Boat parades hail holiday season

Eight floating events
to take place in
December
By BETH FEINSTEIN-BARTL
Waterfront News Writer
Get out the Christmas tree bulbs and the
life jackets, for it's that time of year again.
All over South Florida decorated vessels
will be floating past cheering crowds in the
upcoming bevy of holiday boat parades.
Welcoming Christmas, Hanukkah and
Kwanzaa via these waterway spectacles has
become a unique, local tradition. Each year
thousands of people line the parade routes
to watch from anchored boats or on land.
The processions come in all.sizes, from
the glitz and glamour of Fort Lauderdale's
Winterfestto the neighborhood charmof the
Boynton-Delray Beach Holiday BoatParade.
This year's schedule will kick off on
Dec. 6 with the annual Bayside Holiday
Celebration Boat Parade in Miami, and ends
on Dec. 21 with the New River Holiday Boat
Parade in Fort Lauderdale.
Although police report that few

problems have plagued the south Florida-
style events, they are again reminding
spectators to be courteous, cooperative,
careful, and to curb their drinking.
But just in case trouble occurs, marine
patrol boats from several law enforcement
agencies will be on hand to maintain control.
As in years past, spectator boats are
strongly advised to arrive early for prime
viewing spots.
For example, the W'interfst parade
requires all vessel traffic to be stopped 30
minutes before starting.time to clear a path
for the participants.
To pre,.entspectator boait frini -lipping
into the parades taking place along the
Intracoastal majrlnr patr:ls ill have fhIed
stations along each route.
SPolice are also warning passengers on
spectator boats not to shine bright lights into
the parade path because the glare makes it
hard for the entry craft captains to steer.
Once the processions are over, boaters
are asked to remain on guard and be patient
due to the traffic jams caused by hundreds of
boats trying to turn around and go home at
the same time.
"It's a wonderful time of the season,"

said Fort Lauderdale Police Marine Patrol
UnitSgt. Tom Ogden. "Myself and my officers
are very happy to see people enjoy
themselves. We just ask that everyone take
special care that night to make ita memorable
evening."
Below is a chronological listing of holiday
boat parades taking place throughout the
month of December.

Bayside Holiday Celebration
Boat Parade
The season kicks off with this small
procession at 7 p.m. on Dec. 6 at Bayside
Marketplace, 401 Biscayne Blvd. in Miami.
Everyone is invited to enter their craft at
no charge. The brief route will start at the
Intercontinental Hotel on Biscayne Bay, next
door to Bayside.
After the procession, Santa Claus will
make an appearance. There will also be live
entertainment and a fireworks display.
This year the parade can only be viewed
from land. But a 150-slip marina is due to be
added to the complex this spring. Spectator

The route will run from Peanut Island
in the Lake Worth Inlet and head north up
the Intracoastal to the Jupiter and Tequesta
area.
Registration deadline is Dec. 2. Entry
fees are $25 for private vessels, $100 for
commercial craft up to 60 feet and $250 for
boats more than 60 feet.
Awards will be presented in several
categories by the event's sponsors, the
Marine IndustriesAssociation of PalmBeach

The event is being sponsoredby Delray
Sunrise Kiwanis Club. Vessels will meet at
the staring point south of Marker 46, just
west of the Boynton Inlet. The route will
then progress south, ending at the C-15
Canal.
About 25 boats participated in the 1995
parade. Organizers are expecting between

35 and 40 vessels this year.
Boats of all sizes are welcome to compete
for cheers and awards. There is no entry fee.
Registration deadline is Dec. 11.
For more information call (561) 278-

The parade will be held at 6:30 p.m. on
Dec. 14 and will be followed by a fireworks
display.
Vessels will leave Peanut Island in the
Lake Worth Inlet and travel south on the
Intracoastal to one mile south of the Southern
Boulevard Bridge in West Palm Beach.
Last year, about 20 vessels participated.
But organizers are hoping to increase that
number to 35.
Registration deadline is Dec. 9. Entry
fees are $25 for private vessels, $100 for
commercial craft up to 60 feet and $250 for
boats more than 60 feet. Awards will be

be the grand marshals for the 25th Annual
Winterfest Celebration's Continental
Airlines Boat Parade, to be held at 6:30 p.m.
on Dec. 14.

