THURSDAY, JANUARY 19, 1967 .


Pursuant to adjournment, the Board of County Commissioners et

public hearing at 10:00 A.M. in the Board Room, Courthouse, Tampa, Florida,

I Ithe usual place of meeting. ." .

The following members were present: Chairman Clarence E. Prevatt,

Commissioners Ellsworth G. Simmons, John Glaros, Rudy Rodriguez and Frank Neff.


The meeting was called to order and presided over by the Chairman,

who stated that this was a public hearing, for the purpose of considering

whether it should establish, by resolution, a water conservation district

under and pursuant to Chapter 22935, Laws of Florida, Acts of 1945, en-

compassing all or part of the following portions of Hillsborough County:

Begin at the intersection of Section line between Section 33 and 34,
Township 30-South, Range 18 East with the waters of Tampa Bay; thence westerly i
"in Tampa Bay to the County line between Hillsborough and Pinellas Counties;
thence northerly, westerly and then north along said County line to the north- I
west corner of Section 6, Township 27 South, Range 17 East, being the northwestIi
corner of Hillsborough County; thence east along the North boundary line of
Hillsborough County to the northeast corner of Section 1, Township 27 South,
Range 22 East, being the northeast corner of Hillsborough County; thence south !!
along the east boundary line of Hillsborough County to the southeast corner of
-Section 24, Township 28 South, Range 22 East: thence west to northwest corner
of Section 27, Township 28 South, Range 22 East; thence south to southeast
corner of Section 33, Township 28 south, Range 22 East; thence west to south-
west corner of Section 32, Township 28 South, Range 22 East; thence south to
southeast corner of Section 6. Township 29 South, Range 22 East; thence west
to southwest corner of Section 6, Township 29 South, Range 22 East; thence

Mr. Ward Dougherty of Dundee Ranch made a presentation to the Board,
indicating that his organization was in favor of the creation of such a
district.

SMr. Dale Twachtmann of the Southwest Florida water Management District
next appeared, presenting the Board members with a copy of his statement for
presentation, which he read. Mr. Twachtmann also read the report of Mr. Willii
F. Guyton, which was prepared at the request of his organization. Members of
the United States Geological Survey connected in this with Mr. Twachtmann, and
people who work with it, were introduced. |

Following Mr. Twachtmanns presentation, the following persons appeared
in objection to the proposal for the creation of a water district:

the Southwest Florida Water Management District in this matter.
"We believe no water regulatory district is needed at this time because I i
Sthe ground water resource is not being endangered, and the isolated economic
problems being caused on the surface cannot be solved by the regulation of
pumping they can probably only be solved by a.cessation of pumping."

Following considerable general discussion, Motion was made by Commissioner
Neff, seconded by Commissioner Rodriguez and carr ed, that the following
resolution be. adopted: .


R E S 0 L U T I N .



WHEREAS, The Board of County Commissioners of Hillsborough County,

Florida, is authorized and empowered under The Chapter 22935, Laws of Florida,

Acts of 1945, to establish one or more water conservation districts within

Hillsborough County; and

WHEREAS, notice of the time, place and purpose of a special meeting

of the Board of County Commissioners of Hillsborough County, Florida, to be

held to consider whether such a water conservation district should be created

under the referenced statute, was published once in The Tampa Tribune and

once in the Tampa Times, both of which are newspapers of general circulation

in Hillsborough County, on January 6, 1967, a date not more than fifteen

days nor less than ten days prior to the holding of such special meeting; and

WHEREAS, the Board of County Commissioners of Hillsborough County

has heretofore caused to be made extensive hydrological studies of ground

water, lake level and surface water conditions in Northwestern Hillsborough

County, the most recent of said studies having previously been filed with the

Board and having been outlined orally to the Board by its consulting geologist

Frank Andrews of George Aase and Associates, Inc., at the special meeting

held this day for the aforesaid purpose; and

J rWHEREAS, it is evident to the Board from the Andrews' hydrological

studies, as well as from other evidence presented to it, that there exist in

Hillsborough County problems respecting the use of ground water, and respecting

the maintenance of ground water levels and lake levels sufficiently grave in n tur

nature to make desirable the creation of a water regulatory district and the

implementation of that district by the development, establishment and operation

of such water conservation plans, measures and facilities as may be necessary

or appropriate for the preservation, conservation and use of the water re-

sources of the area hereinafter described:

NOW, THEREFORE, on motion by Commissioner Neff, seconded by Com-

missioner Rodriguez, and unanimously adopted by the Board of County Com-

missioners of Hillsborough County, Florida, it is


RESOLVED, that the Board of County Commissioners of Hillsborough

County, Florida, under and pursuant to Chapter 22935, Laws of Florida, Acts

of-1945, do hereby create a water conservation district, to be known as The 4

RESOLVED FURTHER, that the Board of County Commissioners of Hills-,

borough County, Florida, shall constitute the Board of CoJmmissioners of The

Hillsborough County Water Conservation District and that, in such capacity. ,

they shall immediately take steps directed toward the development of a code

of such rules and regulations as may be necessary and appropriate for the

preservation, conservation and use of the water resources of the area com-

n prising the said district.





Following the adoption of the above resolution, the Chairman i

thanked each of the persons'in attendance and stated that a meeting would be heo

at a date yet to be announced, for the formulation and adoption of rules and

regulations, for the operation of this district.

statement of the Southwest Florida Water Management District, and the

foregoing resolution may be found in the official files of the Board of

County Commissioners of Hillsborough County, Florida. Also established in I

the files of this office is Proof of Publication furnished by the Tampa

Tribune, that this Notice of Public Hearing was published in their issue of

January 6, 1967. All legal requirements were met, for the holding of this

Public Hearing.



















There being'no further business to come before the Board, the

meeting was adjourned at 12:00 Noon.
