Seeking to boost a sagging tax base,
Davie town officials believe a 26-acre site
on the south fork of the New River would
be the perfect placefor a proposed marine
commerce center.
But members of the Lauderdale Isles
Civic Improvement Association in
unincorporated Fort Lauderdale, whose
homes overlook the property, disagree.
They say the plans will have a
negative impact on their neighborhood
and the surrounding environment,
including the river's manatee population.
In October theTown Council granted
initial approval rezoning the site from
residential to industrial use. Now,
association members are asking that the
final decision be deferred so that both
sides can come to an agreement on what
would be best for the area.
If town officials decline their request,
the group, which has hired an attorney,
intends to fight. Their first stop will be at
the Broward County Planning Council
meeting onJan. 23, where the town's land
use amendment is scheduled to be


reviewed.
"We need to present our case to the
best of our ability and that requires legal
representation," said Gary Starkweather,
association president. "Our community
is motivated to resolve this matter to
whatever level is needed to protect our
homes."
The group is planning to show a video
that it made of the river and its waterfront
homes.
Members will also voice their
opposition to the plan before the county
commission and the state, Starkweather
said.
The Broward Planning Council, the
county commission and the state are all
required to examine Davie's land use
change. If there are no objections, the
issue will return to the town council for a
final vote this spring, said Davie
administrator Bob Flatley.
Davie officials contend that the land
use change is needed to help the town
revive its tax base. Without more
commercial establishments, an economic
study shows that residents, could face a


large tax increase by the year 2009, when
the town is expected to be built out, Flatley
said.
The site, once part of the defunct
Hacienda Village and now being used as
a storage facility for trailers, is ideal for a
marine-related business, he said.
Reclassifying the land's use should help
attract a developer, he said.
Frank Herhold, executive director of
the Marine Industries Association of South
Florida, agrees that the land is well-placed
for a "high-quality, well-conceived"
marine commerce center such as a sales
center or a corporate headquarters.
"Being on the water, it's logical for
the land to have a marine-based business,"
he said. "Ultimately, the property would
be an extension of the Marina Mile," he
said, referring to the nearby marine
business community.
The Davie site, located at the
intersection of State Road 7and Interstate-
595, was originally zoned for low to
moderate income housing.

Lauderdale neighborhood group protests casino cruises


Residents fear noise,
traffic from proposed
operation

Residents from Fort Lauderdale's Idlewyld section
fear that docking two casino cruise boats near their
homes would be taking a gamble with their
neighborhood.
"It will create too much noise and traffic," said
Anne Hilmer, vice president of the Idlewyld
Improvement Association.
A majority of the city's Planning and Zoning
Board members agreed. Last month, they struck down
an application to operate one of the vessels, the Max I.
Maxamillion Cruises wanted to sail two daily
trips from the docks behind the Radisson Bahia Mar
Resort Hotel, at 801 Seabreeze Blvd. An application
for the 600-passenger, 229-foot-long vessel was rejected
4-2 by the board.
A hearing on the second gambling cruise boat, the
Atlantic Princess, will be held at 6 p.m. on Jan. 15 at Fort
Lauderdale City Hall at 100 N. Andrews Ave.


"It is our hope that this one will also be defeated,"
Hilmer said.
Hilmer was among several dozen homeowners who
showed up in force at a city planning and zoning board
meeting on Dec. 4 to protest plans for the Max I.
"The area's infrastructure couldn't support this type
of vessel," said board member Hugh Chappell. "We felt
that a boat of this size should be in Port Everglades."
Residents believe the same holds true for theAtlantic
Princess, which also holds 600 passengers and is 228 feet
long.
The boat's owners want to dock the vessel behind
R.J.'s Landing Restaurant and the International
Swimming Hall of Fame, in the 500 block of Seabreeze
Blvd.
Although the proposed plans for theAltantic Princess
sound similar to the MaxI, Chappell declined to speculate
on the hearing's outcome.
"We need to take theseissues one at a time," he said.
It is unknown what steps Maxamillion plans to take.
Attorneys representing the firm could not be reached
for comment.
Idlewyld homeowners again intend to voice their
opinions when the city's planning and zoning board


meets to decide about the Atlantic Princess.
They will also continue their letter writing campaign
to city officials, Hilmer said.
Idlewyld residents aren't alone. They are getting
support -ron" civic associations in Harbor Beach, Rio
Vista, Harbor Inlet, Lauderdale Beach Extension and
Coral'Ridge North, she said.
If allowed to operate, the boats would cruise right
past Idlewyld, a two street island which has 110 homes
and sits along the Intracoastal Waterway just off Las
Olas Boulevard, Hilmer said.
"It seems to us to bring in vessels of that size would
not create a positive impact on our neighborhood," she
said.
Nor would it help promote the beach, Hilmer said.
"For people to park and then leave the area to be
entertained out in the ocean seems contrary to the city's
re-development plan, which is to bring people to the
beach to enjoy and use its amenities," she said.
But residents may have not heard the last of the
Maxamillion Cruises. The company can appeal the
planning and zoning board's ruling by going to the Fort
Lauderdale City Commission or filing a lawsuit to
challenge the decision.

Record number of sailors sign up for Key West Race Week

John Smittle and his J/24 sailboat, Class Act, have
been a fixture at the Yachting Key West Race Week since
the event was founded in 1986.
Smittle lives in the Florida Keys and being involved
allows him to help promote the local economy. But
that's not the only reason he attends.
"It's very well organized," said Smittle, a Cudjoe
Key resident who owns the Southernmost Sailing charter
company. "There's nothing amateurish about it
Whatsoever. You have the opportunity to sail against
some of the world's best teams."
Other sailors echo his sentiments. Indeed, organizers
have worked very hard and long to turn Yachting Key
West Race Week into a premiere sailing showcase, and
so far success has not eluded them.
Now entering its 10th year, the competition has
grown into thenumber one winter regatta in the northern
hemisphere, said Keith Taylor, the race's press officer.
The 1997 race will be held Jan. 19- 24. There will be
between seven and eight races each day, all held off the
southern shore of Key West on three separate courses
ranging in length from eight to 15 miles long, Taylor
said.
At least 17 classes will take part. One-design boats
are expected to constitute close to half of the fleet, he
said.
"We're anticipating at least seven one-design classes
and close to 150 one-design boats," he said.

international team racing format featuring IMS Racing,
Mumm 36 and Melges 24 classes, he said.
The race, which is hosted by Yachting Magazine, is
limited to 300 entrants. So far, 262 vessels have been
registered for this year's competition the highest
number in the event's history, Taylor said.
In fact, so many people signed up that organizers
have had to arrange for overflow docking at the old U.S.
Navy base in the Truman Annex, he said.
Around 13 percent of the entries are from outside
America, with 12 countries being represented.
Nationally, the largest number of competitors come
from Michigan, with Florida and Illinois tying for second
place. About 30 of the racers are from Florida, he said.
Bill Dembek, a furniture builder who moved to Fort
Lauderdale last year from Michigan, is looking forward
to seeing his friends from up north.
"For most of the sailors in the Detroit area, Yachting
Key West Race West has always been a big event," he
said. "To the people there, this race is a pretty big deal.
This is the grand prix class of sailing.".

time that he has entered the competition.
He isn't surprised that the event is attracting more
attention from the boating world. It's always wise to
make hotel and dockage reservations at least 12 months
in advance because space is always at a premium, he.
said.
"The level of competition brings in people from all
over the world," he said. "You can get a pretty good idea
of what your boat can do."
JoelAuerbach, a travel wholesaler from North Miami
Beach, is looking forward to seeing how much his vessel
can handle. He purchased the Mumm 36, called No Fear,
six weeks ago.
Last year, Auerbach placed sixth in the PHRF
division withhis PalmerJohnson 36-foot yacht, Intention
II. But the Mumm 36 class will require a bit more skill, he
said.
"This is probably going to be toughest division at
Key West," he said. "They will have some of the top
sailors in the world."

It looks like,a mini tropical paradise
when the water level is up in the drainage
canal behind Joe Goldscheck's
Lighthouse Point home. Mangroves lend
a jungle-like quality to the scene while
birds, raccoons and other wildlife roam
openly in search of nature's delectables.
But when the water drains, trash
lines the dirty bottom. Sometimes
.., mosquitos
swarm in the
heat. Rats
scurry around.
The strong
odor of.
sulphur could
gag the entire
neighborhood.
Not to
mention the
erosion.
Goldscheck
has been
watching the canal eat up his backyard
since he moved there in 1978.
A municipal drainage easement is
the culprit. In most cases the responsible
municipality would fix it. But this
particular canal sits right smack dab on
the border between Lighthouse Point
and Deerfield Beach. And neither city
has clamored to take responsibility for
the canal's upkeep since it was built in
1971.
After Goldscheck complained to the
Lighthouse Point City Commission in
1987, he received a letter from then Mayor

has for years been encouraging Deerfield
to improve the ditch and we believe that
this is a good step forward."
Deerfield Beach responded by
installing a gabion wall but only on
the side located within that city's borders.
The Lighthouse Point side behind
Goldscheck's home remained
untouched.
In 1992, Goldscheck and his
neighbors complained again. This time


