L TAMPA BYPASS CANAL 13-001

"A. Parcel Nos. 13-001-325 and 327 (Disposal Area "A") and 13-001-190 (Disposal
Area "B") Investigating the possibility of reactivating old spoil areas south
of U. S. Highway 41 Bridge in order for the Corps to be able to move silt
build up between U. S. Highway 41 Bridge and 22nd Street Causeway (i.e.,
funding for this work is not expected until 1983). Memorandum from C. H.
Miller 2/1/82 advising of the possibility that the spoil area may need to be
reactivated by end of fiscal year for the work to be done by the Corps next
(I fiscal year. Awaiting letter from Corps outlining areas to be used as spoil.
,i I We will then proceed with right of-entry letters for Corps to perform survey
and core analysis.

Sx On 1/3/83 the Corps requested that both disposal areas be obtained for spoil,
as the foundation in both areas will not hold large dikes. Received formal

Corps of Engineers can make core-test borings to determine if the borrow
material will be suitable for building dikes for the shoal removal project on
the TBC. -

C. Parcel No. 13-003-292 This was a parcel of land conveyed to the District by
Hillsborough County in the early 1970's. It was intended that the County
would deed only those portions of Six Mile Creek and other ditch rights-of-
way lying within the right-of-way of Tampa Bypass Canal. However, after
Reviewing the deed it appears that Hillsborough County has deeded to the
District the ditches and low-lying areas adjacent to, i.e., outside, the right-
\ of-way of the Tampa Bypass Canal which they are claiming we are now
S responsible for the maintenance of. Survey is preparing a legal description
of those ditches and low-lying areas lying outside the Tampa Bypass
right-of way. As soon as this is completed, we need to prepare quitclaim
I\ deed to Hillsborough County deeding these areas back to the Cou

D. Parcel No. 13-003-120 On 11/22 3 he city of Tampa requested a 10x15
foot easement on parcel 13-003-120 along Buffalo Avenue to the Bufflo
Avenue right-of-way for extension of water service along east Bufflo
"Avenue from the fairgrounds to Falcon Bird Road. On 11/3/82 the
Governing Board approved a Work of the District Permit in connection with
JJ this proposed water service. Staff and General Counsel have reviewed and
approved this request and will be presenting same to the Hillsboough Basin
board on 2/17/83 and the Agriculture and Land Use Committee and
Governing Board on 3/2/83.

1. At White Construction Company's request, the Hillsborough River
Basin Board on 6/24/82 and District Governing Board on 7/7/82,
approved a right-of-entry permit giving White the right to use as a
haul road, the maintenance berm along the east side of TBC between
Harney Road and 1-75 Bypass now under construction. The haul road
will be used for hauling borrow material from a parcel adjacent to the
TBC to the 1-75 Bypass.
a. Pending execution of the permit, White was granted temporary
access on a month-to-month basis on 5/21/82 and subsequently
renewed twice.

maintenance berms south of Harney Road.

pump water from TBC in connection with cement operation.

E. Parcel No. 13-004-264X DOT Right-of-Entry Spoil Placement (M. Silvey)

S1. DOT requested placement of spoil material which was unsuitable for
their road construction on District property. The spoil originated from
Excavation of the TBC and the property DOT purchased from the
District for 1-75 construction.

1. There are outstanding mineral rights on parcels 13-300-122, 125, 126,
128, 131, 133 and 134 (combined to 13-300-714) which need to be
acquired. These rights have been assessed by the Hillsborough County
^Property Appraiser. We have purchased the 1980 tax certificates on
these parcels and anticipate purchasing 1981 and then file for Tax
Deed. Tax certificate has been redeemed by owners. District
received approximately $17 refund.

cover additional area for acquisition above the 40 foot contour line. Project
Sput on hold as of 7/13/82, Interagency meeting with Corps.

G. Title Certificate No. 51 has been amended to extend the expiration date of
7/30/84. Awaiting acceptance letter from Corps of Engineers.

L ANCLOTE WATER STORAGE LANDS (Starkey) 16-010 (SAVE OUR RIVERS

SA. Parcels 15-010-017 and 16-010-007 have been acquired by the Pinellas-
/ ) k Anclote Basin Board by SOR funding which included a 20 percent match on
the Board's behalf.