Both boaters and spectators will have eight south Florida boat parades to choose
from this holiday season.

This year's theme is By the Lights of the
Silvery Moon. Awards will be distributed to
30 boats in 17 commercial and private
categories.
Entry deadline is Nov. 30. Fees are $25
for private vessels and $250 for non-profit

A mandatory skipper's meeting will be
held at 5:30 p.m. on Dec. 4 atR.J.'s Landing,

Last year, 84 boats participated in the

parade. This year about 95 vessels are
expected to float up the Intracoastal, from
Port Everglades north to Lake Santa Barbara
in Pompano Beach.
Spectator boats are invited to anchor
anywhere along the route, except in front of
the bleachers or marinas. Boaters are advised
to arrive early, since police will halt all water
traffic 30 minutes prior to the procession's
start so that they can clear a path.
On land, there will be reserved seating
at the NationsBank Grandstand Viewing

Decorating your boat with style and safety in mind

By BETH FEINSTEIN-BARTL
Waterfront News Writer
Want to make a big splash in one of the upcoming
holiday boat parades? Or maybe you just want to dazzle
passersby by elaborately decorating the boat you keep
docked behind your home.
Organizers for the annual Winterfest Celebration say
the task of decorating vessels can be fun and filled with
fond memories so long as owners follow some well-tested
guidelines.
Mark Beatty, a production manager for Disney Cruise
Lines, advises against waiting until the last minute to
prepare for the parade.
"I remember several years ago when there was some
nasty weather and it limited our access to the boat," said
Beatty, who formerly worked for Disney's event
productions department where he oversaw the decorating
of several yachts for Winterfest.
Beatty recommends that designs be kept simple.
Cluttered vessels, especially when it comes to small
boats, don't look attractive to folks watching from the
shore, he said.
"Rather than run lights all over the boat, concentrate
on one area such as the bow," he said.
Other advice:
Determine how much power your vessel is capable of
handling and be careful not to overload the circuits.
*Make signage, props and logos as bold as possible so
that people can see it from shore.
*To save time, pre-made lighted holiday sculptures

State seeks to educate residents on Intracoastal's impact

Monthly boat tours
offer a quick history
lesson
By BETH FEINSTEIN-BARTL
Waterfront News Writer
Although the Intracoastal Waterway
is one of the most used navigable channels
in South Florida, few people are aware of
its importance or history.
The Broward County Department of
Natural Resource Protection is hoping to
change all that by hosting a series of free
tours and lectures.
"By informing the public about the
Intracoastal, it will allow them to make
decisions on how they want their tax
dollars used to protect this valuable
resource," said Jeff Halsey, a natural
resource specialist with the DNRP.
The project is being funded by a
$46,288 grant from the Florida Inland
Navigation District and $20,976 in
matching monies from the Department
of Natural Resource Protection, Halsey
said.

In addition to the tours and lectures,
the DNRP also plans to produce four
videos and publish a 100-page book on
the waterway within the upcoming year,
he said.
The DNRP's education campaign
kicked off in October with a historical
expedition that centers around Deerfield
Island. The program is scheduled to be
held once a month through March, except
during December.
Deerfield Island, a 56-acre county-
owned park, was created as aby-product
of the Intracoastal's dredging.
Guides from the Broward Parks and
Recreation Division will take participants
on a one hour boat tour around the island,
then spend another hour on land walking
the park's trails.
Already, the excursions have proven
very popular. Tours for January and
February are booked, Halsey said.
"It tells us that is an interest out there
and we are filling a need," he said.
William G. Crawford Jr., a local
historian and Fort Lauderdale attorney,
said the DNRP's campaign will do a lot to
increase the public's knowledge about

