by said District Board of Governors on the 14th day of May, 1975.

changed in any way and is, at the date of this Certificate, in full force

and effect.

Basin advised of all matters relating to it by sending copies of all notices,

agendas and supporting documents relating thereto to the Chairman and to such

other Manasota Basin Board members as so request such materials.

2. The Manasota Basin is hereby respectfully requested to submit sug-

gestions and recommendations and to participate in all meetings, workshops
and other activities relating to all matters affecting the Basin or South-

west District.

3. The Manasota Basin is invited and requested to assign a member of

its Board or staff to serve as coordinator, monitor and spokesman on matters
affecting the Manasota Basin and to occupy office space furnished by South-

west District at its headquarters in Brooksville, Florida, to facilitate
participation in all matters affecting the Manasota Basin.

4. The staff of Southwest District is directed to assist the Manasota

Basin in fully understanding the long-range plans and procedures so it will
be prepared to become an integral part of Southwest District when the trans-
fer can be made.

5. Copies of this resolution shall be forwarded to each member of

the Board of the Manasota Basin and to the Department of Natural Resources.

PASSED and ADOPTED this 14th day of May 1975 by the Governing Board of

the Southwest Florida Water Management District.

SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT

RESOLUTION NO. 601

ESTABLISHING COORDINATION WITH THE MANASOTA BASIN OF THE
RIDGE AND LOWER GULF COAST WATER MANAGEMENT DISTRICT
CONCERNING THE TRANSFER OF THE MANASOTA BASIN


WHEREAS, THE SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT, hereinafter

called Southwest District, was created under Florida Statutes, Chapter 61-691,

as amended, Laws of Florida, Acts of 1961; and

WHEREAS, THE MANASOTA BASIN, hereinafter called Basin, was created as

part of the Ridge and Lower Gulf Coast Water Management District pursuant to

Section 373.069(4), Florida Statutes; and

WHEREAS, Section 373.069(3), Florida Statutes, provides for the area

within the Basin to be transferred to and become a part of the Southwest

District on July 1, 1975, or at such other time as such transfer occurs;

and

WHEREAS, the Southwest District has publicly stated the constitutional,

operational and financial problems that should be resolved prior to the trans-

fer of the area within the Basin and has recommended delaying the transfer

until these problems are more fully resolved; and


WHEREAS, the Southwest District filed suit against Hernando County

seeking a declaratory judgement that the transfer of territory will not

terminate the status and existence of the Southwest District as a special

district vested with continued ad valorem taxing power on the date the 1968

Florida Constitution became effective, which judgement has been denied by

the Circuit Court of the Fifth Judicial Circuit in Hernando County and is

being appealed; and

WHEREAS, the Southwest District believes that the ad valorem tax issue

and other funding and contractual matters should be fully resolved prior to

such transfer but desires to keep the Board of the Manasota Basin advised

of all activities and to afford the Manasota Basin an opportunity to parti-

cipate in all matters affecting the Basin and Southwest District;

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BOARD OF THE SOUTHWEST

FLORIDA WATER MANAGEMENT DISTRICT as follows:


1. The staff of Southwest District is directed to keep the Manasota
