Merchant sees bright spot in Broward's only lighthouse


Nonprofit group may be
formed to repair
structure's damaged lens

Harry Cushing has seen the light, so
to speak. And he hopes others will too.
The Pompano Beach merchant is
spearheading a campaign to help
refurbish the Hillsboro Inlet Lighthouse
in Hillsboro Beach.
Cushing, owner of the Nautical
Treasures store on East Atlantic
Boulevard, is leading the effort to form a
non-profit group that he says will be
responsible for maintaining the structure.
He was moved to take action after

which has jurisdiction overthelighthouse,-
planned to remove the structure's Fresnel
lens.
Instead of repairing the lens at an
estimated cost of about $200,000, the Coast
Guard wants to donate the rare and
valuable piece to the Museum of
Discovery and Science in downtown Fort
Lauderdale, Cushing said.
Cushing can't bare the thought of
losing the lighthouse's crown jewel.


"I understand that the Coast Guard's
role is to save the taxpayers money," he
said. "That's why it's no longer a good
idea to let them manage the lighthouse."
He got the idea to start a non-profit
group after hearing about similar,
successful lighthouse preservation
'societies being formed elsewhere in
Florida and around the United States.
Once up and running, the Hillsboro
Inlet organization wants to lease the land
from the Coast Guard and get the Fresnel
lens back in working order, Cushing said.
The group also wants to turn the
surrounding grounds into a public park
and create a museum. Displays could be
housed inside a caretaker's cottage on the
property, he said.

have the group established by the end of
summer or early fall.
Already, Cushing said hehas received
promises of support from localbusinesses,
politicians and citizens. He is also talking
with the Florida Lighthouse Association.
Cushing believes much of the interest
stems from people's desire to protect South
Florida's past.


"There's so little history we have here
in South Florida," he said. "So much of it
has been torn down, to make way for
newer buildings."
Dave Butler, president of the
Pompano Beach Historical Society, said
Cushing's timing couldn't be better. His
efforts come just as the lighthouse turned
90 years old in March.

The group also wants
to turn the surrounding
grounds into a public
park and create a
museum.

"What a better way to celebrate its
birthday'" said Butler, Who is helping
form the non-profit group and has drawn
up plans to repair the lens'broken turning
mechanism for $75,000, a fraction of the
Coast Guard's estimate.
The 147-foot-tall structure was build
by the Coast Guard in 1907. Its Fresnel
lens can project abeam of light so powerful
that it extends 28 miles beyond the
curvature of the earth, said Butler, an
engineer and architect who owns a marine


technology firm.
"From my understanding, the
Hillsboro Inlet Lighthouse was the second
most powerful lighthouse in the United
States," he said.
By the Coast Guard's account, the
beacon presently used is said to extend 16
miles. "But our people have measured it
at eight to 10," Butler said.
The structure is also a cherished local
landmark that is listed on the National
Register on Historic Places and is the only
lighthouse in Broward County, he said.
Butler has written a 100-page book on
the lighthouse's history, in honor of the
structure's birthday. During his research,
Butler discovered that the lighthouse
became electrified in the 1920s. Prior to
that, keepers had to haul kerosene up to
the lantern room.
When a devastating hurricane hit the
area in 1926, the lighthouse keeper
reported that he was trapped inside the
tower, which was rocking back and forth
due to the high winds, for 32 hours, Butler
writes.
"The keeper saw the roof of the
boathouse blown off and carried across

This is part ofan ongoing series ofarticles
on fun things to do along South Florida's
waterfront.
Jason Cocco is preparing to dangle a
raw piece of squid over large tank where
a nurse shark is anxiously waiting to be
fed.
When mealtime finally arrives, the
shark suddenly lunges toward the water's
surface and emits a loud smacking sound
as its jaws latch on to the fishy treat.
Although the ritual seems scary,
Cocco isn't unnerved. It's just another
day on the job at the Anne Kolb Nature
Center in Hollywood.
The 3,500-gallon aquarium is one of
the most popular features at the year-
and-a-half old exhibit hall, which sits
inside a 1,500-acre coastal mangrove
wetland preserve -that comprises West
Lake Park.
Now folks can get an closer view of
the tank with a new program that offers a
behind-the- scenes look at the saltwater
structure.
The center is hosting "Aquarium:
Behind the Scenes" from 2-3 p.m. every
Saturday and Sunday through September.
The guided tours are free with each paid
admission.
Organizers are offering the program