SB. Agreement with Starkeys to purchase Parcel Nos. 16-010-008, 009, 010 and
011 over the next four years. Closing on each parcel is to be on or before
S7/31/82 each year. A certified survey is to be supplied to the seller 30 days
Prior to closing.

II. JOE'S CREEK 16-040

A. Phase I Pinellas-Anclote Basin Board and Governing Board have approved
appraisals for parcels 16-040-101, 102, and 103. Offers were made on 9/9/82
to all three property owners. Eminent Domain Resolution approved by
Pinellas-Anclote Basin Board 12/7/82. Approved by Governing Board
1/12/83.

1. Parcel No. 16-040-101 (Dynoptic) Received two appraisals from
owners sent to T. E. Cone 12/1/82.
2. Parcel No. 16-040-102 (Mastry) Owner refused offer and sent
counter-offer 9/17/82. Met with owner's attorney 9/28/82. Letter
10/4/82 to T. E. Cone explaining counter-offer and meeting with the
Mastry's attorney. Meeting with T. E. Cone 10/28/82 regarding
counter-offer. Letter to T. E. Cone 11/18/82 concerning value of
partial taking. Letter from Pinellas County 11/19/82 advising against
donating fill dirt to Mastry. Copy sent to T. E. Cone 12/9/82.
3. Parcel No. 16-040-103 (Bozarth) Owner considering offer. Meeting
with T. E. Cone 10/28/82 regarding counter-offer. Letter from T. E.
Cone to Bozarth regarding eminent domain. Letter to T. E. Cone
11/18/82 giving value of entire taking.

B. Phases II and I Pinellas-Anclote Basin Board and Governing Board have
agreed to proceed with acquisition of Phase II this fiscal year (83) as
budgeted. The Pinellas-Anclote Basin Board also agreed that Basin funding
for FY 84 will not exceed $450,000, with the remaining funding requirements
to be contributed by local governmental entities.

S1. Letter 8/31/82 from T. E. Cone stating it has now been determined
that Florida Power Corporation is willing to consider giving the
SDistrict an easement, since they are fee owners. Meeting 10/28/82
1YATJ between T. E. Cone, T. Fox and M. L. Holtkamp. Second amendment
VA to Largo Agreement (authorizes us to acquire lands by easement and
fee title) approved 12/7/82 by Pinellas-Anclote Basin Board and

executed by the city of Largo and Pinellas County.

2. On 1/10/83 discussed with landowners their desire that the property be
left in its natural state.
a. They said if we purchase their property they are not overly
concerned about a deed covenant. Mr. Wolfe, attorney for Mrs.
Perrine, said he may draft a paragraph for deed covenant.
3. Need to determine from Pasco County representatives how much
money County can contribute to project. Pinellas-Anclote Basin Board
wants to know if Pasco County will contribute at least 20 percent of
the total cost of the property.

Work is being held in abeyance.

I. P-3 STRUCTURE ACCESS 20-201-106

/A. Elected to acquire alternate route to P-3 Structure due to many conse-
quences of using easement to Lake Whistler Estates.

B. Letter to Kirkland concerning agreement to use existing easement title and
C \ survey work are completed.

SC. Talked with Mr. Kirkland on 8/4/82. He would not give a perpetual
easement unless we lower the water level in Lake Whistler. This request is
economically unfeasible.

these sites will be acquired in the Peace River Basin, with the balance being
in the Pinellas-Anclote, Alafia, Green Swamp and Withlacoochee Basins.

C. Status report for these sites is attached.

II. WIP
Project Manager Bill Whitman

.A. In FY 82 there were 208 wells capped and 16 wells plugged in the Alafia
Basin, 93 wells plugged in the Peace Basin, and 57 wells plugged in the
Manasota Basin, with the grand total of 374 QWIP wells completed.

B. There are projected for FY 83 a total of 30 sites to be acquired.

C. Status report for these sites is attached.

m. ROMP

A. In FY 82 a total of 123 ROMP sites were acquired by the District Real
Estate Department.

B. There are projected for FY 83 approximately 15 new ROMP sites to be
