RE: SWF Permit Procedure

Central & Southern handles their rules in a much looser
fashion than we do. Many things are not put in their
rules and they merely go by "staff policy" until challenged.

Last month, the Governing Board authorized them to work
with several county commissions toward a cooperative
agreement where the county would be the only agency required
to issue permits for surface water management on tracts
smaller than 50 acres. In order to qualify, various counties
are required to meet with their staff to establish water
management criteria acceptable to both parties and then adopt
the criteria into the county's local ordinance.

In a related matter, notices are being sent to all permit
applicants spelling out additional data that the staff may
feel is needed, including zoning for the area and whether
it conforms to the applicant'sintended use, whether the
proposed use has received the necessary approval from the
local jurisdiction, and whether there will be significant
environmental effects through a land use change. Applicants
wanting permits for public water supply will be required to
furnish population and numbered dwelling units served 10
years prior to date and numbered to be served 10 years from
date, and the proposed population, with existing zoning, at

This kind of environmental emphasis has been applied by their
staff in evaluating DRI's.

FCD has also initiated 2 new policies in an effort to streamline
their procedure. After evaluating an application for a surface
water management permit or a consumptive use permit, the techni-
cal staff prepares a comprehensive report recommending the permit
be approved, denied, or approved with modifications. They then
publish this position along with the routinely advertised date
that the application will come before the Governing Board for
consideration. Between the published notice and the date each
application will be considered, answers to persons will have
at least 14 days to submit objections to the issuing of the

permit or to the staff's recommendation, In order to decrease
the waiting period between the receipt of an application and
final disposition by the Governing Board, all hearings are
scheduled before the board at its regular monthly meetings.
If objections are received, then the hearing is rescheduled
and referred to a state hearing officer to preside,

They are taking just the opposite position than we are. Their
board is referring all controversial permits to the hearing
officer and handling all the noncontroversial ones.