the area's eco-system, saidJoanne Howes,
a park naturalist.
"People always seem fascinated with
the aquarium," she said. "We thought
they might like to see how we take care of
it."
On the tour, participants willbe taken
to the rear pump room, where the water is
filtered. They will also learn about the
tank's daily maintenance and its
inhabitants.
The aquarium is made of cement and
has acrylic walls. It is divided into three
sections high tide, low tide and
changing tide.
The marine life residing inside are
common to the park, including blue crab,
snook, saltwater catfish and red snapper.
Most are caught in traps and nets set up
near the boat docks, outside the nature
center.
"After a while, the fish are released
back into the wild and replaced with new
ones that we catch by the docks," Cocco
said.
To make the fish comfortable during
their stay, the aquarium must simulate
the same conditions as their natural

In addition to the aquarium, the
nature center has a separate touch tank.
As part of its behind-the-scenes program,
employees will bring out specimens for
the public to examine.
Among the creatures are horseshoe
crabs, chocolate chip starfish, Asian
lobsters, spiny oysters, pencil sea urchins


and a Florida horse conch.
Once the four is over, visitors can
spend time on their own exploring the
facility's interactive and static displays.
All of the exhibits examine the park's
eco-system. Activities include a 10-
minute film on West Lake Park, a touch
screen quiz on mangroves and the food
chain and a lighted map depicting the
areas within West Lake that have fresh,
salt and brackish water.
Other displays let guests hear various
bird sounds and compare sands from
different beaches in North America.

trails, a 68-foot tall observation tower

The 40-minute tours are conducted
aboard 32-foot and 42-foot passenger
vessels.
At the park's recreation area onehalf-
mile west of the nature center, there are
more amenities such as canoe, kayak and
johnboat rentals. There are also picnic
tables and grills, racquetball and tennis
courts, a veterans war memorial, biking
and jogging paths; and an interactive,
children's water playground in the shape
of a colorful pirate ship.
"It's a beautiful place," Howes said.
"I tell everyone to bring their binoculars.
You are surroundedby nature and there's
always something interesting to see."


Up close
The Anne Kolb Nature Center is
located at 751 Sheridan St. in Hollywood.
Exhibit hall hours are 9 a.m. to 5 p.m.
daily. Admission is $3 for adults and
$1.50 for children ages 6 to 12.
A combination environmental boat
tour and exhibit hall entry ticket is $10.50
for adults and $5.25 for kids. Children
ages five and younger can enter the
exhibithall and ride theboat atno charge.
The park's south side recreation area,
at 1200 Sheridan St., is open 8 a.m. to 7:30
p.m. daily. Admission is $1 for adults on
weekends and holidays. Kids younger
than five are free. (There is no gate fee to
enter the nature center tract.)

Life has turned into a real ditch for at
least 10 homeowners in Lighthouse
Point.
A legal one, that is.
You may recall that a few month's
back wrote about the notorious drainage
easement that borders the cities of
Lighthouse Point and Deerfield Beach
and how those
living on the
ditchhave long
complained
about rats,
mosquitos and
erosion eating
up their
backyards with
all the voracity
of Pac Man.

the City of
Deerfield Beach erected a gabion wall on
its side of the ditch, thereby nipping any
erosion problems that would have
affected Deerfield homeowners right in
the bud.
And I wrote about Joe Goldscheck,
the Lighthouse Point resident on
Northeast 54th Court who first
complained to city officials in 1986 that
the ditch was eating his backyard alive.
Lighthouse Point did little more than
write Goldscheck a letter back,
eventually deciding the ditch was
Deerfield's responsibility. More
complaints followed with the city
passing the buck off to the county which
in turn passed that buck on to the state
by claiming the ditch was affecting
environmentally-protected mangroves
surrounding the immediate area.
Now 11 years later, Lighthouse Point
city commissioners have opted not to
spend $6,000 from the newly-proposed
city budget that was originally
earmarked for maintenance on the ditch.
CommissionerThomas Hasis researched
the ditch's ownership by lining up plats
from both Deerfield Beach and


