming car.")

Considering that Volkswagen liked
to advertise that their original vehicles
could float, it was actually a pretty
reasonable concept. Probably though, the
most remembered of the recent
amphibious .creations was the Italian-
made Amphicar of the mid 1960s, which
might have lasted longer had it been
made out of a better grade of steel.
The AquaCar, Amphicar and
Schwimmwagen are examples of
personal vehicles that could also be used
as boats. So, the next question is, what
exactly would be. the unique legal
ramifications of owning your own
amphibious car/boat like the AquaCar or
Schwimmwagen?
Well, first, there's the issue of
registration. Such a conveyance would
have to be registered as a car for driving
on the road, and also as a vessel for use on
Florida's waterways. That means your
AquaCar would need both a license plate
on its rear (or is that stern?), as well as
Florida numbers on. both sides of its bow.
This will certainly make for interesting
aesthetics.
Next would b insurance, as- an-
amphibious vehicle would requireboth-
standard auto and vessel policies. Clauses
would be necessaryregarding the unique
nature. of the vehiclelvessel, especially
concerns over liability during launching
and returning to land. Moreover, if an
amphibious vehicle was ever used as a .
commercial taxi, it's interesting to
.wonder whether the driver might be
considered a seaman for purposes of
maintenance and cure, and for Jones Act
liability.
Titling might also be a concern for
such a craft. Would the state title it as a
boat, an automobile, or both? The answer
might make a difference in your ability
to finance the craft, not to mention the
possible joys of dealing with extra
paperwork.

Once the Six knew they were all
winners, they gathered at Nestor's house
for a party of "high fives and screams."
"I saw [Oh] outside walking back
and forth, and I went and asked him
what he was doing," Tierney says. "He
said," 'I' must out here talking to myself.'
And I just said, 'As long as you're not
answering'"
Hawkins' wife quit her job as a
leasing agent in Boca Raton. Oh's wife,
a Coral Springs police dispatcher, is
expecting and gearing up for a maternity
leave of absence, although Oh now
expects his wife to quit for good once
the-baby is born.
The Six itayeach have theireyes on
items that just a few weeks ago seemed
impossible to afford, but none are
quitting their jobs.
"I'm going to buy a new laptop,"
Hawkins says, before offering the details
on a new Dell Experium 366 laptop that
costs $3,500. "That's all I've really
wanted."
Tavares says he and his wife are
planning on using the money to pay off
billsand build a-newpool intithe backyard
of their Coconut Creek.homre.
"We're just .going, tominvest it,"
Vaccaro' says of this plans".

Legal issues make amphibious craft an

unpopular choice for boaters

concerns regarding amphibians the ever present
problem of the maritime lien..As I've discussed before in
previous columns, maritime liens, unlike other liens, are
secret, do not require.filing with any agency, and follow
the vessel forever regardless of whether the vessel is sold
to an uninformed bona fide purchaser or not. In fact,
technically the only time you can be sure you have clear
title to a vessel is when it is purchased at a federal
marshal's sale.
So, let's say at some point you need $10,000 worth
of body/hull work done on your amphibious craft (not
unreasonable if the dam thing actually cost you $100,000).
Could the job be subject to the laws of maritime liens?
Well, since it could be argued that such work would go


towards increasing the seaworthiness of the vehicle/
vessel, the answer is, quite possibly, yes. Which means
that if the bill doesn't get paid, the craft could be arrested
by federal marshals sometime in the future
Considering all these issues, it's no wonder that you
don't see many amphibious cars around. Oh well, I
guess for now it's still cheaper and less of a headache to
have a boat and a car separately rather than trying to
combine the two. On the other hand, if anybody does
happen to find a real Schwimmwagen out there, let me
know!

Tierney's fingers form a tiny figure on top of her
shoulder. "It's as if there's a little Tom Richow angel
sitting on my shoulder," she says.
Oh was promoted to commander of investigations in
October, basically the same job held down by Richow.
"I worked myself into this position where I can
better myself and my career," says Oh, adding that, like
all the others, he has no plans of quitting.