Speak Easy

Fighting impulse at the boat parade

By JEFFREY g. HARRELL
Waterfront News Columnist
Don't do it.
You and your friends have been
hanging out in your boat for a few hours
in a notch off the Intracoastal, ringing in
the Christmas season with a party as the
Winterfest Boat Parade rolls by.
Suddenly that little devil appears on
your shoulder uttering those two little
magic words.
"Do it."
"Yeah,"
you say
between swigs
of that seventh
or ninth brew.
S. "A splendid
i d e a
Everybody
loves a parade,
and this one is

Missing one
/ boat."
You seek
reassurance from the rest of your party,
who by now is enthralled with the
floating light show that defines the
annual boat parade. "Go ahead," goads
the midget Satan. "There's a boat parade
out there just waiting for you to crash.
Do it. Do it now."
Then you take the wheel. The
partyers look at you, then at each other
with astonishment as you crank up the
ol' twin engines and let 'er rip right out
into the middle of the Intracoastal.
And just like that, you're in the
parade. You're now part of the light
show. Your eyes are like spotlights
gazing at the homes along the
Intracoastal that are lit up like no others
in the world. You look up the Intracoastal,
then behind you at the endless trail of
floating lights thia are the fleet of boats
stretching from the basin in Port
Everglades all the way up to the parade's
turnabout at Lake Santa Barbara in
Pompano Beach.
Cances are good that you don't see
Sgt. Tom Ogden of the Fort Lauderdale
Police Marine Patrol.
And chances are even better that he
sees you.

"I will be in the command post at the
Guest Quarters Suite right by Sunrise
Boulevard," Ogden says as he prepares
for this year's Winterfest Boat Parade
slated for Saturday, Dec. 14 at 6:30 p.m.
"All the agencies are there. Winterfest
Committee members. Volunteers. The
Coast Guard. If any problems arise, we
can respond because we're all right
there."
When .one of the eight patrolling
police boats pull up next to yours with
flashing lights, badges and enough
authority to haul your party boat and
all-- tojail, you're amazed that anybody
would know that you belong back in
your cozy nook drinking and observing
instead of floating down the Intracoastal
in the biggest event Fort Lauderdale has
to offer all year.
But don'tbe. The city's police marine
patrol has seen this flick before, 25 times
to be exact. When it comes to crashing
boat parades, this marine patrol knows
where you are and what you might be
up to before any demons can instigate
you into stupidity.
"You're always a little bit
apprehensive because you always want
to keep the parade moving," says Ogden,
who has policed the past three boat
parades.
"My main concern is that the
channels stay clear, there's no traffic
cutting into the parade, and to make
sure the public doesn't shine a light in
the eyes of a boat captain in the parade.
Nor do I want the public to indulge in
drunken behavior. We don't have a lot
of incidents. When people come to see
the parade, they'repretty well behaved."
Ogden recommends that boaters
who want to watch the parade from the
water arrive "around 4 p.m." in order to
find a good spot to set their anchors. The
early time is especially recommended
for boating groups who want to tie up
together.
The marine patrol sergeant also says
that us locals should consider ourselves
fortunate for living in one of the most
magnificently-decorated holiday areas

By MARK ERCOLIN
Waterfront News Columnist
During this holiday season, I
thoughtI'd take the opportunity to reflect
on one of the important lessons of the
first Christmas when Joseph and a very
pregnant Mary longingly sought refuge
for the birth of their child. The message:
it's always hard to find a good place to
stay!
B o a t
dockage is no
exception.
Unlike Mary
and Joseph, a
m prospective
tenant will
probably not
be watched
over by
shepherds,
wise men, or a
multitude of
angels. In fact,
if you are looking for clear legal
guidelines to follow (this goes for both
dock owners as well as renters), you may
have better luck seeking solace from those
"multitude of angels."
First, let's look at the problems of
the dock renter (assuming the boat was
fortunate enough to find "room at the
inn"). Many renters, especially
"liveaboards," believe they are afforded
the same legal rights as apartment
dwellers in a traditional "landlord/
tenant" situation. This is not true. It must
always be remembered that in a maritime
environment, it isn't the person who is
the tenant it's the boat! Boats are not
granted the same rights as people even if
People choose to live on them.
Forexample, if yourboat isn't docked
at a regular marina, odds are you won't
have a written contract with the owner.
This commonly happens when you rent
from a private individual offering dock
space behind a house or an apartment
building. Without an express contract to
the contrary, the dock owner may not be
considered liable for any loss or harm
coming to the boat that isn't the result of

