common sense,
safety experts say

How's this for an irony: Your vessel
catches fire out at sea. There's water all
around. But how much good will it do?
"Not a lot," said Florida Marine Patrol
Capt. Mike Lamphear. "Saltwater is
generally not a very efficient method for
putting out flames. Salt conducts
electricity and the person could get
shocked."
Luckily, few folks in Florida have had
to discover that nasty lesson the hard
way. Last year '57 fires and explosions
were recorded on recreational vessels
statewide with 37 fuel-related. Another
20 were classified as non-fuel, according
to Florida Marine Patrol records.
Considering the thousands of
registered vessels in Florida, those
statistics are not very high. Still, to those
caught in a blaze the effects can be
devastating, boating safety experts warn.


The issue recently generated much
publicity when a fire devoured two multi-
million dollar vessels docked at a Dania
marina onApril 19. One of the vessels was
The Centurion, a 110-foot schooner owned
by actress Kelly McGillis and her husband,
Fred Tillman Jr. The other vessel was a
112-foot yacht named Britannia.
Smoke from the crafts could be seen
for miles and employees had to be
evacuated from several neighboring
marinas.
The fire allegedly first struck the
Britannia. Winds then carried the flames
to The Centurion. Crew members aboard
the boats were able to swim ashore with
one mate suffering minor burns, according
to Dania fire officials.
An official report from the state fire
marshall's office on the blaze won't be
made public until June, said Dania Fire
Department Marshall Larry Yost.
"At this point we suspect that the fire
may have been caused by an electrical
fixture," Yost said.

smoldering in the walls undetected for
several hours, Yost said.

over the years, marine officials say.
Fort Lauderdale Marine Patrol Sgt. ,
Tom Ogden says the recreational nature
of boating lulls people into not taking the
proper safety measures.
"The same precautions that apply to
protecting a home or car, apply to boats,:'
he said.
Boat owners need to be aware that
there are many potential hazards on board
that can lead to fires, said Ernie Braatz, a
technical services manager for Boat/U.S.
and editor of the organization's Seaworthy
magazine.
"Today's vessels are very
complicated," he said. "They carry
everything from gasoline to galley fuel
and barbecue charcoal."

and trucks try the same techniques on
their boats," he said. "Vessels have a
different system however."
Another frequent source behind the
blazes can be traced to portable
automobile battery chargers, which also
have different wiring and are not properly
grounded, he said.
"People should only use marine
battery chargers," Braatz said.
There are other ways to avoid
mishaps as well. Lamphear advises boat
owners to always be prepared by carrying
fire extinguishers and personal floatation
devices, both required by federal law.
People need to remember that boat
fires can spread quickly, especially on
fiberglass vessels, he said.
"Those boats burn very fast and very
hot," he said. "They give off a lot of
smoke and poisonous fumes."
If a fire occurs, boaters have only a
few seconds to evaluate the situation and
make a quick decision to fight or flee,
Lamphear said.
Many boat safety experts recommend
the latter. Unless the fire is caught in the
very early stages, they say it's often best
to place a radio call for help, don life
jackets and jump overboard.
In addition to owning the proper
safety equipment, boaters also need to
use common sense, Lamphear said.
He related one story about a victim
in North Miami Beach who was gassing
up his boatin the dark and smelled fumes.
"He couldn't see so he lit a match,"


Lamphear said. "The match ignited the
gas fumes. It caused the engine
compartment hatch to open and send out
a burst of flame. The hatch then quickly
snapped shut, cutting off the air supply
and putting the fire out."
The victim suffered a burns on his
face, burned eyebrows and singed hair,
Lamphear said.
"He was very, very lucky," he said.

Tips for safety
The Florida Marine Patrol, Boat/U.S. and the Fort Lauderdale Marine Patrol
recommend the following fire safety precautions:
If you have no knowledge of marine crafts, do not attempt to do any electrical
wiring. The electrical wiring in boats is different from cars and trucks.
Frequently inspect the electrical system. Make sure vessels have the proper
size circuit breakers and fuses.
Use marine battery chargers only. Portable automobile battery chargers are
wired differently, are not properly grounded and can cause shocks.
Check out marinas. Does the facility have hoses, security personnel and fire
extinguishers? Also ask dockmasters for the phone number of the nearest fire
department.
Always follow posted instructions when gassing up.
Never barbecue inside the boat. Instead, purchase special marine grills that
extend over the side of the vessel.
Carry fire extinguishers, personal floatation devices and a working VHF
radio.

Summer camps cater to marine-oriented kids

Kids wanting to spend their school
break doing water-related activities and
exploring South Florida's eco-systems
will find plenty to do this summer.
Listed below in alphabetical order
are several South Florida camps that offer
programs ranging from the study of
wetlands habitat to spending the night in
a underwater hotel.
Parents should remember that in
some cases marine sciences are part of an
overall session that includes other fun
stuff such as field trips, drama, swimming
and arts and crafts.
When inspecting any camp, parents
should inquire about children to
counselor ratios and the qualifications of
staff personnel.
They should also ask whether
lunches will be provided and if they're
included in the session fee.
Some camps also have transportation
and extended care hours. Those services
are often not part of the regular price


package and usually cost extra. Listed
below is a sampling of local programs:
Anne Kolb Nature Center Summer
Camp: West Lake Park, 751 Sheridan St.
in Hollywood. Runs June 17 to Aug. 23
for ages 10 to 15. Camp focuses on nature-
oriented activities, with an emphasis on
South Florida ecology. Activities will
include field studies, nature walks,
canoeing, fishing, swimming, boat tours,
crafts and field trips. Cost is $190 per
week, with a 10 percent sibling discount
to families enrolling two or more children.
Hours are 9 a.m. to 4 p.m. Extended care
from 7:30 a.m. to 6 p.m. is available for an
extra fee. Call 926-2481.
Camp Live Oak: Located at Birch
State Park on Sunrise Boulevard and State
Road A1A in Fort Lauderdale. Eight year
old day camp with focus on
environmental and marine studies is in
session-from June 17 to Aug. 16. Program
is designed for kids ages five to 13. There
will also be a special Ocean Quest
program from Aug. 19 to 23 that

Liveaboard marine

sanitation to be

discussed

Fort Lauderdale City Commissioners will hold a
special public hearing on liveaboards and marine
sanitation in the Las Olas area.
The meeting is tentatively scheduled for 6 p.m. on
June 4 inside City Hall at 100 N. Andrews Ave.
Discussion will center around a proposed ordinance
requiring that all boats in areas zoned for habitation on
floating homes or vessels must be permanently
connected to shoreside sewers while docked, said Ed
Hittson, a resident who lives across from Hendricks Isle
and has been active on live-aboard and pollution control
issues.
The city currently requires dock landlords to provide
upland toilets, shoreside pump-outs or mobile pump-
out service. Many residents say this is not working,
Hittson said.
They believe the proposed ordinance is a more
effective and enforceable solution to control waste being
dumped into the waterways, he said.
Hittson expects a large turn out at the meeting,
includingrepresentatives from several civic associations.
City Mayor Jim Naugle said the commission will


probably also discuss an offer from Nova Southeastern
University to do a pollution study in the Las Olas isles
section.

Sailing Solo
Fort Lauderdale sailor calls upon all his resources to
race from England to Newport, R.I.

Etienne Giroire likes sailing solo. But
don't accuse him of being an unsociable
kind of guy. He's just following the rules.
Giroire left his slip at the city-run Las
Olas Marina in Fort Lauderdale on May
20 to compete in the Europe 1 Star
Singlehanded Transatlantic Sailing Race
which starts June 16.
Europe 1 Star, a radio station, is the
race's primary sponsor. Held every four
years, the competition is the oldest in the
world and considered very prestigious,
he said.
Giroire will sail alone from Plymouth,
England, to Newport, Rhode Island. The
trek totals more than 2,800 miles. But he
is no stranger to the rigors of what lies
ahead.
Giroire entered the Europe 1 Star in
1992 in a 40-foot trimaran named Up My
Sleeve. He finished seventh overall, won
his class and broke three multi-hull
records.


