o) P 16 WHEREAS, a common type of irrigation well used in the

0 17 state consists of an open hole of 11 to 24 inches in diameter

27 Be It Enacted by the Legislature of the State of Florida:

29 Section 1. Declaration of policy.--In an effort to

30 prevent further incidents in which members of the public and

31 young children in particular have fallen into irrigation wells

1 in agricultural fields which are open to the public, it is the 1.20/3

2 intent of the Legislature to vest in the Division of Plant

3 Industry of the Department of Agriculture and Consumer 1.20/4

4 Services the duty and responsibility of assisting the 1.20/5

5 Department of Environmental Regulation in its duty to regulate 1.20/6

6 the construction, repair, or abandonment of water wells.

7 Section 2. In addition to the duties and 1.20/9

8 responsibilities of the Division of Plant Industry of the 1.20/10

9 Department of Agriculture and Consumer Services as set forth 1.20/11

10 in s. 570.32, Florida Statutes, whenever the division has 1.20/12

11 reasonable grounds for believing that there has been a 1.20/13

12 violation of part III, chapter 373, Florida Statutes, and

13 rules and regulations adopted pursuant thereto, relating to 1.20/14

14 the regulation of water wells, the Division of Plant Industry 1.20/15

15 shall report such violation. Such report shall be made to the 1.20/16

16 Department of Environmental Regulation.

17 Section 3. This act shall take effect October 1, 1976. 1.35

LEGISLATIVE SUMMARY

Requires the Division of Plant Industry of the u
Department of Agriculture and Consumer Services, whenever
the division has reasonable grounds for believing there
has been a violation of Part III of Chapter 373, F.S.,
relating to the regulation of water wells, to report any
such violation to the Department of Environmental Regulation.
