5 SUMMARY OF RULE: The purpose of this Rule is to implement Chapter 373, Florida

6 Statutes, which provides for the Governing Board of the District to adopt Rules

7 and Regulations to implement the declared water policy of the Southwest Florida

8 Water Management District, and to implement Chapter 120.53, Florida Statutes,

9 requiring Water Management Districts to adopt Rules governing procedures and

10 conditions for obtaining permits within the area transferred to the Southwest

11 Florida Water Management District.

12 Part 2 Consurptive Use of Water

13 16J-2.03 Implementation

14 (1) A program for issuance of permits authorizing the consumptive use

15 of water was implemented commencing January 1, 1975 within the Hillsborough

16 River, Northwest Hillsborough, Green Swanp, Alafia River, Crystal-Hamosassa

17 River, Pithlachascotee River, Peace River, Withlacoochee River and Pinellas-

18 Anclote River Basins; and permits are required for the withdrawal of water:
19 (a) If the withdrawal during any single day is to exceed one million

20 (1,000,000) gallons or if the average annual daily withdrawal is to exceed

one hundred thousand (100,000) gallons average per day on an annual basis.

(b) If the withdrawal is from a well having an inside diameter of

six inches (6") or nore.

(c) If the withdrawal equipment or other facility has a capacity of
25
more than one million (1,000,000) gallons per day.

(d) If the withdrawal is from a combination of wells or of other
27
facilities or of both, having a combined capacity of more than one million
28
(1,000,000) gallons per day.

(2) Such program ahail was also be implemented irnediately and applied
30
commencing August 3, 1977, within the area annexed into the Peace and
31
Withlacoochee River Basins and within the Manasota Basin.

(3) Such program shall further be implemented immediately and shall
33
apply camnencing September 6, 1978, within the area annexed into the District
34
by Chapter 78-65, Laws of Florida.

4 JUSTIFICATIICN OF RULE: This Amendment is to carry out the District's statutory

5 duty of implementing a Consumptive Use Permitting Program in the area transferred

6 into the District by Chapter 78-65, Laws of Florida; and to provide rules for

7 permits for consumptive use of water as necessary to assure that such uses are

8 consistent with the overall objectives of the District and are not harmful to

9 the water resources of the area.