For the 1996 competition, Giroire
hopes to take first place and share that
glory with the city he now calls home.
His 60-foot trimaran, which Giroire
says calls a magic carpet on the water, is
named the Spirit of Fort Lauderdale. It is
the only American Class 1 multi-hull
entered in the competition, he said.
"I want to put Fort Lauderdale on
the map," said Giroire, who is married
and has a year-old son. "This is going to
be a great promotional tool."
The 15,000 pound vessel was built at
a Vannes, France shipyard in 1984. A
Connecticut banker bought it, then
donated the boat to the non-profit Florida
Marine Institute in Tampa.
Giroire acquired it for a $100,000
lease-purchase option in Newport last
summer.
Being on his own in the middle of the
ocean, miles from civilization, doesn't
bother the 40-year-old, French-born
Giroire.
"Of course you miss companionship,

but you have a job to do," said Giroire,
who took up sailing at age 17 and did a
three year stint in the French Navy.
"You're too busy to feel the solitude."
Although Giroire is facing the sea
alone, on land it's been a different story.


A steady crew of four have worked long
hours to ready the boat for its journey,
including Giroire's brother Dominique,
who traveled from his home in France.

Gotta hand it to those manatees.
They may be out of sight most of the
time, sluggish enough to make slow
motion seem like rapid transit. But
they're never out of mind.
On May 1st, the 4th District Court of
Appeal upheld a previous ruling that
allowed the
Flo rida
Departmentof
Environmental
Protection to
Asset speed
limits in

S areas known
to be
congregational
habitats for
xe--- manatees.
After the
original ruling, the DEP designated
manatee protection zones in 13 Florida
counties.
Meanwhile, the Marine Industries
Association of Florida, which represents
650 marinas, boat dealerships and other
marine-related businesses in South
Florida, asked the state to remove what
had been a wintertime speed zone set
along a 17-mile Intracoastal Waterway
stretch between Port Everglades and
Deerfield Beach.
Aside from the fact that Florida's
summer has chased the snowbirds and
their visiting boats back to their northern
nests, the association's reasoning was
simple: Why have a speed limit when in
17 years only one manatee had been
killed by a boat along the entire 17-mile
northern Broward ICW stretch?
So why have a speed limit to protect
manatees when there are no manatees to
protect? Right?
Not necessarily.
First of all, information stating that
only one manatee had been struck and
killed by a speeding boat along the stretch
in the past 17 years might be a tad bit


misleading. Says Patti Thompson, staff
biologist at the Save The Manatee Club
in Maitland, Fla., six manatees are known
to have been struck and killed by
speeding boats in the vicinity of Hillsboro
Inlet.
Besides, Thompson adds, not all
manatees struck by boats die right there
on the spot. Some don't die at all. A
wounded manatee's natural tendency is
to travel to a place quiet and secure, such
as a backwater canal or an area secluded
enough to where a manatee can quietly
nurse itself back to health. And just
because a manatee carcass might be
found floating in a certain area doesn't
mean that area was the precise point
where the manatee was struck. Wounded
manatees have been known to travel for
miles before taking their final breath.
"There have been more than one
killed during the past 17 years,"
Thompson says. "Researchers have seen
manatees resting with severe wounds. I
think somebody took a small piece of
information and started passing it
around."
Researchers have also studied the
travel habits of manatees by tagging them
and tracking their movements. Around
here, they have been tracked swimming
from the waters surrounding Port
Everglades to as far north as Jupiter and
as far south as Biscayne Bay, using one
route and one route only: the Intracoastal
Waterway.
With that information at hand, it's
no wonder that a 1991 survey showed
that 59 percent of the boating public
claimed they wouldn't mind slow
boating speeds from county line to
county line one darn little bit. If you're a
boater you're also probably an outdoor
type with a respect for the environment.
Chances are you don't want to plow
down the neighborhood wildlife
inhabitants. So it's not hard to see why
the survey results were of little surprise.
The surprise lies with who

