Authority; and
WHEREAS, the use of Hernando County ad valorem taxes for

the benefit of the West Coast Regional Water Authority is tanta-

mount to being taxation without representation;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY

COMMISSIONERS OF HERNANDO COUNTY, FLORIDA, as follows:

SECTION 1. That the Board of County Commissioners of

Hernando County, Florida, does hereby officially express its stren-

uous opposition to the use of any ad valorem taxes from Hernando

County to support the West Coast Regional Water Authority inasmuch

as such use would constitute a violation of statutory purposes for

such taxes and would create a situation whereby the citizens of

Hernando County would be saddled with taxation without representa-

tion.
SECTION 2. That the Board of County Commissioners of Her-

nando County, as the representative voice of the people and taxpayers

of Hernando County, supports the efforts of those Basin Board members

who oppose such an illegal and unconstitutional taxation scheme.
SECTION 3. That the Board of County Commissioners of Her-

nando County pledges its efforts and resources to continue its op-

position to the utilization of Hernando County ad valorem tax dollars

for unlawful purposes such as funding public utility authorities

that provide no benefit to the citizens of Hernando County.
ADOPTED in Special Session this 30th day of June, 1976.

RESOLUTION NO. 76-53



RESOLUTION OBJECTING TO THE USE OF AD
VALOREM TAXES OF HERNANDO COUNTY BEING
USED TO SUPPORT THE WEST COAST REGIONAL
WATER AUTHORITY


WHEREAS, the Southwest Florida Water Management District

is composed of a number of basin boards for the purposes of carry-

ing out defined statutory duties; and

WHEREAS, such basins are recipients of ad valorem taxes

from counties within the basin in order to fulfill basin purposes

only; and

WHEREAS, the Counties of Hillsborough, Pinellas, and

Pasco and the Cities of Tampa and St. Petersburg created by mutual

agreement in 1974 a public utility known as the West Coast Regional

Water Authority; and

WHEREAS, the West Coast Regional Water Authority is neither

designed nor authorized by law to carry out basin functions; and

WHEREAS, the West Coast Regional Water Authority is seeking

to utilize certain Southwest Florida Water Management District basin

taxes for West Coast Regional Water Authority purposes; and

WHEREAS, such a use of basin taxes is contrary to authori-

zations of law; and

WHEREAS, ad valorem taxes from Hernando County go to pay

for the statutory functions and duties of the Withlacoochee River

Basin and the Pithlachascotee River Basin; and

WHEREAS, the West Coast Regional Water Authority provides

nor serves any useful or beneficial purpose to Hernando County or

to her citizens; and

WHEREAS, Hernando County has no representation upon the

West Coast Regional Water Authority; and

WHEREAS, there is currently a proposal before certain basin

boards of the Southwest Florida Water Management District for the

use of basin board ad valorem taxes for non-basin board purposes

and for the sole and exclusive use of the West Coast Regional Water
