2. Concurrent with the filing of this motion, Petitioners

have filed three separate petitions requesting that the applica-

tion be referred to the Division of Administrative Hearings for

the assignment of a hearing officer to conduct a formal hearing.

3. The Northwest Hillsborough Regional Well System, the

Section 21 Wellfield and the Cosme-Odessa Wellfield are all

located in the northwest section of Hillsborough County and the

resolution of the issues raised in the three separate petitions

involve similar issues of law and similar issues of fact.

Further, the same parties are interested in or will be affected

by the final agency action on the applications for consumptive

use permits.

4. The consolidation of the three petitions will promote

the just, speedy and inexpensive resolution of all matters.

5. The consolidation of the three petitions will not unduly

prejudice the rights of any party.

WHEREFORE, Petitioners request that the three petitions be

consolidated and assigned to the same hearing officer for final

hearing.

MOTION TO CONSOLIDATE

Petitioners, West Cost Regional Water Supply Authority,

Hillsborough County and City of St. Petersburg, by and through

their undersigned attorneys and pursuant to Florida Administra-

tive Code Rule 28-5.106, respectfully request that the above

referenced matters be consolidated for a final hearing, and as

grounds therefore state:

1. Petitioners in the above referenced matters have filed

applications for consumptive use permits for the Northwest Hills-

borough Regional Well System, the Section 21 Wellfield and the

Cosme-Odessa Wellfield. i
