3 creating s. 201.025, Florida Statutes; levying

4 a surtax on certain documents; creating s.

5 373.590, Florida Statutes; creating the Water

6 Management Lands Trust Fund in the Department

"7 of Environmental Regulation; providing that the

8 surtax collected shall be deposited into the

10 of Environmental Regulation to allocate moneys

11 from the fund to the five water management

12 districts for the acquisition of certain lands;

13 providing for other disposition of moneys in

14 the fund and lands acquired; providing for

15 future repeal; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

18

19 Section 1. Section 201.025, Florida Statutes, is

20 created to read:

21 201.025 Surtax on documents; Water Management Lands

22 Trust Fund.--

23 (1) In addition to the tax levied under s. 201.02, a

24 surtax of 5 cents per $100 consideration paid, or fractional

25 part thereof, is levied on those documents taxed under s.

26 201.02.

27 (2) The Department of Revenue shall pay all taxes

28 collected under this subsection to the Treasurer for deposit

29 in the Water Management Lands Trust Fund. Sums deposited in

30 that fund may be used for any purpose authorized by s.

1 373.590, and may be used to pay the cost of collection or

2 enforcement of the tax levied under this section.

3 Section 2. Section 373.590, Florida Statutes, is

4 created to read:

5 373.590 Water Management Lands Trust Fund.--

6 (1) There is established within the Department of

7 Environmental Regulation the Water Management Lands Trust

8 Fund, to be used as a nonlapsing fund for the purposes of this

-9 section. All taxes collected pursuant to s. 201.025 shall be

10 deposited in the Water Management Lands Trust Fund. The

11 moneys in this fund are hereby continually appropriated for

12 the purpose of acquiring land in accordance with the

13 provisions of this section.

14 (2) The secretary of the Department of Environmental

15 Regulation shall allocate moneys from the Water Management

16 Lands Trust Fund to the water management districts for the

17 exclusive purpose of acquiring the fee or any lesser interest

18 in lands necessary for the conservation and protection of

19 water and water-related resources, except that such moneys

20 shall not be used for the acquisition of rights-of-way for

21 canals. The moneys shall be available to the districts on a

22 matching basis as specified in subsection (4). To the

23 greatest extent practical, lands acquired pursuant to this

24 section shall be managed and maintained in such a way as to

25 restore and protect their natural state and condition.

26 (3) Moneys from the Water Management Lands Trust Fund

27 shall be available to the five water management districts in

28 the following percentages:

29 (a) No less than 25 percent to the South Florida Water

30 Management District to acquire the fee or a lesser interest in

31 lands, including, but not limited to, lands in the water

1 subsection shall not be reduced except by resolution of the

2 district governing board stating that the need for the moneys

3 no longer exists.

4 (5) Moneys in the fund not needed to meet current

5 obligations incurred under this section shall be transferred

6 to the State Board of Administration, to the credit of the

7 fund, to be invested in the manner provided by law. Interest

8 received on such investments shall be credited to the fund.

-9 (6) To the extent practical, all lands acquired under

10 this section shall be open for public use, such use to include

11 fishing, hunting, camping, hiking, and nature study.

12 (7) A district may dispose of land acquired under this

13 section, pursuant to s. 373.089. However, revenue derived

14 from such disposal may not be used for any purpose except the

15 purchase of other lands meeting the criteria specified in this

16 section.

17 Section 3. Section 201.025, Florida Statutes, is

18 repealed effective July 1, 1991.

19 Section 4. Section 373.590, Florida Statutes, is

20 repealed effective July 1, 1992. Any unobligated moneys

21 remaining in the Water Management Lands Trust Fund on the date

22 of the repeal of that section shall be deposited in the

23 General Revenue Fund.

24 Section 5. This act shall take effect July 1, 1981 or

25 upon becoming a law, whichever occurs later.
