4 An act relating to eminent domain, attorneys'

5 fees; creating 73.092, Florida Statutes,
prescribing a formula for determining a

7 median amount; establishing criteria for

8 adjusting such amount; providing an effec-
9 tive date.
10 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 73.092, Florida Statutes, is
12 created to read:

13 73.092 Attorneys' fees.--
14 (1) In assessing attorneys' fees provided for in

15 this chapter, the court shall first apply the following
16 formula:

17 (a) Suit fee for the first parcel..........$250
18 (b) Suit fee for each additional parcel....$125
19 (c) On the highest offer prior to filing suit
20 or the estimate of value:

21 5 of the first $i10,000, plus

22 3% of the next $10,000, and
23 701 of the balance

24 (d) On the amount by which the compensation
25 awarded exceeded the highest offer prior to filing suit
26 or the estimate of value:
27 20% of the first $10,000, plus
28 153 of the next $20,000, plus

29 10g of the next $70,000, and

30 55 of all over $100,000

1 (2) The amount so determined shall be considered

2 a median amount subject to adjustment to a lesser or

3 greater amount in special circumstances upon consideration

4 of the following:

5 (a) Benefits, other than the compensation

6 awarded, resulting from the services rendered.

7 (b) The novelty, difficulty and importance of the

8 questions involved.

"9 (c) The skill employed in conducting the cause.
10 (d) The responsibility incurred and fulfilled.

11 (e) The time and labor reasonably required to

12 represent the client.

13 (f) Any other factors appropriate to be con-

14 sidered.

15 Section 2. This act shall take effect October 1,

16 1971, and shall be applicable to actions filed after such

17 date.
