Dear Mr. Jones:

I received from Commissioner Cresse a resolution of the
Pinellas County Committee of 100 regarding the Department's
water policy rule. As you are probably aware, this rule has
been prepared over a period of approximately nine months. It
has been the subject of several workshops and public hearings by
the Department, as well as at least two public hearings in each
of the water management districts. The Department has taken
great pains to draft a policy which was responsive to the input
provided by the public as well as other agencies such as the
water management districts and the West Coast Regional Water Supply
Authority. We have also worked very closely with representatives
of Pinellas County and St. Petersburg.

Most of the water policy rule was adopted on March 27 at a
public hearing in Tallahassee. One section was reserved for
further public hearings and input. That section on General Water
Policy has been the subject of a recent workshop and is presently
scheduled for public hearing on June 8, 1981, in Tallahassee. Thus,
much of the subject of your resolution has already been adopted.
You should be aware that this rule is to be executed by the adoption
of rules in each of the water management districts. In that forum,
many of the terms which give you concern for lack of a specific
definition will be further defined. The purpose of the adoption
of this rule is to give guidance to the water management districts
in the formulation of their rules so that there is a consistent
water policy being implemented throughout Florida. The purpose is
not to set criteria for the issuance or denial of permits.
