Private sailing
group wants the
city to lease them
the land

Fort Lauderdale might be getting
more than just a new drawbridge when
construction gets underway along the 17th
Street Causeway.
Plans may also be in the works to
create a marina on the eastern side of the
causeway, below the completed structure.
If approved by the city and the Florida
Department of Transportation, the marina
will have 22 slips and an open-sided,
roofed pavilion.
The facility, initially proposed by
officers of the recreational Gulfstream
Sailing Club, will offer amenities open to


the public with one hitch. The private
organization wants to lease the land and
use it as a permanent headquarters, said
Bill Bigoney, a past club commodore.
Club representatives first approached
the DOT last year at a bridge design
workshop. They were told that DOTcould
lease. the property to the city, which in
turn could sign an agreement with the'
club, Bigoney said.
Gulfstream officers addressed Fort
Lauderdale commissioners in May and
have been shopping their proposal around
to various city boards. The marina has
already gained approval from the beach
and marine advisory boards, Bigoney said.
Having the marina would not only be
a boon to Gulfstream. Itwould also supply
a boost to Fort Lauderdale's image, said
Jeff Lichterman, club commodore.
"All of the port cities have sailing
facilities," he said. "This facility will help
our town join that mainstream. Fort
Lauderdale has a sailboat as part of the
city's logo and it is known as the yachting


capital of the world. Something like this is
long overdue."
Club members were scheduled to
meet in June with the city's park and
recreation board. After that, city
commissioners will most likely review
the opinions of the boards and vote
whether to' give their approval as well,
Bigoney said.
A decision had better be reached soon.
Plans forthe bridge are due to be finalized
in September, said Rich Pereira, DOT
project manager for the 17th Street
Causeway Bridge.
Work on the 2,014-foot-long
drawbridge is scheduled to begin in July,
1997 and finished by the end of the year
2000, Pereira said.
During construction, the existing
bridge will be used to maintain vehicle
and boating traffic. After the new structure
is open, the old bridge will be dismantled
and parts of it will be used to create an
artificial reef, he said.

The 1.2 acres of water that the club wants to use for
dock space is presently not deep enough for vessels.
DOT has tentative plans to-fill the site with sand and put
in a bulkhead that will allow access for construction
barges, Pereira said.
Once the building process is finished, DOT could re-
dredge the area to a depth that is boater-friendly, he
said.

If city commissioners vote against the marina, the
eastern end of the causeway will be turned into a parking
lot, he said.
Similar plans for parking and a water taxi landing
have already been earmarked for the west side of the.
bridge, Pereira said.


Bernard Gartner, a past Gulfstream commodore,
hopes that the marina plans go through. The cub has
been floating around the city since it was founded in
1955.
The group, which totals around 300 members, has
never had a place of its own. Over the years they have
rented space at hotels, lodges and other venues, Gartner
said.
In the last 18 months, the organization has been
located at the Lauderdale Isles Yacht and Tennis Club in
the Riverland section of Fort Lauderdale, he said.
Having a permanent clubhouse would give the
organization a site for its meetings, classes and post-
race parties, he said.
The club hosts about 45 sailing competitions a year.
Normally after a race, boaters return to their individual
dock slips and then meet at a pre-arranged destination
for the celebration, Gartner said.
"It really puts a crimp in the momentum," he said.
"It's not convenient."


The current 17th Street Causeway Bridge is scheduled
to be replaced with a new drawbridge by the end of the
year 2000.

Pressure mounts on Lauderdale to clean up liveaboard area

It's a debate that has been raging in the city for
several years: Exactly what is polluting the canals lining
Fort Lauderdale's Las Olas area?
Many waterfront homeowners point the finger at
liveaboard boaters, who theyclaim are illegally dumping
raw sewage into the canals.
Boaters have long complained that they are being
unfairly targeted. City sewers, animal feces, storm water
runoff and deteriorating laterals underneath, the
waterfront homes are also at fault, they say.
Either way, state anl county officials want the
problem cleaned up.
Now, the pressure is mounting for city
commissioners to take a stand. And a solution to the-
clean-up may come before the end of summer, when
commissioners are due to vote on an ordinance that
would require all dock landlords to supply liveaboards
with permanent pump-out facilities.