Lighthouse Point commissioners asked
Deerfield Beach to erect another wall on
the Lighthouse Point side. But Deerfield
countered by claiming the ditch was a
Broward County problem since the
county was also using it for drainage
and sewage.
After a meeting of neighbors,
representatives from both cities and the
county's Office of Natural Resource
Protection which showed up to discuss
the canal's environmentally-protected
mangroves, it was agreed thatboth cities
should share in the renovation
responsibilities.
Both cities did nothing.
Now, 10 years after the initial
complaints, Goldscheck is back before
the Lighthouse Point City Commission
in a last-ditch effort to squelch the canal's
voracious appetite for his and his
neighbor's properties. During an October
meeting, one resident, a nurse,
complained that the rats and mosquitos
drawn to the canal behind her home
pose a health hazard to the entire
neighborhood.
Lighthouse Point Mayor William
Sullivan and Commissioner Daniel Oates
discovered that the county had deeded
the canal over to Lighthouse Point in
1993 without bothering to tell anybody.
Although such an act of secrecy is
generally regarded as seedy even among
the black .holes of government
bureaucracy, Sullivan accepted the news
with a grain. "If I deeded you the
Brooklyn Bridge," he asked, "would that
make you the owner?"
Still, Goldscheck isn't worried about
Brooklyn or its bridge or Broward
County's double-secret probation policy
of passing thebuck. He's more interested
in the recent, powwow between the
mayor of Lighthouse Point and
Deerfield's City Manager Larry Deetjen.
According to Deetjen, two options
were discussed. Either a wall could be
erected on the Lighthouse Point side or
the canal could be filled in completely.
The options were left in the hands of
Deerfield Beach city engineers, who are

In my family New Year's tradition
dictates that we cook up a large pot of
black eyed peas and hog jowls. It is said
that by eating this along with collard
greens on Jan. 1 will bring prosperity
during the following 12 months. (Yes,
it's a "southern thing!" When you come
from five generations of Floridians, you
just don'tmess
with custom).
Another
great annual
tradition is the
S delivery of a
very special
booklet that
usually arrives
just before the
.f New Year. It
always has a
festive looking
eagle on the front cover accompanied by
the powerful words, Internal Revenue
Service. Certainly, there is no greater time-
honored American tradition than paying
taxes to the federal government.
Taxes are not usually a primary
element in maritime legal cases, but they
are an important consideration to the
boat owner, who is required to pay both
state and federal taxes.
State taxes come in the form of sales
taxes and registration fees.
There's no way around the fact that
when buy a boat, you're probably going
to pay sales tax. If you don't pay taxes to
te'state where you purchased the vessel,
then you'll pay the state tax where the
boat will -be based. Federal
documentation is not an element in this
scenario.
If you are a Florida resident and you
buy a boat here, expect to pay Florida
sales taxes (currently 6 percent). Also,
some counties impose a local surtax on
the first $5,000 of the purchase price; so,


check this out with local authorities.
Florida residents who bring a boat
into the state within six months of
purchase will be required to pay a "use
tax." This means you'll be charged the
difference between the sales tax in the
state where the boat was purchased and
Florida's sales tax. In other words, if the
tax was less where you bought it, you'll
pay the state of Florida the difference.
However, if the taxes were higher in the
state where the boat was bought, Florida
won't charge you. Another caution: if
you buy a boat and pay taxes to another
country, Florida won't credit those costs.
Interestingly, Florida has some
programs which are very kind to non-
residents buying a boat within the state.
If the boat is over five net tons, the buyer
can get a permit which allows him or her
to cruise Florida waters for 90 days. (By
the way, that's 90 consecutive days).
Smaller boats only have 10 days after
purchase to leave. The theory is that large
yacht owners will spend lots of money
while cruising our state during that three
month period. Small boat owners don't
get as good a break.
Also, Florida considers aboat taxable
for registration purposes if:
*The boatenters Florida and remains
for 30 days without any valid title,
documentation, or registration.
*The boat enters, with valid
documentation or registration from
somewhere else, and remains in Florida
for more than 90 consecutive days, or
comes to Florida for more than 183.non-
consecutive days within a 12-month
period. Remember, federal
documentation does not stop a state from
charging a registration fee. States wants
their cut!

Lauderdale Isles agree that such a project wouldn't have
been good for their property values."
But civic association members believe that a rental
complex would have never been built on the land because
of its location adjacent to major highways and the Fort
Lauderdale-Hollywood International Airport.
"That property was zoned residential for a long
time and no developer has ever stepped forward,"
Starkweather said.
The industrial classification proposed for the site
worries homeowners because if a marine-minded
developer doesn't show an interest, the town can put


any number of things there, said Ray Figueroa, who sits
on the civic association's land use change committee.
"It leaves too many doors open," he said.
Ideally, the association would like to see the site
turned into a park. Residents are looking into the option

of creating a special taxing district to purchase the land,

The cost could be very expensive. Homeowners


have heard the town quote figures ranging from $1
million to $3 million, he said.
But Starkweather feels confident that the association
and the town of Davie can reach an agreement.
The most successful development plan would be
one with low impact to the land and to the river, possibly
executive office suites, a marine showroom or wet slips,
Starkweather said.
"We don't envision anything industrial there at all,"
he said. "This property faces dozens of waterfront homes.
In some places the river is only around 60 feet across and
sound travels easily across the water. The people would
be greatly affected by the sights, noise and smell."
