Dear Fred:

The Southwest Florida Water Management District anticipates
amending Rule 40D-2.381, Florida Administrative Code. This
rule concerns controlling augmentation and withdrawals from
surface water bodies.

Buddy anticipates taking the request to the Governing Board
at their June 3 or 4, 1980 meeting for approval to commence
rule making procedures.

Enclosed is a notice prepared by me in anticipation of the Board's
approval for publication on June 6, 1980 if Board authority is
given at its June meeting.

Please hold the notice until Buddy or I notify you that it
should be taken to Liz Cloud for publication in the Florida
Administrative Weekly.

RULE TITLE: Limiting Conditions

PURPOSE AND EFFECTS: This proposed rule is to implement the

provisions of Chapter 373, Florida Statutes, and state factors

to be considered before restricting surface water withdrawals

authorized under Consumptive Use Permits.

SPECIFIC LEGAL AUTHORITY UNDER WHICH ADOPTION IS AUTHORIZED AND

LAW BEING IMPLEMENTED, INTERPRETED OR MADE SPECIFIC:

GENERAL AUTHORITY: 373.044, 373.113, 373.149, 373.171, 373.216,

F.S.

LAWS IMPLEMENTED: 373.219, 373.223, 373.244, F.S.

SUMMARY OF ESTIMATE OF ECONOMIC IMPACT: This is the least-cost

method of accomplishing the statutory provisions of managing the

water resources in the District. There will be no effect upon

competition and employment and should not be any change in costs

in implementing the rule. All persons using water within the

District will be benefited and will share the costs of the action

through the payment of permitting fees and property ad valorem

taxes.

A HEARING WILL BE HELD:
