SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT (REGULATORY)

RESOLUTION NO.


ADOPTING AN ORDER TO THE CITY OF ST. PETERSBURG
REGULATING AND CONTROLLING THE OPERATION OF CERTAIN WELL FIELDS
LOCATED IN HILLSBOROUGH AND PASCO COUNTY, FLORIDA


WHEREAS, pursuant to the authority of Section 373. 171, Florida Statutes, the South-

west Florida Water Management District (Regulatory) may promulgate orders regulating

the use of water and requiring the modification of existing use; and


WHEREAS, the Southwest Florida Water Management District (Regulatory) prepared a

proposed order to the City of St. Petersburg affecting certain existing uses and facili-

ties, and on December 8, 1971 and January 12, 1972, held a public hearing on said

proposed order, upon notice and in accordance with the requirements of Section

373. 151 and Section 373.171, Florida Statutes; and


WHEREAS, upon completion of said hearing the Southwest Florida Water Management

District (Regulatory) considered the submitted evidence and arguments with respect to

the proposed order; and


WHEREAS, the Board of Governors has reviewed the statements, written and oral,

made at the public hearing and the statements, briefs, and other instruments duly

submitted for inclusion in the record of the public hearing, and has carefully con-

sidered the evidence, arguments, reports and data with respect to the proposed

order; and


WHEREAS, the Board of Governors finds that a preponderance of the evidence

offered at said hearing shows that unregulated withdrawals of water by the City of

St. Petersburg from the Cosme-Odessa well field and Section 21 well field are

detrimental to the other water users and the water resources of the State of

Florida; and


WHEREAS, the Board of Governors finds that a preponderance of the evidence

offered at said hearing shows that the withdrawals of water by the City of St.

Petersburg from the Pasco well field must also be regulated in order to obtain the

most beneficial use of the water resources of the state and to protect the public

health, safety and welfare and the interests of the water users affected; and


WHEREAS, the Board of Governors further finds that a preponderance of the evidence

offered at said hearing shows that the limitations set forth in the order will allow

maximum beneficial utilization, development and conservation of the water resources

of the State of Florida in the best interest of all its people.


NOW, THEREFORE, BE IT RESOLVED by the Board of Governors of the Southwest

Florida Water Management District (Regulatory) that the following order, designated

ORDER NO. 72-1, is hereby adopted by the Board of Governors of the Southwest

Florida Water Management District (Regulatory).

The Board of Governors of the Southwest Florida Water Manage-

ment District (Regulatory) ORDERS that the City of St. Petersburg comply

with the following instructions:

1. The withdrawals frcn the Cosme-Odessa well field shall be regulated

and controlled in a manner such that the weekly average elevation, as

defined, of the potentiometric surface of the Floridan aquifer shall not

be less than:

a. Twenty-one (21) feet above mean sea level, as measured at

the "Water Plant E-100" observation well (280548N0823557).

b. Twenty-four (24) feet above mean sea level, as measured at

the "James 11" observation well (280703N0823417).

c. Twenty-three (23) feet above mean sea level, as measured

at the "Calm 33A" observation well (280836N0823438).

2. The withdrawals from Section 21 (Lutz) well field shall be regulated

and controlled in a manner such that the weekly average elevations

defined, of the potentiometric surface of the Floridan aquifer shall not

be less than:

a. Thirty-two (32) feet above mean sea level, as measured at

the "Hillsborough 13" observation well (280704N0823030).

b. Thirty-tlhree (33) feet above mean sea level, as measured at

"Jackson 26A" observation well (280753N0823059).

3. Within four months after the effective date of this order a deep

observation well must be constructed by the City near the center of the

Pasco well field. This well must be designed to monitor the quality and

potentiometric head at or near the bottom of the potable water supply in

the Floridan aquifer. Plans and specifications for this well must be

submitted to and approved by the Southwest Florida Water Management

District (Regulatory) prior to construction.

4. During the initial six months of operation of the Pasco well field

specific and detailed individual discharge quantities and corresponding

periods of pumping must be supplied to the Southwest Florida Water

Management District (Regulatory) on a monthly basis. Thereafter these

reports must be supplied at least quarterly.

5. As nearly as practicable during the initial six months of operation

of the Pasco well field, the City will perform one or more thirty day

pumping tests as designed and supervised by the United States Geolog-

ical Survey.

BE IT FURTHER RESOLVED by the Board of Governors of the Southwest Florida

Water Management District (Regulatory) that:

1. The well field and observation well sites referred to in this resolu-

tion and the attached order are shown on the attached map, marked as

Exhibit 1.

2. The elevations set forth in the order for specific potentiometric

levels are subject to review, and change if necessary, by the Board

of Governors at each six months anniversary of the effective date of

the order or sooner ifthe Board deems necessary.

3. Specific potentiometric levels for the Pasco well field will be estab-

lished at the time of the first review, as set forth in paragraph 2 above.

4. The order shall become effective when the Pasco well field becomes

operational, as determined by Southwest Florida Water Management

District (Regulatory). The Southwest Florida Water Management District

(Regulatory) shall notify the City in writing of the effective date of the

order.

5. Definition: Weekly Average Elevation -- The weekly average eleva-

tion of the potentiometric surface will be calculated by using two readings,

the high and the low for each day of the calendar week. The average of

these daily figures for the calendar week will represent the weekly average

elevation of the potentiometric surface.


BE IT FURTHER RESOLVED by the Board of Governors of the Southwest Florida

Water Management District (Regulatory) that copies of this resolution shall be

mailed forthwith to the City of St. Petersburg and to all other persons submitting

a written request for same to the Southwest Florida Water Management District

(Regulatory).