On June 4 during a special workshop on pollution
in the isles, commissioners instructed City Manager
George Hanbury to write up the proposed law. The
meeting attracted a standing room only crowd.
No date has been set for the ordinance to be
presented to the commission, but a rough draft is
expected to be unveiled sometime in July.

action, the county may enact its
own solution ...

Steve Somerville, director of the Broward
Department of Environmental Resource Protection, said
tests taken by the agency continue to show high bacteria
levels in the isles.
The agency considers the amount to be in violation
of state standards. They are encouraging the city to
install permanent pump-out facilities and connect the
hook-ups to its sewage system, Somerville said.
If the commission doesn't take action, the county
may enact its own solution, Somerville said.
A similar statement was echoed at the meeting by
Melissa Meeker, who read a letter from herboss Carlos


Rivero-deAguilar, director of the southeast district
management for the Florida Department of
Environmental Protection.
"Despite efforts to curtail the water quality problems
in the Las Olas isles, violations continue to exist," Rivero-
deAguilar wrote in his prepared statement. "The
department has been patient and allowed the city six
months to try and resolve these issues."
The DEP is also favoring pump-out facilities and
has offered to help commissioners in finding funding to
cover the expense, he said.
"If the city leadership chooses not to take advantage
of this historical opportunity to resolve a long-standing
problem, it may force local, state and federal regulatory
agencies to pursue more drastic solutions," Rivero-
deAguilar said.
Requiring the hook-ups may be the only way-the
city can control the dumping of waste by boaters,
Hanbury said.
"The federal government has always said that we
could not regulate the boaters themselves," he said.
"But, according to the U.S. Coast Guard, we can go
through the property owners."
About 600 slips exist in Hendricks Isle and Isle of
Venice. The cost for hook-ups is being estimated at

Liveaboards may be required to hook up to city sewer system

The city will consider paying half of those fees by
offering grants to landlords, he said.
But passage of the ordinance is expected to prove
difficult.
"We have a real struggle ahead of us," said Vice
Mayor Jack Latona. "To what degree can we compel
landlords to require boaters to use the hook-ups?"
The city also needs to resolve cost factors and create
a pre-approved permit process, he said.
Latona made his statementsafter hearing testimony
from Helene McRoberts, a landlord from Hendricks
Isle. McRoberts told commissioners she had to pay
several hundred dollars for engineer reports when she
wanted to make some improvements to one of her
properties.
"I believe that the hook-ups are inevitable,"
McRoberts said. "But I want some guidelines. Give us
some direction."
Not everyone was ready to accept the possibility of
permanent pump-out facilities.
Mayor JimNaugle, along with city marine advisory
board chairman Sonny Irons, wants the ordinance to be
more open-ended. Both suggested that exceptions be
made for boaters with high-tech, on-board treatment
systems.
"The technology is evolving," Naugle said. "We
need to be careful that the city doesn't get locked into an


antiquated system."
Joe Miano, owner of a mobile pump-out service
called Waste BUsters, thinks the hook-ups arepremature.
He favored the city's existing ordinance, which requires
dock landlords to provide upland toilets, shoreside
pump-outs or mobile pump-out service.
"The major source of pollution is not coming from
theboats," he said. "The system we have now is working.

help commissioners in finding
funding to cover the expense...

Compliance has never been better."
Frank Herhold, executive director of the Marine
Industries Association of South Florida, also agreed
that permanent pump-outs were not the way to go.
Mandatory hook-ups would only serve to increase
the area's boater population. Landlords would be
encouraged to recoup the cost of putting in pump-out
facilities by renting dock space to liveaboards, as
opposed to keeping slips for storage vessels, he said.
The association also would like the city to consider
pitching in funds for a water quality study by the
OceanographicCenteratNova Southeastern University.
The association has offered to kick in part of the $60,000


fee, he said.
Some city officials have said that the money could
.be put to better use.
"The more money we have for studies, the less we
will have for the hook-ups," said City Commissioner
Cary Keno.
Keno said the MIA could do the study on its own
and present their findings to the city. But Herhold
believes thattotal MIA funding would harm the project's
credibility.
"We would like to have a partnership," Herhold
said.
Keno and other commissioners were careful not to
hoist all the blame for pollution on the boaters. Keno
also wants the city to require lateral checks underneath
waterfront homes.
"We don't want to wait until after these houses are
sold," he said. "We need to get in there now."
Ed Hittson, a homeowner who lives across from
Hendricks Isle and has been active in pollution control
issues, said it's only fair that the city require the hook-
ups.
After all, the vessels are dwellings and it's not right
that the city doesn't require them to be hooked up to the
sewage system, he said.
"It sounds plain and simple to me," said City
Commissioner Carlton Moore. "They are counted as
livable units. We should hook up all live-aboards. Even
if they are causing one percent of the problem, that
doesn't mean the city shouldn't address it."

