I was please with the results of our meeting at the Causeway
Inn, South, and believe it is a move in the right direction.
Before going much further, I think we will need to have
proposed legislation consistent with the thoughts expressed
at that meeting.
These should include proposed revisions to Chapter 373 and
378, as well as a revision to the local legislation establishing
Southwest Florida Water Management District. This legislation
should make it clear that the Water Management District has the
proper responsibility and authority for managing both the
surface and ground water resources within the District. The
exceptions and limitations contained in the present law should
be removed in order for the District to have full power to act.
The law should also direct the District to undertake these
added responsibilities and if they fail to do so, then the
Department of Natural Resources should step in and assume
I would like to have your recommendations as to just how far
the law should go in granting the District the authority and
responsibility for production of water for distribution and
consumption. How should the allocation of water for consumption
be made? Should this be done by the District, by The Department
of Natural Resources, or by a separate authority?

Who should have the ultimate authority and responsibility for
flood plain zones?
How much water quality control should the District have? How
can this best be coordinated with the local and state pollution
I would appreciate an early response from you on these points
so I can .give this proper distribution and attention in
connection with the Senate hearings this Fall and the local
bill hearings prior to the next Legislative Session which
starts February 1, 1972.
You are familiar with the recommendations of the people
involved in the Governor's Conference that recently concluded
in Miami. I am sure that you would consider them in your
overall review of our situation on the West Coast area.
I appreciate your efforts in setting up the meeting and
look forward to working with you to bring about any needed
revisions in our law.
