How To Get A Copy Of The Rules And Regulations

A copy of the adopted Rules and Regulations is available from the Southwest Florida Water Man-
agement District by sending a written request to:

A copy of the Rules will be forwarded to you by return mail.

Requirements For A Completed Application

* You must include with your completed application:

1. A check or money order for $10.00
2. A completed affidavit, or letter of waiver,
3. The application itself,
4. An accurate legal description of the land owned, leased or otherwise controlled which is to be
considered under this application, and
5. A survey or scaled sketch showing the boundaries of the property and the location of the points
of diversion or withdrawal. Also show on this sketch the locations of any other diversion or
withdrawal facilities which are not being considered under this application. Make sketch
8% x 11" in size; or foldable to 81/2 x 11".

These must be mailed or delivered to the District Office (Headquarters) in Brooksville in the enclosed
envelope.


WHAT TO EXPECT FROM THE DISTRICT

The application and the attachments, will be screened for completeness, including:

1. Fee
2. Necessity of permit
3. All appropriate blocks are filled
4. Affidavit
5. Notary signatures and seals

If complete, the application will be prepared for computer processing. While being processed, some of the
same items will be re-checked for accuracy as well as completeness.












If the application or fee is in error, the application processing will be discontinued until the errors) is/are
corrected.

After a properly completed application is received, the District will attempt to either issue a permit or
denial or notify you of a hearing within 45 days. If a hearing is to be held, the District shall inform you at
least 10 days in advance of the hearing date and will specify the date and location of the hearing.


HOW TO GET ASSISTANCE

A District representative will be available to you for assistance in the proper completion of the application/
affidavit form(s). The location and availability of these representatives is shown on the enclosed schedule.

INTRODUCTION/PURPOSE

Rules and Regulations were adopted by the Southwest Florida Water Management District and the South-
west Florida Water Management District (Regulatory) September 11, 1974 as a result of responsibilities
promulgated by the Water Resources act of 1972 (72-299). This act modified and expanded Chapter 373,
Florida Statutes which determined the responsibilities of the District.

The accompanying application is for the purpose of permitting the Consumptive Use of Water. The District
can more effectively accomplish its purpose of maintaining and regulating the use of water to the maximum
beneficial use'by knowing how and where water is to be consumed.


LEGAL LIABILITY OF APPLICANT

It is essential that all blanks be filled in with accurate information. Information contained in the
application may be used at a hearing, under oath. Any. material misstatement, misrepresentation or willful
violation or disregard of any rule or regulation adopted and promulgated by the Governing Board will be
grounds for rejection, suspension or revocation of the permit pursuant to the procedure set forth in these
rules and other statutory penalties.

INSTRUCTIONS FOR PROPERLY COMPLETING THE CONSUMPTIVE USE APPLICATION


Item 1. Name (block numbers 31 through 62)

If this application is for a private use, print or type your last name first, skip space, first name, skip space,
then middle initial. If this application is for a corporation or municipality, print or type the name of the
corporation or municipality.


Item 2. Ownership (block 63)

If you own the property, print or type an "0" in block 63; if not, print or type an "L" in block 63. If the
response is "L", or if there is more than one owner, be sure to list the (other) property owners) on the
Affidavit form and indicate their ownership by placing an "O" after the name.


Item 3. Mailing Address (blocks 64 through 96)

Print or type your street or postal box number in blocks 64-96.


Item 4. City, State, Zip Code (blocks 13 through 47)

Print or type the name of the city of residence.

b. State (blocks 41 and 42)
Print or type the appropriate state code for the state of residence found on Table 2-1.

Item 5. Current Permit Number (blocks 48 through 54)

If this application is for a renewal or a modification of a current consumptive use permit, print or type the
current permit number. If not, leave blank.


Item 6. Application Type (block 55)

If this application is for a continued use of water which existed prior to January 1, 1975 and a con-
sumptive use permit has not been issued print or type a "1" in block 55.

If for a use of water begun after December 31, 1974, print or type a "2" in block 55.

If for a renewal or a consumptive use permit print or type a "3" in block 55.

If for a modification of a current consumptive use permit print or type a "4" in block 55.


Item 7. Number of Property Owners (blocks 56 through 58)

Print or type the number of property owners appearing on the properly completed affidavit form (See
Section 3, "Instructions for Properly Completing The Affidavit Form"). Be sure to have the last digit in
block number 58, If you are including a letter of waiver in place of an affidavit print or type "999" in
blocks 55 through 58.

Item 8. Total Contiguous Acreage (blocks 59 through 65)

Print or type, to the nearest 1/10 acre, the number of acres enclosed within the property boundaries de-
scribed in the legal description required with this application. Contiguous acreage is defined as the acreage
enclosed by one continual property line. Rights-of-way are not considered to be breaks in the property line.
Be sure to have the last digit in block number 65. (1/2 acre = .5, 1/3 acre = .3, 1/4 acre = .3, 1/5 acre = .2)

Item 9. Percent Disposed Off-Site (blocks 66 through 68)

Print or type the percent of water requested which will be transported or disposed of outside of the pro-
perty indicated by the legal description as the contiguous acreage: The amount of water which is discharged
into the Gulf of Mexico, a sewer or flowing stream which transports the effluent from the property
described in Item 8 or which becomes a constituent of the product manufactured or processed, is also con-
sidered to be disposed of off-site. For example, if the water is being used for the manufacture of liquid
fertilizer; the percent of the water withdrawn which becomes part of the liquid fertilizer would be considered
disposed of off-site.


