Attached is a copy of a notice in connection with the state water
policy. It includes two proposed rules which I would like for
you to look at very closely and let me have your comments, in
writing, by November 9.

(d) Group 4 Gieup 4 wells are non-hazardous industrial
and commercial disposal wells, and which include laundry
waste, dry wells, sand backfill wells, and nuclear disposal
wells injecting only low level radioactive wastes.
(e) Group 5 Grup 5 wells include Lake level drainage and
stormwater drainage wells.
(f) Group 6 Geothermal wells and 'other' wells are
included in this group.
20. Sec. 17-28.54 (1)
(1) The need for monitoring is shall be determined by the
type of well, nature of the injected fluid, and water quality of
the receiving aquifer. The Department may impose
monitoring requirements for Groups 1, 2, 3, 5 and 6.
21. Sec. 17-28.55 (1) and (2)
(1) Reporting requirements are shall be determined by the
type of well and nature of injected fluid. When necessary and
where applicable, reporting shall be in accord with Chapters
17-6 and 17-19, F.A.C.
(2) Reporting shall be required for: Group 1 water return
flow wells on an open-loop system, with additives; Group 3 -
except for swimming pool drainage wells; and [for] Group 4
and Group 6 [will be required].

general section of a State Water Policy and discussion of

Tallahassee, Florida 32301. THE FULL TEXT OF THE
PROPOSED RULE IS AS FOLLOWS:
17-40.04 Water Use
(5) In implementing consumptive use permitting programs,
the department and the districts shall recognize the rights of
property owners to make consumptive uses of water from
their land and the rights of other users to make consumptive
uses of water, as both limited by law, for reasonable
beneficial uses in a manner consistent with the public
interest that will not interfere with any presently existing
legal use of water.
(6) Nothing in this Chapter shall be deemed to authorize a
permitted to make consumptive uses of water which cause
significant adverse impacts on off-site land uses or legal uses
of water, or abridge the right of affected persons to seek


redress or mitigation of such significant adverse impacts
an appropriate forum.
