3 PROPOSED AMENDMENT NO. 42 7-13-78
5 SUMMARY OF RULE: The purpose of this Rule is to implement Chapter 373,
6 Florida Statutes, which provides for the Governing Board of the District to
adopt Rules and Regulations to implement the declared water policy of the
Southwest Florida Water Management District, and to implement Chapter 120.53,
Florida Statutes, requiring Water Management Districts to adopt Rules govern-
ing procedures and conditions for obtaining permits within the area transferred
to the Southwest Florida Water Management District.
Part 4 Management and Storage of Surface Waters
Part 4 shall continue in implementation from January 1, 1975 throughout
the entire area comprising the District as of 11:59 p.m., December 31, 1976;_

within throughout the areas annexed into the Peace and Withlacoochee River
Basins and within the Manasota Basin; and from September 6, 1978, shall be
implemented immediately and apply within the area annexed into the District
by Chapter 78-65, Laws of Florida.

ESTIMATE OF ECONOMIC IMPACT ON ALL AFFECTED PERSONS: The proposed Amendment
will implement the existing rules in the annexed and unregulated areas as will
27 exist pursuant to Section 1, Chapter 78-65, Laws of Florida. It is the purpose
of these rules to protect the water resources of the District as provided for in
the Declaration of Policy in Section 373.016, F.S. This is the least-cost method
of accomplishing the purpose of protecting the water resources of the District.
31 It is impossible to establish a cost-benefit ratio of the action, but the benefits
32 should not exceed the costs. Nearly all persons who use water should be benefited.
33 Costs will be born directly by all persons who must receive a permit from the
34 District and persons within the District who pay property taxes.
35 JUSTIFICATION FOR RULE: This Rule Amendment is necessary to establish a
36 permitting program for protecting, controlling, managing and operating surface
37 bodies of water and their effects upon the water resources in the areas to be
38 transferred to the District by Chapter 78-65, Laws of Florida.