Boca Raton nature center offers an educational
lecture on the elusive loggerheads ...1^

The long, wooden boardwalk snakes
past a hammock of Gumbo Limbo trees,
a southern stingray named Stinky and a
tank filled with sharks, spiny lobsters
and sea urchins. It finally coils into an
opening where marine biologist Kirt
Rusenko stands slowly vacuuming a
display pool.
Inside the tank, five 80-pound
loggerhead turtles swim in monotonous
circles, coming up occasionally for a long
toke'of air.
The turtles will eventually find
themselves back at sea, but for now, the
Gumbo Limbo Environmental Complex
in Boca Raton is their home.
The loggerheads are the stars of
Turtle Talk, an illustrated lecture and
tank-side program offered by the center
in July.
Because the large reddish-brown
turtles are protected by the U.S.
Endangered Species Act, this is the closest


you can legally come to seeing the
loggerheads up close and personal.
It may notbe easy to spot loggerheads
out at sea because even though they need
air to breath, male turtles never leave the
water and females leave only to nest.
In fact, these creatures love the sea so
much, they actually sleep under water,
holding their breath for hours at a time.
During Turtle Talk, you can learn
more turtle facts, including the typical
life span (up to 100 years), the average
weight (300 pounds) and average size
(three feet).
The center offers additional nature
programs throughout the month of July.
Fees range from free to up to $3 per
person.
The Gumbo Limbo Environmental
Complex is located at 1801 N. Ocean
Blvd. in Boca Raton. The center is open
Monday through Saturday, 9 a.m. to 4
p.m. and Sunday noon to 4 p.m. and is
closed July 4.

I knew I was slipping under the
surface of a boilermaker by the tone of
Clint Ramsten's accusatory voice.
I've never met the man. Had never
even heard of him until I was told that as
Marina Bay president, he'd be the main
guy to talk to. And even though I had yet
to write word
one about this
new work-
release center
the Broward
Sheriff's Office
is planning on
-State Road 84
in Fort
Lauderdale,
hevehemently
informed me

and that my statements had come from
somewhere left of the twilight zone.
As for this new jail-away-from-jail
that wouldhave gone up a stone's frow
from Marina Bay a month ago if not for
pending court litigation, Ramsten.
opposes it, to say the least.
Uh, check that: He really opposes it.
"Everybody's against it," Ramsten
says. "The city of Fort. Lauderdale's
against it. The city of Dania's against it.
It must first meet with the community
and neighborhood's approval and there
are five groups here against it. I can
damn sure tell youthat the Marina Mile
Association's against it. They've
appointed me to saY how much we're all
against it."
-Like Ramsten needed an
appointment.
But, then, like BSO cares.
It's no secret that the Broward
County Jail has about as much.room for
newcomers as a Hurricane Andrew
shelter did in Homestead. That means
the sheriff is always on the lookout for
new sites to farm out inmates. When
BSO stumbled on the old Crossroads


