Dear Mayor Freeman:

I appreciate your input regarding the State Satr Polic and
amendments to that policy which have bee suggested by certain
persons regarding property rights in water. A workshop was held
regarding this issue several weeks ago and representatives of the
Authority, the City of St. Petersburg, and Pinellas County
participated. It was the consensus of the attendees at the
workshop that the Department was not in a position to adopt a
policy on the subject at the present time. Accordingly, a rule
hearing was noticed on June 8 for adoption of the General Water
Policy section but the property rights amendments were noticed
for discussion only, not for adoption. It would not be legally
possible to adopt the property rights section at that hearing
since a proposed draft has not been filed with the Joint Adminis-
trative Procedures Committee or proper notice given.

This issue has been reviewed by legal counsel for both the
Department and the water management districts and I will be
receiving written memoranda from them. At the rule hearing, I
invited interested persons to submit their views to me regarding
both the legal authority to adopt such a policy and the desir-
ability of such a policy under Chapter 373, Florida Statutes.

Your comments, as well as those received from others in your
area, will receive careful consideration. No final decision has
been made on whether such a policy should be considered or the
content of such a policy. I can assure you that careful scrutiny
will be given to such a proposal and it will be well advertised
and comments from both the public, as well as affected agencies,
such as the West Coast Regional Water Supply Authority, will be
sought prior to any action being taken by me as head of this
agency.
