BE IT FURTHER RESOLVED that the County Administrator

and the County Attorney, be and they are hereby authorized to

negotiate any reasonable agreement with Southwest Florida Water

Management District in connection with said easement.

RESOLUTION CONSENTING TO ACQUISITION OF
SEABOARD COAST LINE RAILROAD COMPANY
RIGHT OF WAY BY SOUTHWEST FLORIDA WATER
MANAGEMENT DISTRICT UNDER CERTAIN TERMS
AND CONDITIONS


WHEREAS, it is necessary and imperative that Pinellas

County develop an additional source of water; and

WHEREAS, Pinellas County is proceeding with condemnation

proceedings to acquire the necessary right of way for a water

transmission line to connect its present well field with a new

source of water supply; and

WHEREAS, Southwest Florida Water Management District

has indicated that it would prefer to have title to said rail-

road right of way in its name;and

WHEREAS, Pinellas County has no objection to Southwest

Florida Water Management District taking title to said railroad

right of way so long as Southwest Florida Water Management District

makes a permanent easement available to Pinellas County for a

water transmission line.

NOW, THEREFORE, BE IT RESOLVED by the Board of County

Commissioners of Pinellas County, Florida, in regular session

duly assembled this 17th day of July, 1973, that Pinellas County
has no objection to Southwest Florida Water Management District

acquiring title to the Seaboard Coast Line Railroad Company right

of way so long as the Southwest Florida Water Management District

or any other owner of said right of way makes a permanent easement

available to Pinellas County so that it can proceed with the con-

struction of a water transmission main and such temporary or

permanent wells as may be feasible in or adjacent to said easement.

BE IT FURTHER RESOLVED that the terms and conditions of

said easement must be sufficient for Pinellas County to legally

finance the construction of said project.