the structural integrity of the dock.
The theory is that all you paid for was
a slip, and all other precautions are your
responsibility. In other words, if your
boat gets stolen or vandalized from such
a dock, you may be on your own. Also,
without a contract, it is well within the
dock owner's prerogative to raise your
rates or ask you to leave when next
month's rent comes due.
In the obverse, a dock owner may
actually offer a contract to the boat owner
to protect his own rights and prevent
future misunderstandings arising from
liabilities, responsibilities and the
enforcement of liens. These documents
are usually presented by marinas and
savvy dock owners who invested (and,
wisely, I might add) in a legal professional.
Such contracts are usually enforceable in
their entirety and should be read carefully
by the boat owner.
Dock owners have their problems as
well. Under the old common law, virtually
anyone with waterfront could slap a dock
onto their property and rent it out. Now,
modern environmental concerns and
zoning restrictions makes this more
difficult. Fines for even minor
environmental violations can be
prohibitive when enforced to the
maximum extent of the law. (In fact,
legend says, if any foreign object falls in
the water,, you're supposed to
immediately handcuff yourself, call the
authorities, and start signing blank checks
until they get there).
There is also the problem of rent
collection. While it is true that the dock
owner can place a maritime lien on a
delinquent vessel, enforcement through
the courts is time consuming and
expensive. Unless the lien is in the "five
figure," range or the boat has been
abandoned and is of some real value,
enforcing the maritime lien can be a "zero
to minus" sum gain. Unfortunately, even
with the costs, enforcement of the
maritime lien (i.e. arresting the boat and
selling it at a Federal Marshal's auction)
can sometintesbe the most legally efficient

Charter boat companies also cater to the needs of 'plain folks'

To the Editor:
In response to Mr. Harrell's commentary in the
October issue, "Sweet 16 with Big Boat Dreams," please
be aware that lots of "plain folks" ride up and down the
Intracoastal Waterway on big boats whose names are
not Kennedy. These people charter yachts for very
special occasions and most people have saved their
money for a long time in order to make this event a
memorable affair. The average party on a charter yacht
rivals most first class hotels both in cost and service.
I do not know who Mr. Harrell called in reference to
his party. I took the time today to call the major charter
yacht companies and found all of them to be most

helpful and kind.
In defense of all "boat" companies, there are certain
charges beyond their control that are passed onto the
client; i.e. dock fees are contracted by the marina facilities.
Our company's dock fees typically run $200 to $300 on
average. These are not random charges, but charges
imposed upon us by the docking facilities. In addition,
certified vessels that are permitted to serve liquor have
high overhead fees including licenses and liability
insurance which can cost the company up to $50,000 per
annum. A security deposit can be a common charge but
all boat companies will refund the monies back to the

client within 48 hours after the event if no damage
beyond reasonable wear has occurred.
We create a service, a way to celebrate once-in-a-
lifetime events such as a wedding, anniversary, special
birthday, or corporate milestone. Mr. Harrell's comments
on a regulated, professional industry is uncalled-for
and does nothing except create a bad name for a
hardworking and people-oriented service business.

Misunderstandings can arise when private docks are leased out

DOCK FROM PREVIOUS PAGE
way of removing an unwanted boat, especially if there
aren't any written contracts.
These problems, combined with normal concerns
such as basic maintenance and liability, makes renting
out one's dock less inviting than it was even ten years
ago. This means there are fewer dock spaces available to
boat owners, and those that exist will rent at a premium.

