Brooksville, Florida April 8, 1970

The Board of Governors of the Southwest Florida Water Management District
(Regulatory) met in the District Headquarters building, Brooksville, Florida
at 9:45 A.M. on April 8, 1970. The following persons were present:

Thomas Van der Veer, Member Garald Parker, Chief Hydrologist
Clint Schultz, Chief of Fiscal Division

and the following SWFWMD staff members: Emily Black, Hildred Haight,
Zolda Lambert, Melba Beaty and Carol Ezell.

Vice Chairman Pickard called the meeting to order. The minutes of the
March 11, 1970 meeting were considered by the members and after study
it was moved by Mr. Van der Veer and seconded by Mr. Medard that the
minutes be approved as published to the Board. Motion carried.

Mr. Twachtmann then presented to the Board the transcript of the March 11th
public hearing and explained that this is a separate document from the minutes.
He complimented Mrs. Beaty and Mrs. Ezell for their excellent transcribing
job and explained to the Board that a substantial sum of money had been saved
because of the staff secretaries' ability to do the recording task. Copies of
this transcript have not as yet been made and he asked how many copies the
Board felt would be required. Vice Chairman Pickard suggested three or
four copies be made and circulated.

Mr. Twachtmann stated that the first permit violation has occurred. Mr.
Gibbons then explained to the Board that a driller who is registc red refused
to put decals on his rig and refused to get a permit. Mr. Gibbons stated
that he has written directly to the driller's bonding company and informed

them that if this driller does not comply we will file a suit on the bond. As of
this date, Mr. Gibbons has not heard from the bonding company. This driller
is from the Orlando area and has since completed this well and moved his rig.
He is not operating in the District at the present time and the Regulatory staff
has been unable to locate him. Mr. Pickard asked how it was known that this
driller did not have decals on his rigs to begin with. Mr. Parker answered
that our field inspector found him drilling and the driller was quite abusive
with our inspector at that time. Mr. Gibbons stated that he has this case on
follow-up and will go through the bonding company who in all probability has
been in contact with the driller. He stated that we will proceed to enforce
this permit violation. Mr. Parker pointed out that our usual experience in
working with the drillers is quite satisfactory. Generally it is merely a case
of misunderstanding and once the rules and regulations are properly explained
the drillers have been cooperative.

Mr. Twachtmann said that during the public hearing Chairman McAteer had
said, as a matter of policy and not of law, that another public hearing would
be held on proposed changes to the rules and regulations. Inquiries are being
received asking when that hearing will be held, and in order to give the Board
and staff time to study the transcript, it is suggested that a June date be set
for another public hearing. After discussion it was moved by Mr. Medard and
seconded by Mr. Anderson that this public hearing on the rules and regulations
changes be held on June 10, 1970 at 1:00 P.M. The staff was instructed to
!advertise accordingly.

There being no further business to come before the Board at this time the
'meeting adjourned at 10:00 A.M.
