5 SUMMARY OF RULE: The purpose of this Rule is to implement Chapter 373, Florida

6 Statutes, which provides for the Governing Board of the District to adopt Rules
7 and Regulations to implement the declared water policy of the Southwest Florida
8 Water Management District, and to implement Chapter 120.53, Florida Statutes,
9 requiring Water Management Districts to adopt Rules governing procedures and

10 conditions for obtaining permits within the area transferred to the Southwest
11 Florida Water Management District.
12 PART 1 Works of the District

13 16J-1.003 Implementation is amended to read:
14 Part 1 shall continue to be implemented throughout the entire area

15 which remained as part of the District after the transfer pursuant to Chapter
16 76-243, Laws of Florida, which occurred at 11:59 p.m. cn December 31, 1976; and
17 shall be immediately implemented in the areas transferred as a part of the
18 District pursuant to Chapter 76-243, Laws of Florida, which occurred at 11:59 p.m.
19 an December 31, 1976. In addition, Part 1 shall be immediately implemented in
20 the area transferred as a part of the District pursuant to ater 78-65, aws of
21 Florida, which occurred on July 1, 1978. If any provisions of Part 1 are
22 inconsistent with prior rules and procedures, the new provisions shall apply
23 cnmencing September 6, 1978.

27 ESTIMATE CF ECONOMIC IMPACT CN ALL AFFECTED PERSONS: The proposed Amendment will
28 implement the existing rules in the annexed and unregulated areas as will exist
29 pursuant to Section 1, Chapter 78-65, Laws of Florida. It is the purpose of this
30 Rule to protect the water resources of the District. It is impossible to establish
31 a cost-benefit ratio of the action, but the benefits should exceed the costs.
32 Nearly all persons who use water should be benefited. Costs will be born directly
33 by all persons who must receive a permit from the District and persons within
the District who pay property taxes.

JUSTIFICATION FOR RLE: This Rule Amendment is necessary to establish a permitting
36 program for protecting, controlling and operating the Wsorks of the District and
their effects upon the water resources in the area transferred to the District
37
38 by Chapter 78-65, Laws of Florida.
