4 An act relating to the Florida Water Resources

5 Act of 1972; amending 373.22i, Florida Statutes;

6 extending the time period for an application for

7 a permit for consumptive use of water; providing

8 an effective date.

10 Be It Enacted by the Legislature of the State of Florida:



12 Section 1. e 373. Florida Statutes, is

13 amended to read:

14 373.226 Existing uses.--

15 (1) All e 'sting -es of water, unless otherwise ex-

16 empted from regulati y the provisions of this chapter, may

17 be continued aFter rao na _th-is permniL system only with a

18 permit issued ias ovided erein, .-

19 (2) The governing boaj or the department shall issue

20 an initial permit foithe ntinuation of all uses in existence

21 before the effective da of implementation of this part if

22 the existing use is a eas able-beneficial use as defined in

23 373.019(5) and is /llowable under the common law of this

24 state.

25 (3) Application for permit under the provisions of sub-, J

26 section (2) must he made within period years

27 from the effective date of implementation of these regulations- '

28 in an area. Failure to apply within this period shall create

29 a conclusive presumption of abandonment of the use, and the