Lighthouse Point and concluded that
the two didn't match. In other words,
the ditch, once again, belongs to no
municipality.
That means that after 11 years of
passing the buck back and forth, the
problem has gone back to the
homeowners. And according to the city,
if they want to put up a wall to make
repairs it is they and the not the city -
who will have to pay for it.
Now those homeowners are taking
legal action against the City of
Lighthouse Point.
"We've given an attorney a retainer,"
says Lighthouse Point resident Lou
Aloise who also lives with a backyard
bumping up to the erosion-happy ditch.
The recipient of that retainer fee is none
other than attorney and State Rep. John
Rayson D-Pompano Beach.
You see, the fact is, the ditch doesn't
belong to those 15 homeowners either.
Their responsibility ends at the property
line of their backyards. It is up to city
commissioners to ensure the problem is
rectified.
Taking care of constituents is a City
Commission's job. But after 11 years of
complaints from homeowners who
also happen to be taxpayers nothing
has changed.
No wonder the city will probably
get sued.
No wonder those 10 homeowners
picked a heavy-hitting attorney with
enough political clout to hammer out a
convention.
I hope those homeowners at least
get a court-ordered wall installed on
their side of the ditch.
As for the time, headaches and small-
town political games they have endured
through the years, I hope the
Goldschecks and the Aloises and the
rest of the homeowners on that ditch,
drive home from court feeling like they
hit the lottery.

Joe is an American Citizen who has
justbought a yacht. Even though he plans
to keep his yacht in the United States, he
has registered the vessel under the flag
of the Zoroastrian Republic of Freedonia
(a country situated somewhere between
the Duchy of Ruratania and the Land of
Oz). Joe has never been to Freedonia, but
believes there are many benefits to having
his yacht
registered
under its flag
(a pretty flag it
is), and that it
will end up
being cheaper
than having
his boat
Documented
in America.
Unfortun-
ately, "cheap"

seems tobe the
operative
word. Since Joe has had the boat, he has
not paid his dockage, or for supplies and
repairs to the vessel. Furthermore, he's
forgotten intermittently to pay his crew
and captain, and he has failed to pay
maintenance and cure for a sick seaman.
Finally, someone files the proper
papers to have the yacht arrested for
failure to pay a maritime lien (it doesn't
matter who, I imagine more than one
party will be joining the case). When the
U.S. marshal comes to arrest the vessel,
Joe is not concerned. He smugly looks at
the marshal and proudly points to the
boat's mast flying the flag of the
Zoroastrian Republic of Freedonia!
The marshal and all the other people
on the dock step back in awe. "Wow!
That sure is a pretty flag!" gasps the
marshal. He then shrugs his shoulders,
places a red sticker on the portwindshield
of Joe's yacht and announces, "this vessel
is under arrest and no one is allowed on
board until it posts bond. Have a nice
day."
"Wait!" cries Joe,"I thought you
couldn't arrest this boat. It's under the
foreign flag of Freedonia."
Apparently, Joe has a


misunderstanding as to what a foreign
flag registration can or cannot do for a
boat owner.
Many claims are made about the
advantages of registering a vessel under
a foreign "flag of convenience," including
cheaper insurance, less exposure to
liability, lower taxes, and greater
flexibility for traveling and picking a crew.
Within context, most of these claims can
be quite valid usually for special
individuals with special needs and
circumstances.
One of the things a foreign
registration can't do is alleviate a vessel's
requirement to satisfy maritime liens; nor
will it grant the vessel immunity from
arrest for those liens.
Another context where a foreign
registration may prove less than helpful
is in matters regarding a crew. Whether
it's for a Jones Act negligence action, a
failure to pay maintenance and cure, or
even a failure to pay wages (contract
disputes), a foreign flag alone will not be
sufficient to keep a vessel owner out of
the U.S. courts. Such factors as the
citizenship of the crewman, where an
incident occurred, the facts surrounding
an incident, where the boat is usually
moored, citizenship of the owner, and
any other elements deemed proper will
be considered by the court.
Here's the lesson. If legal
repercussions occur after an incident
involving a seaman, don't be surprised if
a U.S. court says an action filed by that
seaman in those courts is valid even if
the vessel is of foreign registry.
As to the claimed advantages of
foreign registry ... well, as I mentioned
before, it is very dependent on individual
circumstances. Assuming your main
reason for pursuing foreign registration-
isn't for having a;boat for business and/
or for keeping one-armed bandits (which
the state attorney-general seems to want
off of all Florida registered vessels), then
your reasons will probably be based on
personal finances. If you are serious, you
should first check to see if you and your
selected vessel even fit the profile of a
beneficial foreign flag situation:

