Brooksville, Florida March 10, 1971

The Board of Governors of the Southwest Florida Water Management District
(Regulatory) met in the District Headquarters building, Brooksville, Florida,
at 9:35 A.M. on March 10, 1971. The following persons were present:

Chairman McAteer called the meeting to order. The minutes of the January 13,
1971 meeting were considered by the members and after study it was moved by
Mr. Anderson and seconded by Mr. Beville that the minutes be approved as pub-
lished to the Board. Motion carried.

Mr. Parker reported to the Board on the status of driller registration and
permits. During the month of February nine drilling contractors made appli-
cation for registration; five of which are still pending. This brings the
total number of drilling contractors registered with the District to 237.
Eight new drillers were registered, bringing the total number of registered
drillers to 659. Also, a total of 707 permits were issued during the month.

Mr. Twachtmann brought to the Board's attention a letter written to all
drilling contractors by Mr. Parker on February 4th presenting a resume of
the Regulatory activities and emphasizing the importance of receiving com-
pletion reports and logs in accordance with the rules and regulations. Mr.
Twachtmann stated that the need for obtaining the data included in these
completion reports is one of utmost importance in providing the information
necessary to enable the staff to make decisions regarding specific areas.
He also called the Board's attention to a second letter dated February 24th,
with "Special Notice" attached, which was mailed to those drilling contractors
who were delinquent in the submission of completion reports. This was to
notify those contractors that unless some action is taken to comply in fur-
nishing these completion reports, as provided for in the rules and regulations,
their names will be presented to the Governing Board at the meeting of April 7,
1971 for action.

Mr. Parker reported that the staff has compiled information gathered from the
drillers completion reports and is ready to begin transferring it to IBM
cards, which will enable immediate retrieval of information on any location
in the area.

Mr. Twachtmann presented the proposed revisions to the rules and regulations
dated March 3, 1971 to the Board. He explained that in accordance with
previous instructions from the Board these rules were reworked by the staff
to include the engineering testing profession and they are now being pre-
sented in the firm belief that they are the best set of rules now possible
and are now ready for submission to a public hearing. At the re questof to
Board Mr. Twachtmann reviewed the proposed revisions to the ules and

Mr. Wines questioned the use of the term "structural foundations" rn "c- .

Colonel Gee suggested that a solution to this problem would be to omit
the words "or otherwise developed" in the second line, one other change
was also suggested so that this section would then read:

1.01(2)(b) Test or Foundation Hole -- Any artificial hole in the
ground drilled, bored, cored, washed or jetted, the
intended use of which includes obtaining data for engi-
neering and/or for geophysical and geological explora-
tion; prospecting for minerals, or products of mining
or quarrying; and providing certain structural founda-
tions or other construction purposes, but not for the
purposes of either producing or disposing of water.

Chairman McAteer asked Mr. Gibbons if these proposed revisions could be
altered in any way between the time they are approved by the Board for
presentation before a public hearing and the hearing itself. Mr.
Gibbons stated that this would be possible. After further discussion
motion was made by Mr. Medard that the public hearing to present the pro-
posed revisions to the rules and regulations be held on the afternoon of
May 12, 1971. Motion seconded by Mr. Van der Veer and approved.

Mr. Twachtmann then brought to the Board's attention a sworn written com-
plaint signed by Mr. Roy D. Wilt, a registered drilling contractor, con-
cerning a test drilling company drilling a water well. Mr. Wilt reported
to the District through Mrs. Haight's office on February 9th that an
unmarked test well drilling rig was set up to drill a water well. Mr.
Rickels, hydrologic technician, was sent to investigate this situation and
did find the driller set up on the site and prepared to drill a water well
-- he was registered with the District, however, his rig was unmarked and
he had no permit. This driller stated that he had not drilled a water well
before and was not aware he needed a permit. Mr. Rickels had the driller
complete a permit application form and watched him place decals on the rig,
and the driller was then allowed to construct this well. Mr. Wilt does not
feel that the District was firm enough in this complaint action. Mr.
Twachtmann stated that in his opinion the staff gave the driller more than
the advantage of the doubt, but had acted in good faith and felt they were
treating this driller exactly as they had other drillers in the past.
Chairman McAteer assured Mr. Wilt that the Board and staff have no intention
of becoming lax in any way with the enforcement of the rules and regulations
and that enforcement will tighten up now that the first year of regulation
is over.

The Board was advised of the appointment of Mr. Richard Dunham, newly
elected president of the Florida Well Drillers Association, to the Well
Drilling Advisory Committee. Mr. Dunham replaces Mr. Burl Dunlap, past
president. This appointment is automatic in that the current president
of the Florida Well Drillers Association is to serve as a member of this
committee. Mr. Twachtmann announced that the one-year term on the Well
Drilling Advisory Committee, held by Mr. Shelby Payne from Marion County,
was also due for consideration. After discussion, motion was made by Mr.
Anderson that Mr. Payne be reappointed to the Well Drilling Advisory Com-
mittee to serve a three-year term. Motion seconded by Mr. Medard and

meeting adjourned at 10:15 A.M.