As you can see, it's probably a good thing that Mary
and Joseph weren't traveling by boat. Liability and
environmental concerns alone would've kept the
shepherds off the dock.
So, in this season of good will, can a boat owner find
a good, inexpensive facility to moor his vessel? Or, can
a dock owner find a vessel-tenant that will pay its bills
promptly and not dump oil into the water? Two thousand

years ago, a wise man said it best, "Follow That Star!"
Happy Holidays!

Hallandale seeks to be reimbursed for derelict vessels

By BETH FEINSTEIN-BARTL
Waterfront News Writer
A law prohibiting people from abandoning their boats
in Hallandale's waterways was recently passed by city
commissioners.
The ordinance a first for Hallandale will force
derelict boat owners to reimburse the city for towing and
storing their vessels. They must also pay for cleaning up any
fuel spills.
In addition, the city can issue fines and sell the boats if the
owners can't be found.
The law was passed in October because the city has had
too many problems with derelict vessels.
"These boats are not only an eyesore, they create a

navigation and environmental hazard," said City Marine
Patrol Officer Tony Lilly. "We get a lot of complaints from
homeowners."
At least three boats were abandoned in the waterways
over the past year, he said. Two of the vessels were left in
canals. The other, a 40-foot boat, was abandoned in the
Intracoastal for more than a month.
Police had to track down the man who abandoned the
vessel in the Intracoastal. It was discovered that he was living
in California and had left the boat behind a friend's home,
Lilly said.
Before the owner was found, 500 gallons of gas had tobe
removed from the boat and the tanks were sealed to avoid
future leaks. A fuel spill also had to be cleaned up, Lilly said.

Hallandale Police Chief Lawrence Faragher said having
the new law isgoing make enforcement much easier,
In the past, the city had to rely on state statutes and the
court system to get the boats removed, he said.
"It was a more lengthy procedure," he said. "Now, with
our own law on the books, we can start the process
immediately."
But when abandoned craft is found in the future, the city
doesn't intend to take a heavy-handed approach, he said.
"We'll be using our own discretion," Faragher said.
"We'll investigate first. We want to find out what the problem
is before taking action. If it's an owner who left his boat
because it is in need of repair and he intends on returning, we
can work something out."

Intracoastal touted as most important waterway in state

TOURS FROM P. 5
the DNRP's lecture series. "But we have a rich past that
is more than 100 years old and the Intracoastal played a
significant role."
The Atlantic Intracoastal Waterway its official
name spans 1,391 miles, from Trenton, N.J. to Miami,
FL. Statewide, its length is 370 miles from Fernandina
Beach to NMiami, he said.
Construction on the passage began in the late 1800s
and ended around 1912. In the beginning, the channel
was privately owned by the Florida Coast-Line Canal
and Transportation Company. All boaters were charged
a toll, said Crawford, a trustee with the Fort Lauderdale
Historical Society and vice chair of the Broward County
Historical Commission.
The Intracoastal was purchased by the state in 1929
for $725,000. Today, the waterway is owned by the
Florida Inland Navigation District, he said.
Since it was built, the Intracoastal has been
responsible for raising property values on surrounding
homes and businesses, has served as a gateway for
hauling goods and is a prime recreational playground

PARADE FROM P. 6
on the planet. "That's my start for the Christmas season,"
Ogden says. "Up north, it was too cold to get out and
decorate like they do down here. All along the
Intracoastal is real impressive during Christmas time."
As for that little devil whose only mission in life is
to incite you into an act of moronic proportions, take this
advice in the name of local tradition, common courtesy
and the Christmas spirit.
Don't do it.

Already, the excursions have
proven very popular. Tours for
January and February are booked

for all types of watercraft users, Crawford said.
"It's economic impact on South Florida continues to
be tremendous," he said.
All totaled, the Intracoastal provides a $240 billion
tax base for the 12 counties that line Florida's east coast,
said David Roach, assistant executive director for the
Florida Inland Navigation District.
"It's probably one of the most important waterways
in the state," Roach said.
Having the DNRP educate people with lectures,
tours and other materials will hopefully give them an
overall appreciation for the Intracoastal, Roach said.
That means the waterway is more likely to be
preserved for future generations, he said.

