5 SUMMARY OF RULE: The purpose of this Rule is to irrplement Chapter 373, Florida
6 Statutes, which provides for the Governing Board of the District to adopt Rules

7 and Regulations to implerment the declared water policy of the Southwest Florida

8 Water Management District, and to implement Chapter 120.53, Florida Statutes,
9 requiring Water Management Districts to adopt Rules governing procedures and

10 conditions for obtaining permits within the area transferred to the Southwest

11 Florida Water Managceent District.
12 PART 8 Water Levels and Rates of Flow

13 16J-8.03 Inplementation is amended to read:

14 (1) The provisions of Part 8 of these rules shall continue to be

15 implemented as of May 2, 1978 within the Hillsborough River, Northwest

16 Hillsborough, Green Swamp, Alafia River, Crystal-Bamosassa River, Manasota,

17 Pithlachascotee River, Peace River, Withlacoochee River and Pinellas-Anclote

18 River Basins and shall be inplerented immediately and shall apply

19 coamencing September 6, 1978 within the area annexed into the District by

20 Chapter 78-65, Laws of Florida, and shall apply as follows:

21 (a) Management levels of lakes and other imtpoumnd ts as prescribed

22 herein shall becore effective immediately upon:

23 1. Installation of a staff gage in a prominent location on the

24 water body;

25 2. Posting of notice to the public pursuant to Rule 16J-8.673; and

26 3. Publication of notice in a newspaper having general circulation
within the affected area.

28 (b) The extreme low management level as adjusted by the cyclic variation
S shall becroe effective when similar notice has been given.

30 Subparagraphs (2) and (3) remain the same.

33 JUSTIFICATIcON OF ROLE: This Amendment is to carry out the District's. statutory

34 duty of implementing and establishing water levels and rates of flow in the
area transferred to the District by Chapter 78-65, Laws of Florida, and to establish

36 parameters for flows and levels to prevent significant harm to the water resources

37 or ecology of any area of the District.
