r.Tp ste -por e that the Department of Environmental Regulation (DER)
has advised that a public hearing will be held at 10:00 a.m. on Wednesday,
December 20, 1978, in Tallahassee to adopt the State Water Use Plan (SWUP).
Mr. Palmer briefed the Board on DER's intent to give the SWUP some formal
status in the form of an advisory and technical document as set out in a
letter from Secretary Landers dated September 15, 1978. Chairman McAteer
stated that he was concerned with the Governor's Executive Order of Proclamation
and asked Mr. Blain to address the matter. Mr. Blain advised that the method
by which the SWUP is adopted is set out precisely in the law and no provision
is made for an advisory plan. He suggested that the advisory plan DER is
proposing be closely monitored by the water management districts to assure
that it is used as intended. Mr. George Wilson, representing DER, stated
that the basic reason for developing the SWUP as an advisory document is
based on Chapter 373 of Florida Statutes which states that the SWUP will be
a functional element of the State Comprehensive Plan. He said by creating a
Phase I advisory document, a first step of completing a comprehensive set of
water use principles, basically comprised of the water use principles and
policies of the individual water management districts could be accomplished.
Mr. Blain said the proposed preparation of introductory material concerned
him in that the Board will not have adequate time to review it before
publication. He said the District is most concerned that the expression of
the various water management districts is set forth clearly in the final State
Water Use Plan.

Mr. Palmer advised the Board that a request has been received from DER to
retype and make minor format changes to the Executive Summary of the District
Water Management Plan. He said the District supplied DER with a loose leaf
copy of the summary to aid in revisions. Mr. Palmer said the Planning Division
could comply with this additional typing but requested Board guidance regarding
the matter. Chairman McAteer stated that DER should be notified to make the
necessary revisions.
