PROCEDURE FOLLOWED IN ADOPTING LAKE LEVELS
FOR LAKE PANASOFFKEE
The formal procedures (i.e., legal aspects) are identical in
adopting lake levels whether a Governing Board member or a
staff member conducts the workshop.
There is a difference in the public response and formality of
the workshop when a Governing Board member presides. When a
Board member presides, I am told that the public seems intimi-
dated and the meeting is more formal. There appears to be much
more open discussion when a staff member presides.
The following is a summary of the steps followed in implementing
the lake level as a rule for Lake Panasoffkee. It is representa-
tive of all lake level rule adoptions.
1. Staff investigates the lake's environment. The staff
undertakes this activity based on a schedule set out
by the Governing Board about four years ago.
2. Staff contacts Board member representing Basin in which
lake located to ask whether they would like to preside
at the public hearing and conduct workshop.
Staff concurrently makes arrangements for workshop
and hearing location in Bushnell.
3. Staff includes request for appointment of Hearing
Officer in January Governing Board agenda. See "A".
Hearing Officer appointed at January Board Meeting.
The Board members of the Basin in which the lake is
located are notified.
4. Notice of workshop to be held February 1, 1982, and
public hearing February 22, 1982, published in Florida
Administrative Weekly issue dated 1-22-82. See "C".
Surrounding land owners, appropriate state and federal
agencies are noticed.
January 25, 1982, general newspaper notice in local
newspaper. See "D".
5. Workshop held February 1, 1982, conducted by Mr. Stubbs.
Opening Statement read by Mr. Stubbs. See "E".
Explanation of lake levels by staff; slide presentation;
questions; distribution of proposed recommended lake
levels; Public Hearing date announced.
6. Public Hearing held February 22, 1982. Mr. Stubbs was
the Hearing Officer. Formal proceeding. Opening

7. Hearing Officer's Recommended Order of April 6, 1982,
included in April Governing Board packet. See "G".
Board adopts Recommended Order and issues Final Order
amending Rule 40D-8 on April 7, 1982, setting Lake
Panasoffkee levels. See "H".