Foreign registration should be treated with caution

on the subject. And, don't necessarily just go to those
who specialize in foreign documentation. It's good to
get pros and cons. State your plans for the vessel, where
you plan to keep it and yourbasic financial concerns (no
detail is too small or question too dumb). Get details of
how the documenter will handle the project and then:
*Check with your accountant. See if the numbers
fit. Are you really saving on taxes or will the costs end
up being the same somewhere down the line through
other fees and professional costs? Also, consider if
you're really limiting your liability or protecting other
assets (i.e. do you have lots of other stuff?) After all, if
the boat can still be arrested and your main asset and
exposure to liability is the boat itself, there probably
isn't that much protection.
*Very important! Check with insurance agents and
ship's mortgagebrokers. Get their reaction to anyforeign
registry proposal. Get prices. Figure out if it really pays.
@Also (yes, I had to add it), it doesn't hurt to check
with knowledgeable attorneys. Be prepared to pay
attorneys (attorneys like getting paid!)

*Finally, remember a foreign flag vessel in U.S.
waters is considered a "guest" in the eyes of the
government. At this juncture, customs treat most
"guests" pretty well. But, the proper paperwork is
essential-- another burden another potential cost.
Foreign registration is an intriguing option for some
vessel owners, but it should be treated and reviewed
with the utmost caution and care. Make sure that your
primary benefit isn't a "pretty flag."

The property is also the site where James Hamilton,
Florida's famous barefoot mailman, was last seen alive.
Hamilton used to walk the beaches delivering letters
and packages, from Lake Worth to Miami in the late
1800s. His mailbag, clothing and a bottle of pain killer
were found on the grounds, where the lighthouse would
later be built, Butler said.
"It's believed that he was either swept out to sea or
killed by an alligator," Butler said.
If a museum is created, a display inside will be
dedicated to Hamilton, he said.
Doug Everett, president of Greater Pompano Beach
Chamber of Commerce, thinks thathaving preservation
society maintain the lighthouse is a great idea.
"I've offered my assistance and I'm confident that
the chamber's board of directors will take an official
stand and offer its support too," he said.
Having the grounds opened as a public park will be
a real shot in the arm for the city's tourism, he said.
"When I served as president of a chamber in North
Carolina, the lighthouses along the coast were found to
:e extremely good tourist attractions," Everett said.
"I'm confident that the same will happen here."
Frank Rysavy, chairman of the Hillsboro Inlet
District, said he too is in favor of preservation. Members
have passed a resolution asking the Coast Guard to
abandon its plans to remove the lens. Similar resolutions
have been adopted by Pompano Beach, Fort Lauderdale
and Lauderdale-by-the-Sea, he said.


The Fresnel lens on the Hillsboro Inlet Lighthouse has
not worked since 1992. A temporary marine beacon
has been used to guide boaters.
"The district is very concerned with the safety issues
of removing the lens," he said. "The Hillsboro Inlet
Lighthouse is one of the major navigational aids on
Florida's east coast."

Dick Kirkpatrick, 67, longtime boating magazine
writer and editor, died at his Wilton Manors home on
June 1 after a bout with cancer.
Born and raised in Nebraska, he attended the
University of Nebraska and served in the U.S. Air Force.
He began his writing career as handyman editor
with "Better Homes and Gardens" magazine. Later he
was associated with "Popular Science" and was a
