Re. Notice of Rule Amendments To Chapter 16J On
Standardization of Parts and Titles

Dear Buddy:

Pursuant to our conversation at the District on October 9, 1979, I enclose
a a draft of the Proposed Notice for publishing in F.A.W. of Rule Changes to
accomplish the transfer of Water Management District Rules to Chapter 40,
Flor-da Administrative Code, and to place the rules in a standardized for-
mat.

The notice is to schedule a hearing at the December 4, 1979 District Gov-
erning Board Meeting. To meet this date, the notice is to be published in
the November 9, 1979, edition of the Florida Administrative Weekly. The
decisions made at the October 24, 1979 meeting of the Water Management Dis-
t.ict representatives will determine whether some dates will have to be moved
forward.

However, I would appreciate your review and comments on the wording of the
notice.

RULE TITLES: General, Procedural, Consumptive Use, Well Construction, Management and

Storage of Surface Waters, Artificial Recharge,, Works of the District and Land Acquisition.

PURPOSE AND EFFECT: The purpose of these Rule Amendments is to renumber Water Management

Rules from Chapter 16 to Chapter 40, Florida Administrative Code, and to standardize all

five Water Management Districts procedural and substantive rules under common Titles and

Parts.

SUMMARY: Establishes all Water Management District Rules under a separate Chapter 40 in

the Florida Administrative Code and standardization of the procedural and substantive

rules of all five Water Management Districts under common Titles and Parts.

SPECIFIC LEGAL AUTHORITY UNDER WHICH ADOPTION IS AUTHORIZED AND LAW BEING IMPLEMENTED,

INTERPRETED OR MADE SPECIFIC:

SUMMARY OF ESTIMATE OF ECONOMIC IMPACT: This is the least cost method of renumbering the

chapter and standardizing the Titles and Parts of the rules applicable to the Water Manage-

ment District rules promulgated to manage the water resources in the District. There will

be no effect upon competition and employment. The proposed action will involve a minimal

amount of administrative expense to the District to reassign its rules under the standard

format and numbering system. All costs and benefits of this action will be to those

persons using or whose property is affected by the water resources and are subject to

ad valorem taxes; and will facilitate applicants and water resource users in any Water
Management District to locate the pertinent rules under the same common Titles and

Parts in the Florida Administrative Code.