A while back, I mentioned to a friend
who's also in the legal profession that I
was planning a scholarly article on the
rights of passengers traveling on boats.
"That's easy," he replied with a grin.
"They don't

thoughtfully

"okay -
practically no
rights!"
Although my friend's comments
may sound cynical, they contain more
truth than many maritime practitioners
might admit. You see, until the end of the
last century, sea travel was considered
an enterprise for the hearty, not a
recreational sport for the privileged.
To put it in perspective, imagine a
group of soft-bodied yuppies who call
themselves Pilgrims. They announce that
they're taking a shuttle to Mars and
planning to grow corn when they get
there. We would think they were pretty
darn foolish and deserved whatever fate
might bestow on them. Well, a few
hundred years ago, taking a boat from
England to Massachusetts to find
religious freedom and eat turkey was
viewed the same way.
True, modern vessels are now.
"mechanized" and may be less "leaky"
than in previous centuries. But, the law
still recognizes that you're safer on dry
land than on a boat, and you're expected
to know that too before you get hurt
on one. Inmostcases, that means a captain
and crew are obligated to provide
reasonable care under the circumstances for
both guests (non-paying) or passengers
(paying).
Just what does that mean, you ask.

It's not easy to define. As a rule of thumb,
the captain should tell you about the
dangers unique to maritime travel, but
he isn't required to warn you about open
and obvious threats. For example, the
captain should explain where the life
jackets are kept and any unique rules for
putting them on. But that same captain is
probably not obligated to tell you to duck
when you come to a low hung door sill
that everyone else sees. Should anything
happen, it is the passenger's burden to
show that the carrier acted with
negligence or had constructive (should
have known) notice of the condition
which caused the injury.
These rules pretty much apply
whether you're on a luxury cruise liner or
Uncle Charlie's fishing boat. Of course,
Uncle Charlie may keep his boat within
state waters, meaning any injuries or harm
done on board could be subject to state
laws and remedies (this is the stuff of a
long legal discussion). For the most part,
the standard of care and the burden to
prove negligence would not change.
As for the "passenger for hire"
vessels, including cruise liners and even
SCUBA boats, there is another topic which
should be addressed tickets and signed
waivers. My advice is, when you get a
ticket or have to sign a waiver, read them
and keep them! For the most part, courts
consider the clauses in such documents
enforceable. Three of the most important
clauses are time limitations, notice of claim
and choice of forum clauses.
Normally, you have three years to
file suit for an injury which occurred.on
board a vessel. But a time limitation clause
can restrict this to one year, while a notice
of claim clause .could require, that the
carrier be informed within six months of
the injury. The courts consider this
acceptable, so beware.
The "choice of forum" clause is even
more interesting. Basically, such a clause
can restrict the choice of where you file
the claim. In other words, if the ticket
says you have to go to New York or
Detroit to file a case, you better be
prepared to go to New York or Detroit.

the University of Miami's Rosenstiehl School, the survey
was conducted by the speed limit's chief opposition, the
MIA, which naturally is concerned about the impact the
ruling has on marine businesses.
"We have fully supported those speed zones where
manatees were found in abundance," says Kitty
McGowan, director of the association.
"But we have fought speed restrictions in those
areas along the Intracoastal that are not a gathering area
for manatees. If it takes a boat an hour to get to an inlet,
speed restrictions will only make it a long trip, meaning
the boat isn't going to be used as often, there will be less
gas used, less materials used, less business for the
marinas. (A speed restriction) has a ripple effect."
The chief concern around the association these days
is that the appellate court could grant a state agency


such as the Florida Department of Environmental
Protection with more than its rightful share of power.
You know, today we make a speed limit, tomorrow we
make sure you know who's running the show.
"It's a pretty scary thing when they make the rules
without doing all of the research first," McGowan says.
Even scarier is the story circulating about the judge
who ruled on the case and asked the attorneys, "what's
a wake zone?"
But, then, you gotta hand it to those manatees.
Everybody loves them, and what's not to love. They're
as docile as a sleeping monk, and that's only during
those rare occasions when they are spotted. Most of the
time, they're out of sight floating and traveling in a
world that's so all to their own, it's a wonder the judge
didn't ask "what's a manatee?"

Legal clause can dictate where claim is filed

Odds are, the courts will accept this clause as valid,
unless the choice of forum is the People's Small Claims
Yak Court of Inner Mongolia.
So, while passengers may have their rights restricted,
and can't always seek the same damages they could on


land, they can still exercise some control. If you stay

Local sailor to represent Ft. Lauderdale in transatlantic race

Giroire has also lined up several local businesses to act
as sponsors. He estimates his costs in the race will total
more than $100,000. Giroire's ownrcompany, ATN Inc.,
which has made spinnaker sleeves for sailmakers since
1985, will contribute about $60,000.
All sponsors will have their banners posted on the
Spirit of Fort Lauderdale. The corporate names will be
seen by millions of Europeans, who will be following
the race via extensive television and print media
coverage, he said.
Also visible on the boat is the city's official seal.
Special permission had to be granted by Fort Lauderdale
commissioners for Giroire to use the logo.
Ken Sicora, the city's marketing and promotions
manager, said he believes that Giroire will be able
generate a lot of positive publicity for the city.
How many tourists and overseas businesses will be
attracted to Fort Lauderdale because of the press is


unknown, he said.
"But it can't hurt," Sicora said.
While the city couldn't offer any financial support,
they have assisted Giroire in other ways. Officials gave
him free docking space, wrote some press releases and
gave him leads on possible sponsoring businesses, Sicora
said.
"Etienne is a sincere and caring person. I was very
impressed that he was willing to take responsibility for
the project," Sicora said. "He knocked on doors and got
funding for the race by himself."
Alan Fitzpatrick, one of the boat's sponsors, said he
too was impressed by Giroire.
"I inspected the boat, met Etienne and liked what I
saw," said Fitzpatrick, owner of Lauderdale Battery and
M&G Batteries in Fort Lauderdale. "I felt anyone who is
putting in that much effort deserves support. I think he's
doing something that will be very positive for South
Florida."


Sailor Etienne Giroire has lined up several local
businesses to help sponsor his entry in the upcoming
transatlantic race.

SUMMER CAMPS FROM P. 3

Camp Nova: Nova Southeastern University, 7500
SW 36th St. in Davie. Meets June 17 to Aug. 16 for ages
3 to 16. Activities focus on oceanography and ecology.
Cost is $455 for a three week session. Price includes
lunch, snacks and field trips. Hours are 9 a.m. to 3:30
p.m., with extended care from 7:30 a.m. to 6 p.m. available
for an extra fee. Call 475-7338.
Camp Sailfish: Sailfish Marina, 98 Lake Drive in
Palm Beach Shores. Meets June 24 to July 26. Programs
focus on fishing, conservation and the marine
environment. Open to children ages eight to 12. Cost is
$225 per week. Fee includes lunches, snacks and a T-
shirt. Hours are 9 a.m. to 4 p.m. Extended care hours are
available for an extra charge. Call 844-1724.
Lee's Ski School: OnCrystal Lake, 3701 NW Ninth
Ave.-in Pompano Beach. This year-round water skiing
camp is for ages three to adult. Hours are 9 a.m. to 5 p.m..
Cost is $345 per person for a five-day session. Call 943-

Lauderdale Isles Yacht Club: 2637 Whale Harbor
Lane in Fort Lauderdale. Sponsors a summer swim
team for youngsters ages two to 16. Team members
compete against other yacht clubs. Practice is held 8a.m.
to 11:30 a.m. Tuesday through Friday. Meets are usually
on Saturday. Swim lessons are also offered. The team is
only open to the children of club members however.
Yearly memberships are available. Call 583-7422.
McGinnis Ski School: 2421 SW 46th Ave. in Fort
Lauderdale. Camp runs from June 17 to Aug. 30 for ages
6 to 14. Hours are 7 a.m. to 6 p.m. The camp offers two
days of water ski instruction and three days of regular
activities such as field trips, arts and crafts, fishing,
canoeing and swimming. Cost is $85 per week. Call 763-

Miami Museum of Science Summer Camp: Miami
Museum of Science, 3280 S. Miami Ave. in Miami. Runs
from June 24 to Aug. 16. Ages four to 18. Programs
include marine biology, wetlands study, exploring South

canoeing. Costs range from $60 to $228. Hours are 9:30

The camps offers different science-themed subjects such
as marine biology and Everglades exploration during

Scott Carpenter Man in the Sea Program: Run by