Motel's "For Sale" sign, they snatched it
up and contracted with the Wackenhut
Security braintrust to turn it into a 300-
to-500-bed inmate work-release center
housing DUIs and other substance abuse
offenders, not to mention second and
third degree burglars and their fellow
felons.
It was a semi-shrewd move proving
that BSO didn't just fall off the work-
release truck this morning. In the past,
whenever they wanted to move prisoners
within spitting distance of the public,
the public has responded by crying their
eyes out to the county commission. But
by contracting with private corporation
like Wackenhut, Ramstenand everybody
else at Marina Bay can get stark raving
mad enough to hop on a roof and turn
Marina Mile into a newspaper headline,
but they're wasting their time if they
even pretend to whimper to the county's
commission. This public forum is
powerless against a privatized BSO.
"The bottom line here is, everybody
is talking dollars," says BSO spokesman
Ott Cefkin. "The reality of the situation
is that it is far less expensive to keep
people in work-release than it is to keep
them at a county jail."
Cefkin says it costs $56 per inmate
per day at the Broward County Jail.
Inmates farmed out to work-release
centers in other counties cost $46 a day.
Inmates at the new work-release center
near Marina Bay will cost taxpayers $36
aday. "We're projecting numbers like $6
million a year for the county to house
prisoners at the jail," Cefkin says.
But that's not Ramsten's concern.
"Were concerning ourselves with
the fact that we're in the heart of a $4
million-a-year marine industry area.
"There's lots of dockage here. People are
in and out of here all the time.
"But they've got their high-paid
lobbyists directing Wackenhut to put an
insecured [sic], 300-to-500-people jail
here. And there's a judge's order that
says second and third degree felons

and most
expensive boat you can afford (or can't
afford), and find some way to rationalize
its existence. Most soon realize this is a
fool's errand. Eventually, you either give
up on the idea of owning the "baddest
boat on the bay" or you become creative.
To that end, two of the most popular
ways of trying to afford that dream boat
is through some type, of co-ownership,
or by putting your boat up for charter.
There's pitfalls to both these strategies,
but they have become common enough
to be taken seriously.
Co-ownership is exactly .what it
sounds like. You own a boat with a,
-partner, or partners. Sometimes this is
done as a corporate entity, but a straight
partnership is usually the norm.Theidea
is that both parties share the. cost,
responsibilities and enjoyment of the
boat. Sounds good in theory, but there
can be problems.
Even if you're considering such an
arrangement with your best friend, the
use, costs, and responsibilities of the co-
-ownership should be clearly defined in a
contract and followed. This way there's
no room for discrepancies later when

someone says, "But I thought you were
going to have the bottom painted."
This contract doesn't have to be
complicated, but it should be clear and
address some major issues. Those include:
title ownership, arrangements for
insurance, responsibility for liens on the
vessel, maintenance costs, scheduling of
use, rules for severing the partnership,
etc.
Professional help is highly advised
for the drafting of this contract. You'll
also want to keep meticulous records of
cost and use throughout the co-
ownership.
Another popular method to boat
ownership is putting your vessel into
charter. The theory is, you buy the boat
and let other people pay you to use it,
which helps defray costs. Then, once in a
while, you get to use the boat yourself.
(No, you won't make a profit)!
Charter is as old as maritime
commerce, but it's relatively new to
recreational boating. In recreational
boating, most owners give their boat over
to a "charter company" which arranges
for its rental to third parties. The renters
get-full use of the boat as if they were the
owners. This is called a demise or "bare-
boat" charter. If y6u want to use the boat,
you'll just have to wait your turn.
All cautions given for co-ownership
should be doubled when dealing with a
"charter company." Make sure you have
a very clear contract with the company
and that you get a good deposit for the
use of your boat. If the company offers
you a contract, read it carefully andget
second and third opinions from
professionals before you sign. Always
remember, it's supposed to be your boat.
Recently, a new approach to boat
ownership has been created based on
time sharing. It appears to be something
of a hybrid between co-ownership and
charter. You'll want to know if you are
actually becoming.a part owner in a boat
or if you're just reserving a time slot with
a charter service. If you are buying into a

which means anything but a sexually violent crime. It's
undesirable. Besides, it's not zoned for the area."
And Ramsten fears for the marine community's
economic future. "This thing could turn what we've
worked hard to build back into what it used to be."
I remember what it used to be. In the early '80s a
passer-by would drive through a lot of neighborhood
seediness before finding anything remotely resembling
today's Marina Bay. On a good day there were rats, and
not those plastic hockey critters, either.
Cefkin says Ramsten and the rest of the neighbors
have little if anything to worry about. Work-release
inmates need a court order to even think about straying
off the grounds.
"The history of work-release shows that crime
actually goes down in the surrounding neighborhood
because there's extra policing in the area," Cefkin says.
"We're talking people who are non-violent working on
paying for their families and working on a problem. As
for the objections from people in Fort Lauderdale, the
people they fear come out of their own community.
They're not afraid of their next door neighbor coming
home. They only have a fear of being afraid. Besides, if
an inmate escapes, they don't escape back into the
neighborhood, they go as far away as possible."
That's a hard sell for the businesses along Marina
Mile and the two cities involved. Says Dania City
Commissioner Bill Hyde, "They're not really happy


about having it shoved down their throats."
Nor should they be.
As for Ramsten's potential new neighbors should
the judge rule in BSO/Wackenhlud's favor? They may
prefer to remain in real jail.

