RE: Objections to Department of State rules;
recodification of SWFWMD rules
Attached are the following items:
1. Memorandum to you and letter to Steve Nall regarding l(
our objections to the proposed rules of the Department jL
of State. The memorandum summarizes the hearing held J
on April 8 in Tallahassee. The letter, as discussed /
in the memorandum, states our objections in writing. T'7
2. Recodified rules, in final form (letter-size, with no
coding): This is the form produced by the diskettes
we sent to Tallahassee.
Between the time we sent the diskettes and the time I
was in Tallahassee for the department's hearing, Jay
Ahern pointed out several errors. I corrected these
on the diskettes received by the Department of State,
and have incorporated the changes into this set.
Two additional suggestions were not incorporated into
the diskettes in Tallahassee. I have made these
changes in this set and have dictated a letter to Liz
Cloud asking that the appropriate changes be made in
the diskettes we sent. These changes appear in Rules
40D-2.311, in which the law implemented has been
changed from 373.223 to 373.233, and 40D-3.101(3)(a),
the last word of which has been changed from "used"
to "issued." These were both scrivener's errors and
not changes to the existing rules.
3. Recodified rules (legal-size, coded): The changes
suggested by Jay are incorporated into this set, and
I am sending replacement pages to the Department of
State so that their copies will be accurate.
Both of these sets of the recodified rules are the original
sets. We have them on diskettes at the firm but not in