He does plan on using the money topay for graduate
school down the road, and maybe even law school. But
right now, all he wants is for his wife to have a healthy
baby, and his daughter a small bass boat.
"My daughter likes to fish," Oh says. "I told her, one
of these days I'm going to get us a little boat."
One of these days just showed up. And now the boat
doesn't have to be so little.

period and it seems he never lacked for intellectual
stimulation or opportunities for.growth and
adventure.
So many of his boyhood experience could
easily parallel those of the baby boom generation,
so that the author comes alive for us, and for a while
he is our companion aihdneighbor. Without frequent
footnotes, it is sometimes difficult'to judge the
accuracy of his statements but they usually appear
to bear the weight of examination.
But this is not without exception. In one early
passage, he addresses the fate of the revenue cutter
Harriett Lane, a vessel intended to serve as school
ship for the military school he attended on Staten
Island. He states that she was destroyed at Galveston
during the Civil War but in reality she was captured
by a confederate boarding party and later served as
a blockade runner. An interesting highlight is the
fact that the assault'was led by a confederate major
who found his son, a Navy lieutenant, mortally
wounded on deck.
As I proceed through the book, other questions
and insights come to light. He discusses his
involvement with the races between Cambria and
Magic off New York in 1870. This series was
notable because it marked the first defense of what
soon became known as the America's Cup.
He also states that one of Magic's brass signal
cannons is still in the possession of the Biscayne
Bay Yacht Club. A call to the club resulted in
verification that it is in a vault there and gained me
an invitation to see it being used at the annual flag
raising ceremony on New Year's Day.
After cruising happily through the, first three
chapters, it became clear that the nautically
uninitiated must be hopelessly swamped by the
jargon of sailing, navigation, and the many details
of small boats and their rigs. This is extremely

Sailor's tale reveals early life on Florida coast

unfortunate since it robs the novice of so much of
the essence and spirit of many of Munroe's
adventures.
How many readers can readily understand the
significance of an uncontrolled topping lift in high
winds, or form a mental picture of the unfortunate
ship's cook frozen in the jib boom? Many of the
terms are used in an archaic sense so a glossary
composed by one familiar with both the usage of
the 19th and 20th centuries would be a tremendous
help to most readers.
Another grave fault, and one easily mended, is
the lack of maps and charts of any description. Here
again it is only due to the ready availability of my

nautical charts that I was able to follow the
Commodore's adventures on the waters around
Staten Island and Fire Island.
My Bahamas charts let me vicariously.share his
nighttime .sail across the Great Bahama Bank, to
study the change in water depths, appreciate his
passages of Orange Cay, Salt Cay (now known by
its Spanish name Cay Sal), and visualize his
straightforward entry into Key West.
RBased upon these resources, it is clear that
either he was aboard an extremely shoal draft
schooner or the depths on the bankshave changed
significantly in the last 100 years. Based upon
experience, I feel the latter is the case. Still, I
wonder where on earth is Bamboo Key? Is this
another place name that fell victim to real estate
developers and marketers?
There is a-passage, encountered early on, that
sets the tone for the book and for the loss of so much
that was precious and irreplaceable about the Keys
and unspoiled Biscayne Bay. While admitting that
he._has._ccntradictortieelings_aboutthe effects of
"progress" upon our region he holds that this is
undeniable:


"It is of course the atmosphere the flavor -
of these old times which is of greatest significance
in memory, and which is hardest to preserve and
reproduce. The bare facts of my early years on
Biscayne Bay are of small moment to anyone, but
as I look back there is a color- a tone a
resonance a life, in those early days and their
doings which is now unknown.
It is difficult to explain or accept the lack of
even the simplest map of south Florida and Biscayne
Bay to help the uninitiated reader find his way and
this, together with the need for a glossary, is the
only fault of what is otherwise a wonderfully written
tale of early Florida and a life lived on the coast.
