Statutes, in so far.as such Chapter may Relate to the Unincor-
porated Areas of Hillsborough County


The bill will allow the County to establish the procedures
for the creation, operation, financing and management of
water management districts under the home rule powers granted
in Chapter 125, Florida Statutes. The County is drafting an
ordinance that will provide a streamlined procedure for the
creation of all special taxing districts located in the unincor-
porated areas of the County. When completed, the.ordinance will
provide for the creation of special taxing districts by petition
to the Board of County Commissioners. The ordinance would thus
make unnecessary the elaborate procedures that are required
under such Chapters as Chapter 298, Florida Statutes. The bill
also provides for the continuation of existing districts and
requires that consolidation of districts created under Chapter
298, Florida Statutes with districts created by the Board of
County Commissioners shall be according to the procedures found
in Chapter 298, Florida Statutes.

and consolidation; providing an effective date.

18 Be It Enacted by the Legislature of the State of Florida:

20 Section I. Chapter 298, Florida Statutes, is hereby

21 repealed in so far as such chapter may relate to the unincor-

porated areas situate wholly within Hillsborough County.

After the effective date of this act, the creation, financing
24
and management of water management districts situate wholly

within the unincorporated areas of Hillsborough County and

27 not consisting of any lands located in other counties shall

28 be according to the provisions established by the Board of

29 County Commissioners of Hillsborough County under the home

rule powers enumerated in Chapter 125, Florida Statutes, or

1 other applicable law, except as provided in Sections 2 and 3

2 below.

3 Section 2. Existing districts created under Chapter

298, Florida Statutes, situate wholly within the unincor-
5
porated areas of Hillsborough County and not consisting of
6 0
any lands located in other counties shall continue in exist-
7
ence and shall continue to exercise all' the powers presently

9 authorized by Chapter 298, Florida Statutes.

10 Section 3. Districts created by the Board of County

11 Commissioners under the home rule powers enumerated in Chap-

12 ter 125, Florida Statutes, or other applicable law shall be
13
consolidated with districts created under Chapter 298,
14
Florida Statutes, as provided by Section 298.08, Florida
15
Statutes.

17 Section 4. This act shall become effective

18 immediately upon becoming law.