boat, your responsibilities could be more than you
thought. Again, have your contract reviewed carefully.
Finally, a warning about liens. In all these scenarios,
it is possible that a maritime lien could be placed on the
boat due to the actions of another party (one of your co-
owners or a renter). Remember, a maritime lien follows
the boat not the debtor who created it. A clause
should be included in your contract that makes the
other party responsible for such liens when they use the
boat. Even so, it won't help if the culprit moves to Fiji
while your boat is being arrested. So, be cautious!
Can you really buy a boat and save money? Well, a
few years ago a gentleman came into my office wanting
a boat sales contract notarized. He looked like a man
who had just entered the seventh circle of heaven. He
said, "This is the happiest day of my life. I'm selling my
boat and I'm only losing $10,000!"

Sparing your waterfront home from hurricane havoc

One of the benefits to living in South Florida is
owning a house on or near the water. But the bucolic
view from a bay window or dock can turn deadly when
a hurricane makes landfall.
For obvious reasons, waterfront homes are the most
at risk and hardest hit during major storms. This is
mainly due to the wave action that comes on top of the
storm surge, said Fred Murphy, emergency management
coordinator for. the Metro-Dade Office of Emergency
Management. ,
"It's like taking a-hammer and hitting the house
over and over again," he said. "Itbeats thehouse down."
Storm surge, wave action.and flying debris helped
destroy many waterfront homes during Hurricane
Andrew in 1992.
Although the worst part of the massive storm struck
the Homestead and Florida City areas, extensive
damages were reported at homes as far away as Coral
Gables and Key Biscayne, Murphy said.
One way a homeowner can avoid damage is to hire
an engineering or architectural firm to be sure the house

were the ones where the pilings were sunk down to the
bed rock," he said.
There are other precautions to take as well. And the
sooner the better. Hurricane season officially began on
June 1 and will extend through Nov. 30.
Joanne Becker, president of the Waterfront Property


Owners Association, said folks should make an effort to
have their trees pruned on a regular basis.
Becker knows all too well the damage that a flying
palm frond can cause. One recently dropped off a
neighbor's tree and destroyed her orchid house.
"Imagine if it became loose during a hurricane,"
said Becker, who lives on a three-acre site along Fort
Lauderdale's New River.

Disabled boat forces local sailor from transatlantic race

The quest is over for Etienne Giroire. The solo
sailor's 60-foot trimaran, which he dubbed the Spirit of
Fort Lauderdale, is no longer a contender in the Europe 1
Star Singlehanded Transatlantic Sailing Race.
The competition ended prematurely "for Giroire
when his vessel dismasted on May 30. At the time,
Giroire was sailing about 200 miles from Newport,
Rhode Island.
"I was thinking of switching to the staysail when
the boat accelerated in a puff, and then just stopped,"
Giroire said.
Ninety feet of aluminum mast and 2,000 square feet
of sail came crashing down to starboard, chopping 20
feet of outside hull completely away, he said.
"It took one hour to free up the rigging, which was
threatening to maim the boat in increasingly rough seas
and 40 knot winds," he said.
Having a disabled boat is not the type of ending that
Giroire had envisioned when he set out on May 27 from
his slip at the city-run Las Olas Marina in Fort
Lauderdale.
The 40-year-old Frenchman was seeking glory in
the Europe 1 Star not only for himself, but for his