Delray Beach: convenient for boaters, history buffs

By LINDA REEVES
Special to the Waterfront News
Not far from the hustle and bustle of
busier places, Delray Beach has retained an
Old Florida air.
A tour of the city reveals clapboard
houses painted in vivid sherbetcolors. White
picket fences draped with bougainvillea. A
charming downtown lined with red brick
sidewalks, coconut palms and wooden
benches located just a few steps from a
beautifulstretch ofbeach and the Intracoastal
Waterway.
An unsuspecting visitor might never
guess that he's still in south Florida.
The lovely little ocean city of 49,000 has
an "All American City" designation from
President Bill Clinton, the result of a $1.7
million renovation project performed by civic
and private groups. Each year the honor is
given to 10 cities in the U.S. that show the
greatest effort in improving the community.
Since Delray is only about30 milesnorth
of Fort Lauderdale, it's an easy day trip for
boaters. Free dockage is availableat the city's
Veterans Park, located on the west bank of
the Intracoastal, just north of the Atlantic
Avenue drawbridge.
Park facilities include water fountains,
restrooms, picnic benches, barbecue grills
and a kids playground. A short walk east
will take you to Delray's two-mile stretch of
beach, voted the "best beach in Palm Beach
County" by South Florida Parenting
magazine and the "best swimming beach in
the southeast" by Travel Holiday magazine.
Lifeguards are on duty throughout the week
from 9 a.m. to 5 p.m.
Once you've checked out the beach,
stroll Atlantic Avenue. This is where you'll
find dozens of art galleries, a reminder of the
city's past when Delray was a hub for writers
and artists in the 1930s.
Visitors will find, everything from
contemporary paintings and sculpture to
pre-Colombian reproductions to native
American and western art. There's also
what's known as "gallery strolls" when

shoppers have the chance to meet and chat
with artists.
There's no shortage of dining spots
which take the form of sandwich shops,
sidewalk cafes, coffee shops and elegant
restaurants specializing in German, Italian,
French and Russian cuisine. Even American
favorites such as hamburgers and fries can
be found.
In some restaurants you'll find
impressive scenery. For example, the newly
opened Blue Anchor British Pub, originally
built in 1877, once stood on a corner in
London's historic Chancery Lane. A favorite
hangout of Winston Churchill and a frequent
spot for London's famous, the place was
demolished to make way for a more modern
tavern. Piece by piece, the building was
shipped across the ocean to Delray Beach.
Doc's All American, located in a
renovated 1950s dairy barn, is anotherchoice.
If it's barbecue you crave, try Elwood's, a
converted 1950s gas station. Damiano's an
elegant continental restaurant, is housed in a
charming 1920s cottage built by Jack
Saunders, Delray's third mayor. The list of
places to eat could go on and on.
If you're a history or architecture buff,
you might enjoy a taking your own tour of
the city's restored old buildings. The three
buildings that comprise the Old School
Square Block, which is located on the west
end of downtown at the intersection of
Swinton and Atlantic avenues, are on the
National Register of Historic Places and was
the focus of the city's rejuvenation project. It
is the site of Delray's first public school build
in 1913.
The three-building complex has been
converted into a cultural resource center that
stages art exhibits, festivals, films and plays.
The restored school building is home to the
Cornell Museum and the Delray Beach
Historical Society's archive room.
Throughout the year the museum gives
visitors a peek into the area's past with an
array of interesting exhibits.
Camera buffs will probably opt to check

Atlantic Avenue in Delray Beach: art galleries and restaurants domininate this
main thoroughfare.

out the Palm Beach Photographic Museum,
Delray's newest museum with its traditional
to state-of-the-art exhibits. It is located at 55
NE 2nd Ave., a few blocks east of Old School
Square.
The Colony, Delray's oldest hotel, is one
stop you won't want to miss. The lobby of
the 1926 hotel is original, complete with
wood-burning fireplaces, white wicker
