SAn act relating to water management

5 districts, flood control districts

6 and navigation districts, budgets

7 and auditing; amending S378.28(2)

8 and 378.43, Florida Statutes; creat-

9 ing SS 374.512, 374.513, 374.931 and

10 374.9.32, Florida Statutes, providing

11 that certain districts submit bud-

12 gets to the division of interior re-

13 sources, to the senate and to the house

14 of representatives; providing for cer-

15 tain audits by the auditor general;

18 Be It Enacted by the Legislature of the State of

19 Florida:

20

21 Section 1. Subsection (2) of section 378.28,

22 Florida Statutes, is amended to read:

23 378.28 District budget and hearing thereon.--

24 (2) The budget, including the budgets for the

25 respective watershed basins within the district, if

26 any shall also show the estimated.amount which will

27 appear at the beginning of the fiscal year as obli-

28 gated upon commitments made but uncompleted. There

29 shall be shown the estimated unobligated or net

1 balance which will be on hand at the beginning of the

2 fiscal year, and the estimated amount to be raised

3 by district taxes and from other sources for meeting

4 the district's requirements. Immediately upon com-

5 pletion of the preparation of the budget, the govern-

6 ing board is required to submit copies thereof to

7 the division of interior resources, to the senate

8 and to the house of representatives, together with

9 estimates of all other programmed expenditures of

10 the district and all other requested or anticipated (

11 funds from state, federal and other sources.

12 Section 2. Section 378.43, Florida Statutes,

13 is amended to read:

14 378.43 Audit by auditor general.--At-the

15 direeton-of-the-governorT-andit-of-the-distric s

16 aceounts-may-be-made- from- time- to-ti me-by-tfhe- auditero

17 general7-and-sueh-aundit-shall-be-within-the- auhorty
18 ef-said-adtfaer-general7-to-makeT--eopy-of-sueh

19 audit-shall-be-furnished-the-governer-and-the-govern-

20 -ng-board-of-the-distritetfy The auditor general is

21 authorized to audit the accounts and records of the

22 districts, as prescribed by 11.45. In addition to

23 the distribution of copies of the audit, as required

24 by 11.45, a copy is to be filed with the division

25 of interior resources and a copy is to shall be filed

26 with the clerks of circuit courts of each county

27 within or partly within said district. The expense

28 of said audit is to shall be paid by the district

29 upon a statement thereof rendered to the district by

1 the auditor general. Payment of the amount thereof

2 is to shall be made to the state department of bank-

3 ing and finance to be entered in and to reimburse

4 the account of the auditor general so as not to re-

5 duce the legislative appropriation for said auditor

6 general.

7 Section 3. Sections 374.931 and 374.932,

8 Florida Statutes, are created to read:

9 374.931 Budget,--Immediately upon completion

10 of the preparation of the budget, the district direc-

11 tors are required to submit copies thereof to the

12 division of interior resources, to the senate and to

13 the house of representatives, together with estimates

14 of all other programmed expenditures of the district

15 and all other requested or anticipated funds from

16 state, federal and other sources. This section ap-

17 plies to all waterways development and other navi-

18 gation districts, including all districts created

19 pursuant to the provisions of this chapter and all

20 districts heretofore and hereafter created by special

21 act of the legislature.

22 374.932 Audit.--The auditor general is autho-

23 rized to audit, as prescribed by 11.45, the accounts

24 and records of all waterways development and other

25 navigation districts, including all districts created

26 pursuant to the provisions of this chapter and all
27 districts heretofore and hereafter created by special

28 act of the legislature. In addition to the distribu-

29 tion of copies of the audit, as required by S11.45,

1 copies are to be filed with the division of interior

-2 resources and with the clerks of the circuit courts

3 of each county within or partly within the district.

4 The expense of the audit is to be paid by the dis-

5 trict upon a statement thereof rendered to the dis-

6 trict by the auditor general. Payment of the amount

7 thereof is to be made to the department of banking

8 and finance to be entered in and to reimburse the

9 account of the auditor general so as not to reduce

10 the legislative appropriation for said auditor gen-

11 eral.

12 Section 4. Sections 374.512 and 374.513,

13 Florida Statutes, are created to read:

14 374.512 Budget.--Immediately upon completion

15 of the preparation of the budget, the district board

17 of interior resources, to the senate and to the house

18 of representatives, together with estimates of all

19 other programmed expenditures of the district and

20 all other requested or anticipated funds from state,

21 federal and other sources. This section applies to

22 all navigation districts, including all districts

23 created pursuant to the provisions of this chapter

24 and all districts heretofore and hereafter created

25 by special act of the legislature.

26 374.513 Audit.--The auditor general is au-

27 thorized to audit, as prescribed by 11.45, the ac-

28 counts and records of all navigation districts, in-

29 eluding all distTricts created pursuant to the provi-

1 sions of this chapter and all districts heretofore

2 and hereafter created by special act of the legisla-

3 ture. In addition to the distribution of copies of

4 the audit, as required by S11.45, copies are to be

5 filed with the division of interior resources and

7 within or partly within the district. The expense

8 of the audit is to be paid by the district upon a

9 statement thereof rendered to the district by the

10 auditor gerieral. Payment of the amount thereof is

11 to be made to the department of banking and finance

12 to be entered in and to reimburse the account of the

13 auditor general so as not to reduce the legislative

14 appropriation for said auditor general.

15 Section 5. The provisions of this act are to

16 be liberally construed and shall take precedence over

17 any existing section of Florida Statutes which may

18 be in conflict with it regarding the budgeting and

19 control of expenditures.

20 Section 6. This act shall take effect upon

21 becoming a law.