adopted hometown as well.
"I want to put Fort Lauderdale on the map," he
said during an interview with the Waterfront News in
May. "This is going to be a great promotional tool."
This was Giroire's second time competing in the
Europe 1 Star. He entered the race in 1992 in a 40-foot
trimaran named Up My Sleeve. He finished seventh
overall, won his class and broke three multi-hull
records.
The Europe 1 Star is held every four years. It is the
oldest competition in the world and considered to be
very prestigious, Giroiie said.
Entrants sail alone from' Plymouth, England; to
Newport, Rhode Island a trek that totals more than
2,800 miles. Giroire's Spirit of Fort Lauderdale was the
only American Class 1 multi-hull entered in the 1996
race, which started on June 16.
After drifting 36 hours, the the boat was rescued
with help from the U.S. Coast Guard. The 15,000 pound
vessel is docked in Newport. The boat will be sent to a
shipyard in Maine, where it will undergo repairs,
Giroire said.
The storm that knocked the Spirit of Fort Lauderdale
out of the race also forced a 50-foot Monohull named
West Marine to return to Newport and caused a 30-foot

trimaran, Third Turtle,to break up. West Marine and
Third Turtle were both competing in the Legend Cup, a
feeder race for the Europe 1 Star, he said.
Now, back in Fort Lauderdale, Giroire said he is
very disappointed by the tragic turn of events.
"Especially for my sponsors, who supported me,"
he said.

Storm surge and winds can be especially severe in canals

Becker remembers leaping into action when
newscasters began warning that Andrew would hit
shore.
"It took me two days to bring everything inside -
plants, lawn ornaments, tools," she said. "It was a lot of
back breaking work.'
Luckily, damage to her house was minimal. Still,
Becker doesn't need a close call like Andrew to know
how vulnerable she is living on the water.
"Every time we have a storm, no matter how small,
my yard suffers some type of damage," she said.
When strong winds begin to kick up, Becker turns
her attention to her boats.
"We get those battened down, then we take care of
our home," she said.
Ernie Braatz, manager of technical services for Boat
U.S. and editor of the organization's Seaworthy
magazine, said vessels were a hot topic of conversation
during a hurricane conference he attended recently in
Fort Myers.
"People were very concerned about boats tied to
docks at waterfront homes," Braatz said. "Especially in
South Florida, where there are so many of them."
Andrew did extensive damage to boats around the
Coral Gables area, he said.
"People felt they were safe, but the storm surge and
the wind can be very severe in canals," he said. "Canal
waters can rise 10 to 12 feetabove normal high tide levels
during a hurricane."
When preparing for an oncoming storm,
homeowners should secure their vessels by tying the
boats to both sides of the waterway.
Sails, canvas covers and enclosures should be
removed. In addition, equipment and other valuables
should be taken inside so nothing gets ruined or sunk,
Braatz said.
Small boats on lifts should be stored on shore. If
that's not practical, strip the vessel, remove the drain
plugs and raise it to the highest position before tightly
securing it to the lift, he said.
But the most pressing advice that Braatz and other
safety experts give is to never take chances.
During Andrew, Becker and her family hunkered
down inside their home. She doesn't know if she would
do the sameif another storm of the samesizeapproached.
Leaving is always the best option..Folks should
never place property over lives, Murphy said.


To be better prepared for an approaching
hurricane, waterfront homeowners
should take the following precautions:

SHave an architectural or engineering
firm determine whether your home is
properly anchored and above storm
sure levels.

*Regularly prune tree canopies.

*Purchase hurricane shutters for all
windows and doors.

*In the event that a hurricane is due to
hit land, homeowners should:


*Place all tools, plants and other items
lying around the property inside.

* Tie boa ts to opposite sides of the canal.

*Remove all sail, canvas covers and
enclosures from vessels. Also take all
equipment and valuables inside.

*Small boats on lifts should be stored
on shore. If that's not practical, strip the
vessel, remove the drain plugs and raise
it to the highest position before securing
it tightly to the lift.

variety of marine youngsters that will later be released
back into their watery home. Wear old sneakers and
prepare to get wet.
*Sunday, July 21,2 p.m. "Butterflies," an illustrated
talk followed by a .field walk to catch a peek of the
beautiful winged insects.
*Thursday, July 25, 2 p.m.,: "Wrestling Ernest
Hemingway," sit back and watch the movie filmed in
South Florida staring Robert Duvall and Richard Harris.
*Sunday, July 28, 10 a.m. A snorkeling class takes
place for. novice snorkelers ready to view local marine
life up close and personal. Bring your snorkeling gear,
swimsuit, towel and sunscreen.
