4 SUMMARY CF RULE: The purpose of this Rule is to implement Chapter 373, Florida

5 Statutes, which provides for the Governing Board of the District to adopt Rules

6 and Regulations to implement the declared water policy of the Southwest Florida

7 Water Management District, and to implement Chapter 120.53, Florida Statutes,

8 requiring Water Management Districts to adopt Rules governing procedures and

9 conditions for obtaining permits within the area transferred to the Southwest

10 Florida Water Management District.

12 16J-3.03 Inplementation

13 Part 3 shall continue in effect from September 30, 1974, and be

14 implemented throughout the entire area which carprises the District as of

15 11:58 p.m. on December 31, 1976, which area is coterminous with the area of

16 the Southwest Florida Water Management District (Regulatory)t and smhl-be

18 plementation from August 3, 1977 throughout the area transferringed to the

District pursuant to Chapter 76-243, Laws of Florida, except in the Manasota
20
Basin., and shall be implemented immediately and become effective frcm September
21
6, 1978 throughout the area transferred to the District pursuant to Chapter
22
78-65, Laws of Florida. The Governing Board of the Water Regulatory District
23
consists of the members of the Governing Board of the Southwest Florida Water
24
Management District and all actions by either Board will constitute concurrent
25 action of the other Board. This implementation shall in no way be construed
26
to limit the authority of the Board of the Southwest Florida Water Management
27
District (Regulatory) or the effectiveness of its rules and regulations contained
28
herein under Chapter 16J-3 of the Florida Administrative Code, or of any orders
29
issued by said regulatory authority. Wherever applicable and appropriate, the
30
District and the regulatory authority will act concurrently in regulating water
31
wells.

SUMMARY OF ECONCMIC IMPACT: The proposed amendment will implement the existing
35
rules in the annexed and unregulated areas as will exist pursuant to Section 1,
36 Chapter 78-65, Laws of Florida. It is the purpose of this Rule to protect the
37 water resources of the District. It is impossible to establish a cost-benefit

ratio of the action, but the benefits should exceed the costs. Nearly all

3 persons who use water should be benefited. Costs will be born directly by all

4 persons who must receive a permit from the District and persons within the

5 District who pay property taxes.

6 JUSTIFICATICN OF RULE: This Rule Amendment will require permits of well con-

7 tractors and/or drillers and compliance with well construction standards in order

8 to protect, manage and control the water resources in the area transferred to

9 the District by Chapter 76-243, Laws of Florida.