Item 10. Basin (blocks 69 and 70)

Locate your facility on the map on Figure 2-1 and determine which basin contains most of your contiguous
acreage. Print or type the code found on figure 2-1 for the basin in blocks 69-70.


Item 11. County (blocks 71 and 72)

Locate your property on the map on Figure 2-2. Determine the county in which most of your contiguous
acreage is located. Print or type the code found on figure 2-2 for the county in blocks 71-72.


Item 12. Ground or Surface Water (block 73)

If the withdrawal is to be made from lakes or other impoundments, or stream or other watercourses, print
or type a "2" in block 73.

If the withdrawal is to be made from a well and a lake, print or type a "3" in block 73.

If the withdrawal is to be made from a well and a stream or other watercourse, print or type a "3" in block
73.


Item 13. Number of Withdrawal Points (blocks 74 through 76)

Print or type the number of points which will be withdrawing water for the uses applied for in this
application.

Item 14. Use, Percent Distribution, Percent Acreage (blocks 13 through 75)

a. Use (Column A)

Find the specific uses of water requested in Table 2-2. Opposite this use is a three-digit code. Print or:
type this code in the blocks provided in Column A. Be sure the last digit falls into the right-hand-most
block on that line.

b. Percent Distribution (Column B)

For each use code, print or type the percent of the water requested which will be put to that use. For
example, if you withdraw water for your home in addition to your irrigation needs, calculate the per-
cent of water for each use:

Water Requested 100,000 gallons per day
Domestic Use 1,000 gallons per day
Irrigation (citrus, by sprinkler) 99,000 gallons per day
Percent Domestic = 1,000 x 100 = 1 percent

Percent Irrigation = 99,000 x 100 = 99 percent

Be sure.the last digit falls into the right-hand-most block on that line.

c. Percent Acreage (Column C) For Irrigation Codes Only

For each irrigation use code, print or type the percent of acreage allocated to this use.

For example, if you list 1,000 acres in Item 8, and only 700 acres are devoted to your citrus operation;
calculate the percentage of the 1,000 acres allocated to citrus irrigation.

Percent Citrus = 700 x 100 = 70 percent

If the water requested is for private lawn sprinkling of an area five (5) acres or more, print or type the proper
percent acreage in the proper blocks. If the lawn to be sprinkled is less than five (5) acres, this use is included
in the "Domestic Supply" code.

If the use is for domestic, emergency services, or industrial codes, print or type "999" in the proper blocks.

Be sure the last digit falls into the right-hand-most block on that line.

If the response to Item 12 is "1", turn to "Instructions For Page 2A", and follow the instruction there for

Item 16A. Boundary Location (blocks 27 through 38).

Print or type the latitude/longitude coordinates of the point on your property boundary which lies
closest to the corresponding well. Figure 2-3 shows an example of the property boundary requirement.


Item 17A. Aquifer (blocks 39-40)

Locate in Table 2-3, the condition which best fits the well and aquifer from which the water is to be
withdrawn. Print or type the code appearing opposite this condition.

Item 18A. Maximum Daily Withdrawal (blocks 42 through 48)

Print or type the maximum expected withdrawal for a single day in gallons from the corresponding well in
the blocks provided. Be sure to enter the information so that the last digit is in block number 48.

Item 19A. Average Daily Withdrawal (blocks 49 through 56)

Print or type the estimated average daily withdrawal in gallons per day from the corresponding well in blocks
49 through 56. The average daily withdrawal may be calculated by dividing the total expected yearly with-
drawal (in gallons per year) by 365. For example, the total expected yearly withdrawal is equal to 400,000,000
gallons per year.

The average daily withdrawal = 400.000,000 = 109,589 per day.

Item 20A. Pump Rating (blocks 57 through 59)

Print or type the horsepower rating of the pump motor (usually listed upon the manufacturer's information
plate) in blocks 57 through 59. If unknown, print or type "999" in the blocks. If the well flows naturally
and there is no pump installed, print or type "888" in the blocks. Be sure the last digit falls into block
number 59.

INSTRUCTIONS FOR PROPERLY COMPLETING THE AFFIDAVIT FORM

Enclosed in the Application Packet is an affidavit form. In each block of the form, print or type the names
and addresses of the property owners according to Tables 3-1 or 3-2. If the water requested is to be with-
drawn from a well, the requirements are found on Table 3-1. If the water is to be withdrawn from a body of
surface water, the requirements are found on Table 3-2.

The failure to list all property owners and their correct addresses may result in the delay in the processing
of your permit application.

Sign your name in the presence of a notary public. Have the notary public fill in the blanks sign and seal the
form.

If the application is for an existing use as defined in Item 6, the requirement of an affidavit may be
waived upon special permission of the Governing Board. Applicants must send a letter of request for
waiver to the:

1. If the withdrawal is from a lake or other impoundment having an area of 80 acres or less; list all
property owners along the shoreline, within 660 feet in each direction from the property boundaries
described in Item 8 of the Application.

2. If the withdrawal is from a stream or other watercourse, and the withdrawal is for 5,000,000 gallons
or less for a single day (see Item 20B): list all property owners within 660 feet upstream and within
1320 feet downstream from the property boundaries described in Item 8 of the Application.

3. If the withdrawal is from a stream or other watercourse and the withdrawal is for more than
5,000,000 gallons for a single day (see Item 20B); list all property owners within 1320 feet upstream
