Re: SWFWMD vs BERO Case No. 1350, Pasco County

Dear Vince:

We have read your letter of February 3rd including the attachment letter of Mr.
Petteway to you which requests an attorneys fee of $25,000.00 plus $5,321.09
in additional costs. We believe that the fee for the attorneys, for the appraiser,
and for the timber appraiser are all excessive and as a result have made the
following decisions:

A. In keeping with the Governing Board's instruction at its
meeting of November 12, 1969, you are instructed to
disagree with these fees and to proceed with the hearing
before Judge Kelly.

B. By copy of this letter, Mr. Myron Gibbons, counsel to the
Governing Board, is instructed to work with you and assist
you in the presentation of whatever testimony you jointly
feel necessary to defend the District's position in this case.

C. You are authorized to recall our appraisers, Mr. J. Roger
Davis, Mr. Leo DeRosier and Mr. Pete Causey for testimony.
You are also authorized to recall Mr. Beauford Register for
special testimony concerning the timber appraiser's fee.

Chairman McAteer is informed on this matter and available for discussion of it
if necessary. We will also be pleased to provide any additional assistance from
the staff level that we can to help you expedite the conclusion of this case.
