PROPOSED OPENING STATEMENT FOR PUBLIC HEARING ON PROPOSED RULE SETTING



Now is the time to proceed with the public hearing scheduled for
this date and time.

My name is I am a member of the
Governing Board of the Southwest Florida Water Management District.
I have been designated by the Governing Board to preside at this
public hearing. After this hearing is concluded, I will prepare
a summary of this hearing and any recommended changes for presen-
tation to the Governing Board. (It may be appropriate at this time
to announce when the summary will be presented to the Governing
Board.)

This public hearing is part of the formal rule making process of the
Southwest Florida Water Management District. A proposed lake level
rule has been drafted for lake(s) [name of lakes]. These lakes
are located in [eg: Highland County in the Peace River Basin].
These proposed levels are now up for consideration. The purpose
of this public hearing is to receive testimony and other information
concerning the proposed lake levels.

The Governing Board of the Southwest Florida Water Management
District, pursuant to Chapter 373 and consistent with the state
water policy, has the authority and responsibility to establish
minimum lake levels. This is for the purpose of preventing signif-
icant harm to the water resources or ecology, as well as the
protection of nonconsumptive uses of the area around lakes.

A number of people may wish to speak and should do so in an orderly
manner. I request and expect your cooperation and will attempt to
give everyone a reasonable opportunity to speak. Should you wish
to be heard or present material, sign a slip which is available at
the door or from the staff, and when the lake is being discussed
and your name is called, step'forward, and give your name and
address for the convenience of recording it as part of the record.

RULE SETTING


Now is the time to proceed with the public workshop scheduled
for this date and time.

suggested revisions to the proposed lake level rule

purpose of hearing comments and to consider any suggested
revisions to the proposed lake level rule prior to the

This workshop is for the specific purpose of considering a draft
of a proposed rule which, if adopted by the Board, will set lake
levels for [names of lakes]. These lakes are located in [eg:
Highlands County with the Peace River Basin].

The Governing Board of the Southwest Florida Water Management
District, pursuant to Chapter 373 and consistent with state water
policy, has the authority and responsibility to establish minimum
lake levels. This is for the purpose of preventing significant
harm to the water resources or ecology, as well as the protection
of nonconsumptive uses of the area around lakes.

The staff has recommended that these lakes be considered and is
prepared to recommend that certain levels be set. During the
course of the workshop, the staff will explain why establishing
levels for this lake is desirable and the particular lake levels
which are being recommended. .If a level is set by the Board, it
may have some impact on existing or future water use permits.

On a public hearing will be held on the
proposed rule. It will be presented to the Governing Board for
consideration on ___
